I am rejecting this response because: They did not act in a timely manner. We had 7 days to void the contract and did not disclose the actual price we would be paying until a month later. You can see in the contract I have attached this stipulation as well as the date signed was 8/15/16. Then the date they sent out a mortgage paperwork was 9/21/16 over a month later with my wife attached. Also they said I was not approved by myself for the mortgage, doesn't that make the stipulation in the contract of not being approved for the mortgage kick in?

Dear Ms. [redacted] -  Thank you for the opportunity to look in the Revdex.com assigned ID [redacted].  Ryan Homes has reviewed the concerns outlined in the Revdex.com.  The consumer settled on his home in November 2012.  The Ryan Homes Limited Builder's warranty covers this issue for a...

period of one year.  Having said that, our Ryan Homes service manager agreed to review the concern outlined in the complaint on September 7th.  Our service manager explained the warranty but offered to open the wall (remove the drywall) and find the cause of the water but the remainder of the work would be homeowner responsibility.  A shrinkage crack  in the foundation wall was located and the Ryan Homes service manager offered to repair it as a good faith gesture; however, all other repairs would be the responsibility of the homeowner.  The consumer was unhappy with the offer and requested that Ryan Homes take responsibility of the full repair despite the limited warranty.  History of the previous leaks at this house:
• 1/31/13 Foundation shrinkage crack – near front of the home
• 7/11/14 Window leak – right side of home 2nd floor stairway window
• 9/30/15 Window leak – right side of home 2nd floor stairway window (repeat)
• 9/30/15 Basement welled exit door – left side of the home (threshold adjustment)
• 9/7/17 Foundation shrinkage crack – right rear of the basement. (current issue). The consumer is well beyond our warranty period for a foundation shrinkage crack repair. The leaks that are mentioned on the complaint are from other non-related leaks that have been addressed and show no signs that they have returned. Ryan Homes has lived up to and beyond our warranty for the consumer. No further action will be taken on this matter. The consumer settled on his home in 2007. Ryan Homes has offered to locate stone product and vendor contact information, however the consumer did not accept this offer. I am rejecting this response because:
After being told several times that a representative would reach out to me, we finally received an in person response on June 2, 2017. Ryan Homes refuses to take responsibility for telling us not to water the sod and is playing the blame game as to why we did not receive a response before June 1st. They are only responding to the Revdex.com complaint after they came out to the home almost a month later. Brandon came out to our home, was completely combative and only offered to lay sand in our yard. He interrupted me several times while I was speaking to him and even raised his voice to me in front of my husband. He even decided that it would be a good idea to let me know that his customer service rep stated that I called on several occasions and that I would call 'every hour on the hour' until someone called me back. Ryan Homes closed out my initial service request on 5/4 although no one can tell me who it was closed out by. We did not hear from Brandon until 6/2. The lack of accountability is extremely unprofessional and unacceptable. Word of mouth will definitely travel fast in regard to the level of service Ryan Homes provides to their customers after you close on your mortgage.

Thank you for the opportunity to look into the Revdex.com ID [redacted]. Prior to the receipt of this complaint, the consumer contacted our Customer Care on March 31, 2015. Ryan Homes Customer Care advised the consumer to have his concerns accessed by a licensed structural engineer. ...

Further, Customer Care explained that if there was a structural defect identified by a licensed structural engineer, it would be addressed under the 10 year Limited structural warranty. We received no further correspondence on this matter from the consumer.
While this home is now outside of the 10 year Limited structural warranty, Ryan Homes would be happy to review any supporting documentation from a licensed structural engineer as advised in March. I am rejecting this response because: Good afternoon and thank you for the opportunity to allow a rebuttal. NVR Inc./ Ryan Homes was given multiple Weeks and months to correct the negligence, and warranty issues from December 2015 to the present. Mr. A[redacted], Mr. [redacted], and Mr. [redacted] all agreed that April 25 - 29 2016 was the final completion of all damage, repairs, construction, and warranty issues either their subcontractors caused due to their negligence or the normal warranty issued caused by the homes settling issues (most of the issues for the construction was subcontractors errors or damage.) I personally have given more than a month of leave time from my job and command. The April deadline was even extended while I changed my schedule to accommodate Ryan Homes (April 25-May 5 2016) and even explained they could come on the weeks which I was told they don't do that. I have asked and was denied for them to be able to complete the damage and repair work on a weekend and they refused and advised that their guys don't work on weekends and we need to be more accommodating to their schedule if we want the construction to be completed. We have bent over backwards, stressed, have had mental and physical anguish and have even needed to seek medical care for our anxiety because of this issue. The opportunity has been there and they have either refused to complete the work or were unable to do so due to their negligence. My leave time is supposed to be for my wife and two kids before I am to go on a deployment or workups, but Ryan Homes/NVR Inc. have taken those weeks and months away.

Thank you for the opportunity to look into Revdex.com ID [redacted]. The consumer settled on their home in January 2008. The warranty for the roof and the foundation are for a one year period.

In the complaint, the consumer notes that Ryan Homes made a repair to their roof in 2011....

Our Ryan Homes service technician met with the consumer on June 30th and inspected the areas in question. The consumer confirmed there had been no leaks until the recent torrential rains. We did not find there to be a defect in the construction of the home. Our service technician provided guidance on homeowner maintenance to prevent future water intrusions. Ryan Homes believes we have satisfied our warranty requirement.
