I am rejecting this response because:Right after I spoke with [redacted] from InShape Corporate office, I received an automated phone call from InShape, stating that they will proceed with the membership autopay InShape is used to unfair bussiness practice and they want blood (money) no matter what I'm prepared, ready, willing and able to fight them back The buck stops with the ***'s

I am rejecting this response because:I did not receive "a couple voicemails"I received ONE call which was today at 8:am (my cell phone call log and VM log is attachedThe missed call I am referring to is from the number at 8:am) I have not been able to call back yet It has only been 1/hours since I have received the one and only call and I think that is unreasonable that In Shape only gave me 1/hours to callback before sending a message to the Revdex.com with facts that are untrueThis is just another example of how In Shape does not properly document what really happened in reality versus what they made upI will be calling the business back when I am on my lunch break

While the club level was recently changed to a Platinum level under the new structure guidelines, Ms [redacted] continues to have the same access and distinction to a Diamond membership with access to clubs Because Ms [redacted] enjoys a low rate, if she were to reduce her membership to a Platinum level it would now be more expensive and include less club accessThat is a benefit of a founding memberWe have explained the differences to Ms [redacted] regarding the "Legacy” membership versus the new “Platinum and “Diamond” memberships and we hope this will clarify our positionIn-Shape Health Clubs welcomes feedback from members, and will provide resolutions customized for our individual member needs Sincerely, [redacted] Member Services Manager In-Shape Health Clubs [redacted]

To whom it may concern, The last contact I had with In-shape: 1) They were going to cancel it from it from that month on not go to February when I asked for it to be cancelled and was told it was taken care of 2) They were going to deduct the late fee and make me pay the monthly fee to the time of the last call I madeI forgot when that was but it was last year around fall 3) The bills that came were unexpected 4) When I told custom built I was in a wheel chair and unable to work out they cancelled and immediately let me know I could return when my knee or physical condition was betterThey stopped all charges and went back to February the time I came to be in a wheelchair So to me all I was a number and means to an endBut this was not the only problem I had with themTheir were times where I was told it was paid yet got something in the mail for paymentWhen we the card again, it did not go through the first timeI did make a call to Jason, (General Manager) to let him know and he took care of one change Rebuttal of [redacted] To Whom it May Concern, Enclosed is a copy of the first card I gave them connected to an educational fund and how they took advantage of thatThey should have no payment past February Rebuttal, [redacted]

Attn: Dispute Resolution Department RE: Case # [redacted] - [redacted] ***Complaint Detail:I joined the In-Shape Health Club upon moving to Lodi in July of I used my "complimentary" personal training session, met with a trainer/manager, and was convinced to sign a personal training membershipI at first declined, because I am only available for sessions early in the morningI was verbally assured the gym had a personal trainer available for meOn my third session, no personal trainer met me at my agreed timeI was then told the trainer quitI was not informedI called the manager subsequently No return call was madeI called several more times, both local and corporate offices, and I was assured by the manager that they would provide a trainer at the agreed timeNo contact was made with me for an extended timeI negotiated with the manager after a week of discussion over the phone, that my personal trainer contract would be cancelled without penalty fee, and I could use the remainder of the sessions I had paid forAfter a month, I received another bill for training sessionsI am now being told by the corporate office that I owe $to cancel my agreementThe local site is not helpingThe customer service at this location has been egregiousI ask the Revdex.com to help meI was made verbal promises that have not been upheld, and I am being penalized for this company's deficienciesIn-Shape Lodi Personal Trainers are stealing my moneyI hope the Revdex.com can arbitrate.Resolution:In-Shape Health Clubs has received the above referenced customer complaint and appreciates the opportunity to respond We have cancelled the agreement with no penalty as Ms [redacted] mentioned she would like in her desired settlement.In-Shape Health Clubs welcomes feedback from members, and will provide resolutions customized for our individual member needs Sincerely, [redacted]

I am rejecting this response because: There are no more Diamond clubs in my area and so the Diamond membership does me no goodAlso, of course I am getting a better rate, InShape recently raised thier ratesMy postiion still stands, if they had not opened the Diamond club in June I would not have upgraded and now this club has been downgraded to a Platinum, so I am requesting that I just go back to my old plan before what I feel was a "bait and switch"Thank you
