Review: I joined in Shape in October 2015. Since joining InShape I have encountered billing issue with the club. Once signing on and agreeing to have my membership fees deducted from my place of employment which did not occur. In November 2015, I received a bill for 360.00 which I paid. I contacted [redacted] at the corporate office in March because I continue to have issue at the club in Modesto. I told her I was still having problems inspite of paying my bill with a check. she agreed to credit me with a 95.00 off of my payment, after we had resubmitted paper work for direct payments from my place of employment once again. On Sunday, I visited the club only to be told that my entire family membership was now showing inactive.Desired Settlement: I would like to receive the 95.00 credit I was promised and now an additional 95.00 credit for the month of April.

Review: On Oct. 1, 2013 I paid InShape cash #65.00. I asked for a receipt! I was told that the amount will show on the books w/InShape. But I asked again... I gave you cash and I need a receipt. Again she told me she couldn't give me one!

The next day my husband and I went in to use the water therapy. They told us I hadn't paid the $65.00. I asked to see the manager and [redacted]. I told them what [redacted] and I had agreed on...That I would pay cash the first day of every month. (We don't use credit cards or checks (we have our money in a savings account) We use cash only!) No problem I was told (by [redacted]) before I realized what I was signing: he had filled in the blanks on the agreement. The manager okeyed us. But come the next month my bank statement sent me a letter stating that InShape had electronically sent a request for payment after I had paid cash and got the ok from the manager. So Oct.'s changes were 1. InShape- For Oct. after paying them 64.99 cash they owed me $300.00. 2. InShape- For Nov. $300.00 after paying them 64.99 $600.00. My bank= Charges for Oct. and Nov. $600.00 Total- $1200.

On Nov. 12, 2014 we handed I cancellation notice w/Dr.s letter stating that water therapy was causing more harm than good. I handed my letter dated Nov. 18, 2013 of cancellation as per the agreement stated Mr. [redacted] accepted the Dr.s letter, but would not accept my letter on cancellation. On this day all was suppose to be cancelled!

Since then we have received three letters claiming we pay $69.98 Feb.-March- April 2014. Because of the electric errors the company "Gave us 6 mon. free membership" But we told them then verbally that we wanted out! As we were doing the water therapy "trainer had set us up for [redacted]". He would finish in the pool and go to the stream room (it was necessary for item to rinse before entering) then the last was the on Jacuzzi. We noticed 2 different times the Jacuzzi was closed... It so happened that [redacted] got a rash nfection whici was diagnosed as spongithis dermafitis; by Dr. [redacted]. This infection was caused by bacteria in the Jacuzzi. The leg almost took on a rash that would not go away. With anitboctics and creams keeping the area clean- and not using the jacuzzi kept him from not loosing his legs!!

Dr. [redacted] finally healed his infections. Dr. [redacted] was the 1st onw to take biopiosy w/a report from lab 12/26/13.

WATER NOT CLEAN!!!. I do have lab work can you get back. Desired Settlement: Pay me back and the bank, clear all credit lines and give us a substanis amount for all the seriousness of all and what could of been (loss of limbs)

Review: Our family has a family membership to the In-Shape Gym in [redacted]. This is for 3 adults and our 3 children. The gym has a kids club area where kids can stay for up to 2 hrs while parents use the gym. All 3 of my boys (ages 5, 4, and 2) are diagnosed special needs kids. We have aides for them (behavior therapists) that help with home & community social behaviors. The therapists are insured/background checked thru their agency and help our children function. We want to be able to have the aide with the boys while they are in the Kids Club much like a seeing eye dog would be with a blind child but the gym is barring our therapist from accompanying our kids and they keep saying "corporate" is making a decision on this but we have been waiting MONTHS for the decision. In the meantime, their access is denied. I spoke to the Office of Disability Rights of California. I was told that no answer at all is considered a "constructive denial" and our family might want to consider filing a complaint with the Office of Civil Rights (OCR) since all we are simply requesting is reasonable accommodations under Title III of the Americans with Disabilities Act (ADA) in order to resolve this. [Title III of the ADA does require private businesses open to the public and commercial facilities to provide reasonable accommodations to people with disabilities to ensure that they have equal access to goods and services.] I do not understand why there is a delay in allowing us to bring our therapist that we pay for to help our disabled children function. Our therapist allows the gyms kids club employees for focus on the other children. Their employees btw are usually very young adults with no experience with special needs kids. Our therapist makes it so that their employees don't need any addl training, etc. All we are asking for is access which is fair.Desired Settlement: Contact from the Managers of InShape Gym in [redacted], CA on [redacted] that our special needs boys can bring their therapist into the Kids Club area as is a reasonable accommodation.

I am rejecting this response because:The person at In Shape Gym in Antioch that I have been speaking with is [redacted]. I tried to call Cameron back but had to leave a message and then [redacted] returned my call. In Shape Antioch - 4099 Lone Tree Way - phone925.331.3065Apparently, In Shape uses [redacted] to background check their employees that work in the Kids Club area (which is where we want to be able to bring a therapist to stay with our autistic kids while they are there for only 1 hr per visit a few times a week ... just enough for me to walk on a treadmill for 30 minutes and do the ladies circuit upstairs) .... but when I read about getting someone [redacted]d, the cost for application/fees runs from $135 to $170 per person depending on what type you get and the person still has to be LiveScanned which part of the process and is what the ABA therapy companies do for the ABA therapist they hire (LiveScan) for their hiring and background check process. In Shape expects parents to foot this cost. Our oldest two boys have 2 therapists and our youngest son will have 2 therapists. This means we will need to get 4 people [redacted]d which is more than we can afford.[redacted] said she needed to speak with her HQ to find out if the background checks provided by the therapists employers were sufficient and able to be shared which would be free of cost to us. We ([redacted]) really can't afford to have the therapists [redacted]d as we are a family of 5 on one income with 3 special needs kids and we have already paid for a gym membership we can't use as we can't afford the addl cost of the Trustlining. If we were rich we could - but economically we can't so I am feeling discriminated against on so many levels. The Americans with Disabilities Act has been in effect for over 25 years, the Lanterman Act since the 70s. People/kids with disabilities is not a "new" issue. In Shape and their HQ should have already had policy and procedures in place regarding this matter (something cost effective or able to take the background checks of the therapy company's employer). We have been asking to be able to bring therapists for the kids to the Kids Club now since Aug. [redacted] was the only manager that took my call. Other managers never got back to me even after repeated calls/messages left at the front desk and confirmed to have been given to the managers regarding the subject by the staff answering phone. Then it has taken In Shape HQ over 3 months to get back to us with any kind of answer but only after I consulted with the Office of Disability Rights of California and was told no answer at all is considered a "constructive denial" and our family might want to consider filing a complaint with the Office of Civil Rights (OCR) since all we are simply requesting is reasonable accommodations under Title III of the Americans with Disabilities Act (ADA) in order to resolve this. Review: I purchased a personal training package for 12 one hour sessions with a personal fitness trainer. However, after training with a personal trainer for .30 minutes she told me that my sessions were only for .30 minutes. I asked how could that be when I purchased 60 minute sessions. I inquired to the person who I purchased the package and he just stated that I could call the 1800 number and speak to membership to straighten it out. I did call and they stated that they could not refund my money or accommodate me. The odd thing about all of this is that Chris the Personal Trainer Manager filled out the entire contract in his handwriting (not mine). We spoke verbally of the one hour sessions, and never did we discuss .30 minute sessions. He apparently circled the 30 minutes that I was not aware of nor did I initial the 30 minutes which I believe he put in after the fact. I felt he used trickery to get the sale and was not honest in his dealings with me. I then wrote a letter to In Shape to try to come up with a solution, and I followed up with the Main Manager of the Club who said he referred me to the head of personal training who was suppose to call me. He has not called me and it has been at least two weeks since delivering the letter in person. I did following up with the credit card company who stated they will investigate and not honor their billing.Desired Settlement: I want the contract void in full. They need to use better ethics in dealing with new clients and train their managers to always get initials and a clear understanding of what a customer is purchasing.

Review: In Shape Health Clubs are located in California only. I have not traveled here and live in San Antonio, Texas. There was a fraudulent charge on my credit card on September 17, 2014 from someone using it at In Shape Health Clubs. I canceled my credit card and spoke with In Shape Health Clubs on September 17 and September 19, 2014 and was told they could not trace the charge as it was a one-time purchase. On my newly issued credit card, there is a new charge on September 30, 2014 of $5.80. I called my bank, which is [redacted], and they canceled my credit card once again. This time [redacted] said that sometimes a business may have a relationship with [redacted] that would allow the company to call [redacted] and obtain the new credit card number. I'm floored that I'm experiencing fraud charges twice after I called In Shape Health Clubs twice concerning the charge to try to find the root problem/person.Please help as In Shape will continue to obtain any new credit card number I may obtain and may harm my maintaining a security clearance.V/r,[redacted]Desired Settlement: Would desire for In Shape Health Club not to be able to charge my credit card fraudulently ever or obtain new credit card number after I closed my card due to fraud. Review: During the personal training sessions that I had with *., starting in 2/2014, I was very uncomfortable and embarrassed by her behavior. It was also very upsetting because I had made a commitment to get in shape and she could not keep to our schedule. She cancelled on me suddenly, via text message, three different times in the beginning. Then it was a lot of rescheduling as well as cancellations due to her migraine headaches, heavy periods and problems with her children and fianc. I felt she was overly familiar with me during our sessions. She made comments that, "you are going to be my training partner, you will never pay for training again" and " we are going to be good friends, we are cut from the same cloth." She also commented excessively about my "J Lo butt". The way she touched herself, and me during training made me very uncomfortable. She would be talking about a muscle group, but the way she talked and touched was very provocative. She also was constantly hugging different men in the gym and she called them all "baby". There was one man, tall and attractive, I think his name is *. She said she had a huge crush on him, but he had a wife. She would say things like, "just let me at that for a few hours", and other things objectifying the man as a sexual object for pleasure. She said electric sparks shot through her when she stood so close to him that his penis was touching her. She was obviously very sexually charged and excited by him. She would carry herself differently when he was around. I was very uncomfortable with her behavior and didn't like being associated with it. She also went into details regarding drug and alcohol addiction which I did not want to hear about.Desired Settlement: I want to be fully refunded for the personal trainer fee and membership fees from January 2014 through July 2014.

Review: Issue: In-Shape health club, Release of Liability and Risk waiver.

I am having a problem with In-Shape health club. The location is in Shingle Springs, California.

I have been at this location for 20+ years, over that time the club has gone through a couple of ownerships, In-Shape being the most recent, about a year ago. They are requiring us to sign a waiver + release of liability contract, form. I have included a copy. I have refused to sign this because we had California laws that held business responsible and prevented them from releasing their Liability responsibilities thus protecting us the consumers from this sort of thing.

Since I have refuse to sign this document, they have refused me access to the facilities, effectively canceling my membership. There hasn't been anything like this the other owner changes. Needless to say I am frustrated, disappointed, and angry at this action that is being taken by In-Shape Health Clubs.Desired Settlement: Can they do this, do they have to honer the memberships of the previous owner? Are there laws, rules and regulations, codes that require businesses to accept their business and liability responsibilities.

Even though I was not using the club, I fulfilled my annual contract, and they continue to take money from my account electronically without my consent or notifying me in any way to get authorization from me. Review: In-Shape Health Clubs uses unethical sales tactics to drive up your monthly billing, and include cancellation fees which they will not waive or refund. My wife went into the In-Shape Health Club location in Hanford, CA. She intended to sign up for a membership only, but accepted a "free personal training session" while she was there. During the membership sign-up process, she unknowingly signed an agreement for a 12 month personal training agreement at a cost of $260.00 a month on top of the normal membership, which included a $250.00 cancellation fee. The salesperson did not discuss this agreement with her, and she thought she was just signing up for a regular membership only. After calling the local branch to attempt to get a refund, we continued to be charged until I finally called the corporate office. There, I spoke with several personnel who all worked off the same script: "you signed a binding legal document, these charges are nonrefundable." I wasn't able to cancel this service in their five day window because I didn't even know we signed up for it until the next month when they started taking money out of my bank account. We never used a single personal training session. This process has cost me $1020.00, all for services I have never used over a period of three months. The personnel in corporate told me that none of them had the authority to refund me this money, and refused to connect me to anyone that would. In-Shape has lost me as a customer forever, and I urge everyone to avoid this unscrupulous business.Desired Settlement: I desire a full refund for personal training services that I never used. Three months at $260.00 is $780.00 total. I also desire the cancellation fee of $250.00 to be refunded, for a total of $1020.00 which has been taken from my bank account.

Review: Failure to properly cancel membership and continue billing

I canceled my membership prior to the end of the 1 year contract term (originally a 3+ year contract, with a 1 year renewal contract). I completed the cancellation paperwork, the clerk took our key tags, said "you can still come in until the end of the month" and I thought that was the end of it. Term ended 9/30/13. I received a notice dated 10/3/13 regarding a "funds were denied" draft attempt for monthly dues. I replied by mail with a note (attached to their notice) stating "This membership has been canceled. The cancellation form was completed prior to the end of the contract period in the Emeryville location. I trust it was not timely forwarded to you for processing."

On November 9, I received a past due notice and statement. It not only contained a months' improper past due billing, but a $25 Return Item Fee for an attempt against my credit card that never should have been attempted, for a total of $114.41. They did have the audacity to let me know I should set up "auto pay." Acct #XXXXXXX-XXDesired Settlement: I want the improper billing to be reversed, a balance of $0, and a guarantee that nothing has or will be sent to any credit reporting agency regarding this account.

Review: The In-shape gym on Mooney boulevard has scammed me into paying for two and a half months worth of a gym membership that I did not want or agree to. Not only was I uninterested and absolutely tricked into this contract, the customer service from their front desk and management staff was terrible. I signed a up for a one year gym membership. After the year came to end, I spoke with a front desk clerk to inquire about the last day of my membership, she informed me it was at the end of June. I said, "Great, I don't need to do anything else?" the clerk replied, "Nope, that's it."It is now August and I have been charged for two additional months! I called and spoke to a membership adviser and they told me I am now on a month to month membership per my original contract, even though my one year had ended and I was not asked to renew. I was told in order to cancel I would have to go to the gym in person and request for them to cancel my membership. When I got to the gym I went to the front desk and told them I wanted to cancel my membership and asked to speak to a manager. Instead of doing this right away the front desk clerk asked me why I wanted to cancel and why I needed to speak to a manager. I told her I didn't want anything more than a one year contract and that I wanted a refund for the two months that I didn't want or use my membership. The woman said "Managers don't deal with that and we don't give refunds".Furious, I said fine just cancel my membership. I came to find out that the cancellation policy takes 30 days and I will be charged for half of a month next month even though I insisted I wouldn't be using this gym nor any of the In-shape gyms.I hope that this complaint reaches the right ears and the management/front desk take their jobs seriously and make an effort treat their members with respect. I will never again sign a membership nor recommend this gym chain to anyone! They have forever lost my business and hopefully many others do not fall prey to their tactics.Desired Settlement: I would very much like to be refunded for the amount that I unknowingly paid for services that I did not use or know I was under obligation to use. Not only was I uninterested and absolutely tricked into this contract, the customer service from their front desk and management staff was terrible. I signed a up for a one year gym membership. After the year came to end, I spoke with a front desk clerk to inquire about the last day of my membership, she informed me it was at the end of June. I said, "Great, I don't need to do anything else?" the clerk replied, "Nope, that's it."It is now August and I have been charged for two additional months! I called and spoke to a membership adviser and they told me I am now on a month to month membership per my original contract, even though my one year had ended and I was not asked to renew. I was told in order to cancel I would have to go to the gym in person and request for them to cancel my membership. When I got to the gym I went to the front desk and told them I wanted to cancel my membership and asked to speak to a manager. Instead of doing this right away the front desk clerk asked me why I wanted to cancel and why I needed to speak to a manager. I told her I didn't want anything more than a one year contract and that I wanted a refund for the two months that I didn't want or use my membership. The woman said "Managers don't deal with that and we don't give refunds".Furious, I said fine just cancel my membership. I came to find out that the cancellation policy takes 30 days and I will be charged for half of a month next month even though I insisted I wouldn't be using this gym nor any of the In-shape gyms.I hope that this complaint reaches the right ears and the management/front desk take their jobs seriously and make an effort treat their members with respect. I will never again sign a membership nor recommend this gym chain to anyone! They have forever lost my business and hopefully many others do not fall prey to their tactics. Review: I HAVE CONtacted the In-Shape healt Clubs several times. on 5/6/15, I signed up for a trial run and was told I had 30 days to cancel for a full refund.I have called the office and gone down to the local club in person to cancel. I was told I had to send a letter to Stockton to get it canceled. I have sent three letters; each month when I saw yet another debit from my bank account from their company.Desired Settlement: Refund for June, July and August 2015. No more charges to my bank account, stop shredding my cancellation requests before they get opened and cancel my membership.

I was told there was no issue and everything was fine by one of your Ridgecrest representatives. I was not told you would continue to charge me for services not rendered. How is it you can pro rate something that is not, and how is it that you are legally able to charge for something you did not provide, if it is legal it surely is not moral, or ethical.

I now know why you wanted my banking information when I signed up and paid 1 year in advance by cash, which I have witnesses to. You seemed to want to access to my money so you have free rein which by the way I had been told was your practice, and that is exactly why I went above and beyond the call of duty to not give you any information you could or would use at your liberty regarding finances.

Review: I've spoken to 2 different representatives for over 2 hours week of Jan 4th and still they were unable to give any answers to my issue pertaining my account.

For an overview - I have been an In-Shape member for over 6 years now. I was a Platinum member for 5 years, paying $50 for family of four under my husband's corporate discount.

Last February, a new In-Shape gym was being built right next to where we live, the Seven Oaks gym. Unfortunately, we were told we could not access they gym because it is for Diamond members only. My husband and I contemplated many times whether to give up our grandfather Platinum plan and upgrade to Diamond Network for an additional $54, clearly more than double of our monthly rate. We bit the bullet and decided to upgrade March/April 2015.

Less than a year later, the "exclusive & highly coveted" Diamond level of Seven Oaks was downgraded effective December 31, 2015 to Platinum.

Which now led myself, and many other members, perplexed to what happens NOW to your most "valued" Diamond members? What happens to those "chartered" members that immediately signed up long before the Diamond level gym of Seven Oaks opened up? Why are we paying for Diamond level gym when there is none available here in Bakersfield? Why does your customer service representatives insist that I am paying less as Diamond member compared to your (recently increased) Platinum pricing?

We want our money's worth. I wouldn't mind sharing the gym with other Platinum members but there should be a clear distinction between Diamond paying members from Platinum.

What have you got to offer to current Diamond members then? What is it to us paying premium?

I deeply regret upgrading my account a few months ago. Maybe if I waited, I would be whistling my way in the Seven Oaks gym, paying $50 for family of 4 and I wouldn't have to send this letter of complaint for you to read.

I am extremely disappointed on how you do not have a plan laid out for your Diamond members.Desired Settlement: I spoke to [redacted], the District Manager of In-Shape. I requested for two things for consideration.

1. Either lower down my monthly bill as I was paying only $50 for family of 4 for FIVE YEARS as platinum member until my recent upgrade April 2015 where they doubled up the charges to $104 for becoming a Diamond member.

2. Add the VIP Lounge access to my account as Diamond member.

We are paying DIAMOND & PREMIUM fees therefore we should get something better than Platinum members.

In March 2015, Ms. [redacted] upgraded the membership to a “Family Diamond Market” membership providing access to 68 clubs. Ms. [redacted]’s has a fantastic rate at $104.00. New members joining for the same membership type will pay $129.99! While the club level was recently changed to a Platinum level under the new structure guidelines, Ms. [redacted] continues to have the same access and distinction to a Diamond membership with access to 68 clubs. Because Ms. [redacted] enjoys a low rate, if she were to reduce her membership to a Platinum level it would now be more expensive and include less club access. That is a benefit of a founding member. We have explained the differences to Ms. [redacted] regarding the "Legacy” membership versus the new “Platinum and “Diamond” memberships on a few occasions and we hope this will clarify our position. Review: I signed up a few months and informed the gym that I would be moving to woodland Ca and my son [redacted] would be staying at the Yuba City locationuntil going in the military next year. The employee said no problem, we can do that. I moved on 4/19/2014 as I informed the business I would be doing; when I signed the contract. They told me they could not do that unless I paid a platinumaccount rate to allow me access to all of their gyms. The corporate office number I spoke to was 877-446-7427 on 4/23/2014. I called my bank and cancelled the autodebit and informed them that I had contacted the business and they had not honored the contract I agreed tooDesired Settlement: I don't want to have this affect my credit or any other negative action against me. The business did not honor their promise and I should not be punished for their fraud.
