[To assist us in bringing this matter to a close, we would like to know your view on the matter.] I went back through my messages from the dealership because I knew the $4323 didn’t sound correct. They gave me $25000 for my van but only show $24000 on the paperwork. He said he took the extra $1000 off the price of the car rather than putting $25k in my trade value to save on taxes. My payoff was $28353.99 minus the trade of $25000, which leaves the negative equity of $3353.99. I’ve already made 2 car payments at $589.92 each of which $956.90 went to the principal, which leaves my negative equity at $2397.09. I should not have to pay $4323 of negative equity when that in fact is not the correct number and my husband and I have discussed this at length and feel we really shouldn’t have to pay any negative equity because had they be upfront with us to begin with we would’ve never purchased the car. When I emailed Matt, the GM and explained this to him, this was his response: We are buying the vehicle back for the purchase  price you paid. The payments made will not be reimbursed. As far as the number discrepancies, you signed the contract with those numbers and you agreed to them. The offer stands as we talked about.I am willing to pay half of the $4123 but will not pay all of the negative equity, especially since I have correspondence from the salesman explaining what they were giving me for my trade and how he moved the numbers around so the taxes would be less. They sold us this car under false pretenses. If we choose to pursue this we have a very strong case against them for fraudulent misrepresentation and not to mention the fraud their salesman committed by forging a document stating he was my relative with [redacted].Thank you.

We would like to extend our apologies to [redacted] for the less than acceptable experience with regards to her service experience Sept. 4th. I am sending her a $25 fuel card for fuel expenses. In reviewing her complaint, some changes have been put into place regarding communications between the...

departments. Regarding ** ([redacted]), we apologize for his less than usual customer courtesy. ** has been with Jeff Wyler for quite a long time and very rarely have we had a complaint. But, as I learn every day, no one is too seasoned for a refresher course in good customer service.

Again, Jeff Wyle did repair as stated in first invoice nic838983 which states the car is checked and all OK. I brought car back immediately after noticing low oil pressure. Mechanic checked low oil pressure and states it is OK ( see comments of invoice nic840966 bottom of page one). I take car home drive car the next day and experience loud rattling noise and low oil pressure. I then return car again (invoice nic840966). At this point is when Jeff Wyle comments the car had other issues. As they state they changed standard weight synthetic oil to a heavy weight oil and increased idle speed to mask low oil pressure issue they have created. Jeff Wyle had my car for about month.

Regarding the [redacted] complaint.  I have verified that the trade has been paid off.  Additionally, we will issue a full refund to Mr. [redacted] for his extended service contract and his Gap coverage. I have attached the cancelation form that Mr. [redacted] will need to sign and email back to us.  Once this has been received, we will begin the process.  All refund monies will be sent to the finance company that Mr. [redacted] used.  These amounts will be deducted from the loan’s total.  This process takes about 4 to 6 weeks for the financing company to receive the checks. Thank you, [redacted]

He said he has a3000 dollar bill from Kia and I said I will have to look at it but all we set up was to make the last two payments. Which we was...

told by the customer that is all they had left. Let him know that his oil changes will 9.95 and that he old lease is grounded and Kia has pick it up.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me if the work is completed.  Lets be clear and truthful....NO previous appointments had been scheduled and phone calls and emails (I can provide copies)  were NO RESPONSE .... if Jeff Wyler staff  had responded .... I would not have taken the time to file this compliant and other consumer complaints.  I have better things to do with my time, however since this went on for so long, I want other consumers to consider this poor customer service...bait and switch methodology  before they do business with Jeff Wyler.  If I had not insisted this be on the delivery report this sales promise would not have been completed.

[redacted] get a quote for the key. She got the quote and it was less than what her original thoughts were.  I had corporate cut her a check for the key quote. At this point the customer is aware that the removal of inquiries takes time and the only thing she is asking is when her warranty refund will be applied. Attached you will find my buyers order from Jeff Wyler, The current payoff of my vehicle, and the current black book if I were to trade it in.First I want to point out that you paying the warranty off is not going to work for me. As you can see in the Buyers Order I have provided the extended warranty was $2149.00 plus tax (6.75%) total $2288.69. So FYI if you sent a check to Nissan $2149.00 your short $139.69 Second Lets talk about this negative equity, on the Buyers Order attached that came from Jeff Wyler you will see I only took $6686.00 in negative equity. I haven't denied that the whole time. I knew I took negative equity. Here's my issue:Current payoff $33,687.59 If I traded it in today and a dealer actually gave me full black book value $17,735.00Total negative $15952.59Minus the negative I knew I took on $6686.00new total negative $9266.59Remove the extended warranty I didn't ask for $2149.00Total that is left $7,117.59So Ive owned this vehicle 5 months and it has lost its value $1423.52 per month after the 72 month loan the vehicle the vehicle would be worth nothing.As a matter of fact if to take what I owe ($33687.59) minus what I lose monthly in value ($1423.52), at month 24 (2 years) the vehicle will no longer be worth anything. So here is what I want actually ill give you 3 options:1)Take the Rogue back and pay it off and we both walk away you take your business elsewhere and ill do the same.2) Sell me a vehicle of my choice at cost with no money down, to get me out of this whole you have put me in.3) pay the extended warranty off like you say you have (*don't forget about tax*) plus the $7,117.59 im currently negative on for no reason, ill accept the $6686.00 in negative equity and take my business to one of your competitors. Keep in mind we would be here if Drew didn't screw me over, He admitted to putting the extended warranty on without me knowing to make the deal "work". Which put me into a base model vehicle. He could have easily put me into one with more options.

Mr. [redacted] submitted an internet lead while shopping from home in New York and got in contact with our sales team. Mr. [redacted] and his wife are looking for a Mazda3 S-Grand Touring with specific options and equipment.  We promptly gave them pricing including every item they wanted installed...

as well as their discount and rebates. At this point we informed Mr. [redacted] that we do not have the specific vehicle that he is looking for in stock but we could dealer trade to get one here for him. At this time we also made him aware that we do not do dealer trades without a deposit on the vehicle. Mr. [redacted] proceeded to tell us that he would put a deposit on the vehicle if his wife liked the car.  This is when he let us know in a email that his wife would be traveling to Cincinnati for a business trip and may have some extra time to swing by and take a look at vehicles we have in stock. Mr. [redacted] never put a deposit down so that we could locate the vehicle he requested and we do feel that this was communicated with the customer very clearly. His wife came in a few days later on Thursday afternoon.  We didn't have the car that they were going to buy.  We did have a similar car to what they were wanting in stock, we pulled the vehicle up for viewing and a test drive. We told her this car has all the bells and whistles,  even the same color interior and engine that you are looking for. The only difference was the exterior color and the Manual Transmission.  Mrs.  [redacted] then informed us that she does not know how to drive a manual transmission, we offered to take her for a ride in the car to show off the power and performance she declined. We then pulled up a 2nd car for her that would be the same color and style of the vehicle she was seeking so she could get a feeling of how the color looked in the sun and how the interior felt comfort wise. We did not hide any information from her in regards to the car being different than what she wanted. After the test drive we compared the two vehicles side by side for her. The entire Jeff Wyler Mazda staff at no time during Mrs. [redacted] visit, were anything but kind, answered all her questions and never were we disrespectful nor negative. Mr. [redacted]'s memo title was mailed May 26th, well within the 45 day temp tag expiration.  Unfortunately we have no control as to when the finance company mails out there payment coupons.  Once the vehicle has been sold and the finance company has sent payment to the dealership, per HIPPA...

laws, the finance company will not provide any further information to Jeff Wyler.  The payment due date is listed on the paperwork signed by Mr. [redacted].   There will be no compensation from Jeff Wyler Eastgate. [redacted]Jeff Wyler Automotive Family

I bought one and it causes me pain, see Revdex.com case # [redacted]. In that case I complained of the pain the vehicle caused me. I complained about my safety using the vehicle. The Revdex.com form does not allow to select more than one area of complaint. This complaint is solely on advertising. I have been trying to return the vehicle but unlike the words of Mr. Jeff Wyler "You don't like it bring it back no questions asked" I have been asked many questions, and nobody seems to listen to me when I ask about the commercial's claim. Why doesn't Jeff Wyler Nissan dealer honor the words of Jeff Wyler's radio commercial? False advertisement! The dealer has not allowed me to return the vehicle after many phone calls. How can the company advertise such claims and not honor them. Who looks out for the consumer?Refund - Honor the commercials claim. Take back the vehicle and refund me completely.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]We deny the allegations contained in your email.  First, I was never made aware that a deposit would be needed to secure a "test drive" in a vehicle or any vehicle equipped as I had requested been in correspondence to Mr. [redacted] about. Second how would a car dealership go about filling out paperwork on a vehicle that they do not have a VIN for and by Mr. [redacted] admission is not on the lot and that Jeff Wyler Mazda does not own? It would seem to be very easy for them to fill out whatever they wanted and claim “mistake” on the customer part as a defense to this misleading bait-and-switch tactic. Second, the salesman mislead my wife into test driving a car that was not equipped as requested. In an email from Mr. [redacted], he specifically stated:"I am having my manager run numbers for me now. I just want to double check and make sure I have everything that your wife is looking for. I have a Mazda3 S-Grand Touring…” The list continues on from there. And in that same email trade I also stated that:"My wife will be in Cincinnati on Wednesday and Thursday. During her time there she may be able to drop by and would like to be able to test drive either the car we have emailed about or something comparably equipped, the engine/performance being the most important thing at this point. Would that be possible, assuming she has time between or after her appointments?”To which Mr. [redacted] replied: "That would not be a problem sir.”The original internet request was for a vehicle Mazda3 s-Grand Touring with an automatic transmission, etc. This particular vehicle only come equipped with a 2.5 liter engine. Mr. [redacted] seems to suggest that there must have been a failure of every part of the electronic highway between the service provider whom forwarded the initial request for me, the internet service company(s), as well as myself and that the request was for another vehicle. As you can see Mr. [redacted] did not have the car and in fact put my wife in a car that did not have the engine or transmission that she wanted or that was requested to drive. He even admitted that when she asked about the engine after the test drive. Mr. [redacted] did admit at this point that it was not the car we had requested but that he could go ahead and get he paperwork started on the model we wanted. My response to this bait and switch tactic is simple, why would I allow anyone to do the paperwork for the sale of a car I have yet to see or drive and exactly how would you fill out that contract since the dealer by their own admission lacked a vehicle and therefore a VIN to fill in on the blank in the form for the sale of a vehicle as required by state law? Mr. [redacted] also stated that Wyler Mazda had a manual shift vehicle but did not show it to my wife.

[redacted], The dealer is offering me a belt extender with no guarantee it will work. It is a, lets see if this works solution, not a resolution. I was told on Wednesday 12/28/16 the belt extender may arrive on 12/29/16. As of today 12/30/16 I have not received a call. The belt extender clicks onto the same buckle that is causing me pain, so I do not see how this could possibly be a resolution. But the sales manager [redacted] said to give it a try. He informs me this has worked for some people who have complained on this same issue. The key word is "SOME' people, not all. Once the seat belt extender arrives I will try it, but if it does not take away the pain the buckle puts me in, I do not want the vehicle. Jeff Wyler should honor his words used in the radio commercial (Buy a Nissan from Jeff Wyler if you don't like it bring it back no questions asked). This issue is a safety issue. How does anyone expect me to drive a vehicle that puts me in pain. I cannot focus on my driving.
