Caine & Weiner Reviews (%countItem)

This balance is leftover from a credit that Progressive gave me due to misinformation of their customer service representative that signed me up.
I contacted Progressive insurance in 2016 to establish automobile insurance for myself and daughter. The Progressive representative quoted me the rates and I accepted & made a payment. The next month when I received my statement it was over $6xx.xx which was not the amount the representative quoted. I called Progressive and explained that the representative quoted a price of $2xx.xx. The spoke with the supervisor and he told me that he would need to listen to the recording to see what was quoted to me. Nearly 3 weeks later with a few calls back to them for follow up I was informed that after listening to the call, the representative quoted me the incorrect rate and as a result Progressive took care of the bill and advised that I could cancel with them so that I can find coverage with another carrier. Months later out of nowhere, I received a collection notice for $208. I called Caine & Weiner to inquire about the collection status and I was told it was for insurance services with Progressive. I explained how Progressive had to absorb the cost of the services I had during that brief period because their representative quoted me a price that they could not continuously support. The charges were leftover from the amount that should've been included with the $6xx.xx that Progressive absorbed. The representative at Caine & Weiner stated that this was the amount that Progressive sent to them to collect and that is all of the information they have.

Desired Outcome

The debt from Progressive was erroneously sent to Caine & Weiner collections needs to be removed from my credit report.

Our office received the account from the creditor in December 2016 for recovery of unpaid auto insurance premiums. Initial correspondence was sent to the consumer at that time.

Our records indicate that our office spoke with the consumer in December 2016 at which time the consumer acknowledged the amount due and stated an intent to send partial payments to resolve the balance.

Our records show that we were unable to reach the consumer by phone beyond that initial conversation. Our records also indicate that the creditor still shows the balance as due by the consumer. We do not show receiving any written correspondence directly from the consumer.

As a courtesy our office is mailing the consumer additional documentation detailing the vehicle type and policy coverage dates specific to the assigned debt.

The consumer is encouraged to contact our office at XXX XXX-XXXX with any questions.

Company is trying to collect a debt that does not exist. I have tried to explain to them that this was resolved with Pitney Bowes.
Company states XXXXXXXXXX BAL: $*** CW# XXXXXXXX with Pitney Bowes, but we have a email correspondence that states our lease was terminated as of July 2018. This collection agency still decides to buy fake debit from a ruthless company that has non-stopped called us even after we finally resolved the issue with the original company Pitney Bowes.

Desired Outcome

We do not owe this company or Pitney Bowes any money.

Please note that this debt is commercial in nature. Our office received the account from the creditor in December 2018 for third party collection activity. We did not purchase the debt. Initial correspondence was sent to the business at that time.

Our records indicate receiving correspondence from the business in January 2019 disputing the balance and claiming the lease was terminated.

Our office requested additional documentation from the creditor. That information was provided to the business in March 2019. Our records show receiving a response to that documentation from the business and that we have submitted that information to the creditor for review. Our account is listed as disputed and we will provide the business with additional details from the creditor once received. We will continue to work to resolve the dispute amicably between the business and the creditor.

The business can contact our office at XXX XXX-XXXX and ask to speak to the unit manager with any additional questions.

Not only are *** & Weiner Inc. bottom feeders, when they violate the Fair debt Collection Practices Act or the Telephone Consumer Protections Act, they will threaten you if you exercise your rights. Which is fine by me. Treble damages is always a good thing.
It's not hard to collect an alleged debt and stay within the law, but these people are lazy and get sued often. Google it.

I canceled it because the car couldn't move and they never did so.
11/2016 was submitted for $320 file#*** I believe.

Desired Outcome

Deleted off and updated on credit report

and Weiner Company have been calling me regarding a school payment. I don't have a problem to pay my debt, but at the moment I don't have the funds. I am a single mother who is paying everything I can. I'm getting my debt in line because I want a future. The receptionist, ***, is the only person I talk to regarding my school payment. There have been several times I had to tell her to stop taking me rude and there was moments where I had to give the same treatment so she can realize the lack of respect she gives to clients. *** is not equipped being a person who represents the companys? name especially through the phone. I wonder how she is in person. She wears her feelings on her sleeve which is very unprofessional because you can hear the tone. *** doesn't greet or understands life situations like a professional company would. All she really needs to do is put notes on the account and I will give her a call when I get the money. Instead ***, tell me 'well next time tell me because now it's your fault the system is having errors? and hangs up. I had autopay for my payment due to being Christmas I wanted to buy my kids a gift. I thought hey I get paid after Christmas I will give them a call and pay. I'm already in debt and my concern is giving my kids a memorable holiday. I told *** the day I would get paid and her response 'well you calils of told me and now it's your fault ? instead I understand I will reach you on the 26 to make the payment. She can keep her feelings inside like professional business woman. Obviously she can't and the company will one day suffer upon to her actions and the ways she treat clients. *** needs a class in having customer service especially through the phone. One day she will be barking at the wrong tree and the company will suffer because of her unprofessional, rude, and disrespectful responses.

Correction to a credit report All I want is the pay my debt and have her apologize to me.i don't want her to contact me anymore. And I hope the business realizes the people they hire and actually hears the phone conversations she gives to clients.

Our office received the account from the creditor in May 2018 and has been working diligently since that time with the consumer to find an amicable resolution between the consumer and the creditor. We were able to work within creditor guidelines and establish a payment plan from the consumer to pay off the debt in full. The consumer references a conversation regarding a missed payment in which our agent explained that our options are limited by what the creditor allows in terms of minimum payments and time frames. We are continuing to work with the consumer on assisting in meeting those requirements. Management will be reviewing the file for any additional options. The consumer is encouraged to call 818 226-6000 and ask to speak with a manager with any additional questions.

I had recently discovered a collections account on my credit report in the amount of $113. The original creditor shows as Progressive Insurance. I do not have Progressive Insurance. I was never informed by Progressive Insurance that I owe this money, and never received anything pertaining to this alleged amount by *** & Weiner.

Desired Outcome

Correction to a credit report I am therefore requesting that *** & Weiner immediately delete this item from my credit report.

(The consumer indicated he/she DID NOT accept the response from the business.)
Upon learning I would be moving out of state, I called the creditor to ask for an update quote since pricing changes. I also called to update my new mailing address for future correspondence. Based on the quote I received, I decided to go with esurance and cancel my policy. I cancelled my policy on the spot and gave the creditor my new mailing address. However, the creditor never canceled, nor never attempted to reach me at my new address. Also, I called my insurance agent who sold me the policy, they were never informed by the creditor that I owed anything or that they were trying to get a hold of me. *** & Weiner accepted an account whereby the creditor failed to do its job. It's not enough to let the credit reporting agents know I paid, but to let them know I wasn't aware of such payment since I cancelled. I even have proof showing my new insurance policy commenced the day I cancelled my policy with the creditor.

The account was sent to our office by the creditor in January 2018 for recovery of unpaid auto insurance premiums. Initial correspondence was sent to the consumer at that time to the address listed in this complaint. Our records indicate that we received written correspondence from the consumer in June 2018 and in response our office mailed a copy of a final bill invoice obtained from the creditor to the consumer in that same month. In addition, our records indicate that the consumer recently disputed the debt with one or more of the credit reporting agencies and that as a result that same information was mailed again to the consumer in September 2018. As an additional courtesy our office will send details regarding policy dates and vehicle types to the consumer via mail. Our records indicate that the creditor still shows the balance as due by the consumer. The consumer is encouraged to contact our office at XXX XXX-XXXX and ask for a manager for further assistance.

and Weiner tried to collect debt I allegedly owed former employer. They ignored my request for appeal 3 months, then increased my bill $***.
*** and Weiner contacted me by phone, email, and letter April 2018 regarding a debt owed to my former employer for Internet sales leads. I was given 30 days to request an appeal, which I did as it was an employer error. I requested an itemized statement for my bill, and gave a detailed explanation of why I did not feel I owed the debt due to loss of income caused by lack of training and supervision and poor counsel on the part of my employer. *** and Weiner continued to contact me and became very aggressive. They warned me that they were "disappointed in my lack of response". I replied that I had responded with a letter and they informed me that they were trying to get ahold of me in response to the letter. When I called, they asked if I was calling to make a payment. I told them that I had not intention of making a payment until the issue was resolved with my employer. They told me that they were looking into the claims made in my letter, but continued to pressure me to make a payment in the meantime. I again refused. They did not contact me for three months, and when they did, they increased my bill from $*** on May 10, 2018 to $*** on August 29, 2018. This is in spite of my employment contract which states that if I left the company or was terminated, I would owe any balance on my Internet lead again and would be charged an interest rate of 0.5% every month. Additionally, my first notification that I had a balance was from *** and Weiner on April 16, 2018, less than 60 days after I had left the company (I left March 1, 2018).

Desired Outcome

I request that *** and Weiner reverse the exorbitant interest charged due to their lack of effort to resolve the issue and make any correction necessary to my credit report.

Caine & Weiner Response • Sep 06, 2018

Our office received the account from the creditor in April 2018.

Please note that the current balance due on the account is a reflection of updates provided by the creditor to our office in June, July and August.

Our office has not added any interest or other charges to the account or made any changes to the amount due other than what was explicitly provided to us by the creditor. Our account balance is accurate based upon the information and updates provided by the creditor.

We have presented the debtor's information to the creditor for further review. Upon receipt of the response from the creditor we will provide additional information to the debtor.

The debtor is encouraged to contact our office at *** and ask to speak with a manager with any additional questions.

This is a breach of contract claim for *** & ***'s failure to undertake the collection of accountes pursuant to a written agreement.
*** & *** entered into an Independent Contractor Agreement ("Agreement") with County Medical Services Program Governing Board ("Governing Board"), effective December 15, 2016. The Agreement required *** & *** "to promptly undertake the collection of accounts placed with *** & *** by the Board for purposes of collection, and to use diligence in doing so" (Agreement, Ex. A, § A.) The Agreement also required *** & *** to "use its best effort in providing collection services on all claims assigned for collection." (Agreement, Ex. A, § B1.) In March 2017, over $4 million in accounts were placed with *** & *** for collection. *** & *** did not make any effort to collect on the accounts in clear breach of the Agreement. In fact, it took until September 2017, nearly six months from when the accounts were initially placed, for *** & *** to inform the Governing Board that they were not going to provide any collection services.
*** & *** claims the accounts placed by the Governing Board did not include "provider addresses," which allegedly prevented the initiation of collection efforts. However, this argument fails as ***, Chief Operating Officer of *** & ***, acknowledged in an email dated April 7, 2017, that he "worked through the first file" of accounts and found 1,200 provider addresses using *** & ***'s own resources. These 1,200 provider addresses account for approximately one third of all accounts placed with *** & ***. In addition, each of the accounts placed with *** & *** contained a National Provider Identifier (NPI) number that allows a provider address to be located by a simple Google search. The Governing Board also provided *** & *** with provider addresses for each of the accounts at issue upon learning of their claimed inability to collect on the accounts.
*** & ***'s failure to promptly undertake the collection of accounts constitutes a breach of the Agreement. The Governing Board attempted to resolve this dispute directly with *** & *** through a "meet and confer" process as set forth in the Agreement. *** & *** participated in a conference call with the Governing Board on March 20, 2018, but has since failed to respond to any subsequent communications.

Desired Outcome

Money damages associated with *** & Weiner's failure to promplty undertake the collection of accounts as set forth in the Agreement.

Our office received the account from the creditor in February 2017. Initial correspondence was sent to the consumer at that time. The debt relates to unpaid rental storage facility costs.

Our records indicate that our office spoke with the consumer in February 2017 and informed her of the debt and the details at which time she agreed to pay the balance due over time. Our records indicate that the payment methods left on file with our agents to pay the debt were not valid. Our records also indicate a conversation in March 2017 in which the consumer stated payments will begin in 30 days. No funds have been paid on the account to date.

Our records also indicate that the consumer disputed the debt with one or more of the credit reporting agencies and that invoice documentation is being mailed to the consumer to the address listed in this complaint. Our file has been updated accordingly. The records indicate that the creditor still shows the balance as due by the consumer.

(The consumer indicated he/she DID NOT accept the response from the business.)
I am rejecting this response because: I have never made any agreement to pay this company anything. Showing a computer generated bill does not mean that I am required to pay them. The letter that I sent them had the address where I am located on it, and they never sent any "VALIDATION" to me. FCRA does state that they must be able to show VALIDATION bearing my signature that I agree to pay them. They have not proved anything by producing a bill that can be created using any computer. Please remove the tradeline from my credit report otherwise I will file a lawsuit for defamation of character.

Caine & Weiner Response • Jul 11, 2018

Setting aside that our company disagrees with the allegations made by the consumer in the initial complaint, as noted above the consumer is encouraged to contact our office and ask to speak with a manager to assist further in resolving the balance due. The creditor still shows the balance is due. The consumer has previously acknowledged owing the balance to the creditor both verbally to our office on several occasions and via payments made to the creditor. The debt is for storage fees covering multiple months from 2015 into 2017. The documentation provided to the consumer includes invoice dates and payment dates showing multiple payments made by the consumer to the creditor and a final balance due, further confirming the debt. If the consumer wishes to resolve the balance due our agents are able to assist.

There are two accounts. I disputed one that is $382. Both Progressive accounts are not mine, but the one for $382 remains on my credit report. Please delete this. There is a $*** fine for continuing to report errors to someone's credit report under the FCRA rules. I do not want to take this to small claims court, but I need this erroneous account removed from my report. I will not call. I prefer everything to be documented and hope we can resolve this under this forum. Thank you.

As a courtesy additional documentation is being mailed to the consumer to the address listed in this complaint providing policy details including vehicle types and coverage dates. Our records do not indicate receiving any documentation directly from the consumer with any details regarding why the consumer believes the debt is not owed. As noted in our earlier response our company did not create the account with the consumer. We were retained to recover unpaid auto insurance premiums owed to the creditor, Progressive Insurance.

Also as noted above the consumer does state they had an insurance policy with the creditor at one time. As our office has not yet received any correspondence from the consumer documenting specifics regarding that coverage the best way we can assist the consumer is for the consumer to contact our office at 818 226-6000. We ask that the consumer speak with a manager so that we can provide further details as to how the debt was calculated and specific policy information etc. and address the consumer's questions at that time.

Credit agency assigned to Progressive Ins acct promised to settle & remove collections. They're still calling me & running unauthorized credit Inqs.
In April 2017 I contacted this company as a result of a collections account in my name. They immediately offered me a 50% settlement on the account. I tried to pay and found out that the amount was incorrect. Spoke to progressive and sent documents to show I had insurance during the time in question Collector told me not to pay till Progressive fixed it. The amount was to be adjusted with the collection agency per progressive. In Oct 2017 I called again following up, they had reduced $100 only. I waited a few more months and contact progressive again, with no resolve. I called the collection agency and offered to pay the 50% originally offered to get this off my credit report. I was supposed to get a confirmation in writing that the account was closed and would be removed from the bureaus, it never came. About 2 mths ago I got a call that the remaining balance was due on the account. I argued with the *** she said she would take care of it. I pulled my reports today and the account is still showing past due and open - never did get the letter I was promised. These malicious/unethical practices are praying on people trying to do the right thing. I've had my identity stolen and have been dealing with clearing my name and tying up loose ends for 3 years, and these people are just preying people trying to do the right thing. On my credit report for today, I found two hard inquiries from *** and Weiner, one on apr 2017 and the other Oct 2017 both times I called both inquiries were credit checks for installment loans that I never requested or applied for.

Desired Outcome

I want the inquires and the collection account removed from all 3 bureaus, and want a letter stating that this issue is resolved and the matter is closed. I never want to hear from this company again.

Our office received the account from the creditor in April 2017. Initial correspondence was sent to the consumer at that time to the address listed in this complaint. Our records show we were unable to reach the consumer by phone.

Our records also indicate receiving a dispute from one or more of the credit reporting agencies in July of 2017 at which time validation information was mailed to the consumer as a courtesy.

Additionally during conversations with the consumer in August 2017 the consumer expressed a desire to settle the account for less than the entire amount due and informed our agent that there were credits being applied to the account by the creditor that needed to be resolved. Our office did place the file on hold until confirmation of the credits was received.

Our records indicate additional credits were received in August 2017. No contact was made with the consumer again until February 2018 at which time the consumer expressed an interest in settling the account for less than the full amount due.

Our office accepted that payment as a settlement amount based upon the reduced balance due as noted above and creditor authorization. Upon receipt of the funds our office closed our file. Our records show a closed file with a Settlement status and no plans to reopen the account. As a courtesy to the consumer the requested settlement letter is being mailed.

The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with the manager with any additional questions.

Customer Response • Jun 28, 2018

This response only answers half the issue to which the accounts are not correct, they need to stop calling me and update the credit bureaus accordingly. The business, however, also ran 2 hard inquiries on my credit in April 2017 and October 2017 without my authorization for installment loans I did not apply for. I want that removed from my credit report immediately. Thank you.

Caine & Weiner Response • Jun 28, 2018

Please see our prior response regarding credit reporting as information has been sent to the credit reporting agencies based upon the details provided.

Based upon the type of debt handled for the creditor being contractual in nature our office has permissible purpose to pull credit reports.

The consumer is again encouraged to contact our office at *** and ask to speak with a manager with any additional questions.

company placed negative remarks on all 3 credit bureau that is not true. They place marks after original complaint & payment sent to creditor
6/8/2018 complaint number XXXXXX was closed. I stated that I would deal only with the original creditor as *** and weiner staff called with threats, harrassment to family and offensive language. I request cease and desist which they agreed to. I immediate direct any amount owe directly to the original creditor and this company reported to all 3 credit bureau that I have an account in collections with them. They post to 1 bureau on 6/3 and the other 2 on 6/8 when they know payment was made directly to Progressive the original creditor.

Desired Outcome

remove there remarks on all three credit bureau and any other agency they made this incorrect statement that they have a collection account in the amount of$232.35

Caine & Weiner Response • Jun 28, 2018

As noted by the consumer our records do indicate sending additional validation information to the consumer in May 2018 in response to the prior complaint. Our office received no further correspondence from the consumer and made no further efforts to contact the consumer. Our records also indicate receiving confirmation from the creditor in June 2018 that $232.14 was paid to resolve the account. Our records have been updated and the credit reporting agencies will be notified accordingly in the normal course of operations.

Customer Response • Jul 04, 2018

(The consumer indicated he/she DID NOT accept the response from the business.)Caine and Weiner are not being honest, in saying "Our office received no further correspondence from the consumer and made no further efforts to contact the consumer." Also, stating " Our records have been updated and the credit reporting agencies will be notified accordingly in the normal course of operations." It is not clear in what is normal course of operations for this company. I do know they were notified the same day from progressive that the payment was received and it been over 30 days since the next reporting period and they failed to remove the remarks themselves from my report regarding this account. I WAS NOT IN COLLECTIONS with Caine and Weiner due to their illegal actions in attempting to collect a debt. They failed to directly answer questions. I will see if the status is change in a "normal operation of business" at that point I will say this matter is resolve.

If I could give less than a star I would. The tactics employed by by the associates at *** & Weiner are unprofessional, rude & simply not okay. I was not spoken to with any sort of decency, the employee had an elevated, agitated voice and she was essentially trying to coerce me into paying a bill which was erroneously billed. When I tried to explain that the bill was an error, she refuted that adamantly & insisted that the bill was legitimate & I owed the amount she was seeking. When I again insisted I wold speak to the issuing company she mislead me and said that I could no longer speak to them about this bill...that it now belonged to them and was 100% valid and I owed them the money. Long story short, I called the issuing company the next day only to have them fix the erroneously generated bill and apologize for the mix up. This infuriated me as the rep from C & W said that there was no way I could do that and the original company had no control over this bill anymore. I am filing a formal complaint with the Revdex.com as well. If you are going to use a collection agency, this is NOT the agency you want to use unless you want to employ an unprofessional group that does not respect the people they are calling. Shameful.

This business uses already paid accounts and calls you threatening to pay a debt that was already paid.
This business took my already paid account with advanced disposal and is screaming at me that it's not paid. I submitted all correspondence with this company to advanced disposal to make them aware of what they're doing.

Desired Outcome

No contact

Caine & Weiner Response • Jun 02, 2018

Our office received the account from the creditor in October 2017. Initial correspondence was sent to the consumer to the address listed in this complaint at that time.

Our records indicate that our office spoke with the consumer in October 2017 at which time the consumer stated the balance was paid. Our office confirmed that the creditor still showed the balance as due and asked the consumer to provide proof of payment. Our file was updated accordingly.

Our records indicate we have not received any written correspondence from the consumer.

After multiple phone efforts our office was able to reach the consumer again in June 2018. The consumer again stated the amount due was paid. Our office again confirmed to the consumer that the creditor still showed the balance as due and that the consumer needs to provide proof of payment. Our records indicate that the consumer is refusing to provide any proof and as such the debt remains valid and our file remains open.

The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any further questions.
