An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on July 18, 2013. Information provided by the seller, *** *** *** at the time of acquisition indicates this account was originated on February 20, 2007, as a *** *** *** ***account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on April 18, 2011. The balance at the time of purchase was $2,
A review of Midland Credit’s business records indicates that on November 3, 2013, this account was outsourced to the law firm of *** *** *** *** *** * *** *** ** ** *** *** *** *** ** ***. Their phone number is *** *** Midland Credit has forwarded a copy of *** ***’s complaint to the firm
*** *** expresses concern that *** * *** would not accept her repayment offer, and proceeded with litigation. *** * *** advises that *** *** was served with a Summons and Complaint on April 28, 2014, and subsequently called their offices on April 29, 2014. The representative spoke to her about the account, and offered her a three month payment plan on the balance, which at the time was $2,551.45. *** *** advised that she could only pay $a month, which was not an acceptable offer. The representative then advised her that any money sent in would be applied to the balance, however, legal action would continue if she was only going to pay $a month
Judgment was subsequently entered on June 23, 2014, in the amount of $2,751.45. While bank restraining notices were issued, and an information subpoena was sent to *** ***’s place of employement, wage garnishment has not yet commenced. Again, *** *** has not yet made the payment which was discussed. Midland Credit encourages *** *** to contact Account Manager *** *** at *** *** *** *** to discuss repayment options. described in the complaint, *** *** questions the alleged conduct of certain
Midland Credit employees. Please note
that the alleged conduct described by *** *** was investigated. Midland Credit fully respects consumers’
rights and privacy and has established policies and procedures designed to
protect those rights. Midland Credit has
finished conducting its investigation regarding the alleged conduct of its
employees and has determined that no violations of company policy have

the representative advised the consumer that Midland Credit does not remove
accounts from the credit bureaus once the account is paid, but rather, the

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (hereinafter “Midland Funding”), on November 26, 2013. Information provided by the seller, *** *** ***, at the time of acquisition indicates this account was originated on March 18, as a *** *** *** *** *** account number ending in ***, in the name of *** * ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on May 8, 2009. The balance at the time of purchase was $3,064.73.
As described in the complaint, *** *** stated that a Midland Credit representative told her the account would be put on her credit report if she did not settle it immediately. Midland Credit has finished conducting its investigation regarding the alleged conduct of its employees, and has determined that no violation of company policy occurred. Midland Credit’s representatives acted appropriately pursuant to applicable law. A review of the recorded call and interview with the representative found that they did ask *** *** to send their dispute in writing to Midland Credit but there was no discussion of the credit reporting of the account
With that said, prior to receiving the complaint from your office, Midland Credit made the business decision to close the account on February 18, 2014. There will be no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting agencies will be notified to delete all reference to the account in question from *** ***’s consumer credit filesA letter notifying *** *** of the same was mailed on March 3,

Midland Funding is a scam artist and a con company! I have adio recording of the conversations made with Midland funding when I called to rep[ort that this account was a fraud, I was told by the supervisor to file a police report and that would help expedite their investigationI called back the next day and provided them with the case # and was never asked to provide any further documentationMidland Funding has never attempted to contact *** Police department and has stated every time I contact them that they will not speak to me concerning my own case and yet they continued to send me collection letters
Midland funding has committed a criminal act by falsely reporting to the three credit bureaus and when asked repeatedly to verify the account, they simply replied back that it was verified and yet upon several requests to show any legal type of proof that this was my account, such as a signature of receiving anything or to provide even what I was being billed for, Midland funding blatantly refused just as they have stated in their previous repliesTo this date, they have never provided any legal proof that this account was mine or to even provide any information on what I was being billed forThis is their scam, they hide behind an article # and state that they do not have to do anything furtherMidland Funding likes to bully the consumers into paying for debts that are not theirs and consistently reports information to the bureaus
I informed Midland Funding on several occasions that things such as mail being lost does in fact happen and yet they refused to resend anythingI can easily say that on may I mailed Midland Fundoinf all the requested documentation and they never replied backIt's the same as what they are stating
fact is that Midland funding falsely reports to the credit bureaus and they now realize that I have legitimate legal action against them which I will be in fact takeing because they have caused severe punitive damage to my credit scores

acknowledges his concerns, despite the documentation provided, after a search
of its business records Midland Credit is unable to locate any calls to this
number. Additionally, a search for his
phone number within Midland Credit’s files was unable to locate it being
associated with any account being serviced by Midland Credit
With that said, it is possible that Midland Credit is
calling another number which is then being forwarded to *** ***. If this is the case, Midland Credit
respectfully requests *** *** contact its Consumer Support Services team at *** *** *** *** to provide any additional
phone number(s) which could be the source of such forwarding. Midland Credit will then be able to
investigate further and should a phone number it is calling be located, will be
able to block further calls to that number.
In the meantime, Midland Credit is continuing to look
into the matter using the dates and times contained within the provided phone
logs and will follow up with *** *** through your office if additional
information is obtained

I've received a letter from Midland Credit Management regarding a payment offer, which is dated 02/10/
Prior to this, I was unaware of any collections lodged against me by Midland Credit Management until I received this letterI then ordered copies of my credit reports and noticed that Midland Credit Management has an account on each credit bureau's report and the information contained within each report concerning Midland Credit Management varies from bureau to bureau and therefore, is inaccurate
On the *** report, the 'original lender' is reported as Midland Funding Llc and the 'date assigned' is listed as March, However, this is inconsistent with the *** and *** credit agencies' reports which lists *** as the 'original lender' with a 'date assigned' as January, The account number is omitted from the *** report and the account number is encrypted in *** and *** reportsI have never personally opened an account with Midland Credit Management, nor have I ever accepted any extension of credit from Midland Credit Management, and I have never done any business whatsoever with this company
By reporting to the credit bureaus as the 'original lender', Midland Credit Management is in violation of the Fair Debt Collections Practices Act (FCDPA), and my rights as a consumer, to fair and accurate information furnished to the credit bureaus, which is then reported to my credit file and contained within my credit reportFurther, Midland Funding listing itself as the 'original lender' on my credit report is a misrepresentation of the facts, as it is not the 'original lender', but a debt collection agencyAccording to the FCDPA, "the use of any representation or deceptive means to collect or attempt to collect any debt" is abusive and is prohibited by debt collectors such as Midland Credit Management, Midland Funding, et al., that lurk as original lenders or original creditors

As I have mentioned before I have a hearing problem and can not understand over the phone to do a verbal agreement, by law I can request a written agreement, to protect myself and the collection company, I am not trying to be difficult I am just trying to get a written agreement, I will continue the payments even without an agreement, but verbally I cant call and understand, this company is known for sueing people and demanding a high monthly payments and I am paying all I can monthly and I guess if they wont give me a written agreement then at least I have this complaint filed as proof of me trying to get arrangements and voluntarily making payments in the case they sue meAnd a judge will be able to read this as wellThank you for your time and help, I will close this complaint once I hear back

In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account. *** ***’s phone number has been disabled for that account, and no further calls were made to *** *** regarding that account
With that said, Midland Credit has located multiple accounts for which *** ***’ name and phone number is associated. However, Midland Credit needs additional information to determine if *** *** is the correct consumer for these accountsPlease note, additional calls were made to *** *** for these accounts, as Midland Credit has not been supplied with confirmation that *** *** is not the correct consumer for the accountsMidland Credit respectfully requests *** *** provide his social security number so that it may confirm that *** *** is not the correct consumer for these accounts. *** *** may call Midland Credit’s Consumer Support Services team at *** *** *** *** to provide this information

Thank you for your letter inquiry dated July 23, 2014, regarding *** *** complaint, which Midland Credit Management, Inc(“Midland Credit”) received the same day via E-mail. Midland Credit appreciates the opportunity to answer your questions
A review of Midland Credit’s business records indicates that *** *** has retained an attorneyGoing forward, all communication about the matter should be handled by his attorney. If *** *** is no longer represented by an attorney, please provide Midland Credit with written notice so it may update its records and allow its representatives to communicate with him directly
An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on September 8, 2009. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on May 29, as an *** *** *** *** *** account number ending in *** in the name of *** *** under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on August 7, 2008. The balance at the time of purchase was $752.77.
*** *** questions whether the above-referenced account may be reported on his consumer credit files, due to an order issued by the Federal Trade Commission (“FTC”), which he states applies to the credit reporting of the above-referenced account
After reviewing both the account information, as well as a copy of FTC order 1:08-CV-1976-BBM-RGV, please note that while the FTC may have issued an order against the *** *** and *** *** *** *** providing restitution payments to certain defined consumers, it does not render all accounts ever issued by *** *** *** invalid or unenforceable. Part II of the FTC order provides that only affected accounts in which the restitution payments were greater than the balance due were to be removed from a consumer’s credit files. Accounts in which a balance remained after an adjustment for restitution payments were allowed to be updated in the consumer’s credit files under the FTC order
*** *** expresses a desire to have the above-referenced account deleted from his consumer credit files upon resolving the balance. Please note that it is Midland Credit’s policy to report all accounts accurately. Should *** *** pay the full balance, Midland Credit will report the account as “Account paid in full, was a collection account.” Should *** *** pay less than the full balance, Midland Credit will report an additional memo stating “Account paid in full for less than the full balance.” If Midland Credit were to delete the account, its correct and accurate status would not be reflected
In keeping with Midland Credit’s Consumer-First policy, and to provide the highest level of consumer satisfaction, *** *** account has been referred to Account Manager *** *** Please have *** *** call *** *** at *** *** *** ***, to discuss repayment options
