Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Unacceptable, The Horne Kia Service Department are not being accountableI brought my car to be serviced there and I got my car back with a broken windshieldJustifying that the windshield has defect on it already and wanting to use your own vendor is a big cop outI was responsible to bring my car in for a safety recall, I expect that your business does the sameTo resolve this issue, I need my windshield to be restored to the same way I brought the car to the dealerI hold the dealer to pay for the entire cost.Regards, [redacted]

The vehicle was not purchased at Horne Kia it was purchased at [redacted] the warranty is an aftermarket warranty the customer should be complaining to [redacted] not Horne Kia it is not a genuine Kia warranty there is an aftermarket spoiler put on the vehicle which again would not be covered under the KIA warranty.?

[redacted] , the terms of the financing changed due to the lender changing them not the dealer, Mr and Mrs were offered the opportunity to come into the dealership weeks ago to meet with me to see if I could offer them a service credit in our service department but they either did not reply or declinedThey failed there 1st interview with the first lender which is why the terms changed they did not have to keep the vehicle but opted to instead of returning itHorne really tries to make folks happy however in this case the bank didn't participate the way we thought they were going toI don't know that there is much we can do at this point in time to make these folks happyAnd the reason I know what happened is I did speak to Jarvis and the sales personAgain I did reach out to these folks but never heard back from themIf they feel that they can get a better deal by refinancing they can do so with out any prepayment penalty Regards,Michael LH***General Manager

On or about November 26, Complainant purchased a Ford Fusion from Horne KIA At that time Complainant refused to purchase an extended warranty offered by the finance department with knowledge that the vehicle was out of factory warranty On or about December 1, Complainant visited Horne KIA Service Department with his Ford Fusion with concern for an oil leak presented by a "puddle of fluid on the garage floor." The service technician performed an inspection of the transfer case finding fluid leaking as a result of possible overflow The service technician removed over flow of fluid, cleaned the transfer case and noted "no leak detected."It should be noted that on November 22, the Service Department at Horne KIA performed an inspection of the Ford Fusion At that time there was no indication of an oil leak Furthermore, upon initial evaluation of the Ford Fusion the service technician did not add or change the fluid in the transfer case.Complainant alleges a visit to the service department on or about July 14, 2017, over six months after his purchase for which Horne KIA has no record At that time Complainant states that he "demanded replacement of the transfer case."Now comes Complainant on or about October 20, 2017, almost a year later with demand for reimbursement of repairs made to his Ford Fusion.Based upon the information provided above, Horne KIA is not responsible for repairs made by Complainant

Horne Kia has flat-out lied to us on many levels and on many occasions?"first with the sales man(who blames his boss), then the finance department, and then the so-called “general manager”I was told over text message, over the phone and in person that I would need to sign a new contractThat is why I want to sign a new contract?"because I was told I had to and there was no other optionAnd now just because you say the contract is signed does not mean that it was done ethicallyHere are the facts: only after I was told that I have to sign a new contract I responded by telling them I would bring in outside financing to SAVE moneyThe next thing that happens is that I’m told I did not have to sign a new contract because corporate Kia instantly approved my $college graduate rebate?"which come to find out now was another lie because they had to pay it out of pocket apparentlyThey are repeatedly lying and unsuccessfully trying to cover their liesWhat kind of business does that? If they know anything about contract law, a verbal/written agreement is a valid contractAnd the verbal/written agreement I had was to sign a new contract replacing any previous agreement that I had with themIn an effort to resolve this matter, I am more than willing to pay the $along with signing a new contract like we had originally agreed onIt seems as if Horne Kia is willing to do the same

Per the Arizona Attorney General website states the following verbatim: "Used cars in Arizona are sold with an implied warranty of merchantability that applies to every used car sale (although a specific defect may not be covered if it is spelled out in writing)This law is found at? A.R.S§ 44-(link is external)? The implied warranty lasts fifteen days or miles, whichever comes first.? The dealer must be given two opportunities to repair the vehicle, before a consumer can seek a refund."Horne Kia was never given the opportunity to repair the vehicle a second time during the implied warranty period.Therefore, this claim of refund is denied

The original KIA warranty is for miles not and it covers factory equipment not an aftermarket spoiler

For a General Manager to write "she gambled and loss" is astounding to me!!! That is proof of how unprofessional and childish this company is! I had no problems getting this done with Firestone, but was never educated that without getting this done the problem would remain or get worse!!!!!!!!!!!!! At no time did I hold them responsible and blame them for me having to pay extra labor - that is NOT THE ISSUE AT ALL!!! I trust in Firestone 100% and had no issues taking my vehicle to themThey actually gave me quite the deal to get this work done because of the hassle Horne Kia put me through! So, thank you Horne Kia for reminding me not to EVER come to your locationMy other vehicle will NEVER be serviced at your location againMy husband and I will find an alternate Kia dealership to perform any maintenance work on that vehicle Again, please make it known - at no time did I "take a gamble" on getting the repairs done on my vehicleI was not properly educated and therefore had to get the vehicle towed twice to another locationBut, Geico waived BOTH TOW FEES due to the hassle as wellSo, all in all, this is pretty funny how Firestone and Geico recognize the traumatic experience involved and treated me with respect and as a valued customer but Horne Kia only has clichés to throw out about 'taking a gamble and losing" I am a Supervisor at a Corporate Office and my team handles these Agency complaints daily (AG, Revdex.com, CFPB, etc) and NEVER would we speak of a customer in such a derogatory mannerI am very glad this happened, because it has shown me truly how unprofessional this place isI would not recommend this to my worse enemy

We offered to pay for half of the cost of a new one since the windshield was partially broke with a bad chip and pitted to begin with the customer refused because he said he didn't half the money for his half of the costOur offer still stands we will pay for half if the work is done by our vendor so we can keep the cost as minimal as possible

Horne Kia has already responded to this and refunded money to the guestHorne Kia does not report to any credit bureaus Horne Kia considers this matter resolved

Yes the vehicle was purchased from [redacted] ***It is not an aftermarket warranty, as the original Kia warranty is good for 36,milesI did purchase an extended warranty that covers the same items as the original Kia warrantyI received a call yesterday from them that the camera was needing to be replaced, which is a manufacture defect and is covered under warrantyGordon in the service department is amazing and has been the only reason I left my vehicle to be worked onThe rest of customer service at Horne Kia is horribleI will not be bringing my car back to this dealership and I will make sure that everyone learns of this experience that I received

Tell us why here...The customer signed a contract with a $college graduate rebate as a partial payment for the vehicleThe contract for the financing was through an affiliated bank with the dealership after discovering the? customer would not be eligible for the college graduate rebate Horne Kia? took care of the $for the customer the customer is not out any money nor has suffered a loss of any kindand for some reason the customer thinks he can renegotiate the contract or the terms of the financingThe contract is valid it has already been funded by the bank and a lien has been placed on the vehicle.? We can not renegotiate the terms of the contractWhen two people agree to terms, we put it in writing and sign a contract ...that has been doneits final if the customer wants to go and refinance his loan with another bank that's? his right to do that but we can not restructure the loan he already hasHorne Kia is the one that is out the $not the customer Horne Kia would Like him to? give us the $400.? ? Horne Kia considers this matter resolved unless he wants to Pay us the $he owes us ?

*** attached is a copy of the repair order, again Horne Kia will pay for half of the cost of the windshield replacement; only if our glass vendor does the work this is to control the cost and qualitythis offer is on the table until August 15th

On June 13, Janice Wvisited Horne KIA. Janice W. was accompanied by her adult child. Both parties participated in the entire purchase process from test drive through negotiation and to signing the contracts. At no time did Janice Wor her child bring to the
attention of Horne KIA staff that Janice W. experienced any discomfort or health issues. Penny the sales person spoke with Janice Wand she reported complete satisfaction without complaint. In fact, the dealership sold Janice W. the vehicle of her choice at a loss to the store Therefore, the Revdex.com Complaint *** is unfounded and unwarranted. The party making the complaint was not present at the dealership on June 13, and appears to have no knowledge of Janice W.'s feelings about the deal and is looking out for their own personal gain
