CARFAX verified that California did issue a Lemon branded title for this vehicle The CARFAX Report is not in error, the brand is true and correct CARFAX did not report the brand in because the brand was not reported to CARFAX at that time The CARFAX Report in did not state that the title was not branded The CARFAX Report stated "There is no indication in our records that this vehicle has [a branded title] However, there may be other potential problems with this vehicle that have not been reported to Carfax."

CARFAX concluded its research of the accident on 2/27/2017, removing the accident and notifying the customer via email

The vehicle was listed as a 'total loss' on their website However, the vehicle has a clean title If was a total loss vehicle, it would not have a clean title

A Florida police department reported to CARFAX that the vehicle was involved in an accident The court papers only indicate that charges of careless driving against [redacted] were dismissed The court papers do not indicate that the vehicle was not involved in an accident The police report is an official document and CARFAX cannot misrepresent it Only the issuing authority, the police department, has the authority to determine if the vehicle was not involved in the accident and police report lists the vehicle in error The customer must take this up with the police department Once the police department issues a corrected police report, supplement to the police report, or letter of correction, indicating that the vehicle was listed in error, only then can CARFAX remove it from the CARFAX Report

A CARFAX Report would never say that a vehicle has never been in a collision If the complainant reads the CARFAX Report, they will see that it says that no accidents have been reported to CARFAX, and further state that not all information is reported to CARFAX, and therefore the CARFAX Report should always be used as one important tool, along with a pre-purchase vehicle inspection and thorough test drive, before making their decision on their next used car

In the late evening of August 10, 2016, the customer sent CARFAX a corrected police report showing that the customer's vehicle had been reported by the police department as involved in the accident in error The morning of August 11, 2016, CARFAX verified that the erroneous police report had been corrected, removed the accident report from the CARFAX Report, and notified the customer via email

CARFAX collects VIN-specific vehicle history information from thousands of sources and electronically loads that information into its Vehicle History Database CARFAX does not perform any data entry or inspect vehicles, and therefore every CARFAX Report states that it can only report that which is reported to it by its sources, upon which it solely relies A police department in TX reported an accident for the VIN of the complainant's vehicle The CARFAX Report correctly and accurately reported that an accident was reported to CARFAX, and therefore only the reporting agency, the police department, could determine if the agency submitting any errors to CARFAX On June 10, 2016, CARFAX received a letter of correction from the police department indicating that the source had made an error and that the VIN reported was in error CARFAX removed the accident from its database between Friday, June 10, and Monday June 13, according to the source's instructions

The CARFAX Report would have stated that no accidents were reported to CARFAX at that time, that not all information is reported to CARFAX, and that new information from new sources will result in the change the CARFAX Report. Therefore, CARFAX does not offer compensation when prior accidents... are reported to CARFAX.

The complaint indicates that the CARFAX Report stated "the electrical system and other components were in good working order." That statement, or anything similar to it, does not appear anywhere on the CARFAX Report The CARFAX Report actually states that the electrical system had to be checked by a mechanic several times (7/03/2012, 1/21/2016), and suggested that the vehicle should be inspected by a professional prior to purchase The CARFAX Buyback Guarantee is mentioned in only one place on the CARFAX Report: in the Title History section The CARFAX Report states, in that section, "GUARANTEED - None of these major title problems were reported by a state Department of Motor Vehicles (DMV)If you find that any of these title problems were reported by a DMV and not included in this report, CARFAX will buy this vehicle back." Thus, if the customer believes CARFAX missed a one of the listed title problems reported by a DMV, we will buyback the vehicle However, as clearly stated on the CARFAX Report, other problems with the vehicle may not have been reported to CARFAX and are not covered by the Buyback Guarantee
