customerIn accordance with the terms of the loan agreement, Green Gate lent *** *** $and the customer agreed to pay back the loan in installments
In her letter, *** *** questioned whether we are licensed to do business in her stateFor clarification, as stated in *** *** loan agreement, upon her signature and acceptance of the Loan Agreement, the customer entered into a Loan Agreement with a Federally Recognized American Indian Tribe and as such, the laws of the state where she resides are not applicable to this loan agreement. Green Gate Services is a legal tribal lending entity offering installment loans to consumers and is not violating tribal or applicable federal laws
For clarification, *** *** borrowed $and, to date, the customer has paid back $450, so the customer has not even paid back the principal that she borrowed. Additionally, the customer does not owe thousands of dollars*** *** had the option to pay only one finance fee if she paid off her loan in full on her first due dateOr, in addition to the finance fee, she could have applied additional funds to the principal balance, which would have reduced subsequent finance feesOr, lastly, the customer could pay the finance fee only, which would not reduce her principal balance or subsequent finance fees, which the customer elected to do on her first three payments.
*** *** next payment is due on June 23, 2017. Notwithstanding the fact that this loan is legal per the terms of the customer’s executed consumer Loan Agreement, provided *** *** positive payment history, as a courtesy, assuming the June 23, 2017, payment clears, Green Gate Services will waive the remaining balance on the customer’s account, and we will consider the her loan settled, so long as the customer considers this matter resolved.

lent *** *** $and the customer agreed to pay back the loan in bi-weekly installments
On her first due date, *** ***'s funds were returned due to the customer placing a stop payment on Green Gate ServicesAt that time, as a courtesy to the customer, we stopped applying additional finance feesInstead, we asked that the customer pay back her principal balance, the past due finance fee, and one additional finance for the period in which her payment was returned, which the customer agreed to do after working with an Account Specialist
In total, *** *** made successful payment using her debit cardOn the fifth payment, however, payment did not clearSince then, the customer was contacted by a Manager and arrangements have been establishedAs an additional courtesy to the customer, Green Gate waived the remaining fees on the customer's account and 20% of the remaining principal balanceIn return, the customer agreed to send a money order, at which her account will be marked as SETTLED
Per the customer's request, *** ***'s work number, which the customer provided upon being approved for her first loan, has also been marked as "do not disturb"

Due to the fact that *** *** does not have an account with Green Gate Services, we are unable to provide any account detailsGreen Gate has attempted to contact the account holder on multiple occasions, but he has not yet returned our callsWe are happy to get this matter resolved, but we
need to speak with the account holder and get authorization to work with *** directly In the meantime, we will not be debiting the customer's account any further and will have an Account Specialist work the account holder

*** *** agreed to the terms and conditions of a loan with Green Gate Services, LLC (“Green Gate”) on September 7, All loan documents were properly
executed by the customerIn accordance with the terms of the loan agreement, Green Gate lent *** *** $and the customer agreed to pay back the loan in installmentsHad the customer not selected the boxes within the loan agreement, her signature would not have been accepted
Regarding the ability for the customer to revoke authorization, beside the check box for ACH authorization in *** ***’s loan agreement, it states:
“By checking this box you hereby AGREE to the terms of this ACH Authorization section in this AgreementYOU ALSO HEREBY UNDERSTAND AND AGREE THAT THIS LOAN IS NOT CONDITIONED ON PAYMENT BY ACH AND THAT YOU MAY PAY BY PAPER CHECK, MONEY ORDER OR BY ANOTHER METHOD LISTED IN THIS AGREEMENT.”
Additionally, within the loan agreement it states:
“The ACH debit authorization will remain in full force and effect until the earlier of the following occurs: (i) you satisfy all of your payment obligations under this Agreement or (ii) you tell us or the
Paying Bank that we can no longer withdraw money from your Bank Account in enough time (not less than ten business days prior to the scheduled debit date) to let the Paying Bank or us stop taking the money out of your Bank Account.”
The table within *** ***’s loan agreement represents the worst case scenario, if the customer was to only make minimum paymentsOutside of the tightly enforced script utilized by loan representatives, upon receiving her funds, *** *** was issued an email with helpful tips, reminding her of her payment options and the terms of her signed loan agreementAdditionally, Green Gate Services also sent the customer courtesy reminders before each of her due dates to ensure she understood her payment options and balance. *** *** had the option to pay only one finance fee if she paid off her loan in full on her first due dateOr, in addition to the finance fee, she could have applied additional funds to the principal balance, which would have reduced subsequent finance feesOr, lastly, the customer could pay the finance fee only, which would not reduce her principal balance or subsequent finance fee(s).

Green Gate Services is a legal tribal lending entity offering installment loans to consumers and is not violating tribal or applicable federal laws
For clarification, Green Gate Services does not charge over 1000% interestOutside of the tightly enforced script utilized by loan representatives, upon receiving his funds, *** *** was issued an email with helpful tips, reminding him of his payment options and the terms of his signed loan agreement, which has a table to reflect a finance fee is due on each due date. Additionally, Green Gate Services also sent the customer courtesy reminders before each of her due dates to ensure he understood her payment options and balance. *** *** had the option to pay only one finance fee if he paid off his loan in full on his first due dateOr, in addition to the finance fee, he could have applied additional funds to the principal balance, which would have reduced subsequent finance feesOr, lastly, the customer could pay the finance fee only, which would not reduce his principal balance or subsequent finance fee(s), which is what the customer has being paying to date.

Mr*** successfully made five payments; however, on the six payment, funds were returned due to a stop paymentAfter the return, as a courtesy to the customer, Green Gate froze the customer's account, so that no additional finance fees would be accruedIn return, Green Gate requested that the customer pay the past due finance fee, the current finance fee, and the remaining principal balance, which the customer agreed to pay back in installmentsUnfortunately, the second payment was declined and the arrangements were broken
In his letter, *** *** expressed his concerns with the Account Specialist assigned to his accountUpon reviewing the account, while we did not hear any inappropriate language or treatment of Mr***'s employees, we agree that the Account Specialist could have been more professional when working with Mr***With this being said, the employee has been suspended from the account and a Manager has been assigned to follow up with the customer
