Mr*** has made payments on the account. Out of the payments, of the payments
have been paid or more days late which incurs late charges of 10% of the
part of the payment that is late according to his Maryland Retail Installment
Sales Contract. Mr*** has
accrued
$1,in late charges and has paid $when payments were made over the
actual payment amount, leaving the late charges owed on account at a balance of
$588.20. (Example: Customer paid $on 04/05/16, payment is
$523.06, so the extra $paid went towards late charges. Example:
Customer paid extra $on 04/29/16, which $went to late
charges and $went to other fees.)
Late charges and other fees are due when assessed. C&F Finance Company has applied the
customer’s payments in a manner to keep the customer the most current. Late charges owed on the account are
reflected in the past due amount that reports to the credit bureaus. Mr*** is current on installment payments
and is due for 05/31/but still has $in late charges owed on the
account which is reflected in his past due amount. If Mr*** doesn’t want the fees due to
reflect in his past due amount on his credit report then the fees need to be
paid in full.If Mr*** would like more explanation of assessed fees

C&F Finance Company management has reviewed the account notes and recorded calls relating to this complaint. The Collection Representative the complainant spoke to was correct in saying that there is no Grace Period and installments are expected to be received by the due date.
Unfortunately, any account that is day late is placed into our Collections Department for follto contact customers. This is standard business practice. The account will not be reported to the Credit Bureaus until it is over days late so there should be no concern for credit reporting. case# 11454577Ms*** purchased a vehicle at *** *** *** and signed a Retail Installment Sales Contract (RISC) on November
11, with an APR of 16.96%*** *** *** assigned the RISC to
C&F Finance Company. Ms***’s
complaint is that C&F
Finance Company continues to call her in regards to
her account when payments are not made according to the due date on the RISC. Sixteen payments have been made on the
account and six of them have been over thirty days past due. Ten of the sixteen payments have been paid
past the contractual due date. C&F
Finance calls all delinquent accounts daily unless some type of payment
arrangements have been made on the account.
Ms*** rarely communicates with the Collections Department when she is
past due so calls continue on the account until some resolution has
occurred. When Ms*** communicates with
C&F, calls don’t continue as long as there is some payment arrangement made
on the account. (For example: Ms*** was past due for her 04/24/
installment, C&F called her each day since she went past due and received
no contact until 05/02/16. Ms***
stated she couldn’t pay until 05/12/16.
C&F did not call her until 05/11/which C&F stated we would
call the day before to confirm the promise to pay will be made on the
account. On 05/11/16, we contacted Ms
*** as agreed upon on 05/02/and she stated she couldn’t pay until 05/20/16. We informed her that the expectation was for
the account to be paid on 05/since she had just received an extension back
in October to get the account back on track and she hung up on
C&F.) Lack of communication with
C&F and broken promise to pays will keep collection efforts
continuing. Communicating with C&F
and setting up payment arrangements to get the account back current and staying
current will make the collection calls stop.
Ms*** opted in to receive text message reminders on the status of her
account. She can reply ‘STOP’ to any C&F
message at any time to opt out of this service.
Doug D***, Collection Manager, reviewed the account and agreed to not
call Ms*** until her account is days past due, however she will receive
calls after that unless she contacts C&F to make agreeable payment
arrangements before. Ms*** can contact
Doug D***, Collections Manager, if she has any further questions regarding her

C&F Finance Company's management has investigated and reviewed the complaint. *** Dowe, Collections Manager, has made several attempts to contact Ms*** to discuss the complaint and her account. Ms*** has not answered any calls from C&F Finance Company and the voicemail
associated with the phone number we have on file is full and no longer accepting any new messages. C&F Finance Company has removed the NSF Fees on Ms***'s account and would like to discuss what occurred. Please contact *** if you have any further questions or comments at *** ***

Finance Company was used in connection with a credit transaction for the purpose of extension of credit. The application that C&F Finance Company received on 1/4/from *** *** *** *** *** *** was used for the permissible purpose to review the applicant’s credit in accordance with FCRA If Ms*** did not apply for credit at *** *** *** *** *** ***, she should complete the attached Identity Theft package in its entirety Upon receipt of the completed package, C&F Finance Company will provide information to assist in the investigation Thanks, Joyce S*** Compliance Manager

When C&F Finance Company purchased Ms*** contract from the prior finance company, a Welcome Packet was sent which included a disclosure of the available payment options C&F Finance accepts. In addition to the initial disclosure, each time Ms*** calls into the office
to make a payment, company representatives are required to disclose payment options prior to accepting a payment. There is a $fee associated with Express Payment Options which post funds to the account the same day payments are made over the phone or online. Customers are not required to choose this option and may choose to pay using our other lower cost and free options. Lower cost options include *** and *** *** Free options include, making a payment at a C&F Bank branch, mailing a check, and automatic recurring payments. C&F Finance Company management has reviewed the complaint and performed an investigation. The Collections Department made several attempts to contact the customer using the cell phone number we have on file and with an e-mail. No return calls were made from those contacts.
C&F Finance Company is allowed to contact customers at the work number provided in order to verify employment or to leave a message without disclosing the nature of the call. Management has reviewed the recording from 03/14/and determined that no violations had occurred. The collector first asked if the customer was employed and was then asked by the HR person if there was a message that she could pass along in an e-mail. The collector only stated her name and the number that could be used to reach her. The customer called C&F Finance Company back on 03/15/and requested to not be contacted at work going forward. The collector has removed the work number from the account and appropriately documented so no further calls will be made to the work number. So ***? received a check from the company when he was supposed to have received it on the 11thThis was from both the repand the supervisorHe received it on the 15th because they never overnight it on the 10thAnd also I spoke with fed ex ( ***? ) on the 15th he c &f finance gate fed ex the wrong addressThe address that was giving by the rep, was *** ** *** **

The C&F Finance Company Compliance Manager has reviewed the complaint and performed an investigation.? The following was found:- On 09/25/around 2:p.m., Mr*** contacted our office to advise of payment made of $519.39? to collection agency in regards to balance left on
account.? Mr*** wanted to know when he would receive his title.? The representative he spoke to explained that the pay-off amount, as of 09/25/2015, was $and that he would follwith collection agency in regards to payment and call Mr*** back.- On 09/25/around 3:p.m., representative called Mr*** and explained that the title will be released days after money is drafted from account by the collection agency.? Maker advised funds were drafted today.- On 09/25/around 3:p.m., Mr*** spoke to representative stating that he was at DMV and was advised, by DMV representative,? if Lienholder can send documentation on company letterhead that the loan is satisfied, DMV would give him his title.? The representative advised Mr*** this is called a Lien Release Letter and that we would need to receive the funds from collection agency before we could send Lien Release Letter.- On 09/29/2015, Mr*** spoke to a representative and stated the collection agency sent him a letter stating the account was paid off.? The representative advised that we have still not received the funds in our office and we cannot release title until funds are received.No further contact has been made between Mr*** and C&F Finance Company.? As of 10/01/2015, the funds have not been received in officeOnce the funds have been received and the account is satisfied, C&F Finance Company will? send Mr***? the title.? If Mr*** has any further questions, please call Tanya or Melissa at *** in the Recovery Department.? Thanks
