receiving your letter I have reviewed the taxpayer’s account and prepared a detailed response to the taxpayer addressing their concerns. In their complaint, the taxpayer indicated that they received a notice from my office regarding delinquent and local earned income taxesThey raised concerns that they were not previously notified of these unpaid taxes due to an incorrect mailing addressFurther, they raised concerns about the penalties assessed on their accounts It is important to note that under Pennsylvania law every taxpayer is required to file a local earned income tax final return. This return would put the taxpayer on notice of any tax liability or refund if appropriate. Additionally, earnings information supplied by the Pennsylvania Department of Revenue, which is necessary to start delinquent collections, can take years to be forwarded to collectors such as Keystone. Moreover, the mailing address where the notices were submitted was obtained directly from the taxpayer’s and W-2’s supplied by the taxpayer. The Keystone Collections representative states that Keystone cannot be responsible for information listed on ***I would like to point out that the Keystone website directs taxpayers to find their municipality using this precise websiteSame instructions are included on the paper instruction formIf Keystone uses a separate source to determine one's municipality, they should direct taxpayers to the same sourceI am seeking a change in the instructions or a statement, which includes that Keystone is not responsible for the information listed on the government websiteNo such statement is included in the instructions as of now, so one could argue that based on the information provided by Keystone, I am entitled to believe that my municipality is *** Township and I am owed a refund.Furthermore, the Keystone representative did not address the fact that it was another Keystone representative at the supervisor level who has informed me that I was in fact in the municipality of *** Township and asked me to submit an amended returnI only submitted the amended return after being specifically asked to do thatThe representative also did not address why no one has been able to provide me with a response to all of my queries about the status of the refund for three monthsI received very little information throughout the process and the little information that I had received came after my inquiries (I would get bits and pieces of information after I reached out to KeystoneKeystone never contacted me with updates)I am seeking an explanation for the lack of communication.Given that Keystone charges a penalty for underpayment of taxes during a tax year, I am concerned about having to pay this penalty next spring when I am completing the return for To date, my employer has been withdrawing local taxes for me at the *** Township rate again citing ***Unlike with the federal tax return, one does not have an option to withdraw additional taxes from each paycheckConsequently, even if I again ask my employer to change my municipality, my taxes will be underpaid for the year and I will be asked to pay a penaltyI am seeking specific guidance from Keystone on avoiding having to pay a penalty; if the solution is for me to pay estimated taxes, then I request specific guidance in writing for this

I am sending you a pg letter with plus attachments explaining whyKeystone lied to you when they responded with "a detailed response to the taxpayer addressing their concerns"Their letter to me was ONE short paragraph and not signed by anyone at KCGThe response they sent to you had FOUR paragraphs and was signed "Very truly yours, KCG, Christopher E V***, Exquire", I should have been afforded that same courtesyIn their letter to you they said they were limited by the information of the taxpayer and the local tax office and the State of PA's return, they needed further documentationBased on that paragraph, Keystone has misrepresented their intentions in the being a genuine auditOn my PA40-2013, the very first page to the right of our address on the return, the last line of info is "School district name: ***"The PA info worksheet under School code "As of 12/31/2013, enter where taxpayer lived: School District: *** Area, school code 21650"Same page at the bottom "ParkII-Resident status, there is an "X" in the box for Form PA"Full year resident" On the PA School District Code selection worksheet, I completed ***, *** Area, School District code selected 21650"They had all of the info they needed from that returnNone of the info was "changed"All of it confirmed we did not work or live in *** Twsp and that should have been the end of itI am highly and extremely upset with this company, their "style" and their demeanor and their actionsThe *** School District has a problem tooThey have sent a truant officer out to my home on at least three occasions to tell us they had reports that children live in my homeExcuse me, my children were born and raised in *** *** ** attended school there and their ages as of this date are: 50, and I have paid my taxes all of my working life since the age of 14, on time in fullI am a Vietnam Vet, I served your countryI am retired now and want to be left aloneYour company that you are protecting needs to be talked toI sent one cert mail, two faxes, made two phone calls and then the complaint to you I never incurred this "debt", so I was guilty until I had to prove my innocenceTHEY made the "mistake" by stamping that cert mail receipt card with they date: July 29, What is the date today? To MsJennifer ***:In response to the rebuttal by Keystone Collections Group, I would like to first note that I was never made aware prior to moving to *** of who the local tax agencies are, and that I was never notified by Keystone, contrary to what their letter says.If the per capita tax was submitted, then it was because I was billed properlyI was never made aware that this is a yearly occurrence, and this year, I did not receive an initial billRegardless of their records, I can assure you that, for the year, I only received a late notice in relation to the per capita tax, which is why I never paid itWhen I tried to pay it, the website said I needed an account number which, as of now, I have still never been givenA delinquent notice was sent, but not a current oneIn addition, after asking multiple *** City renters of multiple years (some longer than I), not one person could tell me who Keystone Collections Group was or what the per capita tax wasAfter contacting City Hall following these late notices, I was made aware; never prior.The rebuttal suggest that I was made aware that Keystone does not service my taxes; however, I was notI moved to *** on November 1st of 2012, and filed to KeystoneWhen I contacted Keystone regarding this issue, they told me that they forwarded the tax returns for me whenever I filed to them.I don’t ever recall filing with Keystone online in 2014, but I do have an account with them, which I can see that I didI’m not sure how I knew to file there, but perhaps that year I was sent a notice; still, the annual notices are not something I ever recall receiving, especially for the per capita tax, prior to 2014.Because I did not live in Northampton County before November of 2012, perhaps that is why I was never given this notice by mail that they mention from ***The first I’ve ever learned of this was when I filed this complaint after speaking directly with ***As for the website, http://munstats.pa.govI have never heard of this site, and was never given itI’m not sure how they expect me to know of it if they never gave it to me.I agree that there are inconsistencies, but I can assure you I was never outright told that Keystone is the collections group for the City of ***, County of NorthamptonOne would think that there would be a state law of some sort stating that it is the city’s responsibility to tell its taxpayers who their local tax agency is, and, if a per capita tax (or any other tax for that matter) exists, that, for one, it does exist, and for another matter, how to pay itThis year I did not receive any bill, so how could I know that I owed?If the paper tax form came from Keystone, that is something I do not recall; that, as *** told me, is something they would have done if I incorrectly sent them my tax returns instead of sending them to KeystoneBecause I was never sent a notice to stop sending to ***, I’m sure you can see my confusionI do not recall ever agreeing to never receive paper notices from Keystone about my local or per capita tax filing.If you had the ability to check my filing status for state and federal, you would know that I filed my taxes around March 1st, hence, not late.The quote “In fact, I cannot find any evidence that they did not know that Keystone serves as their local tax collector” is a very forward assumption, and is the second time that they claimed that I knew how to file and was being dishonestThat is completely inaccurateIf you asked me this time last year who I was to file my local taxes to, I would have answered, “I file every year to ***, as that is who my local tax agent has been since I was fourteen years old.”As I do not owe any taxes, I can’t see how I am being charged a $late fee, especially when they failed to notify me until October of that my local tax form was not filed by April of for the tax yearHow they could be that lax in their records, I do not know, but if I filed a month early, you would think that they could tell me before six months passed that I was making a mistakeI have been filing to whatever the paper forms and memory have suggested for as long as I can remember, but until the per capita tax of 2014, I had never heard of this agency, and assumed it was yet another tax scam until I was able to verify the legitimacy of the per capita taxIf I had been billed properly for 2015, I would have paid itI do not let bills slide as this company seems to be suggestingIf I had the means to pay it (i.ethe “account number” they’re requesting online), I could have paid it by nowBut because I was not given a bill and because I do not have that late notice anywhere, I can’t find said account numberI asked them for it back in October and still have not received itI tried to use the account number on the local tax that I paid, but it didn’t workIf they want me to be able to communicate with them, they should communicate with me in a less convoluted, more direct, and more timely manner so that I can finally settle thisIf I am charged yet another late fee because they have not given me the account number, that can not be considered my fault.They responded to my request for the account number, but never mentioned what it was or how I could get itI am still awaiting their replyThat response, by the way, came weeks after I originally submitted my first request for informationTheir lack of communication is astounding, especially considering that they responded to the Revdex.com’s notice of a filed complaint so quicklyI’m not sure where their priorities lie, but it doesn’t feel as though it’s to their “serviced” customer, the taxpayer.I would like to know how I can finally get this information and get them to cooperate and give the information I need to finally clean up this mess of a situation.Thank you for your time and your pursuance of this complaint.Sincerely,*** ***

*** *** I received a phone call from a Keystone representative a few days after Keystone sent the response to you stating it was now closed. The company called to inform me that they did not have my tax return paperwork and needed a copy for their records. I did not provide the copy since they cashed my cash so the paperwork had to be attached originallyUnfortunately my township has hired Keystone so I have to deal with them but if I had a choice, I would notFYI: Since my complaint, Keystone was written up in the local paper by a county representative stating that she was due a refund but got a late notice

Dear Ms***: Thank you for your cooperation in working with the taxpayer and Keystone to address this matter After receiving all necessary documents from the taxpayer, my office processed the final return. Unfortunately, the local earned income tax return provided to my office shows that the taxpayer incorrectly calculated their local earned income tax liability The taxpayer’s local earned income tax rate is 1.25% Line of the return states “Total Tax Liability (Line multiplied by 0.0125)” Based on tax liability reported by the taxpayer on the final return, it appears as though they thought the tax rate was 0.0125% (or put another way, they multiplied Line by 0.000125) This error led to a substantial miscalculation, which caused the taxpayer to believe that they were owed a refund. In actuality, the employer withheld too little and a balance remains due and owing I have issued a balance due letter to the taxpayer, as well as an explanation of the error in calculating the tax liability. Since receiving your letter I have reviewed Keystone’s telephone logs and prepared a detailed response to the taxpayer addressing their concerns As you will recall, the taxpayer’s only issue raised in his follow up complaint were allegations of disconnected telephone numbers for Keystone. Keystone’s telephone system has the capability to track and monitor incoming telephone calls. I confirmed that Keystone received calls throughout the day of November 14, 2016. I would note that calls were received throughout the entire day of November 14th and not for an isolated time on that date, further evidencing that our telephone lines were fully operational. As for the taxpayer’s second noted date of contact listing November 19th, I would agree that phone lines would not be answered on this date as it was a Saturday and Keystone’s business hours are Monday through Friday from 8:a.mto 4:p.m Finally, in my letter to the taxpayer I explained that every taxpayer also has the option to communicate with Keystone electronically via www.KeystoneCollects.com I appreciate the additional information provided by your letter and the opportunity to ensure that the taxpayer’s concerns are properly addressed. Dear Ms***: Thank you for your letter regarding the above-referenced complaint ID number In their complaint the taxpayer stated that that their employer erroneously withheld local earned income tax based on
their previous addressThe taxpayer claimed that when they noticed the error they corrected the error and their employer no longer withheld local earned income tax, as the taxpayer resides in a municipality that does not levy a local earned income taxThe taxpayer further expressed displeasure with Keystone’s delay in processing their refund request. Please know that after receiving the taxpayer’s complaint I personally reviewed their accountThere were numerous defects with the taxpayer’s W-2s for the subject year, which created confusion in my officeSpecifically, the taxpayer was issued two (2) W-2s from their employer for the same year with differing withholding, insurance, and company car information. Typically, when an employer amends a W-they issue a new document referred to as a W-2c which outlines the error in the original W- Upon review my office was able to confirm the taxpayer’s residency based on utility bills they provided. Additionally, because the employer failed to properly issue a W-2c or contact Keystone or their third-party payroll provider, it took my office additional time to reconcile the two (2) W-2s to determine whether the taxpayer was entitled to the refund. My office advised the taxpayer on how to insure this error does not occur again in the future and has directed that the taxpayer be refunded their overpaymentAccordingly, my office considers this matter resolved. the School District on July 2, Furthermore, the taxpayer claimed that she did not receive an original bill Please know that I have thoroughly reviewed the taxpayer’s account and advised the taxpayer that Bethlehem Area School District per capita taxes are assessed on July of each yearFurthermore, per capita taxes are not prorated based upon part-year residencyThat is, all residents of the School District as of July of each year are responsible for remitting the tax, regardless of whether they move out of the School District afterwardAccordingly, as the taxpayer conceded that she was a resident of Bethlehem Area School District on July 1, 2016, she remains liable for per capita taxes Moreover, our records indicate that the original bill, which was mailed on July 1, was never returned to my office as undeliverable Please know that it is Keystone’s policy to place a memorandum within a taxpayer’s account if any notices are returned as undeliverable I advised the taxpayer that the penalties assessed on her account are statutorily mandated and owed to the taxing authorities when the tax is not paid when dueFurthermore, Keystone is authorized to recoup the costs of collection based upon Act of 2004, as ratified by the taxing bodiesAs the taxpayer remitted payment in full, my office considers this matter resolved I appreciate the opportunity provided by the Revdex.com to resolve the concerns of taxpayers and improve our processes. her local earned income tax return, because “a person with [her] name and social security number is not eligible to electronically file (“e-file”)”? ? ? ? ? ? ? ? ? ? ? ? After personally investigating this taxpayer’s account I discovered that the taxpayer was precluded from electronically filing a tax return as the complainant’s social security number and address were already provided to Keystone on a different final returnPlease know that for security and anti-fraud purposes, Keystone’s e-file system limits a taxpayer’s ability to file a return, either electronically or by paper, for more than twelve (12) months in any given tax year.? In this particular case, it appears that the complainant’s spouse filed a final return and entered the complainant’s social security number in the spouse portion of the return.? However, no earnings information was entered.? As a return had already been filed utilizing the taxpayer’s social security number for the tax year, Keystone’s e-file system prohibited the filing of another return using her unique social security number identifier? ? ? ? ? ? ? ? ? ? ? ? Accordingly, I have advised Keystone’s Information Technology Department of the issue, and the restriction has been lifted on the taxpayer’s accountThe complainant should now be able to electronically file her local earned income tax return on Keystone’s e-file system? ? ? ? ? ? ? ? ? ? ? ? the concerns of taxpayers.In their complaint, the taxpayer indicated that they had issues with their local earned income tax return and refundSpecifically, they stated that they did not receive their refund and this problem also occurred last yearI can confirm that this individual experienced issues with both their and tax refunds.In early I spoke with the taxpayer by phone to help resolve this issuePreviously, the taxpayer’s employer incorrectly withheld their local earned income taxes to *** City and not *** *** BoroughThis created some confusion when the taxpayer filed their returnWhen they submitted their local earned income tax return, a refund was not issued because the information provided by their employer led Keystone to understand that the individual lived in *** City and not *** *** Borough, which have different tax rates.After receiving the previous Revdex.com complaint, I contacted the taxpayer to explain the confusion, how the employer’s info listed them in the wrong residence municipality and why they had not received a refundAt that time, I ensured that their refund was issued.When I received the most recent complaint, I reviewed the individual’s accountOn their local earned income tax return the taxpayer provided the correct informationHowever, it appears their employer continues to submit their quarterly tax withholdings with incorrect informationConsequently, in the individual was recorded as living in *** City, which has a higher tax rate.I have contacted the taxpayer to explain this issue and encourage them to correct their employer’s informationUntil the employer begins providing the correct Political Subdivision Code (PSD) along with the taxpayer’s tax withholdings, this issue may arise in the future.I have ensured that the error is corrected, the individual’s return is now processed and a refund will be issued next week.Thank you for your attention to this matter.Very truly yours,KEYSTONE COLLECTIONS GROUPBy:Cody JH***, Esquire

In their letter the taxpayer mentioned previously filing their local taxes with ***I advised the taxpayer that *** served as the prior Tax Officer for the Northampton County Tax Collection District prior to Keystone’s appointment and described the steps Keystone takes in easing the transition between Tax OfficersSpecifically, Keystone mails residents informational materials including an official Keystone local earned income tax returnFurthermore, Keystone has a branch office in ***, located at *** *** *** *** ** ***, PA ***, which offers taxpayer assistanceFinally, taxpayers may learn more about their Tax Officer, as well as the applicable local taxes for their resident and work locations by visiting http://munstats.pa.gov? ? ? ? ? ? ? ? ? ? ? ? A review of the taxpayer’s account reveals some inconsistencies between their claim and what Keystone’s records reflectThe taxpayer did not reside in Northampton County when Keystone Collections Group was appointed as Tax OfficerTherefore, they did not receive any informational materials associated with the transition between Tax OfficersHowever, our records reflect that the taxpayer properly filed local earned income tax returns with Keystone starting in the tax year? ? ? ? ? ? ? ? ? ? ? ? Specifically, in the tax year the taxpayer accurately and successfully filed a local return as a part year resident with KeystoneThey filed their local earned income taxes on a Keystone prepared local earned income tax returnThis return included the taxpayer’s typewritten name and address as pre-populated by Keystone’s systemThis paper return also included the account number and a bar code unique to the taxpayer’s account.? Please know that there is no way a taxpayer can pre-populate this barcode and therefore it is conclusive evidence that the taxpayer received this return from KeystoneKeystone mails paper returns pre-populated with taxpayer information and unique bar code identifiers annuallyIt is only when a taxpayer files their return online using Keystone’s e-file system that Keystone stops sending the taxpayer an annual paper return? ? ? ? ? ? ? ? ? ? ? ? As the taxpayer successfully filed local earned income taxes with Keystone Collections Group on official Keystone paper returns as well as the online e-filing system since 2012, I cannot agree that they have never filed directly with Keystone, as they claimed in their complaintIn fact, I cannot find any evidence that they did not know that Keystone serves as their local tax collector?
