Instant Checkmate.com compiles reports from millions of public records including information provided by state and local governments. All of the information contained in our reports is part of what is referred to as the "public record."
We do apologize for any confusion Ms. [redacted] may have experienced regarding our services. Some customers are under the impression that when you purchase a membership with our company you are paying for records; unfortunately, this is not the case. The service that is provided is actually the compiling of all the public records data and the sorting of the data into an easy to read format. When a customer pays for a public records search, we do guarantee that we will search every database available to us, however, we cannot guarantee which records will or will not show up in the final report since we are not in control of the records themselves. We simply display records as they are provided to us.
In addition, premium databases are also more expensive for us to access, so in an effort to keep our monthly membership costs down, we must charge a small, one-time access fee to compile premium reports for our customers.
A premium upgrade is not required to view basic information. However, if the customer chooses to upgrade, their premium report may include:

In order to complete the Premium Upgrade process, all users must agree to the $19.99 charge by clicking the button on the bottom of the page which says, “Continue, yes I want the premium report.”
The text directly to the right of this “Continue” button clearly and conspicuously reads:
A one-time charge of $19.99 will be applied to the credit card on file. You will have access to the available premium data on the PERSON searched as soon as you click the “Continue” button. You will be able to view this data as long as you are an active member.
We get our information from local county courthouses and census bureaus. This information is then uploaded to the database that we pull from. There is a possibility that some information may not show on a given individual because some state and local laws restrict us from accessing certain records which may not be considered “public” in that jurisdiction. There also exists the possibility of false positives, and more than one individual with the same name and basic information may initially match up with many other records. For these reasons, search results are filtered by "most likely," "likely," and "somewhat likely." The following disclaimer is also posted on every page of our website:

In October, I signed up online to pay a minimal amount, 2.99 I believe to look up a reverse phone number. I started getting charged, 25.81 per month and 22.86 per month for 8 months. Obviously I should have caught it sooner. They could reverse a wopping half of one months fees. As I continued to argue with them for 45 minutes, I got down to less than half of the $450.00 I paid to look up one phone number. Obviously the "agreement" was not clear. This is fraud.

Any cancellation request will cancel Your upcoming bill.
e) Refund Policy
Our number one goal at Instant Checkmate is customer satisfaction. Very little information actually available for the base price, although I do get the person's horoscope. Constant prompts for further charges in order to complete information. Although I paid the extra two dollars, for example, for PDF download, no PDF is forthcoming (never ending screens loop, no PDF downloads.)

The service provided was extremely bad. They promise to provide information not available by any other means. When using their service, I was provided with less information than when I did a google search. They charge a premium charge for a service that is non-existent.

The refund of my payments IS acceptable, even generous. BUT I disagree with the opening sentence in the final paragraph of the Instant Checkmate response, namely that "the concerns mentioned in the original complaint have been addressed...." I wanted to purchase a report, and I was willing to pay Instant Checkmate's fee for that, but I did NOT want to purchase a MEMBERSHIP. What I found deceptive here was the requirement that I purchase the membership in order to obtain the report and thereby I set myself up for recurring monthly payments. It is this practice of Instant Checkmate that I object to and that I think should be changed. I'm even willing to give back their $47.71 refund if they would do that.

due to insufficient funds, Instant Checkmate reserves the right to bill in monthly installments at
the rate you selected.
You may
cancel your membership, including any trial or nonstandard membership at any
time by calling our customer support line at 1-866-490-5980 between 5am - 10pm
Pacific Standard Time (7 days a week) to speak with one of our Customer Service
Representatives. Any cancellation request will cancel your upcoming bill.  Our number one goal at Instant Checkmate is
customer satisfaction. If you are ever not satisfied with our services, feel
free to call one of our excellent customer support staff between the hours of
5am and 10pm PST (7 days a week), or between 6am and 2pm PST on holidays, and
we will work to resolve your issue. Refunds are handled on a case by case basis
with the ultimate goal of complete customer satisfaction.
We
have no record of cancellation from [redacted] until the call he placed on
March 31, 2014. We are sorry to hear that [redacted] was not satisfied with our services. [redacted] has been honored a refund in the amount of $45.72. [redacted] Instant Checkmate account has been

The service that is provided is actually the compiling of all the public records data and the sorting of the data into an easy to read format. When a customer pays for a public records search, we do guarantee that we will search every database available to us, however, we cannot guarantee which records will or will not show up in the final report since we are not in control of the records themselves.
