On 1/17/2016, CARFAX emailed the customer explaining that the vehicle was listed as involved in a police-report accident filed by the Gwinnett Police Department, under report number *** If the police department is reporting the accident in error, the vehicle owner would have to
contact the police department about making a correction

CARFAX receives vehicle history information from over 100,sources and loads million of new records into its database every day A CARFAX Vehicle History Report displays records reported to CARFAX and available for display in its Vehicle History Database As the CARFAX Report states,
not all information, including accidents and problems, is reported to CARFAX from all sources, which means that other sources may report problems that are not included on the CARFAX Report The CARFAX Report does not state that no previous accidents exist, only that no accidents were reported to CARFAX, that "Other information about this vehicle, including problems, may not have been reported to CARFAX," and that "Not all accidents / issues are reported to CARFAX." Therefore, CARFAX does not guarantee it will have all information for every vehicle and always recommends that the CARFAX Report is used as one important tool, along with a vehicle inspection and test drive, before making your decision about the vehicle CARFAX does not advertise a "'Buyback Guarantee' if it is discovered their reports were flawed." The CARFAX Report guarantees that no Salvage, Junk, Rebuilt, Fire, Flood, Hail, Lemon, Not Actual Mileage, Exceeds Mechanical Limits "title problems were reported by a state Department of Motor Vehicles (DMV) If you find that any of these title problems were reported by a DMV and not included in this report, CARFAX will buy this vehicle back." CARFAX stands behind the CARFAX Buyback Guarantee, and because no title problems have been reported by any DMV, the CARFAX Buyback Guarantee does not apply to this case If someone is claiming that the vehicle had prior damage which is making it difficult to sell the vehicle, that would have to be taken up with whoever is claiming the vehicle was damaged

CARFAX has already explained that the accident was reported to CARFAX by the police department The accident was not reported to CARFAX sooner because the police department had not reported it sooner to CARFAX I am not sure what other questions there are that we can address

The issue will be reopened and a manager will review the case and contact the customer

The accident was reported to CARFAX by a *** *** ***, and has been verified as belonging to this vehicle by Virginia Unfortunately, CARFAX cannot release the source or any verifying documentation per our agreement with the source.The accident has been reported and verified
and therefore must remaining on the CARFAX Report

The CARFAX Report will show open recalls Once a recall has been closed by the manufacturer, it is removed from the CARFAX Report If the customer believes the recall work was not performed satisfactorily, the customer should take this up with ***

On 11/8/2016, our customer support team email a link to view the CARFAX Report for the VIN the customer provided Today, we also issued a refund for $70.69, which will take a few days to appear in the customer's account depending on their bank's policies

According to the Police Accident Report # ***, there was an impact with the vehicle however no damage was observed by the officer The CARFAX Report states that there was an accident, but the vehicle was not damaged Unless the police report is amended to state there was no
accident, CARFAX must continue reporting the Police Accident Report as it was reported by the police department

As the customer confirmed, the CARFAX Report does not offer or advertise unlimited CARFAX Reports We are sorry if there was any confusion about the product The order page states, "Unlimited CARFAX Reports $/ Unlimited Reports by U.SLicense Plate / Valid for Days."
This is also stated in the Customer Agreement, the purchase confirmation page, the receipt email, and within the account itself Our customer support team received an email from the customer and responded on March adding an additional CARFAX Reports by VIN to the account, offering to add more if necessary, or issue a refund instead We did not hear back from the customer, but the customer has since run several CARFAX Reports

On March 8, 2017, our customer support team notified the complainant that the *** *** Insurance Company has verified that they did declare this vehicle as a total loss If this was done in error, the complainant must address this with the insurance company The rules for salvage titles are not necessarily the same rules used by insurance companies to declare a total loss, and it is not uncommon for a totaled vehicle to receive a clean title. I am rejecting this response because:It seems to me that Carfax is trying to avoid the questions1st Why is the report update years later? 2nd Why Is carfax showing and stating *** *** *** was the one that report the damage but can't provide any kind of proof? 3) Previous report clearly stating that *** *** *** fix the carAfter I contact ***'s and was told they never touch the car and inform carfax about what ***'s told meCarfax removed *** *** *** at the last report,Which means that the information carfax got from is inaccuratefirst Mileage error and carfax didn't even know that ***'s never did the repair until I notify Cafax. How you want me to believe that my car has structural damage? How come was not reported years ago when I bought my car? Last Carfax statingdamage to the structure was visible without the need to remove any panels or other componentsHow do you know? Can you provide proof? On 7/15/2016, CARFAX received an updated police report showing that the customer's vehicle was listed in error CARFAX removed the accident record from the CARFAX Report within minutes of receiving he updated information and the customer was notified of the update via email at that time

On September 18, 2015, CARFAX notified the customer that we verified that Florida issued the Exceeds Mechanical Limits brand in error, and thus the brand was removed from CARFAX's database
