First American has apparently set up a fraudulent processing account in my name I am not and never have been a business owner so I have no need for merchant processing services for credit cardsI tried to tell the collections personnel that it appears that I am the victim of identity fraud and the response was"as far as we are concerned its your account and your are responsible for the bill"When I asked if there was a fraud or disputed process I was told there was none

I am writing today to file a complaint against First American credit card processing company and my sales representative, *** *** *** *** She presented a service, had me sign paperwork, then did not follow through on what she promised
*** stopped into my restaurant early November claiming she could save me money on my credit card processingWe discussed my current rates and reviewed a credit card processing statement We went through the fees we were being charged by my current processing company and how her company, First American doesn’t charge those rates It would be a flat $monthly fee for the terminals and a flat percentage based on how I accept credit cards 0% if I used the credit card terminal she provided and the chip in the card, 1% if I swiped and 1.5% if I typed in the number I explained to her that I would have a $cancellation fee if I cancelled with my current procing company and she assured me that she would pay this once I received

Contract not executed and told the sales person that I am not interested in pursuing a contract with this company after he disclosed the pricing for credit card processing, and he proceeded to falsify the application and the company is holding me accountable for what the sales person did

We were contacted by a sales rep with First American Payment systems He told us that they could process credit card payments for a tenth of a percent plus $per month He said there was no contractsWe decided to sign up with them Within a two weeks of signing up they billed us $to process one credit card payment When we called to see what was going on they told us that there was all these other fees and that's it was stated in the contract We told them to send us a copy of this contract that we had no idea existed They sent us a contract that we hadn't signed We told them we want to cancel our service with them and they told us it would cost $ We said we wouldn't pay that and we put a stop payment on our checking account for anything that came from First American Then under a different identity (their in house collection company) they stole over $from our account The only reason they have an A+ rating from Revdex.com is because they pay for it Do not work with this company They are dishonest !

We were contacted by a woman from Texas named *** *for Merchant Services, Inc She told us that she was the credit card processing wholesaler to *** which is our financing company who also processes our credit card transactions *** claimed that *** was overcharging us fees and that her company (at the top of the processing chain, implied) was aware of it and was going to take over our account to get us a better rate with even retroactive payments of overcharges We were wary but she seemed to have the knowledge of our current billing in card processing Then, we sent her our billing statements from *** card processing and that's where she laid it on thick
She said she would be getting us a much better rate at cents per $spent with a card transaction fee of cents I filled out the contract that was with First American, indicating that we need a $requested ticket size We were not entirely sure of this woman and told her so At some point,

We are in receipt of Mr***’s complaintBy way of background, Merimac Capital (“Merimac”) is the leasing division of First American Payment Systems providing cr**it card processing equipment to merchants These leasing services are sold through Independent Sales Offices, including Payscape
Advisors (“Payscape”) In response to Mr***’s complaint we have enclos** a copy of the Non-Cancelable Commercial Lease Agreement (“the Lease”) and the Terms & Conditions for your review On September 7, Mr*** sign** the Lease with MerimacBy signing the Lease Mr*** acknowl**g** that he had receiv**, read and agre** to be bound by the Lease and the Terms & ConditionsMr*** unconditionally guarante** full payment of all obligations under the Lease (See page of the Lease) Further, page of the Terms & Conditions clearly states that the Lease is not cancelable by the Lessee under any circumstances during the term. Our records show that Mr***’s Lease was fund** by Merimac on September 24, for months with a base payment of $a month plus taxes and insurancePlease note that this Lease is separate from any other AgreementsOn February 1, our attempt to debit the contractual lease payment was reject** Therefore, the remaining Lease payments were accelerat** and the balance was plac** into collections in the amount of $(payments of $and $for equipment not return**). My company had a credit processing serviceFirst american is the payment contractors for the company I was contracted toI was being overcharged every month by these people and could not get it stopped even after the account was closedI placed a stop payment on them with my bankAbout weeks later I receive a phone call from their collections department and that had to be the rudest person I have ever been in contact with in my lifeShe was demanding payment from me right now and threatening to ruin my creditAfter a couple of minutes of this nonsense I told her to go ahead and send it to legal collectionsThat was on 1-22-I received a letter on 1-24-that had run through the post office on the 22nd but had been back dated to the 14th stating that I owed way more than even the remaining balance of whatever account they thought was still openSo I sent a few emails and made a couple of phone calls trying to get some help with proving that my account was in fact closed and that I did not owe anybody anythingMonday came around 1-28-I called first american back because the other companies involved will not call first american and get payments stopped apparently, so I get the same Crystal W*** on the phone and she is once again the rudest lady I've ever dealt with in my lifeShe had been told that my account was closed and that I owed nothingBut, she refused to give me a confirmation in written form until later that afternoon when one of the contractors called her and requested a confirmation sheetI hope you never have to do business with them and maybe with all the money they stole from me they will get crystal some anger management classes!!

Fees have been automatically taken from my business checking account from to The monthly charges ranged from $up to $per month During this entire year period I never once used their services There was zero activity on my account In I stopped using my account with First American Payment Systems in 2012, and I was under the impression that my account with First American Payment Systems (FAPS) was closed They deceptively continued to charge my account by using another name in the charge description That named was "Bankcard." We opened our business in 04/and contracted *** *** of First American Payment solutions to be our Merchant provider for our Credit/Debit cards In 06/2017, We added EBT cards to our service First American set us up to begin taking EBT cards When we received our statement, we realized the transactions for the EBT sales were not being deposited into our bank account We called *** *** immediately and he said they failed to take the terminal out of practice mode when they set us up This resulted in over $of our product walking out the door without compensation After several months of communicating with *** via email and phone conversations, he finally sent us a check for $around 11/ We have made numorous attempts to contact him, via phone and email to determine when he was going to pay us the remainder of what he owes us We have left several messages and he will NOT call us or email us back! various independent sales offices, and Merimac Capital (“Merimac”) is the leasing division of First American, leasing credit card processing equipment to merchants We show Ms*** executed two separate merchant agreements for two separate processing accounts with First American for credit card processing services, acknowledging by her signature that she had received, read and agreed to be bound by the terms of the agreementThese terms do state that the initial contract term will be years and the merchant needs to submit notice of non-renewal no less than 30, but no more than 90, days prior to the end of the year term; otherwise, the agreements will automatically renew for an additional one-year termAs such notice was not received, both accounts automatically renewed In October 2017, Ms*** notified First American of her desire to close both accounts; however, this notification was outside of the period stipulated in the agreement and therefore subject to early termination feesThe accounts were closed in October and our records show the effort to debit the contractual fees was rejected by the merchant’s bank due to stopped paymentThe accounts have therefore been placed for collection of the outstanding fees, which to date have not been satisfied Further, Ms*** entered into a Non-Cancelable Commercial Lease Agreement (the “Lease”) through Merimac for a term of months for processing equipment in July 2015; a copy of the Lease has been enclosed for referenceBefore the term of the Lease was fulfilled, Ms*** stopped payment on the Lease therefore the balance was accelerated per the terms and conditions and the amount in collections on that account is currently $ We appreciate Ms***’s business and would like to resolve this matter amicably; as such, we will agree to waive the balance on the processing accounts and settle for payment of the $lease balance provided payment is received no later than Wednesday, November 29thMs*** should contact Scott Morrison at *** to arrange payment Thank you for your attentionIf you need additional details, please do not hesitate to contact us Sincerely, Merchant Relations
