Revdex.com Complaint Case # XXXXXXXX
Borrower: [redacted]
Case Opened: 02/05/2014
Consumer Complaint:
Lending Club will not cancel a loan once it is issued
Consumer's Desired Resolution:
Refund
Response:
A Lending Club...

customer may withdraw a loan application at any time before the loan issues. Mr. [redacted]'s loan application was approved on 2/2/14, and his loan issued at 4:05 a.m. Pacific Standard Time on 2/5/14. The loan was issued two business days after his loan application was approved. As Mr. [redacted] stated in his Revdex.com complaint, he sent his withdrawal request to Lending Club on 2/5/14. His withdrawal request was sent to Lending Club and received via email less than ninety (90) minutes before his loan issued.
Both events, loan issuance and Mr. [redacted]'s withdrawal request, occurred approximately two hours before Lending Club Member Support opened for business on 2/5/14. Lending Club Member Support is open for business Monday through Saturday between 6:00 a.m. and 5:00 p.m. Pacific Standard Time.
As stated in his Revdex.com complaint, Mr. [redacted] requested a refund. Lending Club contacted Mr. [redacted] by telephone on 2/10/14. During that telephone call, Mr. [redacted] stated that he had already used the loan proceeds and he has decided to continue with the loan obligation.
Initial Consumer Rebuttal /* (3000, 9, 2014/02/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I did not decide to continue with the loan I had no choice after the days it took to get a response I was not going to sit on a loan and then continue to make the payments on the cards it was meant to consolidate in the "hopes" that I would get a resolution, additionally there was NO MENTION ON THE WEB SITE of the hours of operation NOR this "BEHIND THE SCENES" approval/issue process so the consumer has NO way of knowing the timeline of ANYTHING to the end user the 24 hours could start from any point in time. so how is anyone to know when that clock starts? The case has been referred by the CFPB to the FDIC. I STAND BY MY ORIGINAL STATEMENT I notified the company before the loan was issued. They did not offer to take the loan back at without interest or refund the $250 origination fee.

Revdex.com Complaint Case # XXXXXXXX
Borrower: [redacted]
Case Opened: 02/05/2014
Response to [redacted]'s Rebuttal:
Lending Club is located in [redacted] Lending Club Member Support is open for business Monday through Saturday, from 6:00 a.m. to 5:00 p.m. PST. Our hours of operation are visible and easily accessible on Lending Club's public website.
Mr. [redacted] initiated an online Lending Club loan inquiry on 2/1/14. Lending Club presented him with seven (7) different loan options. Consumers applying for a loan on the Lending Club site are under no obligation to formally apply for the loan choices that are offered to them by Lending Club.
After Mr. [redacted] received his loan offers, he chose to submit an online loan application to Lending Club. On 2/1/14 at 9:42 a.m. PST, Mr. [redacted] electronically signed and submitted a loan application. Mr. [redacted]'s loan application was approved on 2/2/14 at 5:46 pm PST.
On the third business day after Mr. [redacted]'s loan application was approved, Mr. [redacted] sent a loan application withdrawal request to Lending Club via email. The email withdrawal request was delivered to Lending Club at 2:49 am PST on 2/5/14. Mr. [redacted]'s loan was issued at 4:05 am PST on 2/5/14. Thus, Mr. [redacted]'s withdrawal request was delivered to Lending Club, during non-business hours, less than ninety (90) minutes before his loan issued.

Furthermore, Lending Club customers are required to complete the online bank verification to further indicate that they want to move forward with a loan. On 2/5/14 at 3:30 a.m. PST, Mr. [redacted] electronically verified his bank account for the transfer of his loan funds. Once he verified his bank account, the requested loan was issued to him. If Mr. [redacted] had not verified his bank account, the loan would not have been issued to him that morning.
As mentioned in our previous response, Lending Club Member Support opens at 6:00 am PST for business. After Lending Club Member Support had opened for business on 2/5/14, a representative did contact Mr. [redacted] to inform him that he had the option to prepay his Lending Club loan. The payoff amount includes the full amount of the loan and the first month's interest which is owed to the investors who funded his loan.
On 2/6/14, Lending Club was notified of Mr. [redacted]'s Revdex.com complaint. In response to Mr. [redacted]'s Revdex.com complaint, Lending Club contacted Mr. [redacted] by telephone on 2/10/14. During that telephone call, Mr. [redacted] stated that he had already used the loan proceeds to pay his credit card bills and was choosing to keep the loan.

Complaint: [redacted]I am rejecting this response because:  this is not my account, I never got anything in the mail from them and this better be removed from my name before I file legal actionSincerely,[redacted]

Thank you for giving Lending Club the opportunity to respond to[redacted] 's Revdex.com (Revdex.com) complaint. We're sorry Mr. [redacted] was disappointed with his experience. We'd like to explain our application process.
Lending...

Club has strong identity verification and authentication mechanisms to ensure that an application is valid and to avoid the risk of identity theft. Our application process is completed online; therefore, we often look to verify identity via a phone conversation during which we ask several personal questions that only the individual would know. Additionally, Lending Club may request documentation supporting the information listed on the application as part of the identity verification process. The aim is to protect our borrowers from security infringements.
We attempted to reach Mr. [redacted] directly by phone to explain the information needed to process his application but were unable to reach him.
Lending Club received a request from Mr. [redacted] to withdraw his application, and we have complied with his request.
Applying for a loan with Lending Club has no negative effect on an applicant's credit score, and applicants who have withdrawn their previous applications are welcome to re-apply with Lending Club at any time.
If there are further questions regarding this matter, please have Mr. [redacted] contact Lending Club directly by email at [redacted]@lendingclub.com or phone XXX-XXX-XXXX Mon-Sat 6am-5pm PST.

Complaint: [redacted]I am rejecting this response because: The business response is inaccurate.  I did not take screen shots, so I do not have the evidence to demonstrate what their application process was, but I am sure I can contact Best Egg (the lender I was referred to through the website) and get their representation to back up my claim.  They were the ones who informed me of the status of the original request (rejected) but helped me work through a new request which resulted in funding at a slightly higher rate.  Hence the reason I wish to be reimbursed the difference.  Additionally Lending Club did not try to contact me.  I did however receive calls from 2 other lenders they work with that I had NOT requested information from indicating they were calling about the status of my application and continued to call after I informed them I had already been funded and did not wish to be contacted anymore.  The facts are plain.  I filled out an application with Lending Club (which they admit), I was referred to several lenders (they also admit), I chose one and my application information was automatically imported, the import function combined household income in to one income which resulted in me being denied the loan which I had originally applied for (unable to prove beyond getting a representation from the lender I was referred to), that lender indicated they could work with me based on the credit report they had and the verification documents I had sent them so I worked with them (why would I agree to another hard credit pull from a different lender if the information provided was not accurate), the lender could fund me, but at a percentage point higher than advertised by Lending Club, since I could afford the amount I agreed to the loan, but updated my complaint to indicate that Lending Club should pay the difference for their deceptive advertising, I was then contacted by lenders I did not request information from who didn't stop calling after I requested they stop, and now Lending Club is denying the action took place.  I stand by my original statement and now include the phone call harassment and still wish for my resolution of paying the difference of interest that will be paid (which ultimately will fulfill the original terms advertised).Sincerely,[redacted]

Poor experience! They responded to my application saying my request had been funded. Then they asked for a copy of my tax return, pay stubs and a release to get info. from the IRS. I provided all of that and they then told me they couldn't fund my loan because my income wasn't sufficient enough! What? The documentation I provided supported the income I stated on my application that they told me was funded. I then applied to [redacted] and I was approved and funded within 4 days.

Look at their response to negative reviews. It's the same canned response you get when they deny you.

We’re sorry that [redacted]’s customer service experience did not meet her expectations. We attempted to contact [redacted] on 4/20/2016 to discuss options for changing her payment date and method, but...

were unable to reach her.
Lending Club allows borrowers the flexibility to permanently change the day of the month their payments are due.  Our records indicate [redacted] has changed her payment date previously; however, we will work with her to change it again and find a payment date that fits with her new pay cycle.  For the security of our borrowers’ accounts, Lending Club representatives cannot change bank accounts linked to loan payments.  We require borrowers to make the change themselves by logging into their Lending Club account online.  When we spoke with [redacted] in March of 2016, we provided instructions for how to change the bank account on file.
Please note that when borrowers contact Lending Club, we require identity authentication to ensure we are speaking with the correct individual.  We apologize for any inconvenience we may have caused [redacted] as a result of this. Please have [redacted] contact our Customer Advocacy department directly to discuss changing her payment date at ([redacted] ext. [redacted] or email at [redacted].  We thank you again for the opportunity to respond to this complaint brought to your attention by [redacted].

Initial Business Response /* (1000, 5, 2015/05/21) */
Thank you for giving us the opportunity to respond to [redacted]'s Revdex.com complaint. We understand Ms. [redacted] is disappointed, and we would like to clarify the pre-approval process.
Lending Club uses information...

provided by credit bureaus, including credit score, outstanding debt, payment history, and recent credit activity, to identify potential borrowers and send pre-approved loan offers.
At the time of loan application, Lending Club asks the applicant for other important information, such as the applicant's personal annual income and employment status. Because several weeks can pass [redacted] the pre-screening process and the actual application, we also request updated information from the credit bureaus. Both sets of information are used to determine if the applicant qualifies for a loan offer at that time.
Common reasons for being declined for a loan after receiving a pre-approved offer are that an applicant's current outstanding debt is too high relative to the applicant's personal annual income or that changes have occurred in the applicant's credit report since pre-screening. The specific reasons why Ms. [redacted]'s loan application was declined are provided in an adverse action notice, which can be viewed by logging into her Lending Club account summary.
Loans originated through the Lending Club platform are underwritten and made by WebBank, Salt Lake City, UT, member FDIC. Lending Club delivered the adverse action letter to Ms. [redacted] on behalf of WebBank.
Please note that the pre-screening process and loan application do not affect an applicant's credit score, because neither action is reported to credit bureaus as a hard credit inquiry. Ms. [redacted] is eligible to apply again for a loan through Lending Club in the future.
We apologize for any inconvenience this may have caused Ms. [redacted]. To ensure Ms. [redacted] does not receive any future unwanted contact from Lending Club, we removed her contact information from our email and direct mail marketing lists. If there are further questions regarding this matter, please have Ms. [redacted] contact Lending Club directly by email at [redacted]@lendingclub.com or phone XXX-XXX-XXXX Mon-Sat 6am-5pm PST.

payments are due and payable over the loan term, generally 36- or 60-months. The payment amount and payment due date are disclosed in the Truth in Lending disclosure and can also be found in the borrower's online account summary. Lending Club allows borrowers to make additional payments, in whole or in part, without penalty or premium at any time. Any partial prepayment is applied to the principal amount outstanding and does not postpone the due date of any subsequent monthly installments. This policy was communicated to Ms. [redacted] on several occasions via phone.

Under the Fair Credit Reporting Act (FCRA), consumer credit reporting agencies, such as TransUnion and Experian, are...

permitted to include a consumer's name on lists used by creditors or insurers to make firm offers of credit or insurance not initiated by the consumer ("Firm Offers"). Under these same rules, Firm Offers must include instructions for how the consumer may opt-out of receiving future offers. Lending Club direct mail solicitations include a toll-free telephone number, as well as addresses for each of the three major national credit reporting agencies, which consumers can call to opt-out of all Firm Offers. Additionally, the solicitation includes a mailing address and email for consumers to specifically opt-out of communications from Lending Club.
Please note that the pre-screening process and loan application do not affect an applicant's credit score, because neither action is reported to credit bureaus as a hard credit inquiry. To ensure Mr. [redacted] does not receive any future contact from Lending Club, we removed his name and address from our marketing lists on 3/2/2015, and a second physical address he later requested on 8/19/2015. Initial Consumer Rebuttal /* (3000, 7, 2015/09/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Nowhere on their mailer does it indicate this was an invitation to apply. It says plain and simple pre approved. What they are doing is false advertising. I was pre approved for a certain amount and asked for an amount about 10% of what they offered. And their answer was NO in less than 10 seconds. I received a phone call, and was yes'd to death.
False Advertising plain and simple.
Final Business Response /* (4000, 9, 2015/09/29) */
Thank you for giving us the opportunity to respond to [redacted]'s Revdex.com complaint.

Under the Fair Credit Reporting Act (FCRA), consumer credit reporting agencies, such as TransUnion and Experian, are permitted to include a consumer's name on lists used by creditors or insurers to make firm offers of credit or insurance not initiated by the consumer ("Firm Offers"). The mailer Mr. [redacted] received is an example of a Firm Offer. Recipients of a Firm Offer must continue to meet the credit criteria established prior to making the offer. The term "pre-approval" is used because final account approval is subject to reverification of credit history, as well as verification of additional information that is unknown at the time of the Firm Offer, such as income and employment status.
Loans originated through the Lending Club platform are underwritten and made by WebBank, Salt Lake City, UT, member FDIC. As noted in the initial response, Lending Club delivered the adverse action letter to Mr. [redacted] on behalf of WebBank, which Mr. [redacted] can view by logging into his Lending Club Account Summary. Mr. [redacted] is eligible to apply again for a loan via Lending Club 30 days after the date of his last application.
If there are further questions regarding this matter, please have Mr. [redacted] contact Lending Club directly by email at [redacted]@lendingclub.com or phone at XXX-XXX-XXXX Mon-Sat 6am-5pm PST.
Final Consumer Response /* (4200, 11, 2015/09/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The term pre approval is very simple, it didn't say invited to apply. This is false advertising and in my opinion it was a fraudulent mailer. They did take me off the mailing list, but now the same mailer has arrived for my wife. A marriage usually means joint accounts. On her mailer it didn't say invited or invitation, is said pre -approved just like mine. False advertising.

I have tried multiple times to get approved and we have average credit and constantly DENIED CREDIT. I wish they would stop the advertisements if they will not honor the pre-approvals. Impossible to get approved!
