I am rejecting this response because it was not on my monthly statements so how was I to know I owed this charge. This contract has small print. I know these are hidden charges, it should have been on statements each month.  This is not good business.

In your letter you mentioned that the tires had been replaced before the vehicle was returned. The inspection done after the return of the vehicle indicated that the right front tire and the right rear tire are worn. Section 35 of your Lease lists examples of what is considered excessive wear and use, including tires with read depth of less than 4/32” remaining at the shallowest point. In regards to filing a complaint against [redacted] BMW, the body shop is located at [redacted]. Their number is ###-###-####. The [redacted] location in the e-mail link was for [redacted],  i am going to move forward and add a complaint against [redacted] bmw body as the location I mentioned above. they kept the car for 2 months. when I asked them to give the car back, they refused. I would have got it fixed elsewhere. they kept saying 2 more weeks, then after 2 weeks went by, they said 2 more weeks, then 2  more weeks,. eventually  it became 2 months. when they said the car was ready, they said they could not give it to my till they got their payment. they said till we get our money, we cannot give you the back. they initially charged my car insurance company $4,000 then $6,000. they charged $21,000+ to fix the car. I went through torture with this shop for 2 months. I am definitely going to file a complaint against them as well.thanks[redacted]

We ask customers to allow approximately 30 to 60 days for all of the credit reporting agencies to change the information in their systems. We sincerely apologize for inaccurately reporting your account history. opportunity to address your issue regarding your end of lease charges through
the Revdex.com complaint process. We hope the following information
and explanation will answer the issues addressed in your complaint.

[redacted], we regret to
learn your leased vehicle was not functioning properly. BMW Financial Services
NA, LLC is a separate and independent financing entity from the manufacturer,
BMW of North America, LLC. As the financial services division of BMW Group, we
are not in a position to agree to grant concessions based on the performance of
your vehicle; we can only address issues dealing with your Motor Vehicle Lease
Agreement (Lease) or your account with us. All issues pertaining to the
performance and/or maintenance of the vehicle, as well as service provided by your
BMW center, are handled by BMW of North America, LLC. You may contact the
Customer Relations department at BMW of North America directly at (800)
831-1117.
Your complaint states you have
not received a response to previous requests you made to us. Dr. [redacted], we
have no record of receipt of any requests to discuss the end of lease charges
with you until receiving your complaint through the Revdex.com. The
only record we have of contact with you occurred on April 15, 2016 when you
spoke with one of our representatives and requested to know the length of time
you were allotted to remit payment for the end of lease charges.
Pursuant to the terms of your
Lease, specifically Section 35, you agreed to pay for any costs related to
excessive wear and use. This section lists examples of what is considered
excessive wear and use, including inoperative electrical parts, scratched or
pitted glass, and scratched body parts, paint, trim or grill work. As you can
see from the enclosed inspection report, the items you are being charged are in
stipulated in your Lease.
Excess wear and tear charges
are determined by the size of the damage. Normal wear and tear is designated as
damages that measure smaller than two inches. Damage that is larger than two
inches but smaller than four inches is considered small and billed at $100.00
per instance. Damage that measures four inches or more is considered large and
billed $400.00 per instance. According to the inspection there was damage to
the front bumper of the vehicle. 
To maintain the vehicle’s
safety and performance, BMW recommends tire tread depth be at least 5/32’, but
does allow the tread to be at 4/32’ at lease turn-in. To be considered
road-worthy, tire tread depth, in most states, must be a minimum of 3/32’ deep
and is considered legally worn at 2/32’ depth. Any measurement lower than 4/32’
or 1/8”, is considered excess wear and tear by BMW Financial Services as
discussed in Section 22 and 35 of your Lease. Because of all four of the tires
on the vehicle had less than 4/23’ of tread remaining at the time the vehicle
was returned, you were billed $1,200.00.
The Excess Mileage Charge of
$52.80 was assessed because the vehicle was returned with 45,279 miles; 264
over the contractually allowed miles. Excess mileage is billed at $.20 per mile
in accordance with your Lease.
The amount of the disposition
fee is disclosed in Section 7 and further discussed in sections 32 and 33 of
your Lease. The fee helps cover the costs incurred in transporting the vehicle
to an auction, preparing it for sale and paying the auction fees. As a loyalty
reward, the fee is waived if you finance or lease your next new or certified
pre-owned BMW through BMW Financial Services within six months of the end of
your lease.    
BMW Financial Services prides
itself in offering premium customer service. We regret your lease end
experience did not meet your expectations and are sorry for the inconveniences
you endured during the term of your lease. We have removed the $400.00 front
bumper charge, plus applicable tax, as a courtesy to you. The removal of the
$400.00 front bumper charge reduced your account balance to $1,747.05.
Unfortunately, the mechanical
and service issues you experienced do not negate the valid charges assessed to
accordance with the terms of your Lease. To close your account, please direct
your payment (including your account number in the memo section of the check)
for $1,747.05 to:

[redacted]Hello, I reviewed the information and BMW told a lap as as. According to their action plan letter they stated that I paid my car-note for the month of December 2016 on the 25th. According to my statement and BMW invoice it was pay on December 23th which makes it the 29th day. They also stated that I paid my January payment on the 25th and that's a lie. According to my invoice I paid my car-note on the 24th day of January.  If you read my statement as I mention before it was only late fee as the count as the car-note. On February 24th I paid my car-note before it hit the 25th day, but they did not put that on their and they want it to look like a miss payment....   My April car note is due on the 25th of April which is the total amount of 441.52, therefore they are trying to make my character look bad as if my car-note for April is not paid. On 4/14/2017, I made 800.00 out to BMW and now I'm left 441.25 which is due on the 25th of April. I have a copy of my credit report which shows that my account is in good standing and paid as agree.  They retro-acted my credit report to due damage. Si if you look at my data and their who are the lair. Please review attached documents..  According to fair debt collection since they accepted my payments the agreed to the terms.... We hope the following information and explanation will answer the issues addressed in your complaint.   Our records confirm you spoke with one of our representatives on March 21, 2017 and discussed the two AutoVIN inspection reports you received, one with a billing of $0.00 and one billing you $1,200.00. As our representative advised, the inspection report issued to you reflecting $0.00 was a result of an AutoVIN error and AutoVIN rectified their mistake by sending you the correct inspection report, billing a total of $1,200.00 for three worn tires.   As a gesture of appreciation for your understanding of the error, we removed one tire charge of $400.00. However, as is stated on the AutoVIN inspection reports you received, the inspection report, “is not a bill. Your final excess wear-and-use charges will be determined based on the condition of your vehicle at the time it is turned in to a BMW center.”   Pursuant to the terms of your Motor Vehicle Lease Agreement (Lease Agreement) you agree to pay for Excess Wear and Use based on our definitions of Excess Wear and Use in Section 35. Mr. [redacted], we are sorry to hear your experience and the customer service you received did not meet your expectations. We reviewed your account records based upon your allegations in your rebuttal. We do show where you contacted our offices multiple times on July 13 reaching different associates with the same question that day as well as on July 14, July 15, July 26, July 27, and July 29. We consistently provided you with the same response, including the need for you to work with your bank to stop payment on your payoff check.
 
Ultimately, the promotional payment credits are in place as a loyalty reward to finance the purchase of your vehicle with BMW Financial Services. Although we do not assess an early payoff penalty for payoffs received prior to your scheduled maturity date, if you are no longer financing your vehicle with BMW Financial Services due to an early payoff, you would no longer qualify for any remaining rewards.  While we can appreciate your stance and rejection of our previous response, and understand you do not agree with our position, our business decision remains unchanged.

The payoff necessary to refinance your 2011 Nissan Versa constituted 174% of the vehicle’s KBB value and up2drive was only able to offer financing of $8,687.25 for your above referenced refinance. [redacted], we understand your concern regarding the amount of interest paid. In order to fully assist, we would first like to explain the way in which interest accrues. Your Retail Installment Contract (Contract) functions as a simple interest account. The per diem (daily interest) of interest that accrues is calculated as a daily rate, and is based on your remaining principal balance and Annual Percentage Rate (APR) on your Contract. Therefore, as your principal balance decreases, the per diem of interest accruing also decreases. Based on the description of the way your Contract functions, when we receive a payment for your account, it is first credited to the accrued daily interest since your last payment was made, and then to the remaining principal balance.   We can confirm, due to an internal system error, each payment you submitted after June 23, 2016, was incorrectly applied only to interest accrual. As a result, the payoff amount did not lower with any of the payments you submitted. This error has been corrected as of March 6, 2017, when you called and spoke with our Customer Service department. We apologize for any inconvenience we may have caused. After correcting the error, each payment now accurately reflects the appropriate amount of accrued interest between payments, and reflects the amount applied to the remaining principal balance. I am rejecting this response because:Again, BMW does not want to take responsibility for their errors and omissions. They are also being spiteful l that I did not lease another BMW product from their company. I will be retaining legal council to sue BMW Financial Services for damages.

1) My address is consistent with my Affidavit and driver's license.  My previous statement is true and correct, which was a key reason you have refused to remove the alleged account from my credit report.  2)I find it unfair and unethical, that you have not provided, nor shown in your investigation another alleged driver's license you claim there is.  Of course you cannot produce it, because it does not exist.   You have not fully explained the inconsistency with the addresses. 3) You have not fully disclosed the full account numbers to this alleged account in question.  4) Finally, as you have correctly stated I owe BMW nothing.  5)  The account on my credit report I am totally not familiar with.  6) If you do not wish my future business consider it done.  But, the error has to be corrected by being removed.  That can be the only remedy.
