Dear Ms***: In response to Ms***'s complaint, Auto Trakk, LLC provided financing to Ms*** to lease a *** ***Auto Trakk, LLC, prior to leasing the vehicle to Ms*** performed an AutoCheck on the vehicle, which showed no structural damage rendering the vehicle
unsafe.Ms*** had contacted Auto Trakk, LLC on numerous occasions stating she could no longer afford the vehicle, which is why she was returning it.Auto Trakk, LLC would gladly discuss this matter further if Ms*** has any further concerns, however, at this time, Auto Trakk, LLC is not in a position to remove this from Ms***'s credit bureaus. I was happy with Auto Trakk in the beginning of last July when I brought my car. I have been making payment on time and early. Now that I lost my full time job and I now have a part time job trying to make the payments, but Ms. Karen wasn't so happy. Calling my job asking and forcing me to make a payment. I am so ready to trade this car in and not having to deal with this company any more. She is rude and they didn't care that I had to walk to work in this hot weather and rain. They only care about themselves!

party to the conversation between [redacted] and the dealership, I am unable to
comment on any of the claims as to what was said in their conversations

Agreement[redacted] claims that there are "hidden costs" and that she was
unaware that it was a weekly payment systemAs you can see, there are no
hidden costsOur Lease Agreement clearly itemizes all costs
In the very top box of the Lease Agreement you can
see the breakdown of [redacted]'s weekly paymentsYou can see it clearly
states that she has a payment of $due every FridayIf the customer does
not make her payment by the following Tuesday at noon, the vehicle may not
start until a payment is made
As this is a weekly payment program, the customer
would have weekly payments due a yearFour months each year there will be
months with five FridaysIn these months, the customer would be responsible
for five weekly payments
The two payments made on 9/19/[redacted] is
referencing were part of her upfront fees paid at the time of the lease
signingOne payment pays for the code that is entered into the device at the
time the device is installed and the second code is given to the customer at
the time of lease activation[redacted]'s first payment that she had to call
into make was not until 9/26/[redacted] has called us and made payments
all for only one week eachEvery payment except one has been paid past her

One of the benefits of the AutoTrakk program is that
you can pay around your pay cycleYou simply have to make sure that you prepay
for any and all paymentsAutoTrakk is a prepaid transportation programIf you
wish to pay bi-weekly, simply prepay for weeks and you will not have a

never prepaid for any payments that were not part of her original down payment
AutoTrakk never receives any of the funds paid as a
down paymentAll of those monies are retained by the dealershipAny request

Please find the attached documentation as it applies to [redacted]’s bankruptcy.
As you can see, we were notified of a Chapter 13 bankruptcy on 3/15/10 which included the 2006 [redacted] VIN [redacted]. The bankruptcy was later converted to a Chapter 7 on 11/29/12. The debt was never reaffirmed and the bankruptcy was discharged on 3/5/13. I have attached copies of the credit reporting which appears to be reporting correctly.

[redacted] entered into a lease contract on 12/6/14 for the 2013 [redacted]. The lease is a 60 month term, with weekly payments of $106.25. [redacted] has made 147 weekly lease payment and 134 remain on the lease. At the completion of the lease term [redacted] has the option to trade the vehicle,...

turn it in or purchase the vehicle for the residual value and the purchase option fee. Short of the lease terms and her options at lease completion, Auto Trakk, LLC is not aware of any other options. Thank you. Randy B[redacted]

My complaint #[redacted] was "resolved" however, the (AutoTrakk) account that was arranged and agreed to be removed from my wife and I's credit reports are still showing as active/derogatory.  AutoTrakk Agreed to removed the accounts and debt from our reports as well as provide me with a written statement, stating the previous.  Neither has happened since 12/04/2015, the date of agreement.

Dear Sir or Madam:
[redacted] advised Auto Trakk on 11/27/15 that the vehicle she currently leases would not start. Auto Trakk provided [redacted] with a service facility for the vehicle on 11/30/15. On 1/24/16 Auto Trakk was made aware the vehicle was experiencing problems starting...

and we have made provisions for her vehicle to be towed and repaired. Auto Trakk was unable to provide a facility any earlier due to weather related issues.
Should we find that there is a defective device in the vehicle. Auto Trakk will replace the unit at no cost to the customer.

Dear Ms. [redacted],
I have received the response rejection, #[redacted], filed with the Revdex.com by [redacted].
I am sorry to hear that Ms. [redacted] had problems with her bank account. We fully understand how important this issue is and we worked diligently to resolve the issue.
Ms. [redacted] did ask to be released from her contractual lease obligations. She explained that she attempted to trade the vehicle in and was instructed that the dealership would be unable to put a deal together as she still owed too much on her leased vehicle. I explained to Ms. [redacted] that she may “divorce” AutoTrakk by trading the vehicle in at any time throughout the life of the lease as long as she and the dealer can make the numbers work. I also advised Ms. [redacted] that she may refinance the vehicle through her local bank or credit union as well.
To clarify, initially Ms. [redacted] account was not double charged. The payment took longer than usual to be debited from her account. When Ms. [redacted] presented her bank statement to us for a refund of the requested $64.00, her statement indicated that her account was already overdrawn before the AutoTrakk payment was even debited from her account. We still paid the $64.00 NSF fee Ms. [redacted] requested, applied a zero skip extension to her account, and paid one of her payments for her.
Unfortunately, Ms. [redacted] did experience a second incident where she was accidently charged a second payment of $110.57 when she only intended to pay one. This was a bona fide error on the part of one of our representatives. Once we were notified of the error the payment was refunded to her account and posted the next day Friday January 23, 2015. I contacted Ms. [redacted]’s bank and was informed that Ms. [redacted] had 3 over draft fees of $32.00 each for a total of $96.00 due to this error. We wired the $96.00 Friday afternoon to Ms. [redacted] account and the money posted Monday January 26th to Ms. [redacted] account. This was an unfortunate error for which we offer our apologies.
I can certainly understand why Ms. [redacted] would not want to keep her card information on file and would prefer to make her payments via [redacted]. [redacted] is one of the payment options Ms. [redacted] has available and they do charge for their service. If Ms. [redacted] chooses to make her payments via [redacted], any fees associated with such a transaction would be her responsibility.

Very Bad Experience with this company!!!!!!!
I purchased a 2012 Nissan Altima with 68043 thousand miles on it from a small dealership because of my credit on 11/7/2016. I was told the financing company was Auto Trakk. I was told by the salesman that the financing company owed their own Warranty company and my car was covered from the day I signed the papers. My payments would be $92.48 weekly. I drove off the lot with my car. Two days later the car started smoking and smelling like burnt oil. I called the dealership back and was told to put oil in the car. I did that, before the week was out, the oil light came on. I called dealership again. I was told to take it to their mechanic. I did, was told it was a seal that was bad and he replaced it and I drove off. A week later I called dealership back due to car smoking really bad. I was told to take it to a Nissan Dealership to have them check it out. Took it to a local Nissan Dealership and to my surprise the engine need to be replaced.
I then called the dealership I purchased the car from to let them know what the issue was. I was told to call the warranty company and they would take care of it. Now, take in mind, this is just the 3rd week of me having this car. The Warranty company named Janus say's that I can not submit a claim for 60 days. I call the dealership back and tell them what Janus had said. Well, to make a long story short, every time I call Auto Trakk , Dealership and Janus every body tells me that the other is responsible for the repair. I have been without the car for 2 weeks and today Auto Trakk calls me for a payment. I asked, did they have notes on my account about my situation. I was told yes, but they still have to ask the same question and note it. I have spoken with 4 different people concerning my car and no one can give me a true answer other than some one else is responsible. I refuse to make another payment on something I am not driving and do not have a estimated time of when this problem will be resolved.

The same thing has happened to me. And the sad part, that I had to walk to work in this hot weather.

Please find the attached lease agreement and device install agreement that were signed by Ms. [redacted] at the inception of her lease.As AutoTrakk was not a party to the conversations between Ms. [redacted] and the dealership, I am unable to comment on what was said in those conversations. Ms. [redacted] selected the vehicle and negotiated the price with the dealership. AutoTrakk simply leased the vehicle to Ms. [redacted] in good faith.
Ms. [redacted] claims that the dealership provided her with a payment amount of $284.00. As you can clearly see on Ms. [redacted]’s lease agreement, her agreed upon weekly lease payment is $88.70.
Ms. [redacted] claims that she had no knowledge of a payment reminder system being installed in her vehicle. Please see the attached Device Install Agreement. You can see Ms. [redacted] initialed the document nine times and signed the document indicating that she read and understood its contents.
Ms. [redacted] claims that she would like to be let out of the lease by paying $225.00. As you can see in item 6 on page 3 of Ms. [redacted]’s lease agreement, the early termination fee would be $250.00 plus the adjusted lease balance. Ms. [redacted] currently has 208 remaining weekly lease payments that would need to be satisfied.
Weekly payments are due every Friday at AutoTrakk. Payments not received by the following Tuesday at noon will be assessed a 5% late fee where state law allows.
Ms. [redacted] did experience and issue while making a payment via our website where the amount that was presented and paid was not the correct balance. Ms. [redacted] contacted an Account Specialist who quickly corrected the issue, gave Ms. [redacted] a code and credited her account the difference between the two amounts totaling $24.56.
Ms. [redacted] has requested to be “let out of this agreement fully with no penalties”. The remaining lease payments would need to be paid in full to complete the lease agreement. Ms. [redacted] currently has 208 weekly payments remaining. One of the benefits of the AutoTrakk lease program is the ability to trade the vehicle in anytime the customer and the dealer can make the numbers work.
I am unable to find an instance on Ms. [redacted]’s account where the payment reminder system has caused mechanical issues with her vehicle. If there was an issue with her vehicle and it was determined by a licensed mechanic that the payment reminder system was causing mechanical issues, AutoTrakk’s policy is to replace the payment reminder system at our expense.

I am rejecting this response because:  On 1/22/2015 I did receive a check for $64.00 in overdraft fees.  Since my mail runs late here in Monroe Charter Township all banking has to take place the next day.  I was forced to use the emergency code as I had a consultation with my neurosurgeon for upcoming surgery on the 5th of Feb.  I deposited the check into my checking account but at this time there is a late fee of $5.00 added to my weekly payment which is $110.57.  When I call Auto Trakk to make my payment I also asked after the payment was made to please delete my card from their file.  I was reassured that payment was confirmed with me receiving my weekly code and that my DFCU Debit Check Card was deleted from their file.  On 1/23/2015 I was contacted by Mr. Rod C[redacted] returning the message I left the evening of 1/22/2015.  I felt that it only fair that since what I was asked what could smooth things over was not going to be done, which by the way I asked to get a divorce from Auto Trakk and get financed by someone else.  I have tried on on my own with no success.  I could have actually been placed in another vehicle but they couldn't do anything with my car.  WTF???  So I wanted to know what could Auto Trakk offer me in light of the error made not just with my account but I was told numerous accounts got hit with one, two and three withdrawals unauthorized.  Well on 1/23/2015 after getting off the phone with Mr. C[redacted] with him offering a free week I think and I said I would consider that but I really didn't feel that I could trust them with my banking information at their disposal.  Mr. C[redacted] really tried to make a point that this ever happening again would be very slim at best.  So he said let him work on that and he would call me back shortly.  Well I check my account as I knew I had less than $45.00 to deal with after my car payment and I needed to send out a payment for $29.88.  To my horror I see Auto Trakk has taken 2 payments at $110.57 on the same transaction which of course screwed my account up YET AGAIN and FOR WHAT?  CAUSE THEY CAN?  I called Auto Trakk to speak with Brandy S[redacted], Customer Service Mgr.  They asked who was calling I said Ms. [redacted] and was told she was unavailable would I like to speak to another supervisor?  I said no but to please inform Ms. Brandy that I am continuing on with my 2nd complaint to the Attorney General and The Revdex.com and all of a sudden I was told she just became available.  I waited 5 minutes and hung up.  Mr. C[redacted] called me right after this fiasco and I told him that Auto Trakk done F----d me AGAIN and I am done with this game!  I am on Medical Leave from my employer and I only receive 60% of my pay and that is taxed so I DO NOT have time for the games, mistakes, excuses with my little money!  I should be treated the same as a person with A-1 credit regardless of what I actually have in my account!  Mr. C[redacted] the first time this happened had the audacity to say my account was in the negative before the transaction on the 7th of January,2015 and I told him whatever was in my account Auto Trakk did NOT have authorization from me on that day to take anything from MY PRIVATE ACCOUNT!  Now I have been forced to order another Debit Card, next I need to close my account but as I just checked It is still in the negative and that is not how my account was before the double withdrawal of $110.57 each!  I received 2 overdraft fees in connection with this so called 'mistake' by a new girl who inadvertently double charged me instead of removing my card!  Excuses are not cutting it with me!  I am on a very limited income which is sporadic at best and errors like this from companies that should have much experience in handling customers money is totally UNACCEPTABLE!  This is a SAD DAY in our time when companies just run roughshod over you and expect you to say oh well!!  Well I am done with being treated with less than the respect I know I deserve!  I may not have a 800 credit score but that by NO MEANS mean they can take advantage of me on ANY LEVEL!!!!  If I am forced to keep financing with Auto Trakk then I will be forced to pay an extra $5.95 a week charge to pay by Money Gram.  Wow so they take from me but its alright and then I am stuck paying more just to find some sort of security with my payments?  I need some help with this ASAP!  Mr. C[redacted] called me around 2:40 pm on 1/23/2015.  I really didn't want to talk to him if my account was not restored and proceeded to inform him of my GREAT DISPLEASURE of being treated in such a fashion!  I am not in the a-- kissing business so that route is not going to work for me.  HELP ME PLEASE!!!

I am sorry to hear that [redacted] is not happy with the service provided to her by the dealership she purchased the vehicle from or AutoTrakk.
[redacted] states that when she purchased this vehicle she was lied to in every way and taken advantage of. To be clear, [redacted] selected the vehicle and negotiated the terms and price of this vehicle with Low Price Transportation in Plantation Florida. AutoTrakk simply provided the financing in the form of a lease with an option to purchase at the end of the lease term. As such, we were not privy to any conversations between [redacted] and the dealership and are unable to comment on what was said. The contract that was provided to us included the signatures of [redacted] and the Co-applicant **. [redacted] agreeing to the terms of the lease.
[redacted] states that she is being robbed and she never agreed to a payment of $126.00 a week. Please find the attached lease agreement signed by [redacted] as well as the agreement to provide insurance. You can see the terms are clearly described and the customer was informed repeatedly that this was a lease. [redacted] was also informed verbally that this was a lease when she completed her welcome call with AutoTrakk. [redacted]’s agreed upon weekly lease payment is $103.98. Unfortunately, [redacted] obtained an insurance policy that does not meet her lease requirements. As such, she has been forced placed on Collateral Protection Insurance (CPI) to cover our interest in the vehicle until proof of lease compliant insurance is provided. The cost of the CPI is $29.00 a week which is added to [redacted]’s weekly payment. As of May 1, 2015, [redacted] will be 9 contractual lease payments delinquent.
[redacted] claims she would like to return the vehicle without it adversely affecting her credit. If [redacted] refuses to honor her contractual agreement, the vehicle will eventually be repossessed and be reported as such to the appropriate credit bureaus.
Our lease does allow the customer to trade the vehicle anytime throughout the life of the lease as long as they and the dealer can make the numbers work. Many dealers tell us it is easiest to put a deal together if the customer has been making payments for at least 24 months. Currently [redacted] has made 52 weekly payments.
[redacted] did advise us that she would not like to be contacted at work and we have been honoring her request. [redacted] also claims we call her everyday which is incorrect. We attempted to contact [redacted] on 4/13/15, 4/16/15, and 4/29/15. We have been attempting to work with [redacted] to bring her account current. Unfortunately, all efforts have been to no avail.
