Our salesperson asked the customer to come in on Friday 1/2/15, as the factory offer on the vehicle she was interested in (a Acura RDX) was expiring that dayThe customer arrived on Saturday 1/3/and was told the deal could no longer be honored as the offer had expiredPlease see the attached Acura bulletin regarding the vehicle she was interested in Our Client Relations Manager reached out to her with an e-mail as well

That’s lower than the previous price you were quoted for a 2WD Please let me know if you will be here in the morning to complete the deal His reference of whether I will be at the dealership in the morning meant very clearly that the deal would still be upheld on SaturdayThat prompted me to then reply that I will be at the dealership at 9:30am on Saturday to close the dealAll of these correspondences are documented in the attached email chain [redacted] also acknowledged this when I showed him his email agreement on Saturday that he made an offer that cannot be upheld due to miscommunications about the expiration of an incentivePer the Uniform Electronic Transaction Act (UETA) that California adopted in 1999, all email correspondences can be deemed as a legally binding contractTo provide a mutually accepting offer via email and over the phone on Friday night for me to come in on Saturday to close that deal and then retracting that deal when the customer arrives to the dealership is not acceptable and breaks the contractual agreement via email per the UETA Regards, Lucy Curtin

In response to complaint # [redacted] : With regards to Ms [redacted] ’s question about Pedersen Toyota releasing personal information we have attached Pedersen Toyota’s privacy notice that was reviewed and signed by Ms [redacted] at the time of purchase that articulates our policies Regarding the missing paperwork (We Owe) Ms [redacted] states they did not receive, Pedersen verified that a copy was provided at time of delivery In addition, the Mr [redacted] requested an additional copy on August that Pedersen provided via a fax as well as a mailed copy of the document We have also attached a copy of that signed document to this response for Ms [redacted] Pedersen Toyota has continued to try on multiple occasions to schedule the work that has been promised and has been unsuccessful in getting the [redacted] ’s to bring the vehicle in for the work needed We have offered multiple solutions to help Ms [redacted] including going to Wyoming to pick up the vehicle, drop off a rental car and then to deliver it upon completion In addition, while the “We Owe” document states the work must be completed within days of the purchase we will make an exception to that as long as we can get the work completed within days from the time of this response Pedersen again would like to emphasize we will be as flexible as possible in completing the work promised in whatever way is the most convenient for Ms [redacted] Pedersen again wishes Ms [redacted] the best of luck in the future and welcomes Ms [redacted] to contact Pedersen directly with any additional questions, concerns or to schedule the work that needs to be completed
