their respective manufacturers contact information.As a courtesy, Meritage offered and the complainant accepted our offer to address the fresh air component of the system. This component we believe is the most important function outside of the solar panels themselves that remain covered under the manufacturers warranty. The solar panels manufacture remains in business and stands behind their product. The conversion process has been completed and the complainant signed off on the work November 2, 2017. Our conversion of this part of the system shows our willingness and desire to go above and beyond assisting our customers to maintan their homes fresh air.We are uncertain why this complaint was filed and trust that the Revdex.com will agree that Meritage has made a good faith effort to assist this complainant and as a result, close this complaint in a satisfactory manner. Best regards,Meritage Homes Corporation

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
In the response from the builder they mention that this is not a warranty issue and that the product selected is a low maintenance and that only required proper cleaning.   I never issue a warranty request on the floor because this issue was noticed during the owners final walkthrough before the closing.  The floor was supposed to be clean before the closing and it never happened.  Also if the floor is low maintenance then why the cleaning crew that they sent wasn't able to remove the stains.  The tile manufacturer representative recommended to clean the floor only with warm water and I have been doing that. Also only the tile was cleaned but not the grout.  As you can see in the attachment from Meritage Homes they included the letter that I sent on December 22, 2014 responding to Mr. [redacted].  As of today I have not hear from them in regard to the letter that I sent.  They have not even been able to give me a clean floor as I was expecting in a new home,The response provided by the company is totally unacceptable since the decisions were made my a person that have not even visited my home to look at the floor.

To whom it may concern. I reject the notion from Meritage that they have done all they can and could have done to resolve this issue. I also reject the notion that the cause of my flooding is due to the 2 down spouts on my back porch. 1). On 5/14/13 12:44 pm an email was sent to Kurtis L[redacted] of Meritage Homes stating that after a recent rain storm my back porch had flooded. This was before I had the gutters installed. 2.) My gutter wasn't installed until September of 2014 and I've have several emails complaining about the drainage an this is after my yard was re-graded by meritage who stated my yard wasn't graded properly in the beginning. 3.) Yes recently meritage did send someone out with a camera to check the the drainage line and his findings were 2 holes he called sunken belly. He place to sticks taped with caution tape to show his findings. Which is the same area meritage has fixed several times over. 4.) I have attached pictures of my back porch today & the day of the rain and you will see the flooding from my backyard into my neighbors yard who has no gutter.from the beginning asked meritage why is my backyard still so soggy and this is days and weeks with no rain. Til this day I cannot get answer

It is important to note all homes will experience some movement form, time to time as homes contract and expand due to the natural settling process. This home closed in 2014 and...

therefore is well into its settling progress. Drywall cracks, nail pops, grout cracks and even some pulling away of countertops are all considered normal and the responsibility of the homeowner to correct after the homes one year anniversary.  We have on several occasions physically joined the complainant in the attic to see the markings they have made in the attic as well as gone above our warranty obligation by contracting a neutral third party structural engineer to inspect their concerns of structural movement. Again, as a courtesy we installed "data loggers" to check for any humidity that could result in abnormal movement. To date, our inspections have not revealed any structural concerns. The third parties report will be completed and shared  with the complainants. Unless the report reveals a structural matter, we will consider this complaint resolved and no further action will be taken. In the unlikely event a warrantable concern is noted within the report, Meritage will at its sole discretion make necessary repairs in accordance with the new home warranty guidelines.  Best regards,  Meritage Homes Corporation

guidelines and best practices, not necessarily hard rules.   We look at each scenario and make a judgment based on making sure there is enough variability between adjacent homes that a particular combination will not detract from the overall look of the community.  We  have built many homes with the same brick, stone,  siding paint, or even the same plan side by side in various communities over the years. After reviewing these two homes, we believe enough variation exist.  The home in question is under construction, once the home is complete and landscaped, it will have a different appearance than that of the complainants home.  While we understand the concerns, Meritage will move forward with the construction of the home as is.  Best regards,  Meritage Homes Corporation

full refund of the earnest monies, if the buyer could not obtain financing within the specified time. The buyers were pre-qualified by their lender; therefore Meritage moved forward and began the necessary administrative work involved to begin construction of their new home. The time period to cancel expired. Later in the process Meritage was notified by the buyers lender that the buyers financial circumstances changed and the buyer no longer qualified; the buyer then cancelled the contract, again well after the expiration period. The earnest money provided at time of contracted was liquidated in accordance with the purchase agreement.  Meritage is not at liberty to share the purchase agreement; we recommend the complaints review their contract in regards to liquidation of earnest monies for non-performance.  We wish the complainants well and do hereby consider this matter resolved.  Meritage Homes Corporation
