Dear [redacted]  I am in receipt of the response given by Amerigas to our original complaint. In the response, [redacted] states “Amerigas takes any complaint by its customers seriously” however, I have been complaining by phone, email, in writing and to the Revdex.com for over a year and this is the FIRST response I have received from Amerigas so apparently they do NOT take complaints too seriously. [redacted] also refers to our contract which states “Amerigas will monitor our customer’s usage and will provide propane when needed.” We have lived in our home and been an Amerigas customer for TEN years and with the exception of the delivery in question, they have NEVER monitored our usage and made a delivery that we did not request. For TEN years we have only requested a delivery when needed and have NEVER been on automatic delivery. We have also been on a [redacted] plan for ten years. This plan allows Amerigas to estimate our usage based on the previous year and bill us monthly for the estimated usage over the next year. Our payments have been $150 per month for the last ten years. Our contract expires and needs renewal each year. Our contract had recently expired at the time of the delivery in question. I contacted my local office to request our new contract when it did not arrive in the mail; previously it had always been sent at least a month before the old contract expired so that there would be no lapse. I was told that our new contract would be sent out to us that same day. Within two days, the delivery driver started showing up for automatic delivery, a plan we had NEVER been on, and our contract had still not arrived. When the driver showed up, I sent him away and immediately contacted our local office to have us taken off automatic delivery. I was told that they were unsure how we had been switched to automatic delivery, but that we would immediately be taken off. I also inquired about our renewal contract and was told that one had NOT been sent. I was again told it would be sent that same day. This continued on two additional occasions within a matter of two weeks. The delivery driver showing up, me sending him away and contacting my local office. The local office informing me that they didn’t know how I had been switched to automatic delivery and that I would be taken off immediately. And being told that a contract had not been sent but one would be mailed that day. To date, over a year later, we have never received our new contract. The delivery driver then showed up on a FOURTH occasion when no one was home to send him away and proceeded to fill our tank. When we received the bill, and still no contract for our payment plan, I contacted the local office and requested that the charge for the delivery be rolled into our new contract (that we had been promised on four previous occasions) and that we would continue to pay our payment of $150 per month. We were told by [redacted], the district manager, that he could not roll the delivery charge into our agreement. He told me that he would allow us to pay for our deliveries as needed at a higher rate, approximately $3 per gallon, and it would cost us approximately $300 per month during the winter months, sometimes more if it was very cold and we needed more propane. Twice our previous payment amount. I was also told that in addition to paying for each delivery in advance, we would need to continue paying our scheduled $150 per month to pay off the delivery that we DID NOT REQUEST OR WANT. I told him that this was not acceptable because it would triple, sometimes more, our monthly payment which we could not afford. He was not willing to work with us and provide us a new contract allowing us to pay our scheduled $150 per month, paying off the delivery we did not request along with any new deliveries we may need. I immediately began trying to contact the corporate office, filing complaints and making phone calls to try and resolve our situation but Amerigas refused to respond to emails or complaints or return phone calls. I have heard of similar complaints from other Amerigas customers. This additional delivery was billed at over $1,000. If the local office is making similar deliveries to just 50 of their thousands of customers each year, they are billing an additional $50,000 per year! I know for a fact that I am not the only customer that they have pulled this scam with. My request to resolve this is simple. First, since I have been making attempts to resolve this for over a year and been ignored by Amerigas, I am asking that any and all fees billed to my account since this delivery in question are removed from my account immediately. Second, I ask that Amerigas take responsibility for causing this situation when I was very proactive in trying to avoid this situation. I am asking that they credit my account for 50% of the delivery cost. Once these two requests are made, I will gladly pay off the balance. At that time, I ask that Amerigas immediately send out our new [redacted] contract plan at our regular monthly payment of $150 and the price per gallon that we are supposed to be paying, $2.86. Thank you for your time and attention to this matter. Regards, [redacted]

AmeriGas takes any complaint by its customers seriously. Therefore, upon receipt of [redacted]’s complaint, we investigated the allegations contained therein and provide the following response based on our findings.
The February letter the customer received had an estimated budget settle-up balance of $2,146.92 placed on it. The estimate letter and figure is meant to inform the customer of their possible settle up balance due at the end of the budge contract. The dollar amount on the letter is not exact, only estimated. The claim using $5,350.92 worth of propane is an inaccurate assumption. During the customers current budget contract they have received 6 deliveries at their agreed contract locked-in rate of $2.589. As of April 27, 2015 the customer has been billed $3,798.81 for 1371 gallons of propane. The customer currently has a balance due of $1,461.81 as of May 1, 2015.
During the previous budget contract the customer’s monthly budget payment was increased from $190.00 per month, to $226.00, to $335.00 to lower their settle up balance. The settle up balance at the end of the contract was $289.01 which they paid. This means an estimated letter would have been sent to the customer prior to this year’s letter.
The customer is on an agreed AmeriGuard contract of $2.589 per gallon, therefore no credits will be issued.We value all of our customers and trust this response addresses [redacted]’s concerns. AmeriGas takes any complaint by its customers seriously. Therefore, upon receipt of [redacted]’s complaint, we investigated the allegations contained therein and provide the following response based on our findings.By way of background [redacted] rented [redacted]. Atwater, OH [redacted] from [redacted] contacted her local AmeriGas office in November 2014 and ordered 200 gallons which was delivered on November, 26, 2014. [redacted] contacted AmeriGas on December 9, 2014 to take over as the account holder for this residence; this was scheduled for December 22, 2014.
[redacted] asserts we delivered 500 gallons in December without “doing an inspection.” On December 22, 2014 an AmeriGas Service Technician completed the leak check on the system and a found leak, the tank was locked off, 10% full of propane. No delivery was made and [redacted] was advised of all the issues with the gas lines and the line to the stove was capped off due to the stove needing replacement.
On December 23, 2014 [redacted] contacted AmeriCas to advise the gas lines were fixed. We went back to the location on December 24, 2014 and performed another leak check on the furnace. The furnace passed the leak check. On December 26, 2014 we made our first delivery to [redacted] of 425 gallons, only after the system checked out ok. [redacted] also claims he was without heat for twelve (12) days; he was without propane service to the furnace for two (2) days.Below is the list of deliveries [redacted] received from AmeriGas during his tenure as a customer.
• February 3, 2015 for 412 gallons• March 4, 2015 for 306 gallons• April 1, 2015 for 169.5 gallons
Account history for [redacted]’s account is enclosed on his final bill statement. [redacted] did receive a credit of $802.50 for the 375 gallons of propane left in the tank. [redacted]’s account was final billed on April 24, 2015 with a balance of $2,097.07. Currently his account balance is $604.93.
Please let this letter also serve as confirmation, no derogatory credit information has been reported to any credit bureau or credit reporting agency.

respond to [redacted]’s complaint. Upon receipt of his complaint, we investigated the allegations contained therein. We have concluded our investigation and provide the following response.**. and [redacted] were in a fixed price contract for the 2013-14 heating season. Their $2.99 fixed price expired on May 31, 2014. They were also on automatic delivery to help avoid run outs and the inconvenience of always checking the tank level. Automatic delivery time frames are computed by calculating the number of degree days gone by; when a certain number have elapsed (based on outside temperatures) a delivery is prompted, such is the case for the delivery in question. The delivery prior was made on March 15th in the amount of 228.5 gallons; based on our delivery formula and the degree days elapsed the June 24th delivery was right on time and the 220.8 gallons is consistent with the amounts delivered throughout the course of the season. This delivery was completely formula driven.[redacted] called on July 11th to discuss her account, the higher priced delivery of June 24th and a budget. During the call she was given the current year’s budget options and pricing. On Sept. 2 [redacted] called to confirm her budget contract was being faxed, she was informed she would need to make two payments (July and Aug.) to make the budget current. [redacted] was offered a reduction to her fixed price contract of .829 cents, which brings her price for the year from $3.109 down to $2.28 for the season; additionally her June delivery was re-priced at this rate.We value our customers and apologize for any inconvenience we may have caused **. and [redacted]. District Manager, Martin M[redacted] contacted [redacted] and explained our pricing structure. Mr. M[redacted] informed [redacted] that AmeriGas does offer several contract options for customers to receive lower rates. Please note AmeriGas always strives to be competitive in our pricing. However, since propane companies are not required to post our advertise their propane rates publicly as do gasoline stations for instance, we are not always fully aware of what price our competitors are charging for propane at any given time. If a customer brings a pricing issue to our attention we try very hard to be competitive by verifying their information and lowering the price as much as feasible to in line with competition.

I am rejecting this response because:
The facts AmeriGas stated are incorrect.  The last payment I made to them was not the $408.62 they stated in their letter.  During my most recent telephone conversation with Paul, the local supervisor, on Wednesday, January 7 he stated the following; 
1.  The error is most certainly on the side of AmeriGas.
2.  They are installing a new meter and will bring my account to a zero balance due.
3.  They are hoping this will resolve the issue, but they are not certain that it will.
What was factual in the letter they sent to you is the fact that they did install a brand new meter on March 17, 2014, in hopes that THAT would resolve the problem...and it did not.  I will not be certain that this issue has been resolved until I have had a minimum of six months with no issues.  Even then, I won't know if its been totally resolved.

opportunity to respond to [redacted]’s complaint regarding pricing. AmeriGas takes any complaint by its customers seriously.Therefore, upon receipt of [redacted]’s complaint, we investigated the allegations contained therein and provide the following response based on our findings.[redacted]’s complaint makes an assertion that AmeriGas is “overcharging” them for propane. Such allegation is not supported by any information submitted with the complaint, as will be set forth below. AmeriGas would like to first provide some initial background information on conditions in the marketplace.The safe and reliable delivery of propane to our residential customers is our highest priority. As an initial matter, AmeriGas purchases the propane it sells from a wide variety of sources, but principally from large producers and midstream companies who produce it and then sell it on the wholesale market. As a propane retailer, AmeriGas acts as a critical link between the producer and the end user. However, we do not manufacture or produce any propane whatsoever.Based on the unprecedented supply issues and market price increases last winter, AmeriGas purchased and/or contracted product throughout the spring and summer of 2014 to ensure our winter supply at the current market prices offered during that time. Many customers locked in their annual pricing for the 2014/15 heating season based on the marketplace cost last spring/early summer. As we moved in to the fall and early winter of the 2014/15 season, with temperatures warmer than normal and a reduction in propane exports, the propane market prices began to fall. However, AmeriGas, like many other propane suppliers, continue to have inventory coming in from the wholesale suppliers at the higher contracted costs based on those contracts entered in to last spring and summer.Our scale, with 360 transport trucks, 370 rail cars, and 28 propane terminals and trans flow sites, explains in part why we are considered to be a premium service provider. Propane is fungible, but our ability to deliver reliability of supply, to provide extensive safety training to our employees, in our view, sets us apart from others in the industry. To our knowledge, no other propane company has gone to the lengths we have with our trucks, railcars and personnel in an attempt to provide better service to our customers.
With respect to specific allegations in the customer’s complaint:First, [redacted] provides no documentation in support of the claim that competitors were charging the amounts alleged in the complaint. At the very least, [redacted] would need to provide a bona fide offer from a competitor to support these assertions. Even assuming the competing prices alleged in the complaint were accurate, it is a well-honored practice in the industry to offer “first fill” pricing to new customers that is below market rates as a vehicle to attract new business. This “first fill” pricing is markedly different from a competitor’s normal market-based pricing. However, because we have no documentation to support the PPG asserted by [redacted] here, we have no way of even knowing whether he was simply quoted a “first fill” price or something else.Second, setting aside the deficiencies noted above, there is no possible way to do a rational comparison of the per gallon price the customer was charged on the date of delivery by AmeriGas to a per gallon price allegedly obtained from a competitor on a different date.Third, as a will-call customer not participating in a protected price program, [redacted] receives residential, market-based pricing for propane deliveries. Stated another way, [redacted] is a “Tier” or “Volume-Based” customer. Therefore, [redacted] receives pricing as part of a formula determined by several factors, including: (i) what “Tier” the customer falls into based on average, annual volume usage; (ii) AmeriGas’ costs to procure propane (e.g., its commodity costs, freight costs, transportation costs, terminal fees, tariff charges, etc.); (iii) other costs such as the cost of our 24-hour delivery service, safety training, insurance, etc.; and (iv) our margin. Self-evidently, smaller competitors, who may, in fact, buy their propane on a wholesale basis from AmeriGas or other larger competitors, likely do not incur the same type of costs that AmeriGas has to incur to service a nationwide base of customers; costs that necessarily have to be passed along to customers in our pricing. In the absence of competitor cost information or pricing formulas - both of which are absent from the complaint - any attempts to compare the same is an impossible task and, as such, makes the customer’s reliance thereon largely immaterial.AmeriGas does offer certain budget and/or guaranteed pricing plans to qualifying customers. Such plans can help customers by providing more predictability on pricing and/or by spreading the costs of propane out over the course of the year. AmeriGas encourages [redacted] to contact his local office at ###-###-#### regarding these various plans.
 
Finally, although [redacted] currently leases a tank from AmeriGas, there is nothing prohibiting the customer from entering into a contractual agreement with a competitor and leasing a tank from that competitor. Therefore, despite claims [redacted] is somehow “forced” to use AmeriGas, the reality is that he could engage a competitor at any time.AmeriGas reasonably believes the explanation provided herein adequately addresses this matter. I SIGNED A CONTRACT WITH AmeriGas FOR A 500 GALLON TANK AND SUBSEQUENT SERVICE IN FEBRUARY 2016. IN JUNE THE TANK WAS SCHEDULED TO BE DELIVERED. THE DAY BEFORE THE DELIVERY, AMERIGAS CALLED AND SAID THEY DID NOT HAVE ONE. A USED ONE LOCALLY PROVED UNACCEPTABLE. THEY WENT TO WILMINGTON NC TO GET ONE. THE DAY THE TANK WAS TO BE DELIVERED THEY CALLED AND SAID THEIR SUBCONTRACTORS BACKHOE BROKE AND THEY COULD NOT BURY THE TANK.HERE I SIT WITH A NEW HOUSE AND NO GAS AND NO EXPECTATION FROM AMERIGAS FOR RESOLUTION.

concluded our investigation and provide the following response.[redacted] was billed for services through the first week of May at $4.629 per gallon. [redacted]’s landlord informed AmeriGas she is responsible for usage through April 30, 2014. District Manager, [redacted] rebilled [redacted] for usage through April 30, 2014 and reduced the rate to $3.249 per gallon. Thank you for your assistance, The local AmeriGas office sent someone to my home to remove the empty propane tank. The AmeriGas representative also advised she would submit my request for the tank rental fee of $70.00. I will advise you when I get a refund. Again thank you for the help with this threemonth request.
