Review: On or about may 10, 13 I went to the Alamo, Vacaville gym to switch my membership from Vallejo because I moved. I spoke to a person that appeared to be very helpful. She was Caucasian, blonde, approx. 40 years old and appeared to be fit. She suggested that my boyfriend and I switch to a couples membership to save money. It sounded like a great idea so we agreed. She said she would transfer my account from Vallejo (single membership) to Vacaville for the couples membership. She said there was a person listed on my boyfriend account, [redacted], who membership had been expired for years. My boyfriend instructed her to remove [redacted] from the account and put me on the account. We left that day under the impression that everything was taken care of. On or about January 22, 14 I tried to use the gym and [redacted], the general manager, told me I had approximately $160 balance due for not paying my membership the last few months. I had been to the gym many times in the past few months and this was the first I had heard about my alleged balance. I checked bank statements and we were up to date on all our payments. [redacted] first said there was nothing he could do about it. Eventually another associate made the corrections that we thought were done in May. Once again I left under the impression everything was taken care of. The next day I received a call from corporate and they were trying to collect the 160 dollar balance form my single membership. After explaining the situation they offered to lower my alleged balance to $75 and told me that that is all they can do. They also threatened to send me to collections. They are trying to double bill me and will not resolve the problem. I also noticed on yelp that there are other complaints that are similar to mine.Desired Settlement: I would like them to remove my existing balance from my single membership because my boyfriend and I have already paid my membership dues through our couples membership.

Review: I was told that I would have 15 days after signing the contract to examine the gym and cancel for any reason. I cancelled my agreement within 5 business days. I was issued a receipt which they told me would be the only copy I would have of my cancellation. Over two weeks later I find charges in my bank account. When I call to dispute this to the corporate location the phone disconnects. I signed an agreement believing that I would have the ability to cancel without hassle. Now I have spent half an hour going in to cancel. Thirty minutes repeatedly calling back the corporate office and now writing this complaint. I still will be calling my bank to block this company from stealing my money! Unbelievable that these corporations can get away with this. Buyer beware!

Final Consumer Response

(The consumer indicated he/she ACCEPTED the response from the business.)

Review: I realized that I been getting charged from In Shape health clubs for the last few years and I terminated my account in 2013, Feb 7th to be exact. I call [redacted] and we go back and forth on the phone for a few days. Finally she calls me and she saids they realized on their end that my account was restarted after I cancelled it, which I have no memory of restarting another account. I ask them to send me a copy of my signature that I restarted my account which they had no record of. So [redacted] saids by law we have to reimburse you for all the time we been charging you. She saids to be patient and my check will come by mail to my new address. Currently I been waiting over almost 2 months.

So today is 5/27/16 I been calling them since 5/19/16 last thursday. All I keep getting is, "sir we don't know whats going on with your account and need to call you back" or "sir we are still trying to get a hold of [redacted]" or "sir this takes time and we need to look into it and call you back". Until now I never got 1 call or 1 email back from anyone. [redacted] and I already have resolved this and now nobody knows what going on and nobody has called me back. This is very very frustrating and horrible customer service.Desired Settlement: All I would like to do is get a call back, and tell me when is my check officially coming to me?

Review: I have a current account with in-shape. And I was told that my account could be put on hold and I didn't have to owe any money. My in shape account was only good for 1 year. They have over drawn my bank account and have refused to pay back my bank account. I have went into the in shape club here in Ridgecrest Ca and have talked to the manager which has been nothing but rude to me. I also have been promised a refund to fix my bank account and they said that they have looked into the problem and when they said that they have talked to my bank they said that are not going to refund any over draft fees to which in shape caused my bank account. And my bank even told corporate that it was in shapes fault and that in shape has to fix the issues that they have caused to my account. They have tried to charge my bank account over 4 times in one month. They over drafted my account the previous month 2 times. This has caused my account to be over drafted by over100.00 . And corporate hasn't held up to what they have told me and neither has the local in shape. This has now caused my bank account to be closed on their trying to steal money.

I would like for in shape to refund my bank account and punitive damages. This has cause stress on me. And I would like for the corporate office to fix all of this and I no longer want my account with in shape.

Review: I cancelled my account with all the proper documentation. They are still charging me, and not returning my phone calls.

I signed up for In Shape fitness when I moved to Bakersfield, CA towards the beginning of 2013. I knew that there was a possibility of me moving back to Montana so when I signed up I specifically asked [redacted], the trainer what it took to cancel. He told me that there was a $50 cancellation fee and that was it, so I signed up (Turns out he was wrong, lying?) and you need documentation and it's $100 cancellation fee. Several months pass, and I got a job offer in Montana and provided them with proof of why I was moving. The club manager, [redacted] was very nice, and apologized for the misunderstanding with [redacted] and offered to waived the $100 cancellation fee and fax in my documentation to corporate. At the beginning of the next month I was charged with my monthly fee and yearly fee. I called and corporate said they never got the fax. I called [redacted] and he said that I needed to call corporate again, and just cancel my account and he would waive the fee, corporate said they couldn't do that and I would have to fax in my documentation again. I am in the middle of moving across the country and don't know where it is, and I already did it. I have tried to call [redacted] back a couple times and he is always in meetings and doesn't return my calls. I had to cancel my bank account (I lost my checkbook) and now they are sending me bills in the mail. I don't want to pay these people one more dime, and am extremely frustrated with the stress they are causing me and wasting my time, and I know if I don't pay them they will send me to collections. It's extremely unprofessional the lack of communication between the stores and corporate. Desired Settlement: I would like a refund of the monthly charge of $39.99 and the yearly charge of $29.00 for a total of $68.99. I provided all the correct documentation they asked for, and it is not my fault they lost it.

Review: I have been trying for several months to cancel my personal trainer contract with in shape. When I signed up I was told I could cancel at any time if I was unsatisfied, and I was never told there would be a charge for cancellation. I tried to cancel one because we moved from our present location and two because the trainer did not advise us on nutrition and never corrected our technique when doing various exercise positions. They refuse to cancel. They say I have to pay another month of service and then a cancellation fee as well. They should not be trying to Bill me for services when I have asked them repeatedly to send me a bill for the cancellation of my account. I already paid a 240 fee for a month of service which we did not use. They say I have to pay 240 for a month and then another 240 cancellation fee. They say I owe a monthly fee because my account is live. I called them in July to cancel and faxed then written documentation in August to cancel and have called multiple times since then, so my account should not be "live". This is completely unethical.Desired Settlement: I would like a cancellation of my account in writing and a bill in the amount I was quoted of $240 if they are imposing cancellation fee.

Review: My husband ([redacted]) signed up with this gym last year (no contract-month to month.) He doesn't speak or read english so I (wife) usually translate for him. About 6 months ago he went in to the Bakersfield location because he was going to school there and cancelled it. Now, 6 months later our account is being debited for the fee and they now say that he didn't cancel it, he only placed a hold. He says that it was his understanding that it had been cancelled, they even have the paperwork to prove it, IN ENGLISH. They verbally told him that it was cancelled, then they had him sign a document in english placing the account on hold. As far as I'm concerned this is an illegal practice. Now, our bank account is negative because there wasn't enough money in the account to pay for the fee so we were charged an overdraft for $50 and two checks bounced totaling almost $100 in fees. I called to straighten it out but they refuse and say that if we want to cancel we have to pay an extra $40. Attached I have included the document they had him sign, he was told it was a cancellation.Desired Settlement: I need the 39.99 refunded back to me IMMEDIATELY. Also, I need the membership canceled. I'll take the $100 overdraft fees as a lesson for not signing up with a gym EVER AGAIN.

Review: Hire the services of a personal trainer for my husband in the InShape gym which is located in Visalia. At a cost of $ 180.00 (monthly) for 6 sessions per month. from the day that I signed up it was one problem after another, for a coach that would give me the service by the person who was supposed to coach my husband could not train him as he was in another area, then I will coach They could not train as assigned by a scheduling conflict for her because she could not after 4pm and my husband could at 7pm. As they began to look coaches and spent days before they could assign someone else fo my husband was coach is not available was not at InShape facility that day, again another session was canceled was scheduled, I communicate and they'll get another coach days later tell me that they have a new coach and give me an appointment my husband is presented and it turns out that the coach did not want to train my husband because my husband speak little English and refused to train, I suggest that they will find another coach and spend more days, my husband decided to visit another InShape installation to see if you have a coach. They would have to contact me. The days pass and nothing indicates that they have a coach available that would communicate to make an appointment I never got the call spend more day and I communicate, I said it would seek another coach and several days later, I called to have one that will bring another installatiion, and finally training begins after 3 sessions the problems begin with the schedule coach one day and then he said he could not well that day and on other several occasions, the last time that happened to cancel was because we agreed the service for an appointment to 7pm and sends me a message if we could attend an earlier appointment for 6:30 or delay it for 8 what happened ?? in the days that have gone by it has been 13 Sessions.Desired Settlement: I want to cancel the contract and reimbursement for any charged me the money. $ 360.00 ( for two months ) , an additional credit of a session I'm missing and they do not charge me a penalty of $ 250.00 that they imposed on me by the cancellation of the contract with which they did not comply by not giving me the services I pay of $ 180.00 ( per month) which are 6 sessions per month, which did not receive , for every problem (previously explained ) I would like to see something more in my claim

Review: I signed up three different family members, including myself, for memberships at InShape. Things were going well until I lost my job. They wouldn't let me cancel the memberships and held my money and bank account information hostage to their business. After a few calls, I did get to one sales rep who was able to put my accounts on hold. Now six months has past, I still have no job, I've lost my unemployment and I just can't pay for the memberships anymore. I've spoken to several people at InShape and they still won't let me cancel, and now they wont let me put my accounts on hold anymore since I used it up before. Never before have I ever been in a forced situation like this with no options. This gym is basically robbing me every month. I understand that we sign a contract and I have honored it for over two years to their benefit but InShape has done nothing to help me out of my tough situation. How can there not be a solution for people in extreme financial hardship such as myself? Even banks are more lenient than this gym. They would rather I go bankrupt, go through the hassle of getting a collecting agency, than for me to be a responsible individual and cancel my membership.Desired Settlement: I want to cancel the memberships I am paying for.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

Review: I sign up my son for a membership and signed a month to month agreement to have $40.00 coming out of my bank account monthly. With a new membership, they give one free session with a personal trainer. These trainers are very aggressive trying to get people to sign a contract for 18 months of personal training valued at $1,729. My son insisted that he didnt want this service and he couldnt afford it because he doesnt have a job. The aggressive trainer convinced my son to go ahead and sign anyway because he had 5 days to cancel and to talk it out with his family to maybe help him to pay for this service. My son, as I am assuming many others, went ahead and signed knowing that he would to turn around and cancel it just to get away from the awkward situation with the trainer aggressively selling this service. I canceled the very next morning but the down payment of $329 was processed on the same day of the agreement and it came out of my account a few days after I canceled. I have two BIG issues with this. 1). They took the money out of MY bank account without my approval. My son does not have access to my account. They had my account on file ONLY for the monthly membership expense of $40. And 2.) its been almost one month and many phone calls and I still have not received the refund. When calling the personal training services, they either never answer the phone or they totally ignore my request. I called the Headquarters several times and they are not much help either.Desired Settlement: I want my refund right away with penalties because they took the money out of my account at a very difficult time for me and I had to take on a pay day advance to be able to stay afloat.

I never signed an agreement and they took the money from my account without my consent. It's been almost one month and I still have not received the money back. They continue to tell my that the check is in the mail but as of today. I still don't have it. I have wated MANY hours on the phone trying to take care of this situation and its very frustrating.

I also had to take a payday loan to cover my bank account. This has cost me additional money and I want InShape to be responsible for it. As of today, nothing has been resolved.

Review: Revdex.com, Am contacting you after not being able to receive any satisfaction from In Shape Health clubs Inc. I have visited your site and noticed that I am not alone in regards to the methods that In Shape Health uses in regards to their contracts. I signed up for a membership with I.S., back in August 2008 and gave them permission at that time to withdraw funds from my account to cover the monthly dues. I continued to attend the club for a period of time until a death in my family prevented me from doing so. I was told that I allowed to discontinue attending for allotted period of time. Which I did, and then continued with the visits to the club. In 2011 I got married and was no longer going to In Shape, and thought that my membership was probably due to expire. Not being sure of how long the break was that I had earlier was. I kept waiting for In Shape to stop withdrawing funds from my account. But to no avail, while my wife kept asking about it. Finally I did contact their corporate office, and spoke with a gentleman named [redacted]. Who, at that time said that indeed my contract had expired back in 2011.He then informed me of what the contract stated, and that I was to notify them of any cancellation before they would stop withdrawing funds. I told him that this was not explained to me when I signed up for a three year membership. I mentioned the lady who had signed me up, and he said he knew her and would be happy to offer me a free 8 month membership. He then stated that he would have to check with the management, and would call me back on Monday. Need less to say, I did not hear from him. I called back and left him a message. After about a week I called back and was told that [redacted] no longer worked there, and that they could not find my account information. I cannot believe that any company has the right to withdraw funds from another persons account without their permission. This company has blatantly taken advantage of my trust.Desired Settlement: I want this company to refund all of the money that it has over charged me.

Review: Hi This is [redacted]. This complaint is filed in regards to the following branch IN SHAPE 2710 Geer Rd Turlock, CA ###-###-####This branch is badly managed. The first time I tried to inquire on membership the staff was very pushy, subsequently when my husband inquired on a possible membership I noticed that the behavior did not change. The group class instructors are literally incompetent. The AC in the group exercise room is very limited and instructors do not have microphones. When it comes to the swimming pool it is very dirty and it seems to be the case that no rules are imposed in a professional member. Specifically, on June the 2nd 2014, my husband as a guest and me as a member wanted to use the swimming pool. We called in prior to see whether we could use the pool and we were told yes. When we entered to the pool a swimming/aerobics/instructor: [redacted] started yelling at us. We immediately took action and got out of the pool understanding that a class was in session. However, it was not clear to us as to why this could not be conveyed in a professional manner. We wanted to try the pool next day and the water was dirty once again. We wanted to swim: however all lanes were occupied with children playing in both lanes leaving us no space to swim safely both for the children`s and our safety. We patiently waited but this lasted an hour and we left. I was concerned and I wanted to talk to the manager however although the receptionist took my mobile number my call was not returned. Finally last Thursday we paid a visit and spoke to the receptionist indicating these above mentioned issues and I asked for my membership to be cancelled. I was rudely told I should contact the corporate office. I left my number again hoping to find a mid point but I was not called. This behavior is executed by a branch whose manager aggressively calls me for promotional purposes. I strictly would like my membership to be cancelled and I need an apology. [redacted]Desired Settlement: apology and membership cancellation

Review: They are continuing to bill for a cancelled membership.

In 2013 I paid for my grandson's membership. Billing was automatically charged to my credit card. In January 2014 he cancelled because he was being deployed in February 2014. I still got charged for the February payment and they would not reverse it even though he was already gone. I now have received a bill for March plus a $25 charge because the credit card company refused to honor the charge, per my instructions. The bill is in my grandson's name, [redacted], and I am afraid his credit will be hurt because of this. The membership is cancelled, there should be no more charges. I've already talked to them on the phone and I thought it was resolved, but clearly it is not.Desired Settlement: I would like to have my February payment returned and I want assurances that no more billings will occur.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me. I will, however, keep this paperwork on file in case there is a problem in the future regarding billing and/or reports to the credit bureau about non-payment. Thank you for your help.

Review: I enrolled in a family plan at In-Shape under my corporate account. My company contributes a significant amount, thus allowing my wife and two children to join for no money down and a total of $65 per month for a full membership for all. When I checked my checking account, I noticed that In-Shape had withdrew $170. I double checked my contract with them, and it stated that only $65 per month would be withdrawn. I called corporate 3 times between March 10-14, and each time sent to a different voice mail system. I have yet to receive a reply. I went to the facility that I signed up with, and spoke with Linda from Member Services. She explained that my name was not on the "outdated" employee roster and therefor could not enroll me at the discounted rate. I asked why I was not notified prior to being billed of any anomalies such as employment verification (twice I have shown them my employee badge); inwhich charged me almost 3X the normal rate. She replied that she will look into it and call me right away once the problem is fixed. I called 48 hours later and she had no updates. I signed my contract with them on Feb 21, thence there was ample time for them to clarify any issues prior to me being over billed. Linda also mentioned that I should contact my Director of HR, and have her send an updated roster to the club. I do not feel I should have to contact the Department Head of HR to send over a roster as this should the responsibility of the health club and their POC with my company. Our membership did not become active until March 1.Desired Settlement: I wish to have a full refund of $170 that was taken from my checking account without authorization. My family and I have yet to use the facility and feel that we should have been notified, prior to over billing us, that there was an issue with my employee verification. They had over a week to do so, but instead over charged me.
