While the individual dents were smaller than two inches in size, we group multiple dents on a single panel together and treat them as a large damage. The third party appraiser assessed this as ‘hail’ damage on the three panels mentioned above.   Pursuant with your conversation with our representatives on December 27, 2016 we have extended a courtesy to you and waived $1,000.00 of the original $1,200.00 in damage. time to speak with us on July 30, 2015.  As we discussed, your vehicle was repossessed on July 22, 2015 for non- payment of the loan.  In order to have the vehicle returned to you, BMW Financial Services is requesting the full payoff of the vehicle, which as of today is $18,050.94. Pursuant to the terms of your Motor Vehicle Retail Installment Contract and the Notice of Sale letter you received, if the payoff is not received by August 7, 2015 the vehicle will be sold at auction and you will be responsible for the deficiency balance. your request, we researched your account and verified your account was reported 30-59 days past due on 15 occasions. Additionally, we confirmed we received notice of your Chapter 7 bankruptcy filing dated February 27, 2015 and your Notice of Discharge dated June 11, 2015.   Mr. [redacted], our records indicate a total loss settlement of $12,869.78 was received from [redacted] Insurance on October 6, 2014, creating a deficiency balance of $1,509.12. The deficiency balance would have needed to have been paid within 12 months to avoid being reported to collections. However, your bankruptcy filing date occurred prior to you satisfying the remaining balance on the account. To ensure all four credit reporting agencies have updated their records, we have submitted an electronic update reflecting the proper Consumer Information Indicator of “E – Discharged through Chapter 7 Bankruptcy”. In accordance with the Consumer Data Industry Association guidelines for Data Furnishers, we are restricted from reporting your payment history after your bankruptcy filing and we are required to cease reporting your account after receiving your Notice of Discharge. the information provided is inc[redacted]ect.  The attached file is the emailed invoice from [redacted] BMW of Sprinfield, NJ which serviced the vehicle in June, 2015 so the information they have on file is inaccurate.  Again please remove this erroneous excess mechanical charge so that I can send you a check and purchase my next BMW at [redacted] BMW in Shreveport Louisiana.  I'd rather drive 150 miles than deal with [redacted] BMW which has botched my lease return and caused undue stress to a good customer.  The last thing I expected was to go through this process with what is supposed to be a reputable company. I was not afforded the opportunity to sign an odometer statement detailing the condition I submitted this car in.  I am responsible for the tire charge, bumper charge and the disposition fee.

  Mr. [redacted], your final EasyPay payment was posted to your account on August 10, 2016 and EasyPay was subsequently deactivated. Your full balance of $1,214.94 became due on your maturity date of September 10, 2016. We made numerous attempts to contact you by telephone and email to discuss your past due balance; however, we were unsuccessful in our attempts to contact you. Your account was 72 days past your maturity date when your vehicle was repossessed.   Our records indicate you have since satisfied your account in full and retrieved your vehicle. We also researched your illegal seizure claims and feel the repossession is valid. BMW Financial Services is committed to reporting account information to the credit reporting agencies regarding the payment experience we have with our customers. In an effort to resolve your request, we researched your account and verified one payment was received 30-59 days past due. The payment due on February 25, 2014 was received 31 days past due on March 28, 2014.
 
Our records indicate you spoke to our collections department on several occasions regarding your difficulties remitting payment. On March 5, 2014 you stated you would remit payment for your past due February installment on March 8, 2014. No payment was received. When we spoke with you again on March 21, 2014 you stated you would be able to remit the past due payment the following week. We have no record of a conversation during which you were told the payment would not be reported as delinquent. Our records indicate our representatives advised you to stay in contact with BMW Financial Services regarding the status of your payments.
 
Your complaint states you made a payment on March 24, 2014. We can confirm a partial payment was received in the amount of $400.00 on March 24, 2014. Pursuant to the terms of your Motor Vehicle Retail Installment Contract (Contract) your monthly payment is $592.90. Because your contracted monthly payment amount was not received in full, your payment was reported as delinquent. The outstanding $192.90 was not received until March 28, 2014, when a payment for $193.00 was posted through your My BMW online account.
 
As you know, as a financial services provider we are required to report payment histories pursuant to established guidelines and therefore, are restricted from changing any payment history we have correctly reported. We have made the decision to report to the credit bureaus and report all of our customers based upon the same criteria. Because we have no evidence indicating our reporting of your account is not accurate, we are unable to accommodate your request to remove the delinquency from your credit report.

The $54,000.00 payoff referenced in your complaint included sales tax and is not for insurance purposes. A total loss payoff of $49,910.09 was posted to your account on June 27, 2016 with an effective date of June 20, 2016. No negative information has been reported to the credit reporting agencies and your account is paid in full and closed. Unfortunately, because payments are due on your account until your total loss payoff has been received, we are unable to honor your request to refund your April 4, 2016 payment. I am rejecting this response because:  I need to know how BMW allowed my address to be associated with his account?  Do you not complete any type of verification?  You had to have ran his credit report.  Did any discussion take place concerning him using an address that was not on his credit report?

Installment Contract (Contract) details the Finance Charge or amount the borrowed funds will cost you as $7764.23. Your Annual Percentage Rate, or APR, is 9.49 percent. The Total of Payments, or total amount you will have paid to us over the term of your financing, was projected to be $31,980.96. The Total of Payments includes the Finance Charge and the Amount Financed. The Total Sale Price of your vehicle, including your down payment and the Total of Payments in alignment with your financing agreement, is $31,980.96. The reverse side of your Contract, specifically Section 1. A-D, explains the Finance Charge listed on the front of your Contract. This charge was based on the assumption you will make each installment on the date it is due. This calculation will be affected by the way you remit your monthly installments. Late payments may mean that you may pay more interest than the projections on the front of your Contract, while early payments may mean that you may pay less interest than the disclosed projections. I am rejecting this response because: the direct and blatant arrogance that Mr. K[redacted] has shown in this reply is the same total disregard to the Estate and the Probate Court Order that was shown upon first sending BMW Financial Services the Death certificate, Judge's Order, and Power of Attorney for the Legal Heir of the Estate of [redacted]
The Estate of [redacted] holds firm that BMW Financial Services did in fact with intention undermined a court order and denied the Estate the total payoff of this account's balance in full. Additionally BMW Fincancial Service contributed mostly to the repossession of this vehicle. On September 9, 2015 when I called to confirm BMW financial services receipt of the Death Certificate, Judge's Order and POA, I informed the representative that I was calling to payoff the account and needed the payoff amount. The agent told me that he was advised that I would be calling and he further had been advised that he could ONLY accept a payment but could NOT give me any details of the account such as balance , the current status, etc. I was told by the agent that the legal department needed to review the documents, then someone would give me a call to arrange the final pay off amount. In which, that never happened until after BMW Financial Services repossessed the car on the assumptions that The Estate had no authority to pay the car off.
Therefore, in efforts to negotiate some type of compromise, I made the offer to make a $6000 payment to bring the account current. And await to hear back from BMW. Therefore, BMW Financial the assumption that refinancing was necessary is mere arrogance to assume ANY such financing was needed because it was not. The money was sitting in the bank upon my initial contact with BMW. I nor the Estate of [redacted] ever expected, requested or considered asking BMW FINANCIAL for nothing more than the pay off balance on September 9, 2015. These fact can be proven in the phone conversation on September 9 and will be proven by the phone recordings when and if necessary.
BMW FINANCIAL with intention and total disregard of the Probate Judge's Order giving the authority of the Estate of [redacted] to take possession of the Heir's property, repossessed this car as a result of its own negligence and unprofessional arrogance. And because of BMW Financial Services contributory negligence, this account went into default to the point of repossession. And further, BMW FINANCIAL again failed to honor the Judge's Order and contact the Estate with regard to this account as the Vehicle is clearly named in the Estate.
It seems to be more about the money for Mr. K[redacted]. In that, I would not be surprise if the assumption that this all was orchestrated by BMW Financial Services as a way to recoup some of the lost interest on this account as a result of it being paid off almost two (2) years early.
It just seems odd that the estate contacted BMW Financial Service to pay the car off and it ended up being repossessed. And a court order can be disregarded. And the Estate is to blame for a repossession for trying to payoff the balance early.
To think, this is the service BMW Financial Services choses to call world class.

I am rejecting this response because the minor damage to the wheels was well within BMWs "Acceptable" parameters as follows:Acceptable• Four original, matching tires that have at least 4/32" treaddepth and that match the original equipment suppliedon your vehicle (speed rating, type, run-flat, brand, and size);• Minor scuffs that fall within the inner circle, to tires thatdo not affect the safety of the tire;• Minor scuffs or nicks to wheel covers or alloys that fall withinthe 4" outer circle of the Evaluator.Unacceptable• Tires, regardless of mileage, that have less than 4/32" tread depth;• Specifications and sizes different from original equipment brand(approved brands are Michelin, Pirelli, Bridgestone, Continental,Dunlop, and Goodyear), type (run-flat), and speed rating;• Recapped or retread tires;• Tire sidewall repair plugs;• Snow tires;• Any tire damage affecting the safe operation of the vehicle;• Mismatched, bent, cracked, or broken wheels, wheel covers, or alloys;• Missing spare tire and/or spare tire that does not matchthe original manufacturer’s specifications;• Bulges or indentations in the sidewall;• Scuffs/scratches to wheel covers/alloys that fall outsideof the 4" outer circle of the Evaluator.If BMW made a choice to replace the wheels, it is their responsibility to cover the cost. A comparable scenario would be if a lease was returned with a minor chip in its paint that fell within BMWs acceptable lease return parameters. Upon prepping the vehicle for resale, the dealership decides to replace the door for esthetic purposes, then charges the leasing party $1000 for the replacement. There are two reasons this is unacceptable:1. The chip is clearly allowed by the defined lease return parameters, and not the responsibility of the leasing party.2. The cost of repairing the paint chip would be significantly less than replacing a door.In the above case $1000 would be an exorbitant fee for an item that feel within the Unacceptable lease return parameters. The cost of repairing minor curb rash is approximately $100 per wheel, something BMW appears to have overlooked. Regardless, it is not our responsibility.Please escalate this issue to someone with the authority to resolve it.

Thank you for giving us another opportunity to address your concern regarding how we have reported your payment history to the credit reporting agencies through the Revdex.com complaint process. We regret our previous response did not completely resolve this matter.
First, we would like to resolve any confusion regarding the way we report payment histories to the credit reporting agencies. We are required to align our credit reporting policies with current industry standards and within the guidelines provided by the Consumer Data Industry Association (CDIA). In order to align with industry practices, BMW Financial Services reports payments as delinquent if they are not received within 29 calendar days of your payment due date.  Based upon your payment schedule and the days in the respective months your payments were received 30 days past the due date.
We understand you are alleging your wife was provided with incorrect information. However, as we previously indicated, we have no record of any contact from your wife regarding your payments or how your payment information is reported to the credit reporting agencies. We do have a record of you contacting us in July, 2015 advising us of a family situation and financial hardship.
As a financial services provider we are required to report payment histories pursuant to established guidelines. We have made the decision to report to the credit bureaus and report all of our customers based upon the same criteria. BMW Financial Services does not instruct the credit bureaus to remove derogatory information unless our reporting of the account information is inaccurate. Our response remains unchanged; because we have no evidence indicating our reporting of your account is not accurate, we are unable to accommodate your request to remove the delinquencies from your credit report at this time.
