Dear Ms***: By way of background, First American Payment Systems is a credit card processing company that processes transactions for merchants set up by various Independent Sales Organizations, including Appstar Financial (“Appstar”)We are in receipt of Mr*** complaint. In response thereto we have enclosed the Merchant Application & Agreement (“the Agreement”) and the Merchant Processing Terms & Conditions (“the Terms & Conditions”) for your review. The processing account in question was set up according to the application receivedBanking information was supplied by the merchant for the inception of the accountOur records indicate that an ACH was attempted on July for the amount of $597.23, but that payment was stopped on this transactionNo other charges have since been attempted, and there is no record of a $transaction on this accountAs a gesture of good faith, the last month’s end of month fees and the contractual early termination fee have been waived on this account, resulting in the account being closed in good standing with no balance owedIn addition, there is no lease on this account*** Capital is the leasing division of First American, does not have a contract with the account holders on this account, and is therefore not involved in this disputeWe appreciate your attention to this matter. Well......once I complained here they called me and told me they would make it rightI came back on here and said they were going to make it rightThey commented they made it right BUT...……………………..still they have NOT answered my emails since that dayI told them I wanted the new rates in writing along with my daily high ticket increase They did fax me a paper over with some lower rates but other fees were INCREASED!!! When I questioned it guess what NO ONE WILL ANSWER ME BACK!!!!!!! When these merchants do this they should be OBLIGATED to let you out of your contract with NO QUESTIONS ASKED!!!!! It is not right to us to have to continue paying their RIDICULOUS rates when they do not do as they promiseI have called and left messages...no return callI have sent emails...no response but yet they were quick to put on here they corrected the issue!! WELL NO NOT REALLY!!!! What they said sounded good but the paper in black and white says different!!!!

Agreement on June 7, By signing, Ms*** acknowledged to have received, read, and be bound by the Agreement and the Terms & ConditionsThe early termination fee is clearly disclosed on the Acknowledgements page of the Agreement and in paragraph of the Terms & ConditionsOur records indicate that the account was closed because the contractual fees were rejected by the merchant’s bank accountThe early termination fee was assessed and paid by cashier’s checkThe account is now closed in good standingWe have no record of a lease on this accountThe equipment used by the merchant was provided as part of a loaner program, and has since been returnedThe merchant does not owe any money in connection with the equipmentWe appreciate your attention to this matter. Dear Ms***:I am in receipt of the complaint filed by BK Town Car Service. I have attached a copy of the electronic Merchant Application & Agreement and voided check provided by the business for credit card services in September of 2016. As a gesture of good faith we have closed

This company totally ripped us offI cancelled my account with them, after they tried to charge me more money for transactions, and a so called early termination fee for an automatic renewal that I never agreed toWhen I cancelled my account the rep on the phone never informed me about this fee, when common courtesy would have warranted itThe collections rep on the phone that works directly for the merchant was extremely rude as wellI would not remommend this company to any small business ever

FAPS/MM Thank you for attaching a complete copy of the contracts you forged to your response to my complaintThere are pages you previously omitted such as the Federal Form Wwhich you submitted to the IRS with the Wrong Taxpayer Identification Number as well as a signature which is the 5th one that also matches a forged signature on your falsified contractYou also make several statements of which I will address one, that in my phone call 08/24/I did not mention fraudThis is when I found that you forged contracts in my nameAnd this was discussed with your customer service department of which I have documented proofWhat FAPS/MM did not do is address any of the fraudulent charges in my complaint for which I have documented proof. My refusal to pay FAPS/MM is based on Documented FactsFirst American Payment Systems and *** are making a mockery of these proceedings and what I believe that the Revdex.com stands forThey know how to work the system and are often successful at getting small businesses to pay unjustified fees and penalties without any fear what so ever of they, themselves being prosecutedPlease put a stop to this, Thank You

I am being billed for an account that was created with First American processing without my consent
Sometime in a representative contacted me offering a credit card processing rate comparison I filled out a few basic questions on the website and was done Shortly after I learned they had gone ahead and started an account I contacted them immediately and cancelled the account and was told over the phone there would be no charges Now in I am being billed I contacted them again and they are not willing to remove the charges

Solutions (“Heritage”)Ms*** executed an agreement through Heritage for credit card processing servicesThe terms of this agreement establish the merchant is responsible for submitting a closing letter, at least 30, but no more than days, prior to the end of the term; otherwise, the contract term will automatically renew for an additional yearAs Ms*** submitted no such letter, the account automatically renewed for an additional yearThe account was closed due ACH rejects in June and the balance outstanding was automatically placed for collectionsPlease be advised that in an effort to resolve this complaint, the $balance outstanding on Ms*** account will be waived entirely and any reports made to credit for this balance will be removedWe ask that Ms*** please allow up to three weeks for her credit report to reflect the removalPlease let us know of any questions or if you need additional informationSincerely, *** ***

My complaint is the misleading process they did to acquire the signature I did not receive any copies from the sales personShe said she did not have any to give me AFTER it was signedI messaged her asking her for them and she has never given me copiesThe contracts that are referred to in the companies response or provided as a CLASSIC BAIT AND SWITCH TATICThe actual merchant terms contract is a page poin font document that is not provided to the customer at signingThe customer is asked to sign a completely separate document titled "Acknowledgement" which is also in small font and includes language that the customer acknowledges receipt of the page Merchant terms agreementIn addition, even if I had been shown a copy of the contract at the time of signing, the higher rated fees are not disclosed anywhere in the contractNot only did I not know the fees existed, but I didn't know what the rates were until I realize there was a statement that I had to find online and they were listed on thereI heard *** *** say on *** *** speakerphone, my rate would be $per month, 1% credit and 0% debit (I have spoken to another small business that was told the same right by *** ***) That rate is what I thought I was agreeing to and signing for and I did not know that I was signing a "contract" The fees on the statement start at 1.08% up to 4.18%I was paying 1.5% and 1.7% with my current company, which *** *** was made aware of because *** sent him a copy of it, so I would not have agreed to these high fees, a contract, lease, or early termination fees, had I been made aware of them I was also not in a contract or lease agreement with my current company, so I wouldn't have knowingly agreed to those terms with this company had I've been made aware of themI don't feel that I should have to pay $to cancel an agreement that the sales person and her up line intentionally concealed material facts, which created a impression of the agreement Once again a " CLASSIC BAIT AND SWITCH"! In the company's response they say that I wasn't charge for equipment and that it was a "loaner", then why was $12.36, $debited 6-20-17, $debited 7-21-from my bank account and I just received an email 8-23-from Ascentium Capital stating that they tried to debit $on 8-20- but the account was closed and now I oh them an additional $All of those charges were listed as "lease charge" on my bank statementThe equipment that First American Payment Systems sent to me required a wall phone jack, which I do not have, so I definitely didn't agree to that equipment They also debited $ 7-3-that was listed as annual feeWhen I spoke to *** on 8-2-about this charge, he said that it was for compliance and since I was a new customer, I shouldn't have to pay that and they would credit it back to my bank accountI have a recording of that conversationI WANT A REFUND OF $495, $compliance fee, $of lease fees, termination of any lease, contract, or fees, no affecting on my credit report and no more contact from MCG, First American Payment Systems and Acsentium Capital to resolve this complaint

Agreement on January 23, By signing the Agreement, he agreed to have received, read, and be bound by the terms of the Agreement and Terms & ConditionsOur records indicate that a transaction far above the contracted amounts for transactions as approved by the bank was attempted on December 17, and was rejected and returned to the cardholderMr*** approved high ticket is $and the transaction attempted was for $7,The loss prevention department, who handles those kinds of transactions, ruled the transaction was too high risk and must be reversed As our records show, Mr*** had his banking information changed without informing the company first (please see paragraph in the Terms & Conditions regarding Payments), leading to ACH rejects which automatically closed his account and sent his balances for collection on January 11, 2017, along with the $contractual early termination fee because his account was still within the original three-year contract (please see paragraph in the Terms & Conditions for term length and cancellation fees)In a gesture of good faith, we will agree to accept payment of $to settle the $balance owed to First American Payment SystemsThis payment can be made by contacting *** *** at ***Mr*** request to not deal directly with *** *** will be honoredWe appreciate your attention to this matter. Although I don't have direct account with First American Payment System, it does not mean that they have the right to ask me to expose unnecessary personal information to them via ISOMERIC PHARMACY SOLUTIONS and subsequently delay release of medical supplies to my practice.

I reject this resolution.  I mailed the notification on May 4th, 2015.  Since this letter has not been returned to me as undeliverable in the 107 days since I originally mailed it, I have no doubt that it arrived.  I had almost two months before the contract was up; I did not feel the need.  It is in their best interest to claim that is did not receive it in order to steal this money from my account.  This is a blatant tactic to excuse themselves for their thievery.   I waited until the end of my three year contract to end my agreement.  I could have closed out the company checking account and opened a new account thus eliminating them any access. I did not do so because this was not our agreement.   I conduct my personal and business life with integrity and expect them to do the same.  I want my $755 returned.
