C&F Finance Management has completed an investigation and found the following:In regards to complainant stating, "I never pay more than one month late." The complainant has been over days late times with only installment payments made since the inception of the contract on 06/17/2014, and has accrued late chargesAs for the grace period, the complainant signed a contract for a Simple Interest Loan which does not have a grace period policy The installment is due on the due date set in the contract and is considered delinquent one day past the due date Late fees will be assessed when the payment is days past the installment date, as stated in the TILA portion of the contract Complainant should read the back of the contract to see how payments are applied and how late payments effect the account in Section Section on the back of the contract discusses what may occur if the promise is broken, and should be reviewed by the complainant.In regards to the complainant's statement regarding being held hostage and threats, C&F Finance Company follows the guidelines of the FDCPA and does not threaten nor harrass customers The complainant was granted an extension in February of in order to assist in bringing the account out of delinquency The policy of the company is to not allow extensions until the customer has made at least installments The complainant was granted a special exemption to this policy as only installments were made at the time of extension C&F Finance Company has gone above policy limits to try and assist customer The complainant is requesting to make an installment on July 10th which would put him back into severe delinquency at days past due and only leaving days until the next installment is due, which is deemed unacceptable coming off of an extension The extension on the account was to assist the customer to stay out of delinquency The account is being reviewed by management to determine the next course of action if the account is not brought current This is not a threat as C&F Finance Company intends to pursue all allowable collection efforts stated in the contract and by state law The complainant may call the office any time and ask to speak to Doug, Melissa, or Stacy, Collection Department Management They can further assist with any questions regarding his account

C&F Finance completed a formal investigation and found that the information being reported to the credit reporting agencies appear accurate compared to the details of the customer’s account historyIf there is a specific reporting issue, Ms [redacted] should contact Melissa G***, Loss Prevention Manger, at ***-***- [redacted] ext***? The Compliance Manager has reviewed the complaint and performed an investigation On 10/20/2015, customer called C&F Finance to make payment arrangements for 11/07/ The collector customer spoke with said that we were unable to accept a payment until next month Customer was given an extension in May of to assist customer in catching the account up Customer is currently days past due and last paid days ago Customer has only made payments on a month loan C&F Finance Company Policy states that we will only grant a deferment once the customer has made payments and only one per year with a maximum of per loan term C&F Finance has already made an exception and allowed for a deferment when customer has made less than payments The Compliance Manager will forward this complaint and account to ***, Collections Supervisor, to contact customer to see if anything else can be done

C&F Finance Company Collections Manager has investigated the complaint and pulled all recorded calls in relation The recordings show that the customer was aware of the extension and agreed to the extension during a follphone call in which a Collector stated that she thought the documentation of a hardship was not needed for such a good paying account and waived the requirement and told customer that the extension was approved Please contact [redacted] if the customer would like to speak to the manager involved with the investigation or if customer has any further questions

C&F Finance Company received an electronic application from [redacted] on 12/17/The application was in the name of [redacted] , [redacted] Drive, [redacted] OH, ***The application that [redacted] submitted to C&F Finance Company was used in connection with a credit transaction for the purpose of extension of creditThe application that C&F Finance Company received from [redacted] was used for the permissible purpose to review the applicant’s credit in accordance with FCRA If Ms [redacted] did not apply for credit at [redacted] ***, she should complete the attached Identity Theft package in its entirety Upon receipt of the completed package, C&F Finance Company will provide information to assist in the investigationThanks, Joyce S [redacted] Compliance Manager

When C&F Finance Company purchased Ms [redacted] contract from the prior finance company, a Welcome Packet was sent which included a disclosure of the available payment options C&F Finance acceptsIn addition to the initial disclosure, each time Ms [redacted] calls into the office to make a payment, company representatives are required to disclose payment options prior to accepting a payment There is a $fee associated with Express Payment Options which post funds to the account the same day payments are made over the phone or online Customers are not required to choose this option and may choose to pay using our other lower cost and free options Lower cost options include [redacted] and [redacted] Free options include, making a payment at a C&F Bank branch, mailing a check, and automatic recurring payments If you have any further questions, comments, or would like assistance enrolling in the free automatic recurring payments, please contact a representative in our Customer Service Department

case# 11454577Ms*** purchased a vehicle at *** *** *** and signed a Retail Installment Sales Contract (RISC) on November
11, with an APR of 16.96%*** *** *** assigned the RISC to
C&F Finance Company. Ms***’s
complaint is that C&F
Finance Company continues to call her in regards to
her account when payments are not made according to the due date on the RISC. Sixteen payments have been made on the
account and six of them have been over thirty days past due. Ten of the sixteen payments have been paid
past the contractual due date. C&F
Finance calls all delinquent accounts daily unless some type of payment
arrangements have been made on the account.
Ms*** rarely communicates with the Collections Department when she is
past due so calls continue on the account until some resolution has
occurred. When Ms*** communicates with
C&F, calls don’t continue as long as there is some payment arrangement made
on the account. (For example: Ms*** was past due for her 04/24/
installment, C&F called her each day since she went past due and received
no contact until 05/02/16. Ms***
stated she couldn’t pay until 05/12/16.
C&F did not call her until 05/11/which C&F stated we would
call the day before to confirm the promise to pay will be made on the
account. On 05/11/16, we contacted Ms
*** as agreed upon on 05/02/and she stated she couldn’t pay until 05/20/16. We informed her that the expectation was for
the account to be paid on 05/since she had just received an extension back
in October to get the account back on track and she hung up on
C&F.) Lack of communication with
C&F and broken promise to pays will keep collection efforts
continuing. Communicating with C&F
and setting up payment arrangements to get the account back current and staying
current will make the collection calls stop.
Ms*** opted in to receive text message reminders on the status of her
account. She can reply ‘STOP’ to any C&F
message at any time to opt out of this service.
Doug D***, Collection Manager, reviewed the account and agreed to not
call Ms*** until her account is days past due, however she will receive
calls after that unless she contacts C&F to make agreeable payment
arrangements before. Ms*** can contact
Doug D***, Collections Manager, if she has any further questions regarding her

C&F Finance Company's management has investigated and reviewed the complaint. *** Dowe, Collections Manager, has made several attempts to contact Ms*** to discuss the complaint and her account. Ms*** has not answered any calls from C&F Finance Company and the voicemail
associated with the phone number we have on file is full and no longer accepting any new messages. C&F Finance Company has removed the NSF Fees on Ms***'s account and would like to discuss what occurred. Please contact *** if you have any further questions or comments at *** ***

Mr*** was informed during the 10/06/phone conversation, with a C&F Finance Representative, that we will release the title once the funds are presented to C&F Finance Company from *** *** ***. Those funds have not been received by C&F Finance Company and, due to C&F Finance Company's policy, we cannot release the title without funds. I apologize for any inconvenience this may have caused, but C&F Finance Company must follow Policy and Procedures. Management has reviewed the complaint and found that Mr*** is currently past due for $537.12, which is comprised of your monthly installment and late fees. Your installment is due on the 12th of each month. Please review your contract. Due to your account status and payment
history, you will continued to be called until your account is brought current. If you would like a copy of your payment ledger or would like someone to explain your payment history, please call Customer Service and ask for Sandra or Will. Management has pulled the recorded calls, Mr*** cannot continue to use racial slurs and expletives towards our representatives if he would like assistance over the phone

MrsTyler, you have signed a contract for a Simple Interest Loan which does not have a grace period, please refer to your contract for further explanation or contact our Customer Service Department and ask for more information Your payment is due on the 1st of the month and is considered
delinquent any time after the 1st of each month. A late fee will be assessed when you are days past your due date, as mandated by state law. In regards to phone calls, during my investigation, I found records where one call is placed to your home number and one call is placed to your cell number when you become delinquent If you have records showing 4-calls per day to your phone numbers, please provide to the Compliance Manager at C&F Finance Company so I may further investigate.In regards to the payment issue, C&F Finance Company does not hold checks nor harass customers in order to obtain fees. C&F Finance offers plenty of free options to make payments. I have listened to all calls placed and received from your account phone numbers and have not found any harassment nor violations on behalf of C&F Finance Company. You stated on 06/12/that you mailed a payment on 06/05/2015, the collector informed you that it had not been received yet, and you stated you would check with your bank and then call back, nofurther contact was made on 06/12/2015. On 06/13/2015, you went to C&F Finance’s online bill payment system and made a payment and did not contact us to inform us. On 06/15/2015, your check was delivered to the office and was processed. You called the office on 06/18/to report that two payments had posted. The phone recordings were pulled and at no time did you state to not process the check and therefore no notations were made on your account and the check was processed. C&F Finance’s Customer Service departmentrefunded one payment but was unable to reimburse any additional fees incurred as it was not our mistake.For your desired settlement statement, we cannot reimburse your overdraft fees if the mistake was not ours. If it had been our mistake, we would have done whatever it took to get your money and fees returned. C&F Finance Company follows the FDCPA anddoes not harass customers. Your payment is due on the 1st day of each month. If payments are not received by the due date, our Collections Department will start calling to bring your account current or offer other services, if applicable. Customers are never requiredto pay using a payment option that contains a fee and we offer several free payment options
