To whom it may concern:

On August 23, 2017 I checked my credit report and there is an item from your company. I do not know anything about this particular item and would like to request validation in regards to your claim. If you have any additional questions please contact me only via mail at the address listed above. If I do not receive validation within 30 days as of the date of this letter I will assume the matter is resolved and all negative information has been removed from all credit reports as required by law.

Thank You,

-

Desired Outcome

Debt Validation or deletion of collection.

Caine & Weiner Response

Our office received the account from the creditor in February 2017. Our records indicate that the initial correspondence was mailed to the consumer to the address listed in this complaint at that time. Our records do not show receiving any communication from the consumer. As a courtesy to the consumer our office is mailing validation information to the address listed in this complaint. Our records indicate that the creditor still shows the balance as due.The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any questions.

and Weiner has a fraudulent amount/account listed on my credit report.
I do not know what information to provide

Desired Outcome

I want this stricken from my credit report, and I want a verification letter from *** and weiner to my address listed in order to settle this compaint.

Caine & Weiner Response

Our office is unclear as to the nature of the consumer's concerns. Our office received the account from the creditor for collection activity in April of 2017 and sent our initial communication via mail to the address on file. It is unclear why the consumer would not have received it. Additionally, the consumer filed disputes with one or more of the credit reporting agencies in July of 2017. At that time our office mailed a validation letter to the address listed by the consumer in this complaint with details as to specific nature of this debt. Our records indicate that the creditor still shows the balance as due by the consumer. The consumer is encouraged to contact our office at XXX-XXX-XXXX and ask to speak with a manager with any additional questions.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)This response is unacceptable. Calling a manager will only lead to you calling me at odd hours over a fraudulent debt. This will be settled in public where everyone can see this, and last as a record of the way you conduct your business. The amount is wrong and fraudulent, and your office is fraudulent by association. I am hereby demanding that this is stricken and you cease all activities involving me.

on 8/19/17 I discovered a collection account on my credit report from *** and Weiner that I have no prior knowledge about.
On 8/19/17 *** and Weiner added a collection account to my credit report with out my knowledge that according to their listing has been open since 3/1/2016 for the amount of $661. This company has not send me any collection notices nor have they tried to contact me in any way providing me the allocated time to review and/or dispute the validity of this supposed debt. Due to the facts I previously stated this company is in direct violation of the FDCPA Collection Practice by placing a collection account on my credit report without sending a letter to me. I request that *** and Weiner verify the following information. 1. Full original Account Number 2. Date original Account was opened 3. Any written agreements between myself and the original creditor stating this debt is owed 4. Full account summary and itemized calculation of alleged debt 5. Date of the first delinquency 6. Dates and times of any phone calls made and to what number in attempt to contact me concerning the alleged debt before it was reported to an agency, and so proving that these calls were made in the times governed by FDCPA law. If *** and Weiner is unable to provide the above identifying account information, this account must be deleted from all CRAs. *** and Weiner also failed to follow FDCPA by not sending a letter giving the consumer time to dispute or validate the alleged debt within the allowed 30-day time frame that is allowed by law.

Desired Outcome

Account deleted from all CRA's, all collection attempt to Cease and account be closed out and not transferred to any other agencies for further collection attempts

Caine & Weiner Response

Our office received the account from the creditor in April of 2017. Our records indicate that the initial correspondence was mailed to the address listed by the consumer in this complaint at that time. It is unclear as to why the consumer would state that the document was never received. Our office has been unable to reach the consumer by phone. Per the consumer's request our office will send additional validation details to the consumer. Our records indicate that the creditor still shows the balance as due by the consumer. The consumer is encouraged to call our office at XXX-XXX-XXXX and ask to speak with a manager with any additional questions.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)I have no knowledge of this account nor have I ever receive any correspondence regarding the stated account from *** & Weiner. Craine and Weiner has failed to provide proof of the dates stated they sent correspondence or the dates, time and contact number when they tried to contact me via phone. I request this account be removed from my CRA immediately and all further collection attempts Cease.

I had a collection with them for 5 months. I received a call and I advised the representative that I would pay the original company instead of the creditor (because I'm familiar with their business). I paid the original company, but Caine & Weiner still have a balance on my credit report. I called the main number XXX-XXX-XXXX, the receptionist answered and placed me on hold (listening to her watch tv in the back ground) I waited patiently. She finally address me, and I begin to tell her about my situation after 4 words she cuts me off. I allow her to finish, quietly, and I start from my cut off point, and she cuts me off again. I request a supervisor, she debates, finally her supervisor takes over the call. I begin to advise her supervisor about the experience, she cuts me off. She goes off on a rant about how she's trying to understand whats going on...while I was talking. I stop talking to allow her to say whatever she needs to say, she finishes and I begin speaking and she cuts me off again. I see why the receptionist is rude. I google the company only to find out they treat even more people like this. Horrible experience. The receptionist is very rude and disrespectful. The supervisors are even worst.

I keep getting phone calls saying they are a debt collector and I owe money to Best Buy. I've called Best Buy and owe nothing...
Multiple calls. And a letter asking for proof I paid through bank statements. I asked for an invoice...all that was sent was how much I owed. The last phone call involved "***" giving me attitude and hanging up on me.

Desired Outcome

I want to be called by a supervisor and apologized for the harrassment. I do plan to go to the police if this does not happen

Caine & Weiner Response

Our office has been working with both the consumer and the creditor in order to find an amicable resolution to the dispute. We have submitted the additional documentation provided by the creditor to the consumer. The consumer believes there are additional payments not posted by the creditor and our office is awaiting that information to review with the creditor. Our office is also working with the creditor for any additional available payment histories. The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any additional questions.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)I asked for an actual invoice with the details of the purchase. Not a document that says I owe $xxx.xx. They did not provide me with that. Also I spoke to the creditor who says I owe nothing. I need to be told this item is taken care of or I'm going to the news. They will fix it if you don't.

Need credit reported updated and erroneous account removed!
See note above in

Desired Outcome

Remove erroneous account immediately or provide adequate documentation to support via FCRA

Caine & Weiner Response

The consumer had previously filed a dispute with one or more of the credit reporting agencies. As a result of our investigation our office sent validation documentation to the address listed on this complaint in June of 2017. We have received no response directly from the consumer. As a courtesy our office will resend the documentation. Our records indicate that the creditor shows the debt as still due. The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any additional questions.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)To Whom It May Concern: I am sending this letter to you in response to a credit item that has been erroneously placed on my Equifax, TransUnion & Experian credit reports Be advised, this is NOT a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested. This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your office provide me with competent evidence that I have any legal obligation to pay you. Please provide me with the following: What the money you say I owe is for; Explain and show me how you calculated what you say I owe; Provide me with copies of any papers that show I agreed to pay what you say I owe; Provide a verification or copy of any judgment if applicable; Identify the original creditor; Prove the Statute of Limitations has not expired on this account; Show me that you are licensed to collect in Texas Provide me with your license numbers and Registered Agent. If your offices plans on placing invalidated information to any of the three major Credit Bureau's (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative *** is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following: Violation of the Fair Credit Reporting Act Violation of the Fair Debt Collection Practices Act Defamation of Character If your offices are able to provide the proper documentation as requested, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist. Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately. I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter. This is an attempt to correct your records, any information obtained shall be used for that purpose. Best Regards, *** D.

I do not have a contractual agreement with this company. I have not EVER received any goods or services from this company.
This company, which I hold no contract with nor have received services from, reported a collection account against my SSN in the amount of $785.00 with Transunion, Experian, & Equifax credit reporting agencies. I requested verification of the debt and account however the business failed to provide adequate proof. Considering this business does not have a contract with me for goods or services they have provided nor have they provided adequate proof I am not obligated to pay for the alleged debt.

Desired Outcome

I demand the business remove the negative report against my SSN at any credit reporting agency, including but not limited to Transunion, Equifax, & Experian. In addition, the business agrees to have no contact in any form with me regarding this account now or in the future. Lastly they agree to remove my personal information from all accounts in the companies database.

Caine & Weiner Response

Our office received an account for third party collection activity from the creditor, Progressive Insurance, in April of 2016. Our records indicate that written communication was mailed to the consumer to the address listed in this complaint in that same month. Our records also indicate that the consumer disputed the debt directly with one or more of the credit reporting agencies. Our file was updated accordingly. As a result of our investigation validation information was mailed to the consumer to the same address in August 2016. Our office does not show receiving any written correspondence directly from the consumer. Our records indicate that the creditor still shows the balance as due.The consumer is encouraged to contact our office at 818 226-6000 and ask to speak with a manager so that we can assist in finding an amicable resolution with the creditor.

I have no contract with this company.
This company which I hold no contract with nor have I received services from is reporting a collection account against my SSN totaling $2,850 with the major credit reporting agencies. Considering that this business does not have a contract with me for goods or services they have provided nor have they provided adequate proof, I am not obligated to pay this alleged debt.

Desired Outcome

I request that the business remove the negative report against my SSN at any credit reporting agency, including but not limited to Transunion, Equifax, and Experian. In addition, the request that the business agrees to have no contract with me regarding this account now or in the future. Lastly, I request that they agree to remove my personal information from all accounts in their company's database.

Caine & Weiner Response

Our system records do not match the information submitted by the consumer. Our records indicate we have one account in our system matching the consumer information listed in this complaint. The creditor for this account is Nestle/Ozarka Waters and the information provided to the credit reporting agencies indicates an $85 balance. We do not have records indicating $*** owed by this consumer. Our records indicate that the creditor still shows this balance as due by the consumer. The consumer is encouraged to call our main office at XXX XXX-XXXX and ask to speak with a manager so that we can obtain any additional information the consumer may have regarding details reported to the credit reporting agencies and so that we may assist the consumer in finding an amicable resolution between the consumer and the creditor.

Please verify account. Account Unverified. Please validate account. I did not sign nor do I have an contract with *** and Weiner.
October 10th 2016

Desired Outcome

Please remove from credit report.

Caine & Weiner Response

Our office received an account from the creditor for third party collection activity in October of 2016. Our office had no direct contract with the consumer. Our records indicate we sent initial correspondence to the consumer in October of 2016. Our records indicate that we have not received any written correspondence from the consumer nor any verbal communication. The consumer submitted disputes directly to one or more credit reporting agencies related to this debt. As part of our investigation our office sent validation information to the consumer at the address listed in this complaint in April 2017. Our records indicate we have not received any direct response or inquiry from the consumer. The consumer is encouraged to contact our office at 818 226-6000 and ask to speak with a manager so that we may find an amicable resolution between the creditor and the consumer.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)I do not know anything about this debt to respond to anyone so please remove this from my credit report. I do not have a contract with Caine and Weiner concerning this debt that they are trying to collect.

Look, I've never had any dealings with this company. They are attacking my credit report without any legal standing.
The collection agency *** and Winer has my personal information and is harassing me with NO legal right. I have gotten calls from strange numbers and searched online and found it is this agency harassing me. The reason for my account being closed with is none of this collections business.
I mailed a request for ALL documentation required by FCRA and FDCPA for legal possession, collection and reporting of an account. NONE of it has been provided.
I requested the original signed contract and agreement, the conversations both on computer and on phone with the original creditor as well as the signed agreement and contract between the collection and the original creditor. I am now demanding the surety bond and collection license number for this collection.
I know the FDCPA clearly states a consumer is to be made aware the right to tell a collection to cease and desist all collection and communication including deletion from any and all credit reporting agencies as FCRA clearly states reporting an account is continued effort to collect a debt.

Desired Outcome

Provide all proof of legal right to collect, contact and report these accounts according to ALL FDCPA and FCRA regulations. Since that is NOT going to be done because this is not within the guidelines of the FCRA this collection is to cease and desist all communication, COLLECTION and HARASSMENT STOP. Delete all accounts from the credit report as FCRA considers that ATTEMPT TO COLLECT as well. This is not legal and I will find the collection agency license number and report them as well.

Caine & Weiner Response

Our office received the account from the creditor in March of 2017 for third party collection activity and sent initial correspondence to the address listed on this complaint. Our records do not indicate receiving any written correspondence from the consumer and that our office was unable to reach the consumer by phone and that the creditor still shows the balance due by the consumer. Our records indicate that the consumer filed disputes directly with one or more credit reporting agencies. Prior to receipt of this complaint, as a result of our investigation and as a courtesy to the consumer to allow time for the consumer to find an amicable resolution directly with the creditor, our office closed our file as disputed and sent deletion requests directly to the credit reporting agencies. Additionally we sent written correspondence to the consumer in early July 2017 confirming the credit deletion requests. The consumer is encouraged to call our main office at XXX XXX-XXXX and ask to speak with a manager with any additional questions.
