For your reference, details of the offer I reviewed appear belowThis company has falsely reported me to the three credit bureaus repeatedly I paid off my *** account several years ago, so therefore I do not owe anything to Midland FundingI feel this company harasses people until they cannot take any moreThere are several websites with numerous complaints such as mine against this companyMidland Funding has re-aged this account for the year to make it look current and try to get me to pay them moneyWhy didn't they provide any information before now when I repeatedly asked them why they were calling me and reporting me to the credit bureaus?? In addition, they say I have an attorneyI do not know what records they are looking at, but I have not retained an attorney for this matterI sincerely hope that my case gets reviewed and resolved to my satisfaction and Midland removes all negative information from my credit report.

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on October 1, 2015. Information provided by the seller, *** ***, at the time of acquisition indicates this account was originated on June 1, as a *** ***/*** *** *** *** account number ending in ***, in the name of *** ***, under the last four of the social security number *** Subsequently, the account was charged-off as an unpaid delinquent-debt on August 14, 2015. The balance at the time of purchase was $2,556.76.
Information provided in the submission through your office, and a review of Midland Credit’s business records indicates that *** *** is the attorney-in-fact for *** ** ***, who is the consumer. *** *** expresses concern that she received repeated calls, and was requesting that any payment plans be presented in writing, and that the calls to her stop. On November 2, 2015, Midland Credit received correspondence from *** *** requesting no more calls. At that time, *** *** account was appropriately marked “Direct Mail Only.”
*** *** also writes that *** *** is unable to pay due to the hardships of advanced age and health issues. In keeping with its Consumer-First policy, Midland Credit made the business decision to close the account. There will be no further collection activity or sale of this account.

Midland Credit provided all of the account identifying information in its previous letter response to your office dated December 5, 2014. *** *** continues to express concern that Midland Credit has not provided adequate verification of debtAs stated in its previous response, Midland Credit mailed *** *** separate and unique validation letters for each of the accounts. None of the letters were not returned “undeliverable” by the United States Postal Service. Copies of the verification information provided by the respective sellers for each of the accounts were provided in Midland Credit’s previous response. Additional copies are attached to this response
*** *** expresses additional concern that Midland Credit has re-aged the accounts by listing an open date that is later than the original. While Midland Credit is sensitive to *** ***’s concern, Midland Credit does not alter or modify any of the original account information provided by the seller, such as the name of the consumer, the date of origination, or the date of occurrence. Midland Credit reports the information on the accounts it services based on the business records maintained by the original lender/seller.
In accordance with the Credit Reporting Resource Guide produced by the Consumer Data Industry Association, the open date being reported on the accounts reflects the “date that the account was purchased by the debt buyer or placed/assigned to the third party collection agency.” The open date listed on *** ***’s credit report for each respective account is in fact the date of purchase by Midland Funding LLC. A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced account to the three major credit reporting agencies

*** *** indicates that the original creditor had determined that the account was fraudulent and had subsequently deleted their trade line from his credit reportPlease note that when Midland Funding purchased the account it was not aware that the account was opened fraudulentlyIn addition, *** *** states that he mailed letters to Midland Credit disputing the account and had not received a responseMidland Credit does not have a record of receiving written correspondence from *** *** pertaining to this specific account
Upon receipt of the complaint filed through your office, Midland Credit was able to confirm with *** that the account was in fact fraudulentMidland Credit acted in a timely manner and has complied with all applicable laws. However, in keeping with its Consumer-First policy, Midland Credit made the business decision to close the account. There will be no further collection activity, furnishing of account information to the credit bureaus, or sale of this account. In addition, the three credit-reporting agencies have been notified to delete Midland Funding’s reference to the collection account in question from *** ***’s consumer credit files

Credit”) received
the same day via E-mail. Midland Credit appreciates the opportunity to

An
investigation of this matter indicates that Midland Credit became the servicer
of the above-referenced account on behalf of purchaser, Midland Funding LLC
(hereinafter “Midland Funding”), on September
8, 2009. Information
provided by the seller, Jefferson Capital Systems, LLC, at the time of
acquisition indicates this account was originated on July 24, 2007, as a
First Bank of Delaware/Tribute MasterCard account number ending in ***, in the name of Micheal ***,
under the last four of the social security number ***.
Subsequently, the account was charged-off as an unpaid delinquent-debt
on May 28, 2008.
The balance at the time of purchase was $855.25.
Mr
*** writes that the account is over seven years old and requests it to be
removed from his credit report. A review
of Midland Credit’s business records indicates that the seven-year Federal
Reporting period for the above-referenced account does not expire until October
2014. Please note that this does not
extinguish the debt. Rather, it prevents
the account from being reported to the credit reporting agencies. The account will remain collectible, due and
owing to Midland Credit.
Mr
*** also conveys that he is a disabled veteran with a traumatic brain
injury Midland Credit is sensitive to Mr
***’s situation, and in keeping with the Forgiveness and Hardship
Guidelines found in Article of its Consumer Bill of Rights, will cease
collection activities once it receives documentation from Mr*** identifying
that his only source of income is from an exempt income source. He may forward the appropriate documentation
to Consumer Support Services at the address on this letterhead.
Per
Mr***’s request, the above-referenced account has been marked “Cease and
Desist.” While it remains due and owing,
Mr*** will no longer receive correspondence or calls from Midland Credit
representatives unless a response is required by law.

Midland Credit Management, Inc("MCM" and the "Company") claims I have an attorney which is incorrectPlease note I am not nor have I ever been represented by an attorney outside of the class action lawsuitI merely indicated if this matter could not be resolved amicably then I would retain an attorneyThis complaint was my last effort to resolve this matter without retaining an attorney
MCM's response is the exact same response I received prior to filing my complaint with the Revdex.com The Company continues to be allusive regarding their agreement with the original creditor and if they have the ability to charge interest on the charged off debt*** code requires the company provide the contracts, both the original credit card agreement and the contract between the Company and the original creditor to the debtor if requestedI've requested this information several times to no availThey claim they are charging an interest rate less than the original interest rate however, can provide no reason or logic for the 15%*** code also specifies the percent a debt collector is allow to charge and it is well under 15%
All in all, MCM has provided no proof they were allowed to charge the post-charge off interest of $to my accountThey have merely taken the "trust me we can charge this" approach hoping I will accept itI do not accept that! They have provided the two pieces of paper (credit card statements) attached to their response here many times which provide only the original debt amount and the interest rate of the credit card which I already knewIt provides no other verification about their ability to charge additional interest in the charged off balance*** *** makes reference to a contract in his June 1, response but has yet to produce the contract to me for review
He further states that they have "made the business decision to stop accruing interest on the account" but what he do not indicate is that there was a company wide policy change to no longer accrue interest on any of the accounts held with their Company effective of December 31, Yet again more word play from MCMI'm sure that policy change came after several similar complaints like mineThey nearly doubled my original debt
I will contact *** ***, the Account Manager in MCM's response, however, I would like my complaint to remain open until I speak with *** *** regarding this matter as I have spoken to many "Account Managers" at MCM with no success

will have to dwell into this a little further On April 31st a counselor
at *** community college had called *** Pd to do a wellness check on
me*** Pd contacted this counselor and stated that I was not at home at
the time of the wellness check a few hours later another counselor had
contacted *** Pd again around 1:Pm*** Pd had me voluntarily committed
to UPC / Urgent
Psychiatric Care Center in *** where I was at for almost eight hours
This can be verified by both the *** Police Department and the Counseling
office at *** Community College
My mother, grandmother, and grandfather
have all passed away in the last four yearsAll of these death records are
public knowledge. In regards to my
injury I sustained a shoulder surgery months before my mother had passed and
was unable to get treatment right away due to her declining healthAnd during
that time I had developed a rather large labrum tear in my left shoulder in
which I had a nearly hour operation and was in a sling for nearly two months
and five months of physical therapyI provided the Revdex.com the arthroscopy photo
graphs of the surgery and a photo my left shoulder with the suture scars from
the incisionsObituaries were also provided for my grandmother and
grandfather
In regards
to the attorney who is handling this case*** *** has an F rating on the
Revdex.com for each and every complaint filed against them they only respond to obtain information on
the debtor not only that he doesn’t formally respond to complaints onlineI
will also provide a copy of the statement he makes for each and every
complaintThere was a car in my drive way blocking me from coming and going it
was a newer model Chevy equinox or trail blazer in which it was silver in
colorA neighbor had also witnessed this car stop at my residence not once but
timesAlso the law states that no debt collector cannot discuss this debt
with anyone besides the debtor
A copy
of the court paper work was placed on my door with a blue painters tapeThis
violates law as it was in plain view as the mail man or anyone else who came up
to the door could clearly see it as the mail box is located directly next to
the door where the paper work was left*** *** did not provide a debt
validation paper or any type of original contract that I may or may have not
signed with the original creditor simply as they did not have itMidland has
only forward this information to *** *** not to assist with this complaint
but only to collect more information I could
have taken this to court but as I stated I do not have the money to even pay a
simple court cost to file an answer with the court
Not only that I have been
punished by my employer by thisMy hours are restricted as opposed to others I did not received a yearly service award and I
cannot purse better job opportunities because of thisI have sought counseling
over this consoled with friends and none of them have ever heard of someone
being sued for a small credit card debt but it has happened to me with this
lawyer *** *** did not reach out
to me once prior to taking me to court he never once calledBut I did get at least
different documents and even a threatening demand letter that I pay up or
they would garnish my wagesThis is simply because he does not want to assist
he simply wants to go to court so that he and midland can get a judgment tack
on interest because they know I cannot
pay them a huge lump sumSo they’ll garnish wages and let the interest
increase because the balance on these accounts has nearly doubledJust alone
they have tacked on nearly for court costs and lawyers’ fees another
just to file the garnishment papers
Not only that even if somehow managed I paid
them they would still not remove any negative information on my credit and I have
even heard from other consumers including the Revdex.com that even after settling that
this lawyer still garnished their wages The bottom line is that the reason Midland and
*** *** won’t let me move on with my life is because there making money
off of thisThey bought these debts for pennies on the dollar but they want to
collect nearly twice what the original debts areI have other debts from the
passing of my mother some more significant than others but this collection agency and
lawyer by far are the most aggressive debt collects they refuse to assist
consumers who face extreme hardships, they take people to court who otherwise
do not have the legal knowledge or know how, nor can’t they afford an attorney
Im tired of midland im tired of them harassing me and what’s worse all they
want is to collect money from and personal information me I do not find this at
all an acceptable response to my complaint.

no***, on behalf of purchaser, Midland Funding, LLC (“Midland Funding”)
on May 29, 2012. Information provided by
the seller, *** *** *** ***, at the time of acquisition indicates
this account was originated on April 23, as a *** *** account
number ending in *** in the name of *** ***, under the last four of the
social security number ***.
Subsequently, the account was charged-off as an unpaid delinquent-debt
on September 21, 2011. The balance at
the time of purchase was $588.65.
Midland Credit became
the servicer of account no*** on behalf of purchaser, Midland
Funding, LLC (“Midland Funding”) on March 26, 2013. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated
on August 13, as a *** *** account number ending in *** in the
name of *** ***, under the last four of the social security number
***. Subsequently, the account was
charged-off as an unpaid delinquent-debt on June 21, 2012. The balance at the time of purchase was
$573.65.
*** *** expresses a
concern that Midland Credit has listed an open date later than the original on
her consumer credit files. While Midland
Credit is sensitive to *** ***’s concern, Midland Credit does not alter or
modify any of the original account information provided by the seller, such as
the name of the consumer, the date of origination, or the date of
occurrence. Midland Credit reports the
information on the accounts it acquires based on the business records
maintained by the original lender/seller.
The open date listed
on *** ***’s credit report is the date of purchase by Midland Funding. In accordance with the Credit Reporting
Resource Guide produced by the Consumer Data Industry Association, the open
date being reported on this account reflects the “date that the account was
purchased by the debt buyer or placed/assigned to the third party collection
agency.”
*** *** also
expresses a concern that Midland Credit is reporting as “late” on her consumer
credit files. Although Midland Credit
submits updates to the reporting agencies each month, Midland Credit does not
report accounts as “late” to the credit reporting agencies. Depending on the current condition of a given
account, Midland Credit will report that account as either “Account assigned to internal or external
collections,” or “Account paid in
full, was a collection account.”
Additionally, *** *** indicates that Midland
Credit representatives declined her request for a deletion letter While Midland Credit is pleased that it was
able to assist *** *** in reaching a resolution which settled the balances
for the above-referenced accounts, please note that it is Midland Credit’s
policy to report all accounts accurately.
A review of Midland Credit’s business records indicates that it is
accurately reporting the above-referenced accounts as “Account paid in full, was a collection account.” If Midland Credit were to delete the accounts,
its correct and accurate status would not be reflected
With that said, *** *** is encouraged
to communicate directly with the credit bureaus should she have any further
concerns about the nomenclature that Midland Credit is compelled to use in
credit bureau reporting. Based on the
law and guidelines governing credit reporting, it would appear that the
above-referenced accounts are being correctly reported Midland Credit will be closing its
investigation of *** ***’s dispute and will be resuming regular collection
activities as allowed by the *** Finance Code and/or the Fair Credit
Reporting Act.

which Midland Credit Management, Inc(hereinafter “Midland
Credit”) received the same
day via E-mail.
Midland Credit appreciates the opportunity to answer your questions.
An
investigation of this matter indicates that Midland Credit became the servicer
of the above-referenced account on behalf of purchaser, Midland Funding LLC
(hereinafter “Midland Funding”), on July 29, 2011. Information provided by the seller, Atlantic
Credit & Finance, at the time of acquisition indicates this account was
originated on April 11, 2003, as an HSBC Bank Nevada, N.A./Yamaha credit card
account number ending in ***, in the name of *** ***, under the last four
of the social security number ***.
Subsequently, the account was charged-off as an unpaid delinquent-debt
on May 31, 2008. The balance at the time
of purchase was $4,983.17. Final payment
on the account was received on November 6, 2013. *** has no further financial obligation
for this account.
Mr
*** writes that while he resolved the debt, a lien release was not
immediately issued to him. A review of
Midland Credit’s business records indicates that on March 11, 2014, Mr***
called Midland Credit to request a lien release. The representative appropriately advised Mr***
that he needed to provide Midland Credit with a copy of the registration as proof
of ownership so that it could issue the lien release to him. Midland Credit’s business records indicate
that the requested documentation was not received from Mr*** until May
9, 2014. Accordingly, a lien release was
forwarded to Mr*** on May 13, via certified mail (#*** *** *** *** ***). A copy is attached for Mr***’s
records.

assured that Midland Credit is a reputable firm, and that it is a member of the

investigation of this matter indicates that Midland Credit is the servicer of two
accounts being reported to the three major credit reporting agencies and belonging
to the complainant. Midland Credit
became the servicer of account no***, on behalf of purchaser, Midland Funding,
LLC (“Midland Funding”), on December 28, 2011.
Information provided by the seller, *** *** *** ***., at
the time of acquisition indicates this account was originated on June 30, 2008,
as a *** *** ** *** *** *** account number
ending in ***, in the name of *** ***, under the last four of the social
security number ***. Subsequently, the
account was charged-off as an unpaid delinquent-debt on January 30, 2009. The balance at the time of purchase was $772.25.
Midland
Credit became the servicer of account no***, on behalf of purchaser,
Midland Funding, on September 8, 2009.
Information provided by the seller, *** *** *** ***, at
the time of acquisition indicates this account was originated on July 23, 2008,
as an *** *** *** *** account number ending in ***, in the name
of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as
an unpaid delinquent-debt on May 5, 2009.
The balance at the time of purchase was $624.55.
*** *** expresses a concern that Midland Credit has re-aged the above-referenced
accounts by listing open dates that are later than the originals on their
consumer credit files. While Midland
Credit is sensitive to the consumer’s concern, Midland Credit does not alter or
modify any of the original account information provided by the seller, such as
the name of the consumer, the date of origination, or the date of
occurrence. Midland Credit reports the
information on the accounts it services based on the business records maintained
by the original lender/seller. The open
dates listed on *** ***’s credit report are in fact the respective dates
of purchase by Midland Funding. In
accordance with the Credit Reporting Resource Guide produced by the Consumer
Data Industry Association, the open dates being reported on the accounts
reflect the “date that the account was purchased by the debt buyer or
placed/assigned to the third party collection agency.”
A
review of Midland Credit’s business records indicates that the statute of
limitations expired on July 4, for account no***, and on November
4, for account no***. However, please note that the passing
of the statute of limitations does not extinguish the validity of the debts
Rather, it eliminates litigation as a potential remedy
Similar
to the statute of limitations, the expiration of the seven-year Federal
Reporting period also does not extinguish the debts. It only prevents the
accounts from being reported to the credit reporting agencies. A review
of Midland Credit’s business records indicates that the seven-year Federal
Reporting period will expire in July for account no***, and in November
for account no***. A review of Midland Credit’s business
records indicates that it is accurately reporting the above-referenced accounts
to the three major credit reporting agencies
If
*** *** is ready to resolve the above-referenced debts, they may qualify
for a reduction in their account balances.
Please have them call Account Manager *** *** at *** *** *** *** to assist in reaching a resolution of the account balances

Once Midland Credit has obtained verification, a copy will be sent to your office. Additionally, as previously stated, Midland Credit will continue to not furnish account information to the three major credit reporting agencies until it is able to provide *** *** with verification of the debt
While not referenced in *** *** original complaint through your office, *** *** requests proof of the statute of limitations. Midland Credit provided all of the account identifying information in its previous response to your office dated October 20, 2015. In his most recent complaint, *** *** expresses a desire to have his account deleted from his consumer credit files upon resolving the balance. However, he also states that if Midland Credit will not delete the account he still offers to resolve the account balance for $300.
In keeping with Midland Credit’s Consumer-First policy, and to provide the highest level of consumer satisfaction, it will accept $in order to resolve the balance with the understanding that Midland Credit will furnish information for the account as “Account paid in full, was a collection account” with an additional memo stating “Account paid in full for less than the full balance.” Additionally, as *** *** states he still disputes the account, Midland Credit will also continue to report that the account is disputed. Midland Credit provided all of the account identifying information in its previous letter response to your office dated December 2, 2014. *** *** writes that she is not going to provide the requested documentation in order to allow Midland Credit to investigate her claim of fraud, because she has already sent it to Midland Credit and ***. As referenced in the previous response, Midland Credit has not yet received any such documentation.
*** *** also writes that *** has recognized that the debt is not hers. As also referenced in the previous response, the seller has not advised Midland Credit of any documentation or information related to *** *** claims. Until such documentation is received, based on the information provided by the seller, Midland Credit must respectfully conclude the above-referenced account remains collectible, due, and owing to Midland Credit. A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced account to the three major credit reporting agencies
With that said, Midland Credit remains ready to assist her in clearing her record if she has been a victim of identity theft or fraud. If such is in fact the case, Midland Credit respectfully requests that *** *** provide it with a copy of either a police report or affidavit of fraud showing that she reported the fraudulent activity. Please note that an affidavit of fraud can be found at *** If submitting an affidavit of fraud, *** *** should complete the form and have the form notarized. She may forward appropriate documentation to Consumer Support Services at the address on this letterhead.
In her current complaint, *** *** writes that she will let her attorney deal with her concerns regarding this account. Going forward, all communication about the matter should be handled by her attorney. The account has been notated appropriately. If *** *** is no longer represented by an attorney, please have her provide Midland Credit with written notice so it may update its records and allow its representatives to communicate with her directly
