As stated in our previous response, a collections manager has made several attempts to contact you.  Please call [redacted] at [redacted] ext. [redacted] directly for the information that you have requested.

Mr. [redacted] has made 29 payments on the account.  Out of the 29 payments, 23 of the payments
have been paid 15 or more days late which incurs late charges of 10% of the
part of the payment that is late according to his Maryland Retail Installment
Sales Contract.  Mr. [redacted] has...

accrued
$1,154.70 in late charges and has paid $566.50 when payments were made over the
actual payment amount, leaving the late charges owed on account at a balance of
$588.20.  (Example:  Customer paid $550 on 04/05/16, payment is
$523.06, so the extra $26.94 paid went towards late charges.  Example: 
Customer paid extra $294.76 on 04/29/16, which $249.76 went to late
charges and $45.00 went to other fees.) 
Late charges and other fees are due when assessed.  C&F Finance Company has applied the
customer’s payments in a manner to keep the customer the most current.  Late charges owed on the account are
reflected in the past due amount that reports to the credit bureaus.  Mr. [redacted] is current on installment payments
and is due for 05/31/16 but still has $588.20 in late charges owed on the
account which is reflected in his past due amount.  If Mr. [redacted] doesn’t want the fees due to
reflect in his past due amount on his credit report then the fees need to be
paid in full.If Mr. [redacted] would like more explanation of assessed fees

So [redacted] received a check from the company when he was supposed to have received it on the 11th. This was from both the rep. and the supervisor. He received it on the 15th because they never overnight it on the 10th. And also I spoke with fed ex ( [redacted] ) on the 15th he c &f finance gate fed ex the wrong address. The address that was giving by the rep, was [redacted].

C&F Finance Company's Collection Manager made contact with customer and resolved any issues.  Customer is satisfied with the outcome.

The C&F Finance Company Compliance Manager has reviewed the complaint and performed an investigation.  The following was found:- On 09/25/2015 around 2:55 p.m., Mr. [redacted] contacted our office to advise of payment made of $519.39 to collection agency in regards to balance left on...

account.  Mr. [redacted] wanted to know when he would receive his title.  The representative he spoke to explained that the pay-off amount, as of 09/25/2015, was $638.69 and that he would follow-up with collection agency in regards to payment and call Mr. [redacted] back.- On 09/25/2015 around 3:06 p.m., representative called Mr. [redacted] and explained that the title will be released 30 days after money is drafted from account by the collection agency.  Maker advised funds were drafted today.- On 09/25/2015 around 3:36 p.m., Mr. [redacted] spoke to representative stating that he was at DMV and was advised, by DMV representative, if Lienholder can send documentation on company letterhead that the loan is satisfied, DMV would give him his title.  The representative advised Mr. [redacted] this is called a Lien Release Letter and that we would need to receive the funds from collection agency before we could send Lien Release Letter.- On 09/29/2015, Mr. [redacted] spoke to a representative and stated the collection agency sent him a letter stating the account was paid off.  The representative advised that we have still not received the funds in our office and we cannot release title until funds are received.No further contact has been made between Mr. [redacted] and C&F Finance Company.  As of 10/01/2015, the funds have not been received in office. Once the funds have been received and the account is satisfied, C&F Finance Company will send Mr. [redacted] the title.  If Mr. [redacted] has any further questions, please call Tanya or Melissa at [redacted] in the Recovery Department.  Thanks.

I will supply C & F  with records of their harrassing calls as I have counted 10 on my cell phone alone starting 6/1/15 - 6/10/15. I also have record of them calling my husbands cell phone and home number several time. I will also supply them with a copy of my contact as well. This dispute with the back is still pending and I do not plan to cancel this or dismiss the matter.
My general purpose for the compliant it to make other consumers aware of the practices of C& F Finance.My I do not foresee this matter being resolved to I have decided to only pay my future payments via money order and pay a fee to have them tracked via the united states postal service.  I am also in planning to have my vehicle refinanced with a more reputable company by August.

[Provide details of why you are not satisfied with this resolution.]  To charge a fee of $17.00 even if I pay ahead of time is absolute highway robbery.  I have also complained to other agencies and was told this could be a legal issue.  Blasphemy and just another way in which to 'screw' the general public!  NO other company charges astronomical fees like this to pay either on the telephone or on the internet!!

C&F Finance Company management has investigated the complaint and found that the delay is coming from the dealership.  The Recovery Manager, [redacted], was able to get exact information regarding the funds from the dealership and contacted complainant to discuss and ensure she was satisfied...

with the outcome.

We did not at that time neglect our arranged agreement.  We simply wanted someone to explain the contradiction in what they originally said we owed from their 2/11/15 letter verse what was recorded on their account ledger.  After several attempts to reach CF, we were constantly hung up on or redirected to someone else who could not answer our questions.  According to their records, it looks as if we satisfied this account on 3/2/15 with a $25.49 credit balance.  CF said we stilled owed $356.72 of the $802.12 balance which they said was accrued interest.  We asked several times if they could forward us a statement showing this $802.12 accrued balance.  We also requested a copy of our GAP insurance policy.  A representative by the name of [redacted] said she would fax both.  She faxed over the policy, but never the statement.  We have no issue paying what we owe, we just wanted someone to make sense of what looks like to us, we over paid.  [redacted] is a copy of the letters and account ledger from CF for your review.
