Our sales and customer service representatives are trained on all of the intricacy's of the service which we provide We pride ourselves on the ability to gain traction for our clients through the ever changing landscape of local optimization We understand the challenges which are unique to each and every marketing campaign and each facet of our service can present its own challenges which need to be overcome in order to obtain results Are proven track record has established eGumball as an industry expert and we ask that the customer allow us to work with them to accomplish their online marketing goals Our customer service team has resolved many of the concerns which the customer has presented us and we have overcome many of the initial challenges designed to build a strong foundation for this customer We have resolved the customers concerns regarding an inaccurate directions and feel that we have proven our abilities to increase the consistency of the business information which is found online The duplicate data which, includes the information found on ***, is an ongoing process which is part of eGumball's regular dutiesWe ask that the customer allow us to re-address their concerns and illustrate the progress which has been made on the accountOur customer service team can be reached at [redacted] ext [redacted] Monday - Friday 7:30- 3:PST

[redacted] s entered into a six month agreement with our company on 08/09/ On 09/12/2014, the client callled in requesting a cancellation with no valid reason - in fact no reason at allWe believe the client experienced buyer's remorse Our agreements are front loaded with service - especially during the first month Without a valid reason we cannot honor a cancellation request - no reason was given As our terms and conditions read, eGumball is not a partner of Google or is owned by Google There can be some confusion with our "Google Partner" badge on our website though Google changed it Adwords Certification program to "Google Partner" for services that have passed a basic Adwords test in addition to meeting the minimum monthly spend requirements The clients claim that we "indicated we were part of Google or similar to Google" is subject to interpretation Responsibily this topic is clearly addressed and defined within our terms and conditions and our website footer Also it is unfair to suggest that our company did not perform any services during the first month since most of the first month is focused on strategizing the campaign and work scheduling The client never issued a complaint directly to our company prior to their cancellation request All of our clients have access to our control panel with campaign reports Lastly, on 09/12/2014, the client requested their account to be cancelled immediately and requested a closing balance for final payment On 09/20/we received the final payment On 09/23/2014, we called our client and offered to set the clients account to expire at the end of term instead of a complete early cancellation Client declined

eGumball is offering settlement in exchange for removing our Revdex.com complaint, [redacted] review and is forcing us to disclose to anyone moving forward that all disputes were amicably resolvedOur complaint is legitimate and they should terminate contract without us having to sign removal of reviews and disputes especially when they are validWe have been paying per contract and in no violation of our contract yet they continue to not provide serviceAgain, see attached settlement agreement that they want us to sign and the summary below in detailThank you!Settlememt Agreement: eGumball has agreed to cancel [redacted] ’s account [redacted] and send [redacted] a refund check in the amount of $via USPS mail within days of the execution of this agreement [redacted] has agreed to remove all online reviews posted about eGumball, Incwithin hours of the execution of this agreement [redacted] has agreed to close all Revdex.com complaints as resolved to [redacted] ’s satisfaction, within hours of the execution of this agreementIn consideration, all previously received payments from [redacted] to eGumball will stand as valid and verified chargesNo disputes or chargebacks are to be filed by [redacted] or anyone else on [redacted] ’s behalf against these settled amountsIf any legal actions have been filed by [redacted] , no later than days from the date of this agreement, [redacted] shall dismiss the action All parties agree to maintain the confidentiality of this Agreement and to not disclose the existence or terms of this Agreement to any third party except as required by law All parties agree that they will not disparage, demean, complain about or otherwise communicate any information damaging to the business or reputation of any of the other Parties, or to any third party except as required by lawIf an inquiry is made, eGumball and/or [redacted] may disclose that the parties’ “dispute was amicably resolved.”

We understand the customer’s frustration, but would like to reiterate that the customer did change their name in the beginning of service, which takes [redacted] and other search engines up to 60-days to register and is the reason why they did not see immediate resultsWe also have proof that this customer’s citations were updated last October when receiving the new business nameWe have been trying to get in touch with this customer to resolve this issue, which we are more than willing to do, but they have not accepted our calls or called us back

We have spoken with this customer who claims that they did not sign an agreement or contract with usHowever an [redacted] signed for the service (see attached), who is an agent and affiliate of the companyAs of this point, this is a matter of the customer and their company, not a lack of service or policy on our endIf the customer has any further questions, we ask that they call our customer service

We understand the customer’s concerns and hope with further communication, they can be resolvedWe offer a three day right to rescission, which allows customers to receive a refund within the first three days of signing the initial agreementThese requests must be received by fax or email, and requests are not permitted by phoneAfter the expiration of the customer’s initial term, when the account is monmonth-the customer may cancel their servicesThe exact details of our cancellation policy can be found on our Terms and Conditions section of our website at [redacted] The customer is required to check that they have read these Terms and Conditions before signing the initial contract with us We did not create a YouTube video for this client with any pop up adsIf the client is having problems with their YouTube video, this is outside of our agreement with the clientOne of our customer service agents attempted to contact the client about their complaints via email and phone on 9/18, but did not hear back from themWe welcome the client to contact us at [redacted] Monday-Friday 7:30-3:PST in order to further address their concerns
