In February we signed contracts with App Star Financial's representative who also provided contracts to sign with *** (aka First American)The rep was signing contracts for my father in laws businesses as well and they put my father in law's name *** *** in a contract for the business belonging to my wife and I, *** ***In addition to sending equipment that did not work and had to be swapped out multiple times because we asked for a wifi enabled machineThey did not have such a machine and sent us a credit card machine that worked off of a land line and ethernet cableWe do not have ethernet and only wifi therefore the machine only work on the landline and even then it did not work reliablyWe have the same problem at Pristine Organic ***However, since our tax ID is under my name and my wife's company the contract is void as *** *** has nothing to do with this storeWe asked App Star to cancel this contract and *** which has privity of contract

In December of I received a phone call from, who I thought was my current processing company, Merimac Capital The salesman, who no longer works for the company, stated he had to ship me new equipment I am a quadriplegic year old man who is used to an old school handshake to do business This young man over the phone told me he was shipping new equipment and just needed to confirm my banking information because they were doing updates He sent me a form, I never signed this form He told me to type my name in and apparently what I am finding out now, was I signed a month contract I personally didn't even type my name in because I am unable to use my arms At this point I was unaware of the trap, so I began conducting business as usual So when I received the equipment I had one of my workers set everything up A few months went by and all of a sudden "SECURE" my actual processing company called me and asked if I went out of business They wanted to know why I wa

Dear Ms***, We are in receipt of Ms*** most recent comments regarding her complaintMs*** signed a 48-month Non-Cancelable Commercial Lease Agreement (“Lease”) on July 21, (Please see documents submitted to the original complaint)The Lease clearly states the term in months on the first page under “Schedule of Payments.” The company has, in a gesture of good faith, waived the last months of the lease payments for Ms***Even after Ms*** defaulted on the Lease and the entire balance came due, we again extended the offer for Ms*** to make payments to satisfy her obligationThe Lease cannot be waived, and Ms*** owes a total of $to settle the balance of the remainder of the shortened lease plus her processing fees for July and a return feeWe will continue to honor the agreement we made with Ms*** to make monthly payments toward the Lease balanceMs*** may provide credit card information to *** *a* *** or may mail a money order, cashier’s check, or regular check to *** Mat *** *** *** *** *** *** *** ** *** as long as the payment is received by the 15th of each month to be credited towards Ms*** balanceSincerely, Merchant Relations

Sales repwas not honest about this companyWhen I contacted my contact person, she informed me the issue was taken care of,which it wasn'tWhen I sent a fax (which is what I was instructed to do to cancel my account}, I was still charged for the next monthThey stated they had not received my fax, because it went to a different deptThey said once I sent a fax I needed to call back the next day to make sure it was receivedI stated I thought whomever received the fax should make sure it went where it was sent toAll you get from this company is the run aroundThey charge you for services they don't provideI am a small business owner, whose store was in the major flood in June (the governor declared the flood a disaster) I was looking for a business that could help me save on costs, but what I got was a company that allows their sales repsto deceive you

I am rejecting this response because: First American Payment Systems has done too much damage and almost nothing to fix itThey took money out of my account without permission (no contract) and wasted so much of my timeThey have not done what I asked to make this a fair completion to the nightmare they have caused.

I closed the account because I could not justify the charges for the amount of usageI asked them not to charge the stopping fee of $as they failed to notify me of the automatic renewal date in August (I would have discontinued at that point if I knew) They went ahead and took that money anyway They also charged me $in monthly fees for processing charges, the majority of which was for a $12,000+ charge that they processed but never deposited into our company bank account They told me that amount was too high and that I had to provide documentation to prove that we were not a risky customer and that would take 3-days to process with no guarantee of success Upon that information I told them to cancel the transaction as this was time sensitive They have charged me twice for a charge that I never received This is unethical behavior and I cannot get them to take responsibility for it - they can take the money but they tell me I have to wait for the monthly report

First American processed a charge for a merchant with which I regularly do business They contacted me to verify the legitimacy of the amount and of the charge I confirmed that all was correct They did not release the funds to the merchant and told the merchant that they would be holding the funds for a month This leaves my money tied up with a credit card processing company instead of clearing my account with the merchant who is entitled to the funds The merchant told them to credit the amount back to me but that still does not show as a credit on my card This credit card processing company has had use of my money for more than a week even though the funds do not belong to them

I am rejecting this response because:Dear Complaint Resolution Department,***’s response by paragraph to FAPS’s rebuttal: ParI was already in the PCI systemI would appreciate a copy of this “Signed” survey as I am confident that it is a SIXTH SIGNATURE MATCH that you “lifted” OFF AN EXPIRED CONTRACT FROM and fraudulently put on a contractI was charged over a hundred dollars a year for PCI plus service fees which my current provider does not do! ParI in fact have witnesses and documented proof of issues with exorbitantly High Fees, with non-compliant non-functioning Chip Readers as well as the 2nd terminal being inoperative which I had been attempting to return for MONTHSParOF COURSE NOT! I only found out about the forged FAPS/*** contracts because I canceled their servicesIn I was told by their agent that he was moving my account from *** *** *** to FAPS without signing a contract under the pretense of getting better rates (did not happen, in fact they were much higher and precipitated me to cancel service) IN EIGHTEEN MONTHS FAPS/*** MADE over SIX THOUSAND DOLLORS BY COMMITING THIS FORGERYParOF COURSE! As I previously stated I only found out about these forged FAPS/*** contracts because I canceled their services.ParAnother statement from FAPSI always had use of one “free” processing terminal, I have documented proof I received the “bar” terminal on a month to month basisI have documented proof and witnesses of problems we had with it and I tried to return it several months ago. AGAIN, I DID NOT SIGN A MONTH LEASE! ParThe documented Facts prove “lifted” signatures(Thanks for providing me with the term used to produce forged contracts) And the “ink smears and other signs” were evidently done during the signature “lift” process and perhaps in an attempt to disguise the forgery. ParI will not contact *** *** by phone, giving him additional undocumented opportunities to lie to meI have recordings of several threatening messages on my home phone left by *** ***All further communication has to be in writingParI find it very convenient that FAPS claims “This matter is closed” Is this up to the Revdex.com or FAPS to determine closed? American Payment Systems (“First American”) is a credit card processing company that processes transactions for merchants set up by various Independent Sales Offices, including TransOne Merchant Services (“TransOne”)Mr*** signed the Agreement with TransOne on May 21, By signing the Agreement, the merchant agreed to have received, read, and be bound by the Agreement and the Terms & ConditionsIt states in paragraph in the Terms & Conditions that in order to close his processing account, that the merchant would need to send notice to close in writing, with the account signor’s signature on the letterWe have received calls to close the account, but never received a closing letter, and so, to date, the account is still activeFirst American had been processing payments for Mr*** for three years by 2011, and had always been using the name “Bankcard” for the ACH monthly chargesFirst American in no way intentionally deceived Mr*** specifically to hide its identity when it continued to use the same ACH label as it always had in the pastAlso, Mr*** had online statements, which he was well aware of while he was still processing transactionsHe called on January 26, and received information from the Customer Service Representative on how he could view his statements onlineBecause the merchant knew how to view statements online and had already done it, he should have been able to log in at any time and view the statements every month from forwardFirst American did not in any way purposefully withhold statement information from Mr***As a gesture of good faith, it has already been offered to Mr*** that if he send in his signed closing request, we will close this account with no penaltyMr*** can send the request to *** or he may fax the request to ***Because the contractual charges per month are valid, there will be no refundsWe appreciate your attention to this matter. I signed up with their partner blue dog because their sales department promised me and told me that there was no cancellation fees, no hidden charges, or other types of fees that I would have to worry about Sadly there was no contracts that I signed or received like other merchant services like first data and payment alliance For reasons I will not mention I had to cancel my service, which is when I found out that blue dog created two different accounts, that first american is the actual merchant service being used, and that there is a cancellation fee I called on the of Oct when they informed me about the cancellation fee and I cancelled the accounts on the of Oct I informed them that I had to close my bank account and have to send them money orders in which they provided me the address to ship them to I asked if there was any additional fees or cost I needed to pay for the account and they said no I only had to pay the I made the two money orders for pl

processing company that processes transactions for merchants set up by our various Independent Sales Offices, including Apex Merchant Group (“APEX”)We are in receipt of Ms***‘s complaint. In response thereto we have enclosed the Merchant Application & Agreement, (“the Agreement”), the Merchant Processing Terms & Conditions (“the Terms & Conditions”), and the Non-Cancelable Commercial Lease Agreement (“Lease”) for your review.
