Vaughn, we regret to hear the multiple vehicular issues you are experiencing with your 2016 BMW M5 Sedan. As the financial services division of BMW Group, we can only respond to inquiries regarding the Motor Vehicle Lease Agreement (Lease Agreement) or the account with us. Issues pertaining to the vehicle itself are handled by BMW of North America, LLC. We encourage you to continue to work with BMW of North America. The Customer Relations department of BMW of North America may be contacted at ###-###-#### Monday through Thursday, from 9:00 a.m. to 9:00 p.m. ET and from 9:00 a.m. to 6:00 p.m. ET on Friday. BMW Group prides itself in providing premium customer service. We sincerely apologize if a representative of BMW of North America failed to provide you with the level of service you expect and deserve. We have forwarded your feedback to management in BMW of North America to address your concerns with the representative in question.   While we understand and empathize with the frustration caused by your situation, we are unable to comply with your request to terminate the Lease Agreement early with no penalty, or to assist you in providing a substitution vehicle. The Lease Agreement is active and the account will remain open until the remaining payments have been satisfied. For your convenience, we have enclosed a copy of the Lease Fulfillment Overview to review your Early Termination options.   We are committed to providing you with the highest level of service. If you have any questions, or if you wish to pursue an Early Termination, please contact me, Chelsea W[redacted] at ###-###-####, Monday through Friday, from 9:00 a.m. to 6:00 p.m. ET, or by mail at either address listed on this letter. Thank you for giving us the opportunity to address your billing and collections concerns through the Revdex.com complaint process. We hope the following information and explanation will answer the issues addressed in your complaint.First, we were sorry to learn you were offended when you...

received your Lease End Statement by certified mail. However, BMW Financial Services is required to send your initial Lease End Statement by certified mail to comply with New York State regulation.Additionally, BMW Financial Services is committed to reporting account information to the credit reporting agencies regarding the payment experience we have with our customers. In an effort to resolve your request, we researched your account and verified five payments were received 30-59 days past due.- The payment due June 12, 2013 was received 36 days past due on July 18, 2013.- The payment due November 12, 2013 was received 44 days past due on December 26, 2013.- The payment due December 12, 2014 was received 34 days past due on March 18, 2014.- The payment due May 12, 2014 was received 36 days past due on June 17, 2014.- The payment due September 12, 2015 was received 31 days past due on October 13, 2015.Our records indicate [redacted] was the email address provided to us when your account was created. We apologize if your email address was incorrect; however, our records indicate your email address was updated to [redacted] immediately upon being notified you were not receiving emails from us. Because your monthly payment amount and payment due date are outlined in your Motor Vehicle Lease Agreement, monthly Account Statements are not required for the remittance of your monthly payments after you have received your initial Account Statement. Unfortunately, failure to receive your monthly Account Statement or to receive past due notifications is not sufficient justification to change the way we are reporting your payment history to the credit reporting agencies under the guidelines and regulations we are required to follow as a financial services provider. As a financial services provider we are required to report payment histories pursuant to established guidelines. We have made the decision to report to the credit bureaus and report all of our customers based upon the same criteria. Because we have no evidence indicating our reporting of your account is not accurate, we are unable to accommodate your request to remove any delinquencies from your credit report. If you have any questions, please contact me, Paul I[redacted] at ###-###-####, Monday through Friday, from 8:30 a.m. to 5:30 p.m. ET, or by mail at either address listed on this letter.Yours sincerely,Paul I[redacted]Senior Account Specialist BMW Financial Services NA, LLC

Complaint: 10802651
I am rejecting this response because:   I need all the balance history that is showing right now to be corrected for [redacted] and myself. I have been disputing all the information with the bureaus since June 2015.There should be no balance history since '012015'' on the report - 0- balances and on the month by month my date should show last date 012015.For [redacted], there should be no repo because the vehicle community property was repo'd while the account was under bankruptcy protection.  Also, the account had to wait for charge off until my discharge which was 052025 . [redacted] filed at the end of the month therefore, he should not have the repo or any late or any history past 052015 - his filing date.  At this moment you are showing balance history in May June July Aug 2015.  It should not.Paperwork was sent via the BMW private message several times.   Per the FCRA the furnisher should not take more than 30 days to correct and should not verify info that is  incorrect.  We are being negatively affected.  It has made our sccore drop 30 pts.    Please correct with all 3 CRAS ASAP or delete from our file if you cannot correct within the 30 days allotted by law.We would appreciate a resolution to this asap. I have ciopies going back to June where the incorrect info has been verified as correct. We would appreciate a letter in writing indicating the correction, and verification of correction in case the account is updated once again in the future.
Regards,
Sandra [redacted]

Dear Dr. [redacted]:   Thank you for giving us the opportunity to address your issue regarding end of lease charges through the Revdex.com complaint process. We hope the following information and explanation will answer the issues addressed in your complaint.   BMW Financial...

Services NA, LLC is a separate financing entity from the independently owned and operated BMW centers. As such we are only able to address issues dealing with your Motor Vehicle Lease Agreement (Lease Agreement), or your account with us. Any agreement you may have with [redacted] exists between you and [redacted] only; we cannot enforce any agreements made outside the parameters of your existing Lease Agreement.   Pursuant of your Lease Agreement you are responsible for 36 monthly payments of $532.94 even if the vehicle is returned before the maturity date. Our records indicate the vehicle was returned with one remaining payment totaling $532.94.    The Excess Mileage Charge of $645.96 was assessed because the vehicle was returned with 39,094 mile; 3,047 over the contractually allowed miles. Excess mileage is billed at $.20 per mile in accordance with your Lease Agreement. The excess miles are subject to state sales tax of 7%.   Pursuant to the terms of the Lease Agreement, the customer agreed to pay for any costs related to excessive wear and use. This section lists examples of what is considered excessive wear and use, including inoperative electrical parts, scratched or pitted glass, and scratched body parts, paint, trim or grill work. We have enclosed a copy of the inspection report for your review. The inspection report indicated all four of the tires needed replaced and each tire was billed at $300.00. The tire charges are subject to state sales tax of 7%. Our records indicate you were present for and signed the inspection report acknowledging the charges.   We have received a payment from [redacted] in the amount of $2,042.77 and have applied it towards your account. The current balance is $408.13. We have enclosed an updated account statement for your convenience. Unfortunately, BMW Financial Services is only able to contact our contract holder to collect a balance due on the account. Although we regret your lease end experience has not met your expectations; however, we are not able to make any adjustments on your account at this time.   To close your account please remit payment to BMW Financial Services for $408.13. We can accept payment via credit card or UltimatePay (automatic debit from your checking or savings account). Your card issuer may impose a cash advance fee or other charges for paying BMW Financial Services by credit card.
