I am rejecting this response because:as a mention before I did sent them a fax to the number that is on the contract ,and them I contacted 30 days after and they said that the fax number on the contract was not a working fax number anymore ,so they provide the new fax number and said they would honor the cancelation.months later they kept harassing me after I explain this to them.

We
are in receipt of Mr. [redacted]’ complaint.  In response thereto we have
enclosed the Merchant Application & Agreement (“the Agreement”) and the
Merchant Processing Terms & Conditions...

(“the Terms & Conditions”) for
your review.
Mr.
[redacted] executed an agreement with First American Payment Systems (“FAPS”) for
credit card processing services on June 13th, 2014, and
electronically signed documentation agreeing to have received, read, and be
bound by the Agreement and the Terms & Conditions (See, pages 3 and 4 of the Agreement). This Agreement was for a
three (3) year term with one (1) year auto-renewals unless terminated by the
merchant in line with the Terms & Conditions; termination outside of these
guidelines is subject to an early termination fee of no less than $495. (See, ¶23).
By
way of background, several security measures are performed to ensure the
identity of the merchant is validated in order to submit an online
application.  The online submission
process is initiated by the sales representative who completes the required
information on the application using the information provided by the merchant. Upon
completion, the application is submitted to the merchant by email for review
and approval. The email received by the merchant contains step-by-step
instructions for submission of the application. These instructions include
several security questions the merchant must answer correctly to validate their
identity and access the application. Upon access, the merchant reviews the
application, which clearly shows the rates and fees and terms of the agreement.
The merchant must check several boxes acknowledging acceptance of the Agreement
and its terms and conditions. At the end of the electronic form, the merchant
is provided the option to accept the application by filling in their name, or
decline the application and provide a reason. Once the merchant fills in their
name, the electronic signature of the merchant is acknowledgment of the
agreement and the IP address of the device used by the merchant to accept the
application is recorded and stored for further verification.
Mr.
[redacted]’ account became active on June 16th, 2014. Our record
indicates that the IP Address associated with the account matches the location
of Mr. [redacted]’ business. Our record also indicates that Mr. [redacted]’ account
was used to process transactions for a total of $19,615.61. Upon receipt of a
written closing request, Mr. [redacted]’ processing account was closed on June 1st,
2015; this closing date is subject to an early termination fee (See, ¶23 of the
Terms & Conditions). Debit attempts on Mr. [redacted]’ account were made to
collect the early termination fee as well as the end of month fees for May, 2015,
but both debit attempts were rejected by the bank; Thereafter, Mr. [redacted]’
account was placed into collections for the contractual fees outlined below.

a gesture of good faith and in an effort to resolve this matter, we will extend

make payment arrangements.

I signed this agreement however I did not terminate my agreement early.  I notified them in writing dated May 4, 2015 to end my agreement with them June 30, 2015. I allowed them to take their last $30 payment then put a stop payment on future payments.  They entered my account under a different business name (Merimac Financial) and took $755 out of my account.  My 3 year agreement was up.  I notified them by calling first, then in writing per their request.  I was told they would not accept phone or email notification so I mailed the notice; I do not have a fax. Had First American not tried to take additional monies out of my account after the contract had ended they would have no casue to charge me a $30 returned draft fee or $200 collection fee.  Since I did not terminate my agreement early there should be no $495 early termination fee.   I acted with integrity per our agreement and I expect them to do the same. I did an online search on this company since this has happened and found over 100 complaints claiming dishonesty and fraud on the part of First American - https://www.cardpaymentoptions.com/credit-card-processors/first-american-paym...  I have been told that the Revdex.com in Fort Worth, TX have had over 500 complaints regarding this company.  I understand that this information has no bearing on my particular case other than to show a presidence.[redacted]

We are in receipt of Ms. [redacted]’s additional correspondence.  Again, Ms. [redacted]’s account was created under the Agreement that was executed electronically.  However, as a gesture of good faith and, to resolve this matter amicably First American has agreed to refund Ms. [redacted] an additional 90 days of fees ($167.55).  Please allow 3 -5 business days for this refund to be received. We appreciate your attention to this matter.  Should you have any questions or need any additional information, please do not hesitate to contact the undersigned directly.

First American has received the equipment from Ms. [redacted] in good condition. Also, Ms. [redacted]'s merchant account and lease account have been closed with no penalty. At this time, we feel that we have satisfied Ms. [redacted]'s demands and hope that she finds these actions satisfactory. We thank Ms. [redacted] for being a merchant with us, and hope we have shown that we work hard to settle problems and take care of our merchants. If you have any questions, please contact me directly.  [redacted] Merchant Relations Specialist

Their representative, [redacted], was never supposed to put the application in.  It was always supposed to be placed on hold until I gave her the ok.  I have emails from [redacted] stating that she is supposed to put in on hold.  She has emailed me several times in December and January stating if I am ready to move forward, and I told her NO.  The representative had illegally put my paperwork through First American Payments without my permission so she can get her commission.  In the email, she also states there will be no termination fees and it is month to month.  The only time there is a termination fee and contract is if they buy over my other merchant account which they didn't.  All of this is in email.  Jennifer [redacted] illegally put my paperwork through the system eventhough I told her not to.  She pressured me to sign the agreement and said it will be on hold until I am ready.  I never thought she would put it through.  Many other people on Revdex.com had also stated that this company's representative pressured everyone to sign right away and let the customers deal with the after effects even though we said we are not ready.  I think the company fraudulently put my paperwork through.  I repeat, I have over 10 emails between me and them stating I am not ready and do not do anything with my application!

Additionally, if the Agreement is terminated prior to its anniversary date, it is subject to an early termination fee. See Terms & Conditions ¶23.  You are now past the thirty day window but, if you will fax a signed letter requesting closure of account directly to me at [redacted], I will agree to waive the early termination fee as a gesture of good faith gesture. This company held my funds that were to be sent to the merchant.  I called them and complained.  They are now hiding behind a smoke screen by saying they can not address the complaint without details which I cannot provide over the Revdex.com website per website instructions.  They have done this to more than one person as shown by other complaints.  They should not be allowed to hold funds for 30 days and affect relationships between customers and merchants without recourse from either buyer or merchant.  I cannot understand how this company with so many complaints achieved an A+ rating from Revdex.com.

I am rejecting this response because:All dealings with any credit card charges that are processed manually at our office are processed by First-American.net.  It is also this company that I have called regarding the charge.  If the charge is Elliot Management then why is everything (internet and phone) referred to as First-American?  If First American deals with Eliot Management then they should be the ones dealing with Eliot Management - my contract is directly with First-American and the fees I am charged are made and taken by First-American.  I most definitely do not accept this very obvious attempt to offload my complaint and not fairly represent their customer.

We are in receipt of Ms. [redacted]’s most recent correspondence regarding her account with First American Payment Systems (First American). First American has provided the electronically signed   Agreement and the acknowledged Terms & Conditions between Ms. [redacted] and First American.Our records and responses indicate that First American has refunded an initial three months of fees in the amount of $172.50, and to remain amicable with our merchant we have refunded an additional   three months totaling $167.55. Finally First American has waived our early termination fee of $495.00 to allow Ms. [redacted] to close her account at no additional expense to her.In reference to Ms. [redacted]’s request we will stand by  our previous decision.
