Without refuting every exaggeration or untruth he has told, the issue at hand is the water leak in the garage On June 24, I talked to *** (mother of complaintant) who confirmed that no water has entered the home since the April incident With over inches of rain in
May and June he obviously does not have a roof leak As I told *** on May 4, the water is entering through the open window above the garage

I am rejecting this response because: Cloud never had any intention of honoring their contract They never contacted me to schedule or set up a date to have roofs put on No one from their company ever came to our homes to discuss or look at the job other than ***.I had to make phone calls and this is what led to them saying they could not honor the contract that their representative wrote up I never wanted this outcome If they would have honored their contract maybe we would not be here Three of the four roofs are over years old and we had put down deposits in early June to have roofs installed in October As soon as I found out they were not going to honor their contract, I did cancel in less than days Mrs*** called and said she would be refunding our deposits and has not They have been holding over 5,000,of our money since June

Yes we have emailed the invoice and the appropriate documentation to your insurance company and those same copies are being put in the mail for you today

I am rejecting this response because:Their response is a misrepresentation in which they attempt to cover their previous misrepresentationsThere was never a discussion of a product called Peel and Stick Modified BitumenThe sales representative, *** ***, said their product is superior to roll roofing because it is the same year shingles that will be installed on the "flat area," i.e., the slightly sloped area as the rest of the roofAdditionally, he makes no mention of our contractual agreement in which the company will allow my son to make six equal monthly payments at no interestI'm anxious to hear their response to the agreed upon monthly paymentsLastly, the first time the Bitumen product was ever mentioned was when Mr*** went to the house to take pictures of the crew's failure to install the year shingles to take to the officeAppearently, he waited for my son to be home to try to convince him that the Sick and Peel Bitumen product was superior to the year shingles and even claimed they cost more than the year shingles! I've been around long enough to know this guy is full of fraud

We purposed a better product for the low pitched area and he agreed to that. It is not rolled roofing. The contract that was signed clearly states that we would install peel and stick modified bitumen to back slope.

I am rejecting this response because:Cloud Roofing has not heard from us concerning "additional leaks" because it is always the same leak. I had to climb on the roof myself and put tarp over the skylights after last week's storm forecast. Fortunately it held and prevented further damage. Last week, Skylights Over Texas installed the correct type of flashing for that particular type of skylight. The attached file has three pictures: Cloud Roofing's job (photo taken on 01/14/17), the tarp (taken on 02/12/17) and the correct skylight job (taken today, 02/27/17). Cloud Roofing stated that "we are supplementing your insurance company for current pricing and expect to be paid in full." I do not recall disclosing my insurance details to any Cloud Roofing representative. Rather, I told Cloud Roofing's salesperson that my insurance had already paid me my share. I have never received any invoice from Cloud Roofing. Please email a final invoice to [redacted].

I am rejecting this response because:  Mr [redacted] did come to my house and explained that he was not at fault for the condition of the shingles.  But then he said that he would try to get someone to fix...

I am rejecting this response because:The owner of the company called me after my phone call  and told me she would be refunding my deposit.  She also told [redacted] Cloud that she would be refunding the deposits.  She never processed my paperwork or ordered materials. They were very adament that they would not honor their contract.

He was aware he would not get a refund and chose to cancel anyway. He got a cheaper bid and chose to go with that. His insurance company estimated replacement cost, which was equal to our estimate. There is always somebody cheaper.

I am rejecting this response because:I agreed to their price...

based on their misrepresentation of a better product, i.e., 25 year shingles on the slightly sloped area of the house rather than roll roofing material. A clear violation of the Texas Deceptive Trade Practice Act.

As stated before your insurance company is responsible for the lighting rod system removal and installation. You must contact them for those expenses. We have not heard from you concerning additional leaking. Therefore, we can assume the more than 4 inches of rain that has fallen since the original leak, there are no current leaks. That confirms  our original statements that the leak occured as a result of leaves built up behind the downspout running across the roof and causing water to run under the shingles because they had not sealed yet because of the cool weather at the time. We are supplementing your insurance company for current pricing and expect to be paid in full.

We have contacted the owner and have found the product he requested. We will be changing it out after the first of the year.

We deny the allegations that he has stated in the complaint. We have met with him and he will not take our phone calls and insist on communication strictly thru faxes and will not allow us back on the property. Therefore we will have no choice but to file a lien on the property and force him into...

arbitration.

We have a signed contract for $4800.00 and we have completed the contract. He agreed to our price based upon a better product verses the other company that was cheaper but offered a lower grade product.
