*** *** ..........ok this part of there response is true.*** *** purchased her vehicle on 12-5-15....and yes this part is also true..At that time, she was informed that we needed proof of all her income including award letters...but not this part . letters and bank statements as per the lender requirements, and it was a condition nof the loan itself. She did not have all of it at that timeOnce she left, we had difficulty in communications, with no response to our texts or calls to herShe did call about the vehicle having wet carpet after she brought it in for a full detail, and we explained it was from the detail company not letting the car dry out enough and we would take care of thatWe never heard anything more about that particular aspect from the customer..is all lies I have copy,s of texts where I sent to ** *** about the carpets ans witness that send the car before I left the lot and heard *** tell me the wetness on the carpets where due to them detailing it for me.and that it would dry in a few days not to worry about itthat was before I left the car dealerships lot...and if everything was not complete why would you let me drive off the car lot with this car if I was not already financed that would make no since and to let me drive it for days and sneak and take the car back one day before my payment was due then try to say it was because I defaulted on the finance ,so it could only be one I was finance are I was not financed ,,,then when I finally got to talk to *** told be on the phone that they and the bank was backing out of this contract that was on jan.19.2016.at that time I could see clearly where this conversation was going so I ask *** is this conversation being recrded he responded yes I do belivie so..I also have proff where I have texted the lady at the front desk times letting her know that *** never got back with me yet...and as far as this statement not true ....To this date, she has still never provided the proof of income required to get her loan finalized/funded to her lender, and we were extremely patient in allowing her the time she felt was necessary to get these documents to her lender..again if I was not already financed why did you allow me to drive away off the lot with your inventory if they did not leave me to think that I was financed and everything was fine.that would be taking a big chance with such inventory would you not agree ,I don't think dealerships are in the habit of letting maybe financed customers to drive away with there inventory ...and for this statement they made is not honested it is lies.... After approximately a month of us sending someone out to her home in an effort to collect such, we were finally able to collect some of the information required by the lender, they had me jumping throw hoops I have prove that I faxed copy's different times where they where asking for crazy documents like birth certificate of my oldest child and grand daughter I told them I don't have my daughters she is almost years old then they wanted documents showing I had legals custody of my granddaughter and I faxed that ....then a few days latter it was I need a bank statement for december...then a day letter it was now they need December's bank statement as well as reference's they already had December's bank statement ,so I faxed the bank statement and my reference's and for this statement they made... After another week of text's and calls and no return response from her, she then provided a document that was not what the lender required.not true they never texted are called me for a week and no response, and I did submit a print out of my bank statement I went to the bank and had a bank manager to print me out my bank statement...and for this statement they made .....and was unwilling to provide such, we had no choice but to get our vehicle back.....not true I was never unwilling to do my part ....but again on 12-05-i was lead to think that everything was finalized after I meet with the finance officer and we sign all the paper work and I said is that it and he said yes,,,plus I have prof that I was lead to think nothing else was need all my paper work .on the customers vehicle acceptance sheet paragraph( 7) column( c) states there are no additional items due as a condition of the sale of my vehicle unless listed below..then in bold it states the following items will be completed within day's ,,,they wrote nothing due...and also on the Qualified Delivery Permit Form...it don't state that I need to do anything..and when they stated that I said,, or want to do business with usthat's not true I never told them I did not want to do business with them..and as far as this statement they made..We never received what we needed in order to finalize her initial loan, and we pro-actively made her aware of what would occur (she would not be able to keep a vehicle that financing could not be obtained by non-compliance of the conditions of the loan), if she did not get the lender/bank what was needed/required.not true I gave them everything they ask of me..*** *** does not qualify for a zero down loan with any of our lenders, and at the point we had initially gotten her into a vehicle, she could not prove the income required for said loan (which is why the vehicle was never funded/returned to our inventory)and this is not true it was down and a month payment with being financed ....this is all lies to cover up the dishonest sale that they tried to do with me thinking that I was a women with no man there on a fix income would jump to it and do what ever to keep the car...but to there shock I was not going to act like I would do anything for the car meaning take the lemon and not trying to get to the bottom of the issue with such car...I called question them about the car being soaked ,they said they detail it it will dry ok but then it started to smell like mildow and I tried to get to the bottom of that but no response then I contacted them again trying to get to the bottom of the condensation build up on the inside of the glass in the car then when it got really cold the floor mates was frozen to the floor broads of the car and instead of me having to clean the outside of the glass I had to scrap the frost off the in side off the car ,,,that was it for me I called and question about where the car came from who was the other owner I wanted to see the carfax and that was the car in a flood ,,,that's when everything went bad for me they tell me do this get that ,,,they where trying to fine away to do away with this contract because off all the questioning I was doing ,so I started looking my self the carfax report showedYOUR SEARCH RESULTSVehicle:CHEVROLET SONIC LTVIN:***VIN:***Your vehicle has history records.....to me that** a lot for a with only miles on it so I did more searching ...GRIFFIN MOTOR COMPANYWRoosevelt Blvd.Monroe, NC this is who the other owner was of my car......so I did more searching ........this is what I found I thought wow miles so I did a carfax search on this car and I found this..YOUR SEARCH RESULTSVehicle:CHEVROLET CAPTIVA LTZVIN:***Your vehicle has history records.......I searched over vehicle's and they all had so many reports one had and it I think they know that they tried to push a lemon on me the reason I say they pushed it on me is they picked the car for me I did not pick it out..........and they say I brought the car back in to have it fully detailed I would like to see that document that show's where I brought it in and signed for them to fully detail the car...I have witness that will come fourth I have text's fax's my paper work from them that we signed I believe they took the car back because they know that I found out it was a lemon..which was not in good faith and was dishonest untrustworthy as well as giving fraudulent information on some of the car's in there inventory if I could afford the complete carfax I would buy it so I can prove that I had a lemon and they know but I would like to see the paper that I signed off for them to do a detail on such car thank you...FWD 4dr LTZ MarMiles36,322ExteriorBlueInteriorN/ADrive WheelsFWDTransmissionAutomaticStock NumberX144095VIN***OEM ColorBlueket Price $18,981 CERTIFIED2014ChevroletCaptiva Sport Fleet

We have checked with the credit bureau and they have indicated that the removal of inquiries by Equifax/Transunion, those removals should remove any inquiries created by the dealership when the inquiry was ranAgain, we only ran credit for this consumer because her daughter was sitting with a Product Specialist, relaying the information that consumer was providing to her daughter (income/SS #, etc) in an effort to explore the option of a vehicle loanIf consumer was indicating to her daughter to not run her credit, this information was not being provided to the Product Specialist working on this possible saleMcCluskey Chevrolet, has, and does apologize for any inconvenience experienced as a result of this situationWe are offering the consumer the service of having these inquiries removed from her credit reporting

McCluskey Chevrolet has reviewed/researched all the elements regarding this customer complaint*** * *** *** received a great value/deal on the 2006, 109,mile Hummer that they purchased, which I'm sure is part of the reason they purchased the vehicle to begin withThere were no promises
made to the customer with regards to ANY future repairs and that information has been verified by multiple sourcesIf we, as a dealership, had decided to replace/repair items on this high mileage vehicle, then the price that it was sold for would have been reflective of those additional expenses and repairs performed by being a much higher price, not the price that the *** purchased it for.McCluskey in no way, shape or form intimidates or discriminates against anyone - ever, as *** *** has referencedIn fact, most of our buying customers are women! We do, and have valued all of our diverse customer base over the decades of successful selling and the tens of thousands of varied customers that we've provided with a vehicleAs a measure of customer goodwill, McCluskey Chevrolet would be willing to make any repairs that the *** would like, at our internal costWe believe that this is more than fair for a vehicle that was purchased "as is."

Mr*** was/is not a signor on the current vehicle loan for the vehicle purchased recently by his ex-wife, although he was a joint owner on the title of the vehicle that was traded in As previously stated in other Revdex.com communications to Mr*** a payoff on trade in vehicle does not occur until AFTER the new loan, for the new vehicle has fundedAs part of our procedure @ McCluskey Chevrolet, once the funding occurs, within the next 2-business days from that date, we provide the payoff to the lender of the vehicle that was traded in, so that our dealership can then take complete ownership of the traded in vehicle, and get the title into our name, for a possible future saleMore specifically (this information has already been provided to both parties), we overnighted the payoff to the lender of the traded in vehicle on 4-19-In an effort to assist Mr*** with his concerns in this regard, our administrative staff even contacted this lender to verify that the overnight was received, and this fact was verified that it had been signed for/received by them/their company. They also indicated that it usually takes 3-business days for their system to update with the loan being paid off, but that they would make a note in the system until that automated update occurred internallyObviously, McCluskey Chevrolet has no control over the period of time, or the processes that another business/lender follows in the regard of posting the payoffSince Mr*** is not a party/signor on the current loan for the new vehicle, the issue of the shortage of the payoff is a matter to be resolved between McCluskey Chevrolet and Mrs***

I am not comfortable with McCluskey performing any additional work on my vehicle because I believe that they will miss the issue againI would like a $refund so I can go to another dealership to perform the diagnostic and get work done.

We do not have a current approval for *** *** under the terms and conditions of the loan she is referencing, and that she indicates that she would like to haveThis is based upon what has been provided, or was not provided, and was a requirement of her lender, at that timeAlthough we have our collateral (vehicle) back in our inventory based on these factors, (an unfunded loan by the lender), *** *** still has possession of our property, which is a set of keys for our vehicleWe have made attempts to collect our property (keys), by McCluskey staff, she is refusing to turn over our keys to us, and refuses to answer her door in this regardWe wish *** *** luck in the future with a vehicle purchase, but McCluskey is unable to accommodate *** *** in this regard based upon her particular situation, and we do require/need the keys back to our vehicle

Thank you for sending us a copy of the mail piece you receivedThis is something that General Motors sends out from a vendor that they select to use for their mailingsAs of this date, we have also notified them to cease any future mailings from them, to youAs indicated, our internal data bases no longer has your information populated within those data bases for any type of future mailings from usWe trust that this will resolve this situationThanks!

Sales Manager *** *** * McCluskey Chevrolet, received this communication from *** *** on 12-10-with regards to this claim:"I'm paying to have it repaired myself so it's irrelevant at this point." In our opinion, this should now close this case initiated by *** ***

We have requested a check from our administrative office for MsNelson for the "new" key fob she purchased, and has been returned by the customer to our dealershipCash isn't kept on premises in any of our locations, by any department, for employees to refund back to customersThere is a process
that must be followed and it is in the form of a check request to our accounting staff, with proper documentation for a check to be issued back to a customerI will personally follow up with the accounting department to expedite the refund/check to MsNelson if she hasn't yet received it.Our Service Department does charge for programming a key fob for a vehicle, and it a task that must be completed in order for a key fob to properly operate on any vehicle that has a key fob

*** *** purchased her vehicle on 12-5-At that time, she was informed that we needed proof of all her income including award letters and bank statements as per the lender requirements, and it was a condition nof the loan itself. She did not have all of it at that timeOnce she left, we had
difficulty in communications, with no response to our texts or calls to herShe did call about the vehicle having wet carpet after she brought it in for a full detail, and we explained it was from the detail company not letting the car dry out enough and we would take care of thatWe never heard anything more about that particular aspect from the customerTo this date, she has still never provided the proof of income required to get her loan finalized/funded to her lender, and we were extremely patient in allowing her the time she felt was necessary to get these documents to her lenderAfter approximately a month of us sending someone out to her home in an effort to collect such, we were finally able to collect some of the information required by the lender, but there was still another statement (bank statement), that was required by the lender - to prove income, as wellAfter another week of text's and calls and no return response from her, she then provided a document that was not what the lender requiredWe explained, several more times to her, that we would have to get our collateral back (the vehicle), if she did not get the exact statement/document (again, the lender's requirement, not McCluskey), the lender was requiring, because without it, the lender would not fund the loanWhen given this information, she indicated that she couldn't provide this information as she was paperlessMany individuals are paperless now, but that doesn't mean that a bank statement cannot still be printed out, and it's certainly not an excuse in a lenders eyesIf the stipulations/conditions of the approval/loan aren't met by a potential buyer, again, they will not fund the loanWe explained this to her, that documents could still be printed out for her lender, and since she did not provide the required lender conditions of the loan, and was unwilling to provide such, we had no choice but to get our vehicle backThe approval she had previously with us has now expired and there is nothing more that we can do for *** ***She indicted to our Finance Manager (after we got the vehicle back), that she does not even want the car, or want to do business with usShe even indicated to this Manager that she went elsewhere in an attempt to secure a vehicle/loan and they were unable to get her financed, on the conditions that she wanted met by a dealer/lenderWe never received what we needed in order to finalize her initial loan, and we pro-actively made her aware of what would occur (she would not be able to keep a vehicle that financing could not be obtained by non-compliance of the conditions of the loan), if she did not get the lender/bank what was needed/required*** *** does not qualify for a zero down loan with any of our lenders, and at the point we had initially gotten her into a vehicle, she could not prove the income required for said loan (which is why the vehicle was never funded/returned to our inventory)
