I am rejecting this response because: I fully concede that oversights happenMy concern also lies upon how this situation was dealt withEven when I pointed the issue out to both of the gentlemen at the facility and then it was further explained to the person on the phone (Lydia, not certain who she is), the answer given to me was simply, "it doesn't matter whether it is in the contract, that is our policy"There was not ONE person willing to get down to the bottom of itI myself had to submit an e-mail enforcing my cancellationThere was no sense of customer service and essentially, hands were thrown up in the air as if to say "oh well"That was thatI had no other option, than to electronically sign the cancellation agreement, which also displays different language than that included in the agreementAt which time, I declined signatureIt is hard to believe that numerous oversights could get passed a legal departmentI should hope that customers are treated more fairly in the future and that you have knowledgeable associates that are fully versed in the contract with which they are imposingI understand that getting consumers to sign up and be part of your program is important to your bottomlineBut there must be a certain level of respect for the people supporting your livelihoodBusiness ethics comes to mind
The complainant signed a month committed Membership Agreement, meaning monthly dues payment Her billing did not start until 4/1/ although she was using the facilities in March of In August her membership was put on hold for month of usage and should have been
billed but due to a technical error the billing was also put on hold The error has been corrected and as of March 1, the required month obligation has been met and the "frozen time" has been applied to the membership allowing use of the gym until 4/30/with no further billing.A copy of the cancellation request dated 2/27/is included along with original Membership agreement, payment history, usage and freeze request This matter was already brought to the attention of this office when our operating system would not allow the cancellation on 2/and the club manager notified this office where the missing 12th payment was discovered on 2/and applied to the membershipThe club manager was informed of the discovery and the process needed in order for the membership to be cancelled
The account that was opened with ***'s would never have been terminated by them with a balance still dueSince themembership transferred into Fitness Evolution's system in April of with a balance, the account charges all remain validA member's request to close a membership when there is stilla balance due on the account, would not have been granted by ***'s or Fitness Evolution

I do apologize for any confusion however the cancellation procedure is clearly outlinedI can assure you that we are not misleading you or trying to take advantage of youThis is our policy regarding cancellation and it applies to all members. All termination request need to be submitted
either via certified mail or in club with a Manager. At this time your account is terminated and not further action taken. I have blocked any email, calls, or text that we have on file to not receive any advertising

I am rejecting this response because:This information is completely false, my wife went into the business in June of
to cancel my membership and they said they would take care of cancelling it. It was not cancelled, I have called many times since then to cancel, every time they state it will be cancelled and then I am charged again. This very frustrating because everyone I spoke to said they would take care of in and they did not. When I called after my wife went in there in June no one stated to me that I could not cancel over the phone either. If you check on this businesses *** page you will see they make a practice of doing this to many of their clients

In his complaint *** ** states that he cancelled both his and his wife's membership in April His wife’s signed cancellation request is dated 2/16/and according to our records *** ** was not present in the gym in April, however we have him
logged in thru July 2013.According to our contract each member who signs to join must also sign to cancel thsir own membershipWhen *** ** provides a signed cancellation request his billing will discontinue after the required day notice policy and his membership will be cancelled provided he has cleared his balance.Should there be any further questions, please contact our office.Sincerely,Sheila KBilling Manager
I'm not sure who agreed upon major renovations before the membership was signed but there are no notes in regards to this on either the agreement its self or on the membership account I do show notes a call was made and they did inform you on how to properly terminate the membership
All termination requests must be done either in club with a manager or via certified letter mailed to the facilityThere is a full day notice needed to do so, any and all fees due in that day period will be owed There will not be a refund issued

Per Mr***'s complaint, he signed a contract and a cancellation form at Fitness Evolution, "the exact same thing the previous year" The membership he had the previous year shows a contract and a signed cancellation request Both of these electronic forms are automatically emailed
from a Fitness Evolution account to the member when they are signed The membership for shows a signed contract which was emailed to him when he signed (with the same email address used the previous year) and no other files A check of his email history would illustrate this pointThe contract states the need for cancellation in writing and we have nothing on file As a courtesy we did cancel the membership when the member called in late October but held him to the terms of the signed contract which states a day notice required to stop billing It is our policy to accept cancellation only in writing - not by email or verbally - and this is explained during the sign up procedure as well as in separate locations on the contract No refund is warrantedA copy of Mr***'s signed contract is attachedSheila K***
