These terms are stated on the website from where the customer places their order. Each order placed is what is known as a straight sale. For the single bottle orders all customers agree they will be charged for $48 that day plus the $4.95 for shipping and handling and be enrolled for the 30 monthly membership. If the customer does not call or email to cancel within those 30 days another 30 day supply will be sent and billed to their account for $24.63 (50% discount) until the contact us to cancel. Mrs. [redacted] placed the order on July 5, 2013 for our one month supply. She has called our customer service line and has spoke with one of our representatives on September 9, 2013 when she was given an option to return the 2 bottles of Miracle Garcinia Cambogia from our satisfaction guarantee that were sent from the membership she agreed to. The customer declined to return the bottles received and the refund. As previously stated we do value all of our customers here at Miracle Garcinia Cambogia. Review: This is the full text of the email I sent to the company, which outlines in detail the nature of my problem:

"I am writing today to request a full refund of the two bottles of Miracle Garcinia Cambogia I have purchased — not because of dissatisfaction with the results but because of the blatantly false and misleading product claims made in your marketing material. I'm unsure if you simply neglected to submit the brochure to your FDA lawyers for review prior to publication or if that is a compliance measure you routinely skip, but as a former Chief Marketing Office for a national nutritional supplement and skin care company, I am fully aware of your responsibilities in this regard, and you have fallen short, to say the least.

As a moral vegetarian, I am mindful of the products I purchased and consume. Your promotional material (shown below) boldly promises, "All natural veggie capsules…", yet I noticed this morning the small print on the back of the bottle that lists GELATIN under "other ingredients." Gelatin — sometimes used in pharmaceutical and pharmaceutical-grade capsules to make them easier to swallow — is a mixture of peptides and proteins produced from the skin, boiled crushed horn, hoof and bones, connective tissues, organs and some intestines of animals (e.g., cows, chicken, pigs and even horses). How dare you promise consumers "All natural veggie capsules…", when — in truth — the capsules are produced from the skin, bones, tissues, organs and other various and unsavory insides of ANIMALS!

I don't believe this is an intentional deception; it is more likely a disconnect between your marketing and product development departments, but it is a deception nonetheless — one that needs to be rectified immediately, not just to satisfy my individual complaint but for the sake of other conscientious consumers who would rather not ingest cow hooves when swallowing what they are being told are "All natural veggie capsules…" If you won't consider reformulating an actual "All natural veggie capsules…", at least remove the false claim from your promotional literature to avoid drawing FDA/FTC scrutiny.

Below you will find my full name/address, which should assist you in locating the account information necessary to process a full refund of both bottles and cancel further auto-shipments. The consumer did contact us with the e-mail inside of her statement. We replied immediately verifying she did receive an old brochure, but that online we do not offer vegetable capsules whatsoever. We notified her to verify if she was returning the products for the refunds, and we would issue them as soon as she verified this. We did not receive the products returned back to us for the refunds, and the account was only cancelled from all further billing and shipping. Regarding the brochure, we have apologized as it is old literature, and we do verify online that we do not offer vegetable capsule for our product as we discontinued use of this. For the reasons spelled out in detail in my complaint — one of which is false advertising — I requested a full refund of the $105.90 paid to this slippery organization. The specifics of my complaint are not addressed in their "refund policy," and the $52.95 they have arbitrarily offered to refund me does not satisfy the crux of my complaint.

The customer requested we refunded her for all charges applied to her account from our company, which we have done. We issued a refund of $24.63 and $52.95, those are the only charges applied from our company specifically. There was no charge of $105.9 applied from our company. We issued those refunds from the original response from the consumer for a total of $77.58 refunded to the Mastercard ending in [redacted]. She would need to check her statements for the correct company to contact regarding those other charges.

Review: I placed an order in January 2014 for the buy 2 bottles get 1 free plus free shipping for $104.97. I continued to receive a bottle each month and in June I became confused about why they kept coming each month. I never opened any of the packages past the 3 bottles. I went through my credit card statements and saw that I was being charged each month but believed they must have broken down the payments into monthly but something did not seem right so I called the company in June. I could not get through to anyone and left a voice mail requesting that someone call me back. I left my cell phone for the return call but never received one. At that time, I had 3 charges for $24.63 each from April, May, and June and thought maybe that was the 3 month bottles. I did not realize my card was previously charged the full amount in January. I called again on July 16, 2014 after I received another bottle and no call back from the company. I saw that my credit card was charged $24.63 again. During that call a customer service representative told me that I agreed to the terms of the sale which include a membership to receive a monthly supply at a discounted fee and such will be automatic if not canceled at the end of the 30 day period. I did not agree to that but he kept repeating that I did. He sent the "terms and conditions" to my email which do not state the membership terms in any way, however, they clearly describe what I ordered in 2 sections without mention to a membership. In addition, the webpage that I ordered from has very clear selections that include what you are ordering. The part about enrolling in a membership is not in the same section but off to the side with an *. However, there is no * in the section where I selected my order so it does not appear applicable to me - and, it is misleading in any case. Therefore, I never agreed to such terms. The customer service representative agreed to give me only a one month refund.Desired Settlement: I want a full refund of all charges on my credit card past the initial sale in January. That is $24.63 each month from April to July. I was told I will receive one month but I did not authorize the payments on my credit card and want all 4 months refunded.

She also added the shipping protection for her package for $4.99 making her total $109.96. This is paid for upfront when she entered her credit card information on 1/3/14. As with any website, if the product is not purchased upfront the order would not process nor be shipped to the customer. We do not and have never offer a 100% money back guarantee. We have a satisfaction guarantee as the terms and conditions state and she agreed to when the order was placed. Each customer may call or email customer service at anytime to request a refund as all refunds, if any is granted, is purely on a case by case basis. Those terms and conditions also state that all sales after 30 days are final and also state that the customer is responsible for all packages billed and/ or shipped prior to their cancellation date. Each order for the buy two get one free enrolls each customer in a monthly membership after 60 days. Those 60 days began the day she placed her order as it states. She has called our customer service line to request to cancel her monthly membership on 7/16/14, several months after her 60 days expired. During this call she was explained the terms and conditions that state she is agreeing to and authorizing the original charge and monthly membership charges until she contacts us to cancel. Mrs [redacted] was billed, shipped, and received a new 30 day supply on 4/10/14, 5/10/14, 6/9/14, and 7/9/14. All monthly membership charges are $24.63. When she called our customer service line and spoke with a representative, she was given a courtesy credit to her account for one supply of Miracle Garcinia Cambogia of $24.63. The credit given only as a courtesy since it is not guaranteed that any customer will receive a credit and the membership had continued for many months with no cancellation requested. As previously stated we do value all of our customers here at Miracle Garcinia Cambogia. Mrs [redacted] has been refunded two more charges of $24.63. She will also receive emails confirming the refunded amounts. Due to the date of the the first monthly billing, we are unable to refund her account for the 4/10/14 charge. When she contacted our customer service line and spoke with a representative she was sent an additional email confirming her account was canceled. Review: I ordered a one month supply of the product. I found out one month later they were automatically sending another months supply, and charging my credit card. Had I known this was a recurring payment, I would not have ordered the product. I contacted the company who agreed to cancel future payments/shipments but said too bad about the new charge on my credit card.Desired Settlement: I would like a refund of $19.95 I did not authorize. He has e-mailed our customer service line and had a conversation with one of our representatives on 05/15 when he was given a courtesy credit to her account for the 1 unopened bottles of Miracle Garcinia Cambogia from our satisfaction guarantee. The credit was applied for the full charge of $19.95 back onto the card.

Review: Unsure if this complaint should be categorized Advertising or Customer Service: 3/23/14 - I ordered 3 bottles of Garcinia Cambogia and were to receive 2 bottles free. I received all 5 bottles and was charged and paid $149.94. Approx. June 28 I received another bottle in the mail. On July 28 another bottle arrived. I checked my credit card and it was charged for the bottles. I called Garcinia Cambogia and inquired. I was told that the special they advertised in March was for an automatic delivery every month until cancellation. Since I would never have ordered it had I known it was an automatic delivery, I asked for the customer service to show me that ad and prove that is what I ordered. All customer service could do was cancel future automated deliveries. Review: I ordered the tropical garcinia and mango cleanse where you only had to pay shipping. No where on the website did it state that this was a 14 day trial. I was on my IPad. If I had know this was a trial and I would be charged that much I would not have ordered. Review: I ordered the Garcinia Cambogia and the Cleanse Pro from this company through their "14-day trial offer." What their website NEVER stated was that by ordering the "trial offer" I was also signing up to have them automatically ship me both of these products on a monthly basis and have my credit card charged automatically every month ($160 per month total!). The product has not arrived yet, but after reading SO many complaints online from people who were charged WITHOUT CONSENT, I called to cancel. I was told by [redacted] that it would cost me $15 to cancel my enrollment in the auto-billing (which I never signed up for!!). I asked for a supervisor as it is INSANE to be charged in order to cancel a service you never signed up for. He then claimed to be a supervisor!!! He said my options were to either stay enrolled in the auto-billing and pay $80 per month, or pay $15 to cancel. He said that it was NOT POSSIBLE to avoid any additional charges... either $80, or $15, but not $0. I hung up, and immediately called back. I spoke with [redacted] who did not claim to be a supervisor, and after he tried to charge me $38 to cancel, then $15 to cancel, [redacted] finally gave in and provided me with an RMA# and address to return the product to and informed me that my account had been canceled. Review: I went on the website to purchase one bottle of product. I accidentally purchased a three month supply. I immediately emailed the company and told them that I only wanted the one bottle. I received an email back from them stating that they had taken care of that. I received my one bottle in the mail. Two days ago I noticed a charge on my bank account from this company for another bottle. I emailed them right away and they responded with this:

"Thank you for choosing Miracle Garcinia Cambogia. You agreed to be charged at the 50% discounted rate for your next 30 day supply of the product. The price is $24.63 every 30 days until you cancel the membership. As of today your membership is cancelled and you will not be billed again or sent anything further. You will receive an email confirming this cancellation. Please let me know if you need anything further. Thank you! I have copied and pasted the terms listed on the website you ordered from or feel free to visit our website you ordered from also listed below:

On this page of their website: http://miraclegarciniacambogia.com/article/gs/ it clearly states that there are no hidden costs or charges. This is what it says: "Every order of Miracle Garcinia Cambogia is a one-time-only transaction. In other words, there are absolutely no reoccurring charges or hidden offers."

This is incredibly misleading. I trusted that this statement which is highlighted in a very prominent pink box on the page and has the link in it that I clicked on to make my purchase. In order to find out that this is in fact a total lie I would have had to have dug deep in the fine print of my order. Not to mention the fact that I had emailed the company immediately after my order stating that I only wanted the one month supply.

She stated she was satisfied with just having the one-month supply instead of the three-month supply. We verified it did process. Review: I recently purchased a product from this company. A couple days after my purchase I started receiving excessive amounts of telemarketing calls, as many as 4 times a day, from companies I have never heard of or done business with. I have made other recent purchases online, but this was the only company I had not used in the past. Therefore I was concerned that it was due of this purchase that I was receiving these calls, and that may personal information may have been given out to third parties. As a result I went back to check the company's privacy policy and this is what it stated: (this is copied exactly as it is listed on their website) "3.1 Sale or Transfer to Third Parties.Miracle Garcinia Cambogia. MAY SELL OR TRANSFER INDIVIDUAL INFORMATION TO THIRD PARTIES FOR ANY PURPOSE IN Miracle Garcinia Cambogia.'s SOLE DISCRETION. If you do not wish us to use personal information about you to promote or sell our products and services or to sell, transer or otherwise provide personal information about you to third parties, please inform us by contacting customer service at 1-855-253-2449 and we will certainly honor your request".Therefore I emailed customer service and requested that my personal information not be sent to third parties or used to promote or sell services. Which they first responded that they do not give out personal info and then told me that the above information was not listed in their Terms and Conditions (which, is true, it's not--IT'S IN THE PRIVACY POLICY). Review: It was my understanding that I was to receive a free bottle of Garcinia Cambogia - It was also my understanding that I would pay shipping charges so I entered my credit card number and the next page showed I ordered three months supply of this product and now I owed $149.94. I did not see any way to cancel this order and they already had my credit card number, so I called the company. They had a recording and I was on hold for over 40 minutes - I emailed them and my email came back saying it was aborted after so many seconds. I called the company for three days at different hours and did not get to speak to anyone. I felt helpless and I called my credit card company and told them and they took charges off and started an investigation.

Meanwhile two weeks later this product arrived in the mail - Someone from the company left a message on my phone and said to return product to sender and that is what I did - I did not accept delivery, never touched the package, told postal person I do not accept delivery. I recevied feedback from my credit card company that the company sent me product and therefore I owe the money.

I ask them to open another investigation because I did send product back. Meanwhile I called the company and ask if they had received the product and they said yes but they could not talk to me because of the investigation. My credit card company came back again and said the company did not receive product.

I called company again and ask to talk to a manager they told me they would take my number and have mgr call. that was two weeks ago and no call received!!! the company appears to be lying to my credit card company about receipt of the product. They say I did not contact company to cancel in time but I could not get thru I did leave a message. and someone called and left me a message to refuse delivery (which I did)i

I feel that this company is scamming me and once they receive this money I will not get it bACK. I sincerely hope that you can resolve this issue for me. thank you very muchDesired Settlement: Take charges off of the credit card

At Miracle Garcinia Cambogia we appreciate all of our customers. Any customer that purchases from our site agrees to our terms and conditions as they would with any other ordering website. Mrs [redacted] placed her order on our website on 4/16/14 for our package of 5 bottles for $144.95 with the discounted monthly membership. We do not have nor offer trials, samples, nor free bottles. You must purchase at lease one bottle at retail value ($53.98) to get one bottle free. The offer was also for no shipping and handling costs. She then added the shipping protection for her package for $4.99 making her total $149.94. This order was placed voluntarily on our website where she entered all her information including her credit card numbers and three digit security code. Without any information entered by the customer on our site, no order would have been placed. Mrs [redacted] called our company on 4/17/14 and left a voice mail informing us that she would like to cancel the order that she placed and received email confirmation for. We state on our website that all orders are shipped within 24 business hours so her order had been shipped and was on the way to her. However, on 4/21/14 we received paperwork from her bank and/or credit card company that she had disputed the voluntary charge and order. As with any company, we have to wait until the investigation is complete by the customer's credit card and/ or banking institution and cannot issue any refund nor charge to the card used. Mrs [redacted] then again called on 5/31/14 and 6/14/14. Each representative and supervisor she spoke with informed her that she had disputed and lost her dispute. We have received the returned package. As a courtesy, although the dispute had been lost, we will refund her the $149.95. Mrs [redacted] will receive an email confirming the refund.
