Dear Mr. [redacted]:   Thank you for giving us the opportunity to address the way we are reporting your payment history to the credit reporting agencies through the Revdex.com complaint process. We hope the following information and explanation will answer the issues addressed...

in your complaint.   In an effort to resolve your request, we researched your account and verified one payment was received 30-59 days past due.  The February 28, 2017 was received 35 days past due on April 4, 2017.   Our records confirm you enrolled in our paperless billing initiative on October 29, 2014 to receive monthly Statement Notification emails containing the amount due and a link to your My BMW online account. The February 2017 Statement Notification email was generated and emailed to you on February 9, 2017. To date, we have not received a change of address notification from you; however, an address change with the United States Postal System (USPS) would not impact receipt of your electronically generated Account Statements.   We are not obligated to notify you of past due payments; however, as a courtesy we verified three emails were delivered to alert of you of the missing February 28, 2017 payment. A review of your My BMW online account activity confirms you viewed your payment history on February 19, 2017, March 23, 2017, and March 31, 2017 which at the time, your account would have reflected a missing payment for your February 28, 2017 payment due date.  While our records confirm we received your consent to contact you via your cellular telephone as of June 2, 2017, your correspondence does not provide sufficient justification to change the way we are reporting your payment history to the credit reporting agencies under the guidelines and regulations we are required to follow as a Data Furnisher.  As a result of your dispute, we will be providing an update to the credit reporting agencies to reflect the results of our investigation.   We are committed to providing you with the highest level of service. I am submitting my same response as before. You still have failed to provide sufficient evidence that this debt is owed and that I am contractually obligated to pay. My response is detailed an accurate. I advise that you carefully review my response again and adjust the information you are reporting accordingly. This is your last chance to correct this issue before I seek litigation. As review of the case law shows that this is NOT the first issue BMW/MINI has had with fraudulently and incorrectly engaging in business with consumers. The case law is clear and dictates that I will prevail should legal action be pursued. No information/documentation provided validates anything. I again reassert my demand as outlined in the attached response.

I am rejecting this response because:  BMW continues to lie to it's customers when they state that they "are committed to providing the highest level of service" because they cheat their customers out of hundreds of dollars with their lease program. Once again, the car was not returned with excessive damages so my position remains unchanged as well.  My sister also leased a BMW from the same dealership and went through the same experience.  She was forced to pay an excessive amount of money for made up damages to avoid hurting her credit.  This is ridiculous and I will never do business with BMW again!  I will also let as many people know as possible how they really treat their customers and I am hoping that the Revdex.com will do so as well.  I have purchased a new Infinite and will be an Infinite driver for life!!

I am rejecting this response because: you have failed to prove to me that anything came back from my bank that says insufficient funds, there was damage done to my vehicle I am placing a lawsuit against you, I don't feel IOU no money , your supervisors your managers have refused to return my phone calls I have proven car was paid off in December with clear title, u  sent people to my house not once but twice , pitbull recovery received all the information title paid in full you still hired another repossession company knowing you had no right to touch my vehicle I will be seeing you in the court of law I will cost you money and aggravation as you've cost me , I dare you to send the repossession man to my house it only strengthen my lawsuit . ALS funding is also going to be getting sued .

you have not been receiving your monthly Account Statements. We can confirm we have been sending your Account Statements to [redacted] Street, Apt. [redacted], Oklahoma City Oklahoma 73104. During one of your telephone conversations with our representative we attempted to confirm the address with you; and confirmed an address of [redacted] as your primary number rather than [redacted]. We apologize for our error. We have changed your address to [redacted] St Apt. [redacted].
 
As a service to our customers, we bill our customers approximately 20 days prior to their payment due date. The next morning this information is sent electronically to our vendor that produces our monthly Account Statements. The Account Statements are printed and mailed within 48 hours (excluding weekends and holidays) after being received by our vendor. Our records indicate that the Account Statement for your June 19, 2015 payment due date was printed and mailed on May 30, 2015. The Account Statement for your July 19, 2015 payment due date was printed and mailed on June 30, 2015 and the Account Statement for your August 19, 2015 payment due date was printed and mailed on July 31, 2015. We have enclosed copies of your Account Statements for your records.

As I said before the leap year was the reason.  This is an not acceptable response from BMW.  I need the late payment removed from my records ASAP.   30 days past due would be on the following day, not the 28th of the month.  Also, I was just alerted Saturday August 26th that BMW has looked at my credit report. This was after I filed the complaint.  I did not give permission for this.  I am not asking for credit help or counseling from BMW.  I do not wish to modify my account or need to be told my account is  late from time to time.  Both looking at my account and telling me I am late (not 30 days) is just intimidation tactics.

explanation will answer the issues addressed in your complaint. First, we would like to wish you and your unborn child good health. It is not our intention to place any undue stress on you or your family. As of the date of this letter your account is 63 days past due for your September 1, 2017 payment due date. In an effort to collect on your past due balance BMW Financial Services is actively engaging in an outbound campaign via our representatives and automatic dialing technology in order to contact you and make appropriate payment arrangements. Our records confirm payment in the amount of $767.00 was remitted October 31, 2017 via [redacted] and was posted to your account on November 1, 2017. $426.28 of this payment was applied toward the satisfaction of your August 1, 2017 payment due date and was received 91 days past due. $340.72 of this payment was applied toward your outstanding September 1, 2017 payment due date. As of the date of this letter $425.56 remains outstanding for your September 1, 2017 payment due date. Although you have been notifying BMW Financial Services of your intent to remit payments, as you were advised October 23, 2017, further collections activities continue until such time as delinquent status has been sufficiently reduced. Additionally, your vehicle risks being requested for repossession until your balance is paid under 60 days past due. While we keep detailed notes regarding our conversations and interactions with customers, your current delinquent status requires we continue our collections efforts until your delinquency has been sufficiently reduced. At this time, due to the delinquent status of your account and the insufficient funds return of both your July 29, 2017 and August 31, 2017 payments, we are requiring you to remit payment via certified funds like [redacted], money order, or debit card until your account has been paid current. Mr. [redacted], BMW Financial Services NA, LLC is a separate financing entity from the independently owned and operated BMW centers. We apologize the dealer did not make you aware of the sales tax assessed on the disposition fee.
 
Sales tax is charged by The Division of Taxation which defines the termination fee, excess mileage, excess wear and tear, and reconditioning fees as charges related to the use of the car, not an interest expense or financial institution service charge, and therefore taxable. The Division excludes from taxation late payment fees, federal luxury tax, parking tickets or other violations, and legal fees.
   
Mr. [redacted], we would also like to clarify that the late charge balance of $58.38 was not charged due to the turn in date of the BMW X3. Pursuant to the terms of your Motor Vehicle Lease Agreement (Lease), late charges are assessed when payments are received beyond the ten day grace period established in your Lease.
 
As a gesture of our appreciation for your business, we have removed the balance of $88.67 and closed your account. We hope our resolution and explanation of the charges has restored your faith in BMW Financial Services and you will return to our brand in the future.

terms of your Motor Vehicle Lease Agreement (Lease Agreement), you agreed to pay for any costs related to excessive wear and use. The Lease Agreement lists examples of what is considered excessive wear and use, including inoperative electrical parts, scratched or pitted glass, and scratched body parts, paint, trim or grill work. Additionally, any tire tread depth measuring lower than 4/32’ or 1/8”, is considered excess wear and tear. We have also enclosed a copy of the Lease Agreement for your convenience. We have also enclosed a copy of the inspection report with photos for your review. The inspection indicated a small scrape on the left quarter panel, billed at $100.00. The inspection report also shows that the left rear, right front and right rear tires were below the contractual tread depth of 4/32 of an inch and each tire was billed at $300.00.   The $350.00 disposition fee is a contractual fee disclosed in your Lease Agreement. The disposition fee is assessed to compensate for the expenses of selling or otherwise disposing of the vehicle. These expenses may include vehicle cleaning and reconditioning costs, vehicle inspection fees, transportation costs, storage fees, auction fees, administrative costs and funding costs until the vehicle is finally sold. As a loyalty reward, the disposition fee is waived if you finance or lease your next new or certified pre-owned BMW financed through BMW Financial Services either two months prior or within six months after the end of your lease term.   Our records indicate that the account was initially billed $1,350.00 which was for the disposition fee, the tires and the exterior damages. We agreed to accept $1,012.50 as a settlement in full on your account, a reduction of 25%. We also agreed to setup an interest free payment plan on the settlement. Our records indicate $400.00 has been paid so far towards the settlement with $612.50 remaining. We are unable to remove or reduce the charges any further as they were assessed in accordance with the terms of your Lease Agreement.   We are committed to providing you with the highest level of service. We are currently reporting your Account Status as “Unpaid balance reported as a loss, (charge-off)” with a current and past due balance of $18,030.23.   Ms. [redacted], we have no record of the payment arrangements referenced in your complaint. Our notes indicate we made numerous unsuccessful attempts to contact you prior to repossessing your vehicle for a second time. The Notice of Sale was mailed to you on April 27, 2016. We also spoke with you the same day and advised payoff was due in full by May 12, 2016 to redeem your vehicle. However, the Notice of Sale expired and your vehicle was sent to auction and sold. Mr. [redacted], your end of
lease balance is composed of your disposition fee and a partial monthly
payment. We reviewed your account and confirmed the payment posted March 30,
2015 satisfied your March 22, 2015 payment due date which is the final payment as
listed in your Motor Vehicle Lease Agreement (Lease). The referenced payment
was reflected on your bank statement on April 1, 2015.
Because you extended your
Lease one month, you became responsible for an additional payment due April 22,
2015. As a result, you were billed $313.79 for a partial monthly payment. Your
partial monthly payment was calculated based on a per diem for the number of
days you had your vehicle past your original maturity date and prior to
returning your vehicle on April 28, 2015. Unfortunately, your lease extension
payment due April 22, 2015 was not received. The $350.00 disposition fee and
partial monthly payment fee of $313.79 were billed in accordance with your
Lease.
In your letter you state since
the account has been referred to a collections agency BMW Financial Services
has damaged your score. BMW Financial Services has not reported your end of
lease charges to the credit reporting agencies.

This vehicle has been paid in full as of this date. I just feel that I overpaid BMW (all those late fees) and would like some type of refund other than the $1.10 they are refunding.

Thank you for giving us another opportunity to address your end of lease charges through the Revdex.com complaint process. We regret our previous response failed to resolve your concerns and your complaint.
 
We understand you do not agree with our position; however our response remains unchanged. The balance due on your account includes $2,000.00 in exterior charges, $250.00 in mechanical charges, $7.80 in excess mileage and $600.00 listed as a glass charge because of the damaged windshield. The charges were billed with applicable sales tax.
 
In order to comply with New York Personal Property Law, BMW Financial Services must hand deliver the final itemized bill or send it by registered mail. In addition, there is a time frame given to contest the excess wear and damage to the vehicle by having an itemized appraisal done by an appraiser that is licensed by the New York State Department of Motor Vehicles. However, the time frame has expired to contest the end of lease charges.
 
Mr. [redacted], because our efforts to resolve the outstanding balance of the account were unsuccessful, we placed the referenced account with the third party collection agency, [redacted]. Please contact [redacted] at ###-###-#### if you would like to discuss making payment arrangements.
