will no longer receive calls from Midland Credit representatives regarding the
referenced account. Additionally, Mr***’s phone number (***) has
been added to an exclusion list to prevent it from being called in the future

As described in the complaint, *** *** writes that Midland Credit’s representatives refused to speak with him because he indicated that he was going to contact a lawyerAs stated previously, the representative was unable to speak to *** *** regarding the account details as he had previously claimed to be speaking to his lawyerUpon receiving the information that consumers may be represented by counsel, representatives are not able to release information to the consumer*** *** was advised of this, and refused to send in any documentation confirming that he did not have representation prior to receipt of the complaint from your office
*** *** additionally alleges that Midland Credit continued to report the account to his consumer credit files, despite *** ***’s dispute of the account as fraudA review of Midland Credit’s business records indicates that *** *** was advised to send documentation to support his fraud claim, but *** *** initially refusedOn May 20, 2014, *** *** contacted Midland Credit and stated that he had filed a police report for identity theft with the *** Police Department, and verbally provided a case number of *** *** was advised to provide a copy of the police report or an affidavit of fraud showing that he reported the fraudulent activity. Midland Credit did not receive a copy of such police report or an affidavit of fraud as requested from *** *** and in its previous response to your officeWhile Midland Credit did not receive the requested documentation, it conducted an investigation using the information provided by *** ***, and was unable to locate such record with the *** Police Department
As previously stated, while Midland Credit did not receive the requested documentation from *** ***, and was not able to further investigate his fraud claim with the information provided, Midland Credit made the business decision to close the accountThere will continue to be no further collection activity, credit reporting, or sale of this accountThe three credit-reporting were notified to delete all reference to the account in question from *** ***’s consumer credit files

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on June 28, 2012. Information provided by the seller, *** *** Holdings LLC, at the time of acquisition indicates this account was originated on January 4, 2008, as a *** cellular account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on September 29, 2011. The balance at the time of purchase was $3,223.49.
Ms*** expresses a concern that Midland Credit representatives have contacted her before 8am local time and after 9:00pm local time. Please assure Ms*** that Midland Credit has safeguards in place to prevent its calls from being placed before 8:00am local time and after 9:00pm local time. Midland Credit’s determination of which local time should control is based on information then available to it, including the phone number’s area code. Ms***’s phone number contains an area code belonging to Yonkers, New York. Based on that information, Midland Credit attempted to contact Ms*** at times consistent with New York. All calls were placed after 8:00am and prior to 9:pm local Yonkers time.
As described in the complaint, Ms*** questions the alleged conduct of certain Midland Credit employees. Please note that the alleged conduct described by Ms*** is being investigated. Midland Credit fully respects consumers’ rights and privacy and has established policies and procedures designed to protect those rights. However, if, in spite of Midland Credit’s best efforts to ensure professional and courteous communications at all times, it is determined that a violation of company policy may have occurred, the same will be addressed and dealt with in a prompt and appropriate manner.
Additionally, Ms*** expresses a concern that, prior to Midland Funding’s purchase of the account, a *** representative changed her phone plan without her consent, resulting in her account being forwarded to collectionsA review of Midland Credit’s business records indicate it was not advised of Ms***’s concerns with *** prior to receipt of her complaint. However, now that Midland Credit has been made aware of Ms***’s prior issues with ***, in keeping with its Consumer-First policy, Midland Credit has made the business decision to close the account. There will be no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting agencies will be notified to delete all reference to the account in question from Ms***’s consumer credit files

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on November 25, 2015. Information provided by the seller, *** ***, at the time of acquisition indicates this account was originated on March 28, as a *** *** *** *** account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on October 28, 2015. The balance at the time of purchase was $2,344.09. A copy of the verification information provided by the seller is enclosed for *** *** records
*** *** expresses a concern that his *** *** card was closed years ago after he paid thousands and he has not heard from *** ***. Consumers are sometimes unclear as to what the term “charge off” means for a debt. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account.
In addition, *** *** advised the most recent payment received by *** *** was in June of for the amount of $70.00, and that the current balance is due. The current balance information is reflected on the verification information Midland Credit has enclosed with this response. If *** *** believes that his payments to *** *** paid the balance in full, Midland Credit respectfully requests *** *** provide documentation or evidence which substantiates his claim. *** *** can contact Midland Credit online at *** where he can email questions to a Consumer Support Services (CSS) specialist, find the answers to frequently asked questions, and upload documents to support his request. Uploaded documents are automatically sent to a CSS specialist, who will investigate the consumer’s question and mail back a response. *** *** may also forward appropriate documentation to CSS using the contact information on this letterhead
*** *** indicated that he received a letter advising the account could potentially be forwarded to an attorney. There are several factors used to determine the eligibility of accounts for legal effortsAs a result, the account has been determined to be eligible for legal efforts. Midland Credit acted appropriately in advising that non-payment on the account may result in the account being forwarded to a law firm in *** ***’s area to review for possible legal efforts to collect the balance. This was an accurate statement of potential next steps to be taken on the account
*** *** also advised he read about a class action lawsuit involving Midland Credit and CPTA Regulations. Midland Credit is unable to identify the referenced CPTA class action against Midland Credit regarding *** ***’s account. If *** *** has documentation that indicates he, or his account, were included in a CPTA action, he may forward that to CSS as indicated above
Based on the information currently available to Midland Credit, it has acted in a timely manner and has complied with all applicable laws. *** ***’s account remains valid, due, and owing to Midland Credit as servicer for Midland Funding. With that said, *** *** also states that he cannot afford to pay $for this account. Should *** *** now recognize that the debt remains due and wish to resolve the matter, he may qualify for a reduction in his account balance. The three accounts that Midland is "collecting" on behalf for *** and *** *** are NOT my accountsThese have been disputed with the bureua as wellI am attaching the police report when I had an identity theft since Midland still refuses to send me a copy of any contract I signed, etc showing that these are my accountsThese three accounts are NOT mind and must be removed immediatelyPlease find attached the police report filed in regards to identity theftThey continue to say they sent documentation to me, but I have not received ANY documentation prior to me disputing these accounts when I saw them on my reportTHey need to STOP asking me to settle any accounts with them because I refuse to pay for any account that is on my credit and is not mine!
I am not sure if Midland is aware what Identity theft is, but it is when someone else uses your identity to obtain services or contacts in your name, these individuals know the social security etc of the person they are stealing from, so therefore, Midland saying this was in my name with my social would tell you that this is identity theftMidland has NOT provided anything with my signature etc showing that these are my accounts because they cannot, they are not my accountsPlease use this police report as proof that these accounts must be REMOVED immediately from my credit report

Midland Credit has acted in a timely manner and has complied with all applicable laws. However, in keeping with its Consumer-First policy, Midland Credit has made the business decision to close account no***. There will be no further collection activity or sale of this account. In addition, as stated in is previous response, the three credit-reporting agencies were previously notified to delete Midland Funding’s reference to the collection account in question from *** ***’s consumer credit files
*** *** continues to express concern that he has a letter stating that the accounts would be removed from his credit report. As indicated in its previous response, Midland Credit previously made the business decision to close account nos*** and *** on February 8, 2016. Shortly thereafter, Midland Credit notified the three major credit reporting agencies to cease reporting the tradelines of account nos*** and ***. Midland Credit ceased furnishing information for the tradeline for account nos*** and *** on February 29, 2016, and for account no*** on April 11, 2016. Please note that the credit reporting agencies have advised that they may require to days to update to a consumer’s credit files.

Midland Credit has finished conducting its investigation regarding the alleged conduct of its employees, and has determined that no violation of company policy occurred, and its representatives acted appropriately pursuant to applicable lawA review of Midland Credit’s business records indicates that while no payment arrangement was reached with *** ***, he was advised that he could settle both accounts with a balance reduction of 50%*** *** was also advised that the accounts would not be removed from his consumer credit files upon payment.

The balance at the time of purchase was $130.60. Final payment on the account was received on December
13, 2013. Mr*** has no further

As described in
the complaint, Mr*** questions the alleged conduct of certain Midland
Credit employees, alleging that the account manager he spoke to advised him
that the account would be deleted from his consumer credit files if paid. Please note that the alleged conduct
described by Mr*** has been investigated, and it appears no company policy
was violated.
While Midland
Credit is pleased that it was able to assist Mr*** in reaching a
resolution which settled the balance for the above-referenced account, please
note that it is Midland Credit’s policy to report all accounts accurately. Once paid, the account would be reported as “Account paid in full, was a collection
account.” Midland Credit’s business
records do not indicate that Mr*** was told otherwise

Credit provided all of the account identifying information in its previous
letter response to your office dated July 13, 2015. Mr*** expresses that he is
unsatisfied with the validation documentation provided by Midland Credit. Please note that the verification information
provided by the seller meets the requirements of the Fair Debt Collection
Practices Act. The original contract,
complete payment history, and a full set of billing statements are not required
under the FDCPAChaudhry vGallerizzo,
F.3d (4th Cir1999).
Additionally, while not required, a copy of the bill of sale verifying Midland Funding as the rightful
owner of the account is enclosed

demonstrating that Midland Credit has the ability to collect on this debt, and
is licensed to collect in the state of *** Please assure Mr*** that Midland
Credit is licensed in every state which requires such licensing for collection

Midland Credit acted in a timely manner and has complied with all applicable laws. However, in keeping with its Consumer-First policy, Midland Credit has made the business decision to close the account. There will be no further collection activity, furnishing of account information to the credit bureaus, or sale of this account. I, *** *** did not receive anything from Midland Company...Here in my neck of the hood....mail always placed in another tenant mail box...When mail don't belongs to them...they throw it on the floor...when the janitor comes to clean all paper on the floor...he throwing everything in the garbage....Midland should have send their verification through Revdex.com so we both would have saw what was sent....Any information from this point be seen through Revdex.com before mailed...Also, In order to collect a debt legally, Midland must prove it has the right to collect from meTo do this, Midland must show an unbroken, valid chain of assignment back to the original creditor.

In my opinion, this is a fraudulent organization We received a letter advising they were debt collectors for a Synchrony Bank/Walmart account We have no such account When I called them for more information, they wanted either SSN or date of birth to tell me anything I refused I then called Synchrony Bank, and they had no record of the account I checked with CreditKarma, and no such account has been opened in either my name or my wife's I believe this is a phishing expedition

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (hereinafter “Midland Funding”), on February 27, 2009. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on April 30, as a ** *** *** *** *** account number ending in ***, in the name of *** ***, under the last four of the social security number***. Subsequently, the account was charged-off as an unpaid delinquent-debt on February 1, 2009. The balance at the time of purchase was $234.24. Final payment on the account was received on January 13, 2011. *** *** has no further financial obligation for this account
*** *** writes that she was told by a Midland Credit representative that the above-referenced account would be deleted from her consumer credit files upon settlement. Midland Credit has finished conducting its investigation regarding the alleged conduct of its employees, and has determined that that no violation of company policy occurred, and its representatives acted appropriately pursuant to applicable law
While Midland Credit is pleased that it was able to assist *** *** in reaching a resolution which settled the balance for the above-referenced account, please note that it is Midland Credit’s policy to report all accounts accurately. On January 14, 2011, following settlement of the account, a letter was mailed to *** *** advising her that the account had been paid and that the reporting of the account would be reflected as such. A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced account as “Account paid in full, was a collection account.” If Midland Credit were to delete the account, its correct and accurate status would not be reflected
