This debt relates to unpaid auto insurance premiums and per our records the creditor still shows the balance as due by the consumer. In 2016 I moved from a property that I rented from ***. During my move I started receiving harassing phone calls from ***, who advised I was not allowed to collect the rest of my belongings that are estimated to be around $***. Following thisi I filed a police report and *** reported me to collections. As validation of debt they sent me a move out inspection that *** did not invite me to attend and the inspection issues were completely falsified. I disputed the findings and sent in pictures validating the errors. Caine and Weiner have not once, but twice reported it to my credit regardless of my dispute. I have asked multiple times for pictures validating ***s move out damage claims, just as I have provided and they refuse to provide it. Not only that, regardless of my requests, they did not give any written or verbal response to my request or advise me that this would be reported to my credit report regardless of my verbal and written dispute. They have my number and address. I have no problem paying what is owed, but what is being claimed is not correct and I want this case handled and reported fairly. My last conversation with *** on 01/08/18 she stated they would no longer persue validation and I am responsible for what he states I am responsible for. That is not how the Fair Credit Reporting Act works..

Desired Outcome

This needs to be handled properly and within the law, not just based on your fraudulent clients claims. This has all been sent in written and verbal requests. I want this removed from my credit until your client can provide proof of this alleged debt. Legally he was required to invite me to the walk out inspection at which he did not. I have provided photographic proof that his claims are not correct and I ask that he do the same. In addition to that your client has the issue of my property that needs to be deducted from whatever so called balance that I have.

Our office received the account in July 2016 and initial correspondence was sent to the consumer at that time. We received correspondence from the consumer in August 2016 disputing the balance due. Our system was updated appropriately and we opened an investigation with the creditor. Any negative reporting items were removed from the credit reporting agencies while the documentation provided by the creditor was being confirmed. Our office obtained the validation details from the creditor and that information was sent to the consumer in October 2016. Our records indicate that the creditor still shows the full balance due as reported to our office upon placement. The creditor believes that the documentation submitted does in fact properly detail the entire amount due. The credit reporting agencies were then notified of the disputed status of the account. Our records do indicate that the consumer informed us in July 2017 that a portion of the debt was due and undisputed. The consumer has not yet contacted our office to resolve the undisputed portion of the debt. We encourage the consumer to contact our office at XXX XXX-XXXX and ask to speak with a manager so that we can find an amicable resolution between the consumer and the creditor and also resolve the credit reporting situation.

Plus broke commercial law under UCC ? 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response.

Also, *** & ***,***, President " failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA ?809, which is $1000 per violation and the state of TX allows treble damages.

Under ? 809. Validations of date and Mini-Mirandi under Section 807(1) *** & ***,***, President failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the FTC, and that my state attorney general can also enforce this with a $1000 penalty as well.

Therefore, provide me documentation of notification (i.e. a copy of the notification sent), and proof that it was delivered to me in a timely manner (i.e. a dated certified mail delivery confirmation with my signature).. 30 days before or 30 days after the date derogatory reporting was started with the bureaus as you have listed or DELETE the reporting .A "strong presumption" of receipt applies when notice is sent by certified mail, because it creates actual evidence of delivery in the form of a receipt. Santana Gonzalez v. Att'y ***, 506 F.3d 274, 279 (3d Cir. XXXX) (emphasis added). A "weaker presumption" arises where delivery is sent via regular mail, for which no receipt, or other proof of delivery, is generated. I do not believe it is accurate and would rather not have to spend more time than necessary for both of us to resolve this situation. Even it's been transferred *** & ***,***, President is still responsible for reporting under the FCRA I appreciate your help regarding this and look forward to an amicable resolution.

Our office received the account from the creditor in October 2016. Our records indicate that initial correspondence was sent to the consumer at that time to the address listed in this complaint. Our records also indicate a second correspondence was sent o the same address in November of 2016. There is no record of mail return. Our records also indicate that an agent from our office spoke with the consumer on 12/31/16 at which time the consumer stated that she only owed a portion of the debt but was unable to resolve any balance at that time.Our records indicate that the consumer filed a dispute directly with one or more of the credit reporting agencies and our system was updated accordingly. Our records also indicate a second conversation with the consumer in May of 2017 in which the consumer again disputed the balance but was unable to resolve any portion of the amount due and that the creditor still shows the balance as due by the consumer. The consumer is encouraged to contact our office at XXX XXX-XXXX so that we may assist with an amicable resolution to the dispute with the creditor.

I just ran my credit report to find a collection for Caine Weiner. I have never received a notice or phone call regarding this collection.
According to the Fair Credit Reporting Act, my rights as a consumer is to be notified of any and all collection attempts BEFORE a collection is placed on my credit. My FIRST and ONLY notification of this collection was when I pulled my credit report. This is a VIOLATION of my rights.Therefore, I want the collection removed from all three credit reporting bureaus immediately as this matter has adversely affected my credit score.

Please note that our office received the account from the creditor in August 2017 and our records indicate that initial correspondence was sent to the consumer at that time to the address listed in this complaint. Our records also indicate that the consumer contacted our office on 11/8/17 and spoke with an agent at which time the consumer was informed of the debt and the balance, including confirmation of a $35 payment made directly to the creditor that was posted to the account and reduced the balance. At that time the consumer stated they would need time to gather the balance of funds but intended to pay the remaining amount due. As such we are unclear as to why the consumer would make a statement that they were unaware of the debt or the balance. There has been no further contact made by the consumer to our office.As a courtesy to the consumer our office will resend documentation to the address listed in this complaint. Again, Before a debt is placed on the credit report it has to be validated. I never received anything from Caine and Weiner in writing. I never spoke to any representative regarding this matter. Remove the account from my credit report. The appropriate business practices were not followed.

A representative of this company called my place of business and was very rude and unprofessional! He was so pushy and insisted I was lying when I told him we were a very small company and did not have any big delinquent accounts! I am beyond disgusted with pushy men who think they can bully you into giving them what they want. Absolutely, under any circumstances, do NOT give this company the time of day!

I have never had a signed contract with Caine & Weirner Company I request contract information from them regarding the contract but no information was provided in return.

Caine and wiener customer service placed in collections after payment
Caine and wiener customer service made a monthly payment arrangements with me to pay off so called amount owed to progressive insurance to keep it from going on credit report as soon as I made payment it was reported. If they were not going to honor their promise I would of never agreed.

Our records indicate that we have not received any written correspondence from the consumer, but that a verbal agreement was reached with the consumer on a payment plan to satisfy the debt. One payment has been received to date. Our system will update the balance with the credit reporting agencies as additional payments are received. C&W purchased an alleged debt from PODS and has been unable to verify it despite several requests. Collection attempts continue.
I conducted business with PODS in Dec 2015, with drop-off in Jan 2016. Full payment was made at that time, I have supplied bank records and the PODS contract and emails. On 1/23/16 I was informed that I was erroneously double charged due to an accounting error. That refund was processed on 02/03/16. However, PODS phoned me approx. 6 mos. after I completed business with them. They informed me my balance showed $340 outstanding, but they could find no invoice. This amount far exceeds the initial estimate and is unverified. PODS later attempted to make an unauthorized charge to my CC. When this was disputed with bank fraud protection, my bank conducted an investigation and PODS was again unable to verify the debt. The charge was refunded. On 3/27/17, Caine and Weiner begins collection attempts. I disputed the debt in writing on 4/11/17, but phone calls continued, I have supplied phone records and proof of delivery of my dispute. On 10/17/17 they mailed me a statement that does not include a detailed invoice, and indicates dates that do not match my bank records. Further, this statement does not even reflect the double charge and refund that PODS emailed me about and bank records prove. I have paid to PODS and total of $4,068.96, almost 10% above estimate. This additional debt could not be for mileage as it was paid for, and it could not be a late fee as they took payment automatically. Despite repeated attempts to verify the debt made by me and my bank, PODs and Caine and Weiner have failed to do so. Please verify the debt with an invoice and explanation of the charge that so greatly exceeds the estimate and originally billed amount. If not, please cease all further attempts to collect this unverified debt.

Desired Outcome

As required by law, a debt collector and creditor must verify the debt they are collecting. As stated above, they have failed to do so. A statement is not an invoice. Please verify the debt in a manner that allows me to dispute it properly or to pay it, or cease all further attempts at collections. I also demand that this not be reported to any credit reporting agency while in dispute.

Please note that our office did not purchase this debt. The creditor assigned the account to our office for 3rd party debt recovery in March of 2017. Initial written correspondence was mailed to the consumer at that time. Our office received a written dispute in April of 2017 at which time an investigation was opened with the creditor and our records were updated accordingly. Our records indicate that there is no current entry regarding this debt with any of the three credit reporting agencies. Validation documentation was provided by the creditor and mailed to the consumer. Our office had not received any response to the documentation directly from the consumer until receipt of this complaint. As a courtesy to the consumer and to allow the consumer the opportunity to work directly with the creditor to find an amicable resolution to the dispute, our office is closing our file. The consumer is encouraged to contact our main office at XXX XXX-XXXX and ask to speak with a manager with any questions.

Inaccurate reporting to credit bureaus
Caine and Weiner is stating that I owe $296 to Progressive insurance, which billed me for coverage after I had already provided proof of my new insurance policy. Caine and Weiner asked for this proof on July 6, 2017 and I promptly sent it to them and they told me that they would correct the information and remove it from my credit reports. It is now October 18, 2017 and they have yet to remove the incorrect negative information.

Our records show that our office received the account from the creditor in July 2017. The creditor records indicate applicable coverage dates for the assigned balance to be 2/5/17 through 4/28/17. The cancellation date of the policy does match the date noted by the consumer in this complaint. The creditor records provided to our office indicate that the $295.63 balance is for insurance premium money due prior to the 4/28/17 cancellation date and that the balance is still due by the consumer.The consumer is encouraged to contact our main office at XXX XXX-XXXX and ask to speak with a manager with any questions.

This company is attempting to collect on a debt that I do not have a binding contract with their company, they are illegally trying to collect a debt without a contract between me in their company. The original owner is progressive insurance. By law they can not collect a debt if there is no contract binding me with their company. They are violating the FCRA.

(Complaint entered by Cleveland, Ohio Revdex.com staff - LST)***I had a car insurance policy with Progressive Insurance. Unfortunately due to my health end stage liver disease, due to financial difficulty, I was unable to have my car covered with insurance for a month therefore I did not pay it. The following month I was able to get financial help from family I was able to reinstate my policy with one month prior of no coverage therefore I was not to be billed for that month. So I paid for the month I wanted my coverage for. After the payment was received and posted by Progressive, I recved another bill stating I still owed them $300 which I was shocked to have received. I contacted them immediately and told them that I was upset and requested that they adjust my balance to what I owed for the following month which would have been my monthly premium of $128, They stated they would check into this and contact me. I never heard back until today I received a letter from a collection company called Caine and Weiner stating that they represent Progresive as a collection agency and that I was to pay $300/47. I could not believe Progressive without hesitation and never contacting me of this incorrect billing and amount other than the bill I had received prior to this collection agency. I am requesting that they adjust the balance to reflect the right amount.

Learned of Equifax data breach so checked credit history. Found this company listed twice.
I learned that Equifax had a data breach, so checked my credit report to ensure everything appeared accurate. Found *** and Weiner Company listed twice for two different amounts in 2011. I have never been notified of anything in collections in the amounts listed, through this company nor any other, and have never received any communication from this company about any debt whatsoever. I have filed an identity theft report online.

I found a derogatory collection account filed on my credit report from *** & weiner for western union. I called *** & weiner and they could not provide any validation. I contacted western union and was told I do not owe any debt for time period during 2016. western union opened a fraud investigation against *** & weiner
western union also stated to me that they use no third party collection agencies to collect debts. western union suggested I file police report and other gov agencies against *** & weiner which I did.stull waiting for this derogatory to remove from my credit report. this company has over 100 fraud complaints exactly like mine.

This account was assigned to our office in May 2017 for recovery of unpaid funds from an international wire transfer. Our office has recently spoken with the consumer and the consumer's dispute has been noted in our account. Updated information will be sent to the credit reporting agencies. The consumer has recently spoken with both an agent and a manager within our organization. Our office has details from the creditor documenting the wire transfer date and amount and indicating the same e-mail and phone number provided by the consumer in this complaint. The individual noted as receiving the funds has the same last name as the consumer. The consumer would not confirm whether they know the individual that received the funds. The details have recently been mailed to the consumer to the address listed on file. Our office has noted the information provided by the consumer regarding the apparent fraud claim filed by the consumer with the creditor. Our office will review any updates received by the creditor as a result of the claim filed by the consumer upon receipt. Currently our records indicate the creditor still shows the balance as due by the consumer. I asked them to givee me their creditor info to be able to contact them. I was told I was contacting the wrong creditor and they never gave me info requsted.I purchasedmy credit report I see derogatory collection account from Caine and Wiener with a correct phone number for Western Union.I was able to contact the consumer creditor western union and was told I did not owe any debt to them and they said they were contacting Caine and Wiener to stop collection against me and clear my credit report. Western Union has sent me an email stating this and I have called caine and Wiener several times to forward this email and they will not return my voice mails. Western Union is also sending me a letter via mail and it should be received in 7 days.Western Union says this matter should never had gone to collections since I never owed them any money as the transaction was never completed in july 2016 because of a problem on the western union website. Roger at western union said thousands of customers were affected by this problem in july 2017. Roger had no explanation how his matter was sent to collections.I stated to Roger that was recently declined a auto loan because of this and that's how I discovered caine and weiner had sent a derogatory collections to all 3 credit report agencies.caine and Wiener has done nothing to date to rectify this matter that is personally damaging to me.they have been unresponsive to all my requests.I have phone calls, emails and letter from western union stating that I owe nothing to them.

I was part of a scam I received a laptop but did not order. Told *** & Weiner via phone on 8/7/17 I need a label to send the laptop back. Never sent
Received a laptop via fedex from Best Buy as part of a scam on my credit card. I called the CC company and told them of the scam and they removed the charge. I asked them what to do with the laptop and they said Best Buy would follow up. No one ever followed up. A letter then arrives in the mail from this company stating I've been turned over for collection for not paying $586.26 for the laptop I did not order. I explained the situation and asked them where to send the laptop that I never opened and received as part of the scam. On 8/7/17 via phone they stated they would get with Best Buy and find a prepaid label to have me send the laptop back. This never happened. I called back on 8/11/17 asking for a label as they never sent one or called me. *** stated to not call back anymore but to wait for a label to be sent to me. So I wait and wait and never receive a label or follow up call. Next thing that happens is I receive another eat *** and *** letter in the mail yesterday stating my balance is still unpaid in their system and they will escalate the collection for being unpaid. I would like this harassment to stop and someone to let me know where to send this laptop to get this matter resolved. Every person you talk to at this company is completely rude and never follows through on what they say.

Desired Outcome

Give me the label needed or stop contacting me.

Our account has been updated with the dispute information previously provided by the consumer. The account is coded to prevent calls to the consumer as a result of the fraud allegations the consumer provided to the creditor.We are unclear as to the exact concerns of the consumer. Per the creditors's requirements our office notifies the creditor of the consumers' return merchandise request and the creditor provides the actual return label. The time frame for that action is determined by the creditor and not by our office.As noted above our collection efforts are on hold. The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any additional questions.

Attempt to collect debt on a closed company. Additionally this in not a correct collection and is not a verified collection. The company.
I notified on the company on the phone of all the problems with the debt. The person said they will continue to call me anyway. They said they recorded the message. I ask that they not delete any recordings as I may pursue this in litigation as it is harassment.

I want the company to say they will not illegal try and collect money from me or anyone else.

Please note this account is a commercial debt. It involves unpaid freight charges owed to the creditor for merchandise shipped commercially by the company. Our records indicate that the creditor shows the company failed to pay freight charges for products shipped from mainland China to the business located in Chicago at the address listed in this complaint and that the balance remains due. This is not a consumer or individual liability matter. The individual filing this complaint states that the company is out of business but no proof has been provided to our office as verification. Our collection efforts continue for this commercial debt.Anyone representing the debtor company may contact our office at XXX XXX-XXXX and ask to speak with a manager with any additional questions or to provide proof of business status and/or any alleged disputes.

Caine & Weiner sent me collection notices for Best Buy account. I telephoned Caine & Weiner and told them they had the wrong person.
I telephoned Caine & Weiner to tell them they had the wrong person, and that I did not have a Best Buy account. The representative could not tell me why I received the requests for payment for Best Buy account I do not have. I believe this is fraud attempt. Caine & Weiner did not have my DOB, SS# or Telephone #. I asked the representative how can a person get a Best Buy account with out providing this information. The representative could not answer this question and told me they would get back to me.

Desired Outcome

Discontinue this fraudulant practice.

Our office received the account from the creditor in August 2017. Our records indicate that the creditor still shows the balance as due.Based upon recent communication from the consumer our file has been updated to reflect the consumer's fraud claim and we are requesting validation information from the creditor. Once received that information will be reviewed for submission to the consumer.Our file is currently on hold pending further information from the creditor. The consumer is encouraged to contact our office at XXX XXX-XXXX and ask to speak with a manager with any questions.

(The consumer indicated he/she DID NOT accept the response from the business.)I telephoned this company and told them I have never had a Best Buy account, and never received any correspondence from Best Buy concerning overdue account. How does a phony account go into collection without the account holder receivin any correspondence from the Best Buy?
