of this matter indicates that Midland Credit became the servicer of the
above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland
Funding”), on May 14, 2012.
Information provided by the seller, *** *** ***, at the time of acquisition indicates this account
was originated on March 10, as a ** *** *** and
*** *** account number ending in ***
in the name of *** ***, under the last
four of the social security number ***. Subsequently, the account was charged-off as
an unpaid delinquent-debt on October 7, 2011. The balance at the time of purchase was $825.70. Final payment on the account was received by
Midland Credit on February 6, 2014. *** *** has no further financial
obligation for this account
*** asserts that Midland Credit has updated the dates on his consumer credit
files to reflect this account as new. Please
note that Midland Credit furnishes information on the accounts it acquires
based on the business records maintained by the original lender/seller, and the
payment history of each individual consumer.
While Midland Credit is pleased that it was able to assist *** *** in
reaching a resolution which resolved the balance for the above-referenced
account, it is Midland Credit’s policy to furnish accurate account information. A review of Midland Credit’s business records
indicates that it is accurately furnishing information for the above-referenced
account as “Account paid in full, was a
collection account.”
Midland
Credit has no control over the manner in which each credit reporting agency
decides to display information which is furnished to them. *** *** is encouraged to communicate
directly with the credit bureaus should he have any further concerns. Based on the law and guidelines governing
credit reporting, it would appear that the account information being furnished

his credit report from a compilation source, the information being reported may

*** *** filed a similar complaint through the Consumer Financial Protection Bureau (“CFPB”). A copy of Midland Credit’s response to the CFPB is enclosed. An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on March 8, 2012. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on June 3, 2005, as a *** *** account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on May 29, 2009. The balance at the time of purchase was $482.26. Final payment on the account was received by Midland Credit on March 13, 2013. You have no further financial obligation for this account
*** *** expresses a concern that she paid the above-referenced account in March of 2013, but that it still shows as an open account, in collections, and days past due as of April on her *** *** *** credit reports. Although Midland Credit submits updates to the reporting agencies each month, Midland Credit does not report accounts as “days past due” to the credit reporting agencies. Depending on the current condition of a given account, Midland Credit will report that account as either “Account assigned to internal or external collections,” “Account paid in full, was a collection account,” or “Account paid in full for less than the full balance.”
*** *** is encouraged to communicate directly with the credit bureaus should she have any further concerns about the nomenclature that Midland Credit is compelled to use in credit bureau reporting. In addition, if *** *** obtained her credit report from a compilation source, the information being reported may appear to vary. The credit bureaus have advised that it appears this way because they do not directly populate the fields on credit reports pulled from any source other than directly from the credit bureau itself
*** *** also asserts that each time she disputes the information on her credit report, a new collections date is reported. Please assure *** *** that Midland Credit does not modify or alter any of the original account information provided by the seller, such as the name of the consumer, or the date of occurrence. Midland Credit reports the information on the accounts it acquires based on the business records maintained by the original lender/seller, and the payment history of each individual consumer.
*** *** expresses a desire to have the above-referenced account deleted from her consumer credit files since the debt has been repaid. While Midland Credit is pleased that it was able to assist her in reaching a resolution which resolved the balance for the above-referenced account, please note that it is Midland Credit’s policy to report all accounts accurately. Midland Credit’s business records indicate that it is appropriately reporting the above-referenced account to the three major credit reporting agencies as “Account paid in full, was a collection account,” starting March 20, shortly after the final payment was received
Per *** ***’s previous request to have Midland Credit cease all communications, the above-referenced account will remain marked “Cease and Desist.” *** *** will continue to not receive correspondence or calls from Midland Credit representatives unless a response is required by law.

The balance at the time of purchase was $981.50. Final payment on the account was received by Midland Credit on May 28, 2014. *** *** has no further financial obligation for this account
*** *** expresses a concern that he has received calls times a day. Please assure *** *** that Midland Credit has safeguards in place to ensure that its calls are being placed according to applicable law. A review of Midland Credit’s business records indicates that Midland Credit did not call *** *** more often than is allowable pursuant to applicable law
*** *** also expresses a concern over information that he was advised during phone calls with Midland Credit representatives. A review of Midland Credit’s business records appears to indicate that *** *** was not advised that the account would be removed from his credit report once it had been paid. Midland Credit apologizes for any misunderstandings that may have happened regarding this account. A review of Midland Credit’s business records appear to indicate its representatives have acted appropriately
With that said, on October 3, 2016, a Midland Credit representative reached out to *** ***. During the phone conversation, *** *** was advised that an update would be sent to the credit reporting agencies to have the account information removed from his credit files. The confirmation number for the update that was sent to the credit reporting agencies is ***
Please assure *** *** that Midland Credit is a reputable firm, and that it is a member of the Revdex.com of San Diego in good standing. With numerous scams noted in the media, it can be confusing for a consumer to discern which companies are operating within the law

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on July 30, 2012. Information provided by the seller, *** *** *** LLC, at the time of acquisition indicates this account was originated on May 31, 2007, as a *** *** account number ending in ***, in the name of *** Ajym, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on October 17, 2011. The balance at the time of purchase was $358.85. Final payment on the account was received on October 29, 2012. Dr*** has no further financial obligation for this account
Dr*** expresses a concern that *** added erroneous insurance charges to the account, and that Midland Credit agreed to remove the account from his consumer credit files in exchange for payment resolving the balance. Midland Credit has not received any documentation supporting Dr***’s claim, or any indication from the seller that charges on the account were inaccurate. Additionally, while Midland Credit is pleased that it was able to assist Dr*** in reaching a resolution which settled the balance for the above-referenced account, a review of its business records does not appear to indicate any agreement was made to remove the account from his consumer credit files as part of that resolution
With that said, in keeping with its Consumer-First policy, Midland Credit will fulfill Dr***’s request. While the account will continue to reflect a paid status within Midland Credit’s files, the three major credit reporting agencies have been notified to remove the account from his consumer credit files.

Information provided by the seller, HSBC Bank Nevada, N.A., at the time of acquisition indicates this account was originated on September 15, as a HSBC Bank Nevada, N.A./Best Buy MasterCard account number ending in ***, in the name of *** F ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on September 30, 2010. The balance at the time of purchase was $1,046.45.

Ms*** expresses a concern that Midland Credit has re-aged the account by listing an open date that is later than the original. While Midland Credit is sensitive to Ms***’s concern Midland Credit does not alter or modify any of the original account information provided by the seller, such as the name of the consumer, the date of origination, or the date of occurrence. Midland Credit reports the information on the accounts it services based on the business records maintained by the original lender/seller.

The open date listed on Ms***’s credit report is in fact the date of purchase by Midland Funding LLC. In accordance with the Credit Reporting Resource Guide produced by the Consumer Data Industry Association, the open date being reported on this account reflects the “date that the account was purchased by the debt buyer or placed/assigned to the third party collection agency.”

With that said, a copy of the bill of sale is enclosed. A copy of a seller data sheet confirming the account was included in the purchase from HSBC Bank Nevada, N.Ais also enclosed. Ms*** also states that the last payment made to the account was in 2007. According to the information provided by the seller, the last payment was made on February 5, in the amount of $30.00. Additionally, a review of Midland Credit’s business records indicates the seven-year federal reporting period does not expire until March 2017. Please note that this does not extinguish the debt, rather, it prevents the account from being reported to the credit reporting agencies. The account will still remain collectible, due and owing to Midland CreditAlso, Ms*** states in the previously mentioned email sent directly to Midland Credit that the first date of delinquency has been altered. Further review of Midland Credit’s business records indicate it has consistently reported the first delinquency date as March 11, and continues to accurately report the above-referenced account to the three major credit reporting agencies.

In an email to Midland Credit which was received on October 1, 2014, Ms*** also claims that the Statute of Limitations for the account should be three years, and not eight as indicated in Midland Credit’s previous response. Midland Credit stands by its original response The Statute of Limitations in Montana for Ms***’s account is eight years

If Ms*** is ready to settle the above-referenced debt, she may qualify for a reduction in her account balance. Please have her call Account Manager Denise Longtin at (800) 825-ext*** to assist her in reaching a resolution that will be both beneficial to her, as well as settle the account balance

In the meantime, Per Ms***’s request, the above-referenced account has been marked “Cease and Desist.” While it remains due and owing, Ms*** will no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law

Midland Credit became the servicer of account*** on behalf of purchaser, Midland Funding, on January 18, 2011. *** *** writes that one credit bureau is listing Midland as the original lender. Please note, Midland Credit does not report
as the original lender. Midland Credit reports
as a “Debt Buyer” to the three major credit reporting agencies, and has no
control over the manner in which each credit reporting agency decides to
display that information.
*** *** also states that the credit bureaus all reflect different origination
dates, account numbers, comments and notes.
Midland Credit does not alter or modify any of the original account
information provided by the seller, such as the name of the consumer, the date
of origination, or the date of occurrence.
Midland Credit reports the information on the accounts it services based

Instead, it appears Midland Credit representatives advised her that the account would be reported with a paid status in response to her inquiries about credit reporting.

Yes, I have a account with Midland Credit ManagementI have been trying to pay my account off and they said their home base is in Great Britain I have got three different number and two difference addressWhen you call they ask if you want to speck to an English personWell, you dont get oneyou can not understand themI have tried times with debt card and it was not accept I have called or time and they give me a round around every timeThey ask me to send a money gram, money order or a checkThey will not accept a debt card and they say you can pay it on line and it refuse every timeI dont owe but but I can not get it paid offI have been scam once before and so afraid this is what is happening

Subsequently, the account was charged-off as an unpaid delinquent-debt on June 13, 2014. The balance at the time of purchase was $308.48. Final payment for the account was received on March 16, 2016. *** *** has no further financial obligation for account no***

Additional payments to *** *** after the charge-off date resulted in a balance at the time of purchase of $197.97. Midland Credit received five payments forwarded by *** *** totaling $103.00, which were made directly to *** *** between January and May of 2016, resulting in a remaining balance of $
Please note that Midland Credit management has not charged any interest toward the balances of your accounts. In keeping with its Consumer-First policy, Midland Credit made the business decision to consider the amounts paid satisfactory to resolve the balance for account number ***. *** *** has no further financial obligation for the above-referenced account
