made by the business in reference to complaint ID [redacted], and find that this resolution is somewhat satisfactory to me.  My complaint was that they weren't communicating with me.  Now they have offered less money that it costs to fix the problem.  They say they are reviewing it.  So on this issue, I am satisfied.  It is possible I file another complaint about communication or the way they handle the case.  But for now, I am happy that there is at least a dialogue.

The Complainant is in no way obligated to have the vehicle repaired at the Company’s preferred repair facility, however if the Complainant chooses to have the vehicle repaired at another facility, the Company would not be responsible for repair costs which exceed this Company’s estimated cost of repair.  While the Complainant had not previously inquired about a rental vehicle, rental reimbursement, if any, would be based on the number of labor hours required to repair the vehicle.Tell us why here...

This is a complaint under a private passenger liability policy filed by the Complainant Claimant; however there was no coverage on the date of loss, 3/2/2016, as the policy canceled 2/10/2016.   The Complainant chose to have the repairs completed through his own insurance carrier, The...

Hartford.  They in turn filed a subrogation claim on behalf of the Complainant with this Company.  A letter stating there was no policy of insurance with this Company was properly sent to The Hartford on 3/16/2016. This complaint is without merit as the Complainant’s carrier has been made aware of the claim’s status. All rights are reserved and none are waived or invalidated.

Our investigation disclosed that the Complainant Insured had no prior physical damage coverage and that she claimed that this alleged hit and run accident occurred on the same day the physical damage coverage was added to her policy.
However,...

there was no verifiable evidence that the loss occurred at the time that the physical damage coverage was in effect. In addition, the Insured initially reported to the Company that the alleged hit and run occurred in the state of Michigan and later reported that the alleged loss happened in Indiana.
The Complainant was informed that the claim could not be honored as there was no verifiable evidence that the alleged loss occurred within the policy period and contradictory statements were provided to the Company regarding the location of the alleged loss.

As previously stated, on 12/22/17 the policyholder contacted the Company and asked to close the collision claim without payment and this Company has yet to receive the completed [redacted] form and the entire series of medical records and invoices to evaluate the injury claim. Our investigation, including a recorded statement and vehicle inspection, disclosed that the damages resulted from the Insured driving the vehicle through water. Specifically, despite observing the water the Insured knowingly continued to drive...

through it causing the damages. Please note that this does not meet the definition of "Loss" or "Accident" under the Insured's policy of insurance with this Company. The claim was denied and the denial letter was forwarded to the Insured.
This complaint is without merit as the claim was handled properly and promptly.

the reports I recieved from the police department have both vehicle information and it states accident involving both cars I took pictures of the driver and her d.l ,car(front end)and registration she has front end and I have side damages

The policy was cancelled 07/16/15 and would have appeared on the producers July 2015 statement. In speaking with the producer, check #[redacted] for $125.00 was issued on 10/20/15 and the complainant should be receiving her check within 7-10 business days.

the application’s date be disclosed to the Company.In addition, it was disclosed that the 2015 Subaru Outback was used for business/occupation purposes to travel to various client locations, which was also not disclosed on the application of insurance. Had this information not been misrepresented the Company would not have accepted the risk or would have charged a higher premium rate. Please be advised that the Adjuster confirmed with the Complainant’s agent, [redacted] Insurance Agency that no accident and/or violations nor vehicle business/occupation usage were disclosed when the policy was purchased.Therefore, this Company exercised its option to declare the policy null and void.  The Complainant was advised that the premiums paid are to be returned by the Complainant’s agent.All rights and defenses are reserved and none are waived or invalidated.

As previously stated, our investigation disclosed that the driver of the loss vehicle had a suspended driver’s license at the time of the loss and due to policy exclusions the claim was properly denied. The Complainant can contact their producer, Insure One, and request their policy be canceled at any time. I am rejecting this response because: I do not have any paperwork in my policy states that they will deny the claim if my car is left unattended I did not sign anything and they do not have a copy of anything with my signature on it so there's no way that this insurance company should be denied my claim because they are saying that after the fact that my truck has been stolen they are saying that after the fact that my truck has been stolen is nowhere in the policy they have it nowhere in the policy
