our client's insured's vehicle. As Mr. [redacted] allowed his automobile insurance to lapse the duty to reimburse our client falls directly on him.
A review of the claim shows all supporting estimates were sent to Mr.[redacted] previously but I will arrange to have another set sent to him.

I spoke with state farm and this company is not representing them. Hey have no knowledge of who Wilber and associates is and told me to speak with them directly . Further more this company is threatening my license before this has ever gone to court. They are just debt collectors trolling for business.

this claim. The FDCPA also does not apply as the claim is not a consumer debt. Mr. [redacted] claims that we have followed and harassed him are untrue. We have never spoken with him. I encourage Mr. [redacted] to contact our office with his liability insurance information which as I have to assume he has as it is required by law in California.

Since this organization is working in the capacity of collections the FCRA does indeed apply to them. Regardless of that they are still, either way, obligated to honor a CEASE AND DESIST letter. They continue to send debt collection letters with NO VALIDATION of the debt, continuing to refer to an auto accident which did not happen. I was in my home in Ecuador. I have already submitted proof from Avis that on the dates I were here as well as all dates I am ever here I was fully covered by all insurance through them. This organization attempts to extort moneys from me by "offering" to settle for a reduced fee. PLEASE NOTE that collection agency OR law firm - EITHER ONE obligates them to respect a CEASE AND DESIST letter. They are also obligated to provide PROOF - There is no named "victim," no police report, no insurance report, no witnesses, and this is an invented event which occurred while I was not even in the country. I am not a resident of California and they do not appear to be licensed in California. Their lack of proof would assure a loss in any court case - Any review of their history, ANY RESEARCH, will show that they have a history of extortion and losses in court. This is NOT a valid debt. That it must be demonstrated as such matters not whether they choose to call themselves a law firm or collection agency, as they are acting in the capacity of the latter. These people are known criminals. They refuse to provide proof because there is not any because I was never involved in any accident on the date they accuse me of or on any other date anywhere near that date. Please instruct them to provide evidence. Please instruct them to cease all HARRASSMENT as required by law. Please advise them that ALL communications from them will now no longer be received, as I terminated my mailbox in the United States. Please advise them that legal action against them will once again be forthcoming and they will once again lose should they make ANY attempts to harm me financially or in ANY other way. Please be advised that the burden of proof is on THEM, NOT ME - although I did submit the forms from AVIS proving that I had insurance at all times. I am not, however, required to prove anything. They are. I wish to reinforce the CEASE AND DESIST demand at this time based on their lack of proof and attempt at one more extortion.

I have asked wilber several times for a copy of the incident/accident/police report which confirms me or my vehicle's involvement in this incident in [redacted],ma on 2/12/15. I can also confirm that I was working in my office in [redacted],nj on 2/12/15 and was not personally in [redacted],ma on that day. I can provide a letter from my complex director confirming my physical location on 2/12 in my nj office. I will accept a response that closes this case. thank you

As Wilber Compliance Officer I have reviewed all of the recorded calls on this file. Over a 48 hour period Mr. [redacted] repeatedly called our office 19 times. Of those 19 times he simply hung up 11 times before he was connected with an associate. I will arrange to have the police report and estimates...

This is not how this happened. I did not hang up but the first time the lady who called her self Keisha started talking to be like I was a 5 year old and basically told me I was a horrible person... This is a false allegation. The itemized list is not accurate and it is reaching for money that is not owed. We still dispute this claim. The house fell under landlord neglect. There was no physical damage from tenets, nor missing anything. We have proof to support our innocence in most of these false claims. Also, if there was something missing, the landlord could have spoken to us, not sue us. We do not accept this response, nor the financial responsibility.

Ms. [redacted] has entered into an installment agreement with our office to pay for the damages to our client's insured's vehicle. Ms. [redacted] did return the signed installment agreement to our office for our notarized signature. She was verbally told that she would have to file it with all signatures...

with her DMV in order to avoid suspension. When we returned the signed agreement it to her the accompanying cover letter also states in paragraph 2 that she will need to file the agreement with the DMV. If Ms. [redacted] would need our office to prepare these documents again for her she may contact our office at [redacted] Ext [redacted].

According to the Illinois police report number [redacted] Mr. [redacted] was the owner of the at fault vehicle that struck our client's...

insured's vehicle. His name and address match the information on the police report and this complaint. Mr. [redacted] contacted our office 4/10/17 asking for proof of the loss which we will send to him at his request.

This company sent a collection letter to me. While the names are the same, they are looking for another man. They refuse to rectify the error.
A letter was sent to me but addressed to my parents,demanding payment of $5000.00. It was sent for [redacted] and a person we called said it seems to involve some kind of incident on someone with my name, but a different age and state of residence.

The letter also contained my social security number, which I find alarming, they are not supposed to have access to this information except under specific circumstances.

We called the firm about this claim. It was immediately obvious that they are looking for someone else, and the obvious inaccuracies in the age and hometown as described in the records. We were switched to voicemail and hung up.

This is very alarming as a debt of this size can very adversely affect my credit rating and reputation, so we consulted our attorney, who said to call again. We did, but the woman who answered was rude and obnoxious, and then hung up the phone. We read the complaints and reports about the firm's practices, which are just this side of legal, and most certainly unethical and immoral. They obtained my social security number through illegitimate means, and it is probable that the firm has cavalierly and recklessly sent these letters out to anyone with the same name and age range age as the actual person sought.

We called back and spoke to [redacted] and said that this was a case of mistaken identity and explained why. He said they'd investigate. This is complete rubbish because the initial investigation should never have resulted in identifying me as the person in question.

We requested that the firm cease and desist in pursuing this collection as a debt belonging to me, and that a letter be sent confirming that they had done so and that this claim would not be sent to any of the credit reporting bureaux. He became belligerent, demanding to know if this had appeared on any credit reports. We said that it had not, but that we wanted to make sure that did not. He became even ruder saying to wait until it appeared before making a claim. We asked to speak to one of the attorneys, were sent to Mr. [redacted] voicemail and left a message.
It is unconscionable that this firm so recklessly engages in such practices. It sends out correspondence to any and all potential debtors and their families in the hopes of intimidating someone into paying up. It can be assumed that the risk/reward factor is such that it is worth ruining the reputations of innocent people in order to make a profit. Throwing enough mud at a wall in the hopes that some of it sticks is a lazy and irresponsible way for a law firm to behave. The fact that the representative, Mr. [redacted] refused to even consider assisting us in taking action to prevent damage to my credit rating, insisting that my reputation must be harmed before any remedy could be effected, is appalling and rather despicable. It should not be my job to correct the mistakes that were made by their cavalier business practices.
