We have reviewed *** *** complaint which she filed on behalf of her granddaughter, *** ***, and her grandson, *** ***, and are responding accordingly. In her complaint, *** *** disputes the denial of her grandchildren’s claim for Trip Cancellation benefitsPlease note that
the plan *** *** purchased for her grandchildren does provide reimbursement for a cancellation due to a medical condition. However, in order to qualify for reimbursement under the plan, the medical condition causing the cancellation must meet certain criteria. In particular, the illness necessitating cancellation must meet the following plan requirements: The Sickness or Injury must: a) commence while your coverage is in effect under the plan; b) require the examination and treatment by a Physician at the time the Covered Trip is canceled; and c) in the written opinion of the treating Physician, be so disabling as to prevent you from taking your Covered TripIn addition, there are specified exclusions which would preclude coverage for a cancellation in certain instances. One such exclusion states: General Plan Exclusions In Parts A & B: We will not pay for any loss caused by or incurred resulting from: mental, nervous, or psychological disorders, except if hospitalized; being under the influence of drugs or intoxicants From the information provided, *** *** grandchildren cancelled due to *** *** mental or nervous condition. However, based on the information received, there was no hospitalization for such condition and no verification confirming treatment of this condition at the time of the cancellation. Based on this, we were unable to consider *** *** request for reimbursement of her grandchildren’s airline tickets.However, while *** *** grandchildren do not qualify for reimbursement as the reason for their cancellation did not meet the plan requirements, we have agreed, as a gesture of goodwill, to provide an accommodation to them and provide the requested reimbursement. Please understand that this is being done solely as a courtesy and does not impinge on the basis of the claim denial. Accordingly, payment in the amount of $298.03, made payable to each insured, will be sent to *** *** under separate cover.We trust that we have responded to the issues raised in *** *** complaint. We have reviewed *** ***’s complaint and we are responding accordingly. In his complaint, *** *** notes that he did not make use of his original return airline ticket as he drove home instead with his family, who had driven out to attend his father’s funeral. As such, ***
*** was seeking reimbursement of this unused, return airline ticket. As the plan does not provide coverage for unused airline expenses, providing instead coverage for additional transportation expenses incurred, we were unable to consider *** ***’s request. However, upon further review of the claim we have agreed, as a courtesy, to provide *** *** with the requested reimbursement of his unused return airline ticket in lieu of additional transportation expenses. Accordingly, payment in the amount of $169.97, equal to the value of his return airline ticket, is being sent to *** *** under separate cover We appreciate this opportunity to further review this matter and are glad we were able to provide *** *** with this requested outcome. We have reviewed *** ***’s complaint and we are responding accordingly. Please note that the plan *** and *** *** purchased contains a listing of specified reasons of the participant, their immediate family member or traveling companion, which would make one eligible for
reimbursement under the Trip Cancellation waiver. The plan contains definitions of Immediate Family Member and Traveling Companion to further detail the eligibility requirements. From the information the *** submitted, they cancelled due to the death of their friend’s parent. They indicated that these friends were scheduled to sail on this same cruise however, they did not meet the plan requirements of a Traveling Companion and therefore, we were not able to consider the death of a friend’s family member as a specified reason for the ***’ cancellation While the denial of the ***’ claim was appropriate in keeping with the plan language, we have agreed, solely as a business consideration, to provide the *** with the requested cash reimbursement in the amount of $per person. Please note that with this reimbursement, the future cruise credits previously provided to the *** by the cruise line have been voided We trust we have responded to the concerns raised in *** ***’s complaint. We have reviewed *** ***s complaint and we are responding accordingly*** *** had filed a claim with our office for Trip Cancellation benefits due to his cancellation of his scheduled trip. Regrettably, *** ***s reason for trip cancellation was not one covered
under the plan. Please understand that the plan purchased provides reimbursement in the event of a cancellation due to a number of both medical and non-medical reasons as specified in the plan. However, a cancellation due to a weather related issue is not one such specified reason. As such, we were unable to consider his request for reimbursement More particularly, *** *** chose to cancel his scheduled trip to Miami as there was a weather event occurring in another area of the state and the governor declared certain counties, on the opposite coast line of the state, under a state of emergency. *** ***’s destination was under no such state of emergency nor were there any issues with his scheduled flight, which landed on time. While we certainly understand *** ***s decision to cancel his travel plans, his reason for cancellation is not among those enumerated in the plan making one eligible for reimbursement. As such, we are unable to consider *** ***s request for payment Please note that the plan in its entirety is provided prior to purchase for review. Further, the confirmation provided to *** *** contained a link to the plan, including the specified reasons for cancellation as well as the contact information for our office for any questions regarding the planFinally, please note that the plan provided also contains a Ten Day Right to Examine which allows a plan participant to cancel their coverage within days of receipt of the plan should it not meet with the participant’s needs While we appreciate *** ***s disappointment at the outcome of his request for reimbursement, we hope this has provided further clarification of the claim determination and understanding that we must review each request in accordance with the terms and conditions of the plan purchased. We have reviewed *** ***’s complaint and are responding accordingly. From the particulars received, *** *** cancelled her and her companion’s trip due to *** ***’s job loss. As advised to *** ***, in order for our office to review the claim, we must receive
sufficient documentation confirming that the reason for cancellation meets the plan’s terms and requirements, in particular that the employment from which *** *** was released was one that she had had for at least one continuous year prior to such job loss and that such termination or layoff was involuntary. Unfortunately, to date, the information submitted by *** *** does not confirm either criteria has been met. As such, as per our correspondence to *** *** of July *** and July ***, as well as our discussions with her, we have requested that *** *** submit verification from her former employer affirming she meets with the plan requirements. Once such documentation regarding the length of her employment prior to termination or lay-off, as well as the nature of such termination or lay-off, is submitted, we will be happy to continue our review of *** ***’s claim. While we can certainly appreciate *** ***’s position, due to the number of inconsistencies previously noted, we are unable to consider this claim at this time until the requested documentation has been received and we have an opportunity to review same. Please note that death for which *** *** stated he had cancelled his trip occurred in mid-June 2016, as per the information he originally supplied. However, *** *** did not contact our office to initiate a claim until September **, 2016. Further, there is no time limit on claim submissions. Once *** *** has time to gather the correct documentation for his claim submission, he should feel free to submit same for our review We trust this has responded to the additional comments from *** ***. We have reviewed *** ***s complaint and we are responding accordingly. In her complaint, *** *** states that she is unable to make use of the credits she has with Aeromexico from a cancelled flight last September as the airline does not have any available flights to her
destination city. As such, she is seeking to receive a cash reimbursement of her originally cancelled tickets from that September flight. As we have advised *** ***, the plan purchased does provide coverage for a cancelled trip due to one of the specified reasons contained in the plan. However, in order to confirm that the reason for cancellation meets the plan’s terms and conditions, we do require sufficient documentation of such situation As *** *** is currently pursuing a claim for her cancelled airline tickets from last September based on her late father’s illness, we have advised that we will need documentation of her father’s examination and treatment by his physician at the time of her cancellation. Further to that end, we had sent an Attending Physician Statement to *** *** to have completed by her father’s physician. Once we receive same, we will be happy to continue our review of *** ***s claim. With regard to the issues *** *** mentioned with making use of the airline credits she holds from that cancelled September airline ticket, please understand that an airline’s availability, or lack thereof, to a particular destination, is not a specified reason under the plan and we would be unable to consider *** ***s claim on such basis. Finally, should *** *** submit the requested necessary medical documentation, and her claim for reimbursement of her cancelled September airline ticket be deemed payable, the credit she currently holds from that airline ticket would no longer be available to her. Please note that the plan in its entirety is provided prior to purchase for review. Further, the confirmation provided to *** *** contained a link to the plan, including the specified reasons for cancellation as well as the contact information for our office for any questions regarding the plan We trust this has addressed the concerns raised in *** ***s correspondence. We have reviewed *** ***’s additional comments and are responding accordinglyWe understand that *** *** continues to question why the travel warning issued by the US Department of State did not qualify her for coverage under the Plan. As previously advised, the Plan contains a specified listing of reasons making one eligible for coverage. Also as previously explained, one such specified reason is in the event a terrorist act has occurred in the destination city within days of the departure date. The coverage is not regarding the potential for a future Terrorist Act to occur. Please note that this language is contained in the Plan for review and the plan also provides our telephone number for any questions an individual may have regarding the terms and conditions of the plan. As no Terrorist Act, as defined, had occurred in Germany within the days prior to *** ***’s departure date, we are unable to consider her request for a cash refund of her travel expenses. Please allow me to advise that though not eligible for a cash reimbursement, under the “Any Reason” Cancellation Waiver, *** *** is receiving future travel certificates from Trafalgar equal to the cancellation penalty assessed on her booking. In order to make use of such credits, *** *** should contact Trafalgar directly We trust we have further clarified the basis for the decision made on *** ***’s claim and we are closing our claim at this time. refers to photographs of the damaged luggage submitted to our office We have reviewed the documentation *** *** has submitted to date and can confirm that a number of items requested have still not been submitted. In particular, we have requested *** *** provide written verification of the damage to the suitcase and loss of its contents from the airline. No such documentation has been submitted to date. Further, as this coverage is secondary to any indemnity of the responsible party, we are also awaiting submission of the response from the airline, Delta, to whom *** *** indicates he reported the loss. Finally, please note that the photographs *** *** references in his complaint have not been received by our office. Though please understand that submission of such photographs, without the balance of the documentation required, would not be sufficient to finalize this claim From the discussions *** *** has had with various staff members in our office, we can certainly appreciate his view of the claims process. his traveling companion’s baggage. Please allow us this opportunity to further clarify the information provided. Please note that the plan *** *** and his companion purchased provides coverage in the event an individual suffers a direct loss, theft, damage or destruction of their baggage during their covered trip. *** *** can find a description of this benefit in his plan under Part CBaggage Protection, Baggage and Personal Effects BenefitsThe plan does not include a Baggage Delay Benefit*** *** and his traveling companion did receive their baggage during their covered trip, though it was received several days later than their arrival at their destination. As such, *** *** and his companion did not experience a direct loss, theft, damage or destruction of their baggage. Though *** *** and his companion’s baggage was in fact delayed in its arrival at their destination, such event is not one covered under this plan. Further, this plan does not provide coverage for reimbursement of the cost of personal effects purchased while awaiting receipt of delayed luggage. While we certainly appreciate the situation in which *** *** and his companion found themselves, we are unable to provide the requested reimbursement as this plan offers no such benefit We trust that we have addressed the concerns raised in *** ***’s complaint and explained our position in this matter. We have reviewed *** *** complaint and we are responding accordingly. In her complaint, *** *** questions the decision made on her claim regarding the denial of her request for medical expense benefits. Please note that the claim was denied as the loss was one specifically
excluded under the plan Apparently during her stay, *** *** was brought to the hospital in Mexico and treated. Based on the medical records which the *** supplied to our office, and which underwent a medical review by the carrier, the condition which *** *** suffered from and for which she was treated at the hospital in Mexico fell directly under the plan exclusion related to losses caused by or incurred resulting from: being under the influence of drugs or intoxicants, unless prescribed by a physician. Based on the medical records received, *** *** was diagnosed with alcohol intoxication and intoxication without alcohol, from other substances. These records also indicated positive findings of several narcotic substances other than alcohol in *** *** system. Please allow us to reiterate that this information was contained in the medical records that *** *** submitted to our office herself. As such, we advised she could review such documentation with regard to the determination made on the claim. Based on the medical information submitted by the ***, *** *** losses are specifically excluded under the plan and no payment shall be forthcoming While we understand *** *** disappointment at the outcome of her claim, we hope this has provided further clarification of the claim determination made and understanding that each request must be considered in accordance with the terms and conditions of the plan purchased.
