dated February 28, 2014. In her
follletter, *** *** pasted information about how the above-referenced
account is appearing to her when she is checking her consumer credit filesAs
there was no statement made to explain what may be of a concern to her, Midland
Credit assumes it has to do with the commentary in the Current Status field of
the information she provided in her follow-up
As stated in its previous response, although
Midland Credit submits updates to the reporting agencies each month, Midland
Credit does not report accounts as “days past due” to the credit reporting
agencies. Depending on the current
condition of a given account, Midland Credit will report that account as either
“Account assigned to internal or
external collections,”
or “Account paid in full, was a
collection account.” Midland
Credit’s business records indicate that it is appropriately reporting the
above-referenced account to the three major credit reporting agencies as is
required
It appears that *** *** pulled her
credit report from a compilation source, ***
rather than from the credit bureaus directly.
As a result, the information being reported may appear to vary The credit bureaus have advised that it
appears this way because they do not directly populate the fields on credit
reports pulled from any source other than directly from the credit bureau
itself

An investigation of this matter indicates that Midland Credit is the servicer of an account belonging to another consumer with the same name as *** *** During a search for the correct consumer, *** *** phone number was provided to Midland Credit representatives by a third party. In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account.
A review of Midland Credit's business records indicates that it made contact with a third party, presumably *** *** on February 2, 2016, in an attempt to contact the correct consumer During that conversation the phone number listed in her complaint, the phone number *** *** was disabled. An additional review of Midland Credit's business records does not indicate there was a conversation with *** *** last year in which she requested calls to cease, in fact, Midland Credit did not dial the above referenced phone number prior to January 1, *** ***’s phone number has been added to an exclusion list to prevent it from being called in the future regarding the referenced account

Thank you for your letter inquiry dated April 18, 2014, regarding *** *** complaint, which Midland Credit Management, Inc(hereinafter “Midland Credit”) received the same day via E-mail. Midland Credit appreciates the
opportunity to answer your questions.
An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (hereinafter “Midland Funding”), on September 8, 2009. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on April 18, as a *** *** ** ***/*** *** account number ending in ***, in the name of *** * ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on April 27, 2009. The balance at the time of purchase was $987.60. *** *** writes that Midland Funding continues to report on his consumer credit files while the original creditor has deleted their tradeline.
As the original creditor, *** *** ** *** may be reporting the account or may have decided to delete its tradeline when it sold the account. Whether or not the original creditor is reporting the account, the account remains valid, due and owing. Consumers are often unclear as to what the term “charge off” means for a debt. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt to a collection agency. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account. *** *** also expresses concerns that interest has continued to accrue
Please note that the account was purchased from the seller with all rights. Interest charged by the original creditor is allowable by law. Likewise, any interest added by Midland Credit is permissible and was provided for in the contract with the original creditor when the account was purchased. This information would also normally be included in the paperwork the consumer receives when the account is initially opened. Midland Credit does not assess interest to a consumer’s balance throughout the period of active repayment; however, missed payments will invalidate the agreed upon arrangement. Interest on the account which had been deferred while payments were being received would be added back to the account after payments ceased.
With that said, Midland Credit stands ready to assist *** *** in clearing his record if Midland Credit is somehow attempting to collect an account which was resolved prior to Midland Credit becoming the servicer, and requests that he provide documentation or evidence which substantiates *** ***’s claim. *** *** may forward the appropriate documentation to Consumer Support Services at the address on this letterhead As no indication from the seller, nor documentation from *** ***, has been provided to indicate the debt is no longer due and owing, Midland Credit must respectfully conclude the debt remains valid. A review of Midland Credit’s business records indicate that it is accurately reporting the above-referenced account to the three major credit reporting agencies *** *** also expresses a concern that calls were made to him at work after advising Midland Credit not to do so and that its representatives hung up on him
A review of Midland Credit’s business records indicates all calls with *** *** were ended by him and not its representatives. Additionally, although *** *** did not provide the number in question within the complaint forwarded by your office, a review of Midland Credit’s business records indicates it has one work phone number for *** *** associated with the above-referenced account: *** ***. Upon *** ***’s verbal request made on June 12, 2012, Midland Credit marked the phone number as “Do Not Call.” No calls have been made to this number since June 12, 2012. All other phone numbers associated with the above-referenced account were provided to Midland Credit as non-work phone numbers. Subsequent attempts to contact *** *** via phone were made accordingly and within applicable law. During a March 22, phone conversation, *** *** stated not to call him at work before hanging up on the Midland Credit representative. Although the phone number in question ((907) 376-8400) was provided to Midland Credit as a home phone number, the Midland Credit representative marked the number as “Do Not Call” at that time per *** ***’s statement. Adhering to *** ***’s request within his complaint, the above-referenced account has been marked “Cease and Desist.” While it remains due and owing, *** *** will no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law Midland Credit considers consumer complaints a serious matter, and fully respects consumers’ rights. Midland Credit apologizes for the inconvenience caused to *** ***

I first discovered the existence of this account on my credit report, not from any letter or validation they sent. Under *** Finance Code, Midland should have responded to my request within days. I am making every effort to resolve this matter without presenting this case to a courtroom before a jury. This is a consumer rights issue. For your reference, details of the offer I reviewed appear below.As we can all now see and has been confirmed by MCM, I was unaware of the pending lawsuit at the time I paid the debt in full, which eliminates the idea that I paid it because I was being suedAgain, I maintain my position that I was led to believe that I would be able to have this deleted from my credit report if I paid in fullIt's common knowledge that people settle old debts like this for to cents on the dollar EVERY DAYI had literally no other incentive to pay in full other than the fact that I thought it would improve my credit reportEveryone knows that a "Paid in Full" notation on a collection account does nothing to help a credit score, and can actually hurt a credit score in some casesI know that debt collection agencies are dishonest by their very nature, but MCM's steadfastness in denying my simple request to honor their agreement shines a new light on them from my perspectiveMCM and Midland Funding have had multiple class action lawsuits brought against them for their deceptive business practicesIt's clear to see that they run a shady business with no concern for those they harass. They got every penny they said I owed them, yet they still wish to see my credit damaged for the next several yearsRegarding *** *** assertion that they received no letter from me, I have attached copies of the return mail receipts that were signed by one *** *** The letter was sent on September 26, 2015, and was signed for by MCM on September 29, I'm not sure what role *** *** serves within the company, but he did sign to claim he received the letter
Once again, this is another lie put forward by MCM and Midland FundingIt's a good thing I sent it return receipt, or else we would have had to believe *** *** claimI'm going to allow MCM to read my latest response that catches them in their growing web of lies so that they can resolve this matter before I file suitIn the meantime, my complaints with the agencies in the previous correspondence will be filedI look forward to MCM's response, and I would appreciate it (as I'm sure *** *** would) if the outright lies stoppedThis has a simple solution, so fix it before you rack up $10,000+ in expenses and hassle over a $alleged debt that was paid in full

As such, going forward, all communication about the matter should be handled by his attorney. If *** *** is no longer represented by an attorney, please have him provide Midland Credit with written notice so it may update its records and allow its representatives to communicate with him directly
An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on May 8, 2013. Information provided by the seller, *** ***, at the time of acquisition indicates this account was originated on January 14, 2004, as a *** *** *** *** *** account number ending in ***, in the name of *** * ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on February 28, 2011. The balance at the time of purchase was $4,833.78.
*** *** expresses a concern that the account status was not updated properly following settlement of the account. A review of Midland Credit’s business records indicates that on October 20, 2013, this account was assigned to Midland Credit’s *** *** collections department (“*** ***”) whose mailing address is ** *** *** *** *** ** *** *** *** *** ** *** ***. Midland Credit has forwarded a copy of *** ***’s complaint to the firm and inquired with them regarding the matter. The firm has advised that a settlement amount of $was agreed to and satisfied via a payment received by *** *** in July
Due to administrative oversight, the account status was not updated in Midland Credit’s records until January 2015. At that time, Midland Credit notified the three major credit reporting agencies to report the account as “Account paid in full, was a collection account” with an additional memo “Account paid in full for less than the full balance.” Further review indicates the account has been reporting as such since January
While the current reporting is accurate, the three major credit reporting agencies have been notified to delete Midland Credit’s reference to the collection account from *** ***’s consumer credit files. Midland Credit will continue to reflect the account as Paid within its files Please advise *** *** that it may take the credit bureaus up to days to reflect the removal of the account on his credit report. *** *** has no further obligation for this account

It is preposterous to think I would settle a nonsensical 'debt' with NO upside, namely full removal from my reportAbsurd!]

I know that I was told by the account specialist that I was offered a payoff amount of $and not anywhere in the dollar amountAs for the pay off my daughter did call in February to pay this off and since then I have tried two other times to pay off that they are not reveling
I have also called and spoke to many managers about this account and know ever gives me any information I did move a partial payment to the end of the month to make it a whole payment at once and said not to have anything changed on the account
The last payment I made is when I asked about paying off the account and that is when I was told I cannot do that they must have stopped the payment plan themselves
I do not wish to have further contact with this company since the last time I called and spoke to a manger he was very rude and yelled at me saying they will not take a pay off and then hung up
I am still waiting for a break down or some kind of confirmation of what was said to me to pay off account and the payments when I asked my account person for this she said she cannot help with this and I have not heard from any one since

As the above-referenced account was originated on August 1, 2001, it could not have been included in that bankruptcy filing.

In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account. A review of Midland Credit’s business records indicates that one call was placed to *** *** on November 21, 2015. At that time, the Midland Credit representative appropriately marked *** ***’s phone number “Do Not Call” in its computer system for the referenced account

Often a consumer will speak to someone from one collection agency and then believe that any subsequent collection calls, even those from another collection company, are from the same company. Since *** ***’s complaint states that he is receiving calls well in excess of those made by Midland Credit representatives, it appears that this has happened to *** ***

Information provided by the seller, Asset Acceptance, LLC, at the time
of acquisition indicates this account was originated on March 8, as a ** *** *** and *** credit card account number ending in ***, in the
name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as
an unpaid delinquent-debt on June 2, 2010.
The balance at the time of purchase was $1,227.98.
Midland Credit became
the servicer of account no***, on behalf of purchaser, Midland Funding
on March 28, 2012. Information provided
by the seller, *** *** *** and *** Receivables, at the time of
acquisition indicates this account was originated on June 7, as a *** *** *** credit card account number ending in ***, in the name of ***
***, under the last four of the social security number ***. Subsequently, the account was charged-off as
an unpaid delinquent-debt on August 5, 2010.
The balance at the time of purchase was $197.74.
Mr*** expresses
a concern that Midland Credit representatives have contacted him
excessively. Please assure Mr*** that Midland Credit has safeguards
in place to ensure that its calls are being placed according to applicable
law. A review of Midland Credit’s business records indicates that Midland
Credit did not call Mr*** more often than is allowable pursuant to
applicable law
With that said, per Mr
***’s request, the above-referenced accounts have been marked “Direct Mail
Only.” While they remain due and owing, Mr*** will no longer
receive phone calls from Midland Credit representatives and all correspondence
will be sent via the United States Postal Service

Midland Credit provided all the relevant account information in its previous letter response to your office dated May 20, 2014. Mr*** writes that he has received the incorrect lien release. A review of Midland Credit’s business records indicates that the seller, Atlantic Credit & Finance, included documentation on the account matching two separate vehicles. Due to administrative oversight, the initial lien release was processed for the incorrect vehicle. A new lien release has been prepared, matching both the information provided by the seller and the registration information Mr*** previously provided to Midland Credit, and it was mailed out to Mr*** on June 9, 2014, in a certified letter (#*** *** *** *** ***). A copy is attached for Mr***’s records

I have been dealing with midland credit management for approximately 2years for a sears/citi credit cardI have been making timely payments until I was able to make a lump some of payment of $to clear off the accountI wrote a personal check to them and the check was processed and cleared by capital one bankI have called repeatedly and requested a paid-in-full letter, and I was told that the process will take 3-weeks because I paid off the account with a checkI FIND IT DIFFICULT TO UNDERSTAND THAT IS THERE POLICY WHEN I WAS NEVER SENT TO LITIGATION WITH MCM OR SEARS/CITI BANKTHEIR BUSINESS PRACTICE AND COLLECTION TACTICS ARE UNETHICAL AND THE Revdex.com SHOULD INVESTIGATE THEMI SHOULD BE ABLE TO GET A PAID-IN-LETTER IF THE ACCOUNT WAS PAID OFF AND THE PAYMENT HAS BEEN PROCESSED FOR WELL OVER WEEKSTHEN, THEY HAVE THE AUDACITY TO REPORT MY ACCOUNT TO THE CREDIT BUREAUS AS A SETTLED ACCOUNT/ LEGAL SETTLEMENT WHEN INFACT I HAD NO LEGAL/ COURT DOCUMENTS STATING OTHERWISE

Midland Credit Management, Inc(“Midland Credit”) received December 15, 2015. Midland Credit appreciates the opportunity to
answer your questions. Midland
Credit provided all of the account identifying information in a previous letter
response to your office dated November 18,
In *** *** follletter, he continues to expresses concern that
Midland Credit indicated a balance of $1,for account no***, but is furnishing a balance of $1,to the credit reporting
agencies. As indicated in the prior
response dated December 9, 2015, the account was purchased by Midland Funding,
LLC with a balance of $1,940.41. As also
previously stated, interest is permissible and provided for in the contract
with the original creditor. Please note
that while Midland Credit has not assessed any interest since September 2014,
prior accrued interest and prior payments totaling $have resulted in the
current balance of $1,
While Midland
Credit has acted appropriately and according to applicable law, it will inquire
with the seller for additional information and documentation for the account. Once Midland Credit obtains the requested
information, a response will be forwarded to *** *** through your
office. The account will not
be furnished to the three major credit reporting agencies until Midland Credit
is able to provide *** *** with further information
Midland
Credit previously requested more specific information to *** ***’s
allegation that he was told that the balance of account no*** was
$3,at some time, and the alleged conduct described by *** *** is being
investigated. Midland Credit fully
respects consumers’ rights and privacy and has established policies and
procedures designed to protect those rights.
However, if, in spite of Midland Credit’s best efforts to ensure
professional and courteous communications at all times, it is determined that a
violation of company policy may have occurred, the same will be addressed and
dealt with in a prompt and appropriate manner.
Midland Credit will provide your office with an update at the conclusion
of its investigation

further writes that when he requested verification for account no***,
Midland Credit advised that it had proper verification
documentation, but then indicated to the contrary in a previous respond by
saying it would take additional steps to obtain verification documentation from
the seller. As stated in its response
dated December 9, 2015, once Midland Credit obtains the verification
documentation, a copy will be forwarded to *** *** through your office. Information for account no
*** will continue to not be furnished to the three
major credit reporting agencies until Midland Credit is able to provide *** with verification documentation
Concerning
account no***, Midland Credit maintains that it has
acted appropriately and in accordance with applicable law*** ***’s accounts remain marked “Cease and Desist,”
and he will continue to not receive correspondence or calls from Midland Credit
representatives unless a response is required by law
Midland

an account belonging to another consumer.
During a search for the correct consumer, *** ***’s phone number appears
to have been provided to Midland Credit representatives by a third party. In reliance on that information, Midland
Credit attempted to contact the consumer regarding the referenced account. Please note that Midland Credit had no
information that it was contacting a wrong number for the consumer until
receipt of the complaint through your office.
Further review of Midland Credit’s business records does not indicate
that any phone calls have been placed to *** *** since June
Additionally,
Midland Credit did not directly generate the e-mails that *** *** has
received. As the phone numbers provided
in *** ***’ complaint do not appear to have been dialed by Midland Credit
since June 2014, if at all, Midland Credit respectfully requests that *** *** contact its Consumer Support Services team at *** *** *** *** to confirm that her current phone number is no longer associated with the
referenced account
With
that said, *** ***’s phone numbers have been marked “Do Not Call” in
Midland Credit’s computer system for the referenced account. *** *** will no longer receive calls from
Midland Credit representatives regarding the referenced account. Additionally, *** ***’s phone numbers
have been added to an exclusion list to prevent them from being called in the future
regarding the referenced account

During a search for the correct consumer, *** ***’s phone number was provided to Midland Credit representatives by a third party. In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account.
Please note that Midland Credit had no information that it was contacting a wrong number for the consumer until a phone conversation, presumably with *** ***, on March 16, 2015. While the phone number that the call was received from does not match the phone number indicated by *** *** in the complaint, the phone number was marked “Do Not Call” in Midland Credit’s computer system for the referenced account at that time. Additionally, Midland Credit does not have record of placing any calls to *** ***’s phone number, *** ***, and the number does not appear to be in Midland Credit’s system
*** *** also expresses concern that Midland Credit representatives refused to disclose information to her because she declined to verify her social security number. Please note that it is Midland Credit’s policy to verify a consumer’s information on each call to ensure it does not disclose personal information to the wrong individual, as well as to protect the privacy of those with whom Midland Credit conducts business. Because *** *** refused to verify her information, the Midland Credit representatives with whom *** *** spoke were unable to disclose information to her

HorribleI have accounts with them which I wish they were through another companyThe filed through the court to garnishment my wages after SEVERAL attempts to clear my debt with them, or trying to to anywayAfter speaking to a lovely young lady, she had me fax everything instead of mail which takes 2-weeksOnce faxed she personally took it to the lawyer for meIt was handled and now I am making my payments but seems like they are tacking on money
My second account they have sent hardship papers several times, and either 1) I have not received them or 2) they are not getting my responseSince I am sending personal information after tries I told them I don't want to go through mail and every time I get this is how they handle thingsThey don't want to make me an offer to settle by any means but yet they continue to call and harass meI have asked several times to make a small payment every month but that is not good enoughI cannot by any means afford the $they asking for especially when I can't even afford health insurance which I assume is a little more important this day and ageI want to work it out but they are uncooperative and not understanding by any means
Wish my debt would go to another company
