My husband & I bought a timeshre for cash in Cabo San Lucas, My husband passed away May 2016. I tried to surrender the timeshare to Universal Vacation but they would not take it back unless I paid back dues & maintenance fees. Now this company is threatening me by calling my home phone, my cell phone and sending me threatening e-mails that if I do not pay the back dues by Dec. 30th it will hurt my credit report and then it will be sent back to Universal Vacation where they will take legal action. All I want to do is surrender the property. Paying the other fees is a financial burden. I live on Social Security and being harrassed is affecting my health and my well being. by the way once an account is turned over to a collection agency even if you pay your credit is already dinged which I could care less. This company is committing elder abuse. Even if I had the money the contract was for 30 years and the only way it will go away is when I pass away. I have all the copies of the e-mails when I was trying to surrender this timeshare whose maintenance fees are over $800.00 a year.

Finance Supervisor on 3-18-15 (subsequent to this complaint being filed), who explained that her obligation to the [redacted] contract has been satisfied as of 2-10-15. The balance that is reflecting is the remaining balance on the full term of the lease that [redacted] entered into. Since [redacted] satisfied her early buyout obligation, this remaining balance will be closed, and reflect a $0 balance by the end of this month. A paid in full letter has been sent in the interim.

My private information should not be used by nobody. I did bussiness with flex pay NO MONTEREY FINANCIAL . WHAT ARE THEY DOING WITH MY CREDIT? I don't remember sign nothing that saying that.
They are saying we buy it . But I don't authorize you to use my checks. The contract doesn't say that.

If the contract says "SCHEDULED 22nd " IS 22nd . If you wanted my benefit you woulnd't do it . You are playing with my time my schedules. And that'ts not legal. Since the begining its not good. I asked FLEX PAY and they don't use to sell debts only when the cases are not able to pay just collection services...

On June 29, 2016 [redacted] placed a defaulted timeshare balance in the amount of $47,250.01 for...

[redacted].   We mailed out the appropriate initial dunning notice.   On July 11, 2016 [redacted] called our office concerning the debt.   [redacted] claimed that the account was cancelled verbally and did not have any written proof of the account being cancelled.
 
We informed [redacted] that per the terms of the promissory note, the member may cancel within 5 days following the execution of the contract by returning all related documentation received to the Member Services Representative and sending s written notice by certified mail, return receipt requested to [redacted].  [redacted] claims that the account was cancelled verbally and that she would never pay on this account.   We marked the account as disputed per FDCPA policy.
 
[redacted] called back on July 13, 2016, still claiming the account was cancelled and that she will send an email with proof of the cancellation.  We then spoke with [redacted] and informed him that we needed proof of cancellation to resolve the account.  On July 15, 2016. [redacted] forwarded an email sent by [redacted] on Novemebr 27, 2012 that stated she was requesting to cancel since they had not sold her other timeshare as of yet.   We informed [redacted] that the email was not confirmation of cancelling the account as it was simply a request to cancel and the request was well outside of the 5 day rescission period.
 
We received a cease and desist request from a legal representative attorney claiming to represent [redacted] on July 28, 2016 and thus will not be contacting [redacted] concerning this matter any further.  That being said, we have requested to verify with our client if the account was in fact cancelled as well as requesting a copy of the contract.  As of today we have not yet received the contract nor a response to the status of cancellation.   Since [redacted] do not have valid proof that the account was cancelled per the contract terms, the account will continue to report as a disputed open collection account.     I strongly encourage [redacted] to contact our office to resolve the defaulted balance.

On 01/18/15 [redacted] signed a consumer pet lease agreement for the financing of a pet at [redacted]. Her account was placed with Monterey Financial Services on 01/20/15 to act as a 3rd party servicer throughout the term of her lease. I have attached a copy of the lease agreement for your review and reference.
The terms and conditions of the lease were agreed to by [redacted] as indicated by her signature on page 4 and initials on pages 2 and 3. All of the charges [redacted] references in her complaint are clearly outlined in the lease agreement. Including but not limited to specifically being outlined in section 8. Located on the page labelled Authorization Agreement for Prearranged Payments for [redacted], LLC [redacted] was given the option to sign up for automatic withdrawal or mail her payments. Based on the documentation provided and the options given I am unsure how [redacted] felt she was forced to be on automatic payments.
To the best of our knowledge the pet was purchased from [redacted], while in good health. [redacted] is welcome to discuss any health concerns regarding the pet with the pet store or [redacted] directly.
“Unfortunately we will not be able to accommodate [redacted] desired settlement as the terms and conditions were clearly outlined and agreed to in the attached lease agreement.. [redacted] contacted our office on 02/09/15 requesting an early purchase amount to pay in full her lease agreement. She was quoted the amount of $785.84 which was only good through 02/19/15. Since then her early purchase amount has increased to $873.30 due to February’s due date elapsing. Monterey Financial is still willing to honor amount quoted on 02/09 of $785.84, if the amount is paid in full by 03/06/15.
As of today the account is past due for $87.46 for Ferbaury 20, 2015 lease payment. If [redacted] does not take advantage of our above offer and the February payment remains unpaid the account could be reported the credit bureaus as past due in addition to late fees being applied to her account. I encourage [redacted] to contact our office immediately to pay in full her lease agreement before any rent fees apply to her balance.

I just wanted to share how the horrific situation I was in was made into a real life Blessing. Monterey Financial was a godsend to my family in a desperate time of need. Our terminally ill child needed a companion dog so we financed thru a store. The store filled out all the paperwork even signed my name. We just wanted to make our child happy for what was the last 3 months of her life. we were clueless that our monthly payments that were being paid directly to the store in cash were not going towards the actual price of the dog. it wasnt until after our child's passing that we realized the scam the store was pulling on us. Once we found out Monterey was servicing our account, we called and called but never got thru, one day I had enough and left a message simply saying CALL ME. Our town was flooded and lost our home, we had so much debt from our childs medical bills. I was shocked when I got a phone call that same day from a roabotic sounding lady telling me what I already knew about our account being passed due. I yelled and cursed at her while I vented about everything going on in our lives. As the anger turned to sadness and I began sobbing, she said Ma'am, Im so sorry for your loss, I'd like to help you if youd let me. This complete stranger stayed on the phone with me and hashed out a plan of action. She should have been rude, or mad or my first impression, a total robot, but she wasnt. When I asked her name again she replied, and I laughed. She was named after my child's favorite food Macaroni and Cheese. She kept me in the loop as far as the investigation and proof I sent from the store payments, and I was able to keep my promise of taking care of our dog. Mac, you dont know just how much you have helped me. You are truely a blessing. Thank you.

Monterey Collections was hired by the bankruptcy trustee for [redacted] to collect on some of their unpaid balances for services rendered. Monterey Collections was informed by [redacted] bankruptcy trustee that the patient’s insurance company mailed a check to the patient to cover...

the expense for numerous lab tests that were authorized by the patient’s doctor, instead of mailing the payment to [redacted]
Since the check from the insurance for services rendered was mailed directly to the patient, the debt remains unpaid and the patient is responsible for the amount of the check received. The account was placed with Monterey for the above mentioned unpaid balance and thus we mailed out an initial dunning notice on April 29, 2016 to the patient informing the patient of the unpaid laboratory costs.
We have not spoken with [redacted] to be able to explain that we need the explanation of benefits to determine if [redacted] is responsible for any amount. We have flagged the account as disputed and we are not currently reporting it to the credit bureau. Should [redacted] provide us with the explanation of benefits and if there is no mention of a check being sent to her then we will cancel the account with no impact on her credit whatsoever.
However if the explanation of benefits confirms that [redacted] received a check, she will be responsible for the amount of the check received that should have been previously forwarded to [redacted] I encourage her to contact our office to provide us with an explanation of benefits so we can investigate and resolve this matter promptly.

was financed through Monterey Financial. The contract was loaded to our system
on November 11, 2013 with the first payment due on December 05, 2013. On
November 12, 2013 Monterey Financial sent required notification and a coupon
book to the address listed on the original credit application.
On December
11, 2013 Monterey Financial began making calls to the primary contact number
listed on the application to discuss the past due payment. Delinquent notices
were mailed to the contract address on December 18th and December 22nd.
On December 28, 2013 a user name and password was created on the Monterey
Financial website and a payment of $238.00 was scheduled to be processed from a
[redacted] card ending in [redacted]. The payment was declined by the credit card company.
Monterey Financial continued to attempt to reach [redacted] throughout the month
of January and February to discuss his past due account including attempting to
contact him the work phone number listed on his application and making calls to
the references on the credit application.
 On February 02, 2014 another payment
was scheduled via our website. Upon viewing the website the account would have
reflected past due for both the December and January payments, late fees and
return payment fee, making the total amount due of $475.08. However, a payment
of only $237.54 was scheduled, but it was also declined. On March 04, 2014 our
website was visited again, but no payment was scheduled. On March 04, 2014 we
also received our first call from [redacted] wanting to discuss the details of
her husband’s account. This is the first record we have of any attempts to
reach us by [redacted] or [redacted].
As [redacted] is the only party on the contract we
were unable to release any information without his consent. [redacted] did
contact Monterey Financial later on March 04th to provide
authorization to release information to his wife. The representative [redacted]
claims to have left messages for as early as January did not become involved in
the account until March 07, 2014 when he attempted to contact [redacted]. On March 21, 2014 [redacted] provided a routing number and account number
to process ACH transactions to bring her account up to date. The first payment
was scheduled for March 21, 2014 for $230. On March 25, 2014 the payment was
returned by [redacted] due to being unable to locate the
checking account. On March 26, 2014 we spoke with [redacted] and explained that
the payment was returned at which point she indicated that she intended to send
a payment via [redacted] quick collect that day. To date no [redacted]
quick collect payments have arrived in our office from [redacted] or [redacted].
Due to
non-payment the defaulted contract was placed with our collection agency. The
defaulted payoff on the account is currently $5,446.83 and due immediately. The
information reported to the credit bureaus is accurate and correct. To date, despite
the attempt to make payment, no payments have been made on the account. In an
effort to resolve the account Monterey Financial would be willing to reduce the
balance owed on the account to $5,100.00. Should the discounted payoff amount
offered not be paid by May 15, 2014 the account would report on [redacted]’s
credit as and open and active collection account as of May 31, 2014.  In
addition the account would be assessed additional interest. **. or [redacted]
need to contact our office at [redacted] to schedule a payment to resolve the
defaulted contract.

From my communications with the company they have made no changes to what I originally requested.  I informed them that I would make weekly/monthly payments to resolve my balance.  The "status" of my account to be in good standing if I make a payment by October 1st is not satisfactory to me seeing I was never informed of being late or having a balance.  I am glad they will provide statements;but it is sad it had to take this for it to happen.  I will make payments to them to resolve balance.

[redacted] entered into an agreement with [redacted] on 01/24/2014 for the financing of a sound bar system as outlined in her complaint. The total cost of this product was $275.00. [redacted]...

[redacted] paid $137.50 towards her balance then financed the remaining $137.50. Her account was placed with Monterey Financial on 11/20/2014 to act as a 3rd party servicer for the remainder of the balance. 
 
The contract [redacted] entered into was a revolving credit agreement with a limit of up to $3000.00, which I have attached for your review. She does not currently owe the $3000.00, but has the ability to make purchases up to that amount with [redacted].
 
[redacted]’s first payment was due on 12/05/14 for the amount of $28.05 which has not been received. Since there has been no payment received she has assessed a $10.00 late fees every month that her account is not paid. She currently is due for the balance in full for $180.25 that must be paid to prevent any further negative credit reporting.
 
Monterey Financial is willing to remove the negative credit reporting if the balance mentioned above is paid by 04/13/15.

As [redacted] mentions in her complaint she signed up for a
contract with a 90 day same as cash...

option. I have attached a copy of the
contract for reference. The 90 days same as cash option can be located on the 1st
page of the attachment under the section labelled “90 DAYS SAME AS CASH
OPTION.” The option clearly indicates that the same as cash option expires on
October 20, 2013. [redacted]’s acknowledgement and agreement to this term is
indicated by her initials at the bottom right of this same page, and her full
signature on the next page.
On October 21, 2013 at 1:13pm PST [redacted] logged in to the
Monterey Financial website and schedule a payment for $461.86 for what she
believed to be the remaining amount owed on her same as cash option. Up until
this point Monterey Financial had no communication with [redacted]. At 2:18pm
PST on October 21, 2013 Monterey Financial contacted [redacted] to advise her
that her same as cash option had expired and that the payment she made on the
website was not enough to satisfy the payoff amount.
 On October 21, 2013 the
total amount needed to pay the account in full was $791.78 as [redacted] would be
responsible for the interest on the account from the open date of the contract.
 As seen by the attached transaction history the payment [redacted] made
prepaid her account until February 01, 2014. Since we communicated with [redacted] and explained that the account was not paid in full, there was no need
for Monterey Financial to draft any payments until her next scheduled payment
date of February 01, 2014.
I apologize [redacted] felt the representative she spoke with
was rude because he would not close her account out or honor her same as cash.
I have personally reviewed that call recording and will address training issues
with the representative in question. Although contractually due for the full
pay off balance of $542.73 as of today, in an interest to resolve this matter
Monterey Financial would be willing to settle the account for the payoff amount
due as of October 21, 2013. This was the same date [redacted] made the payment
on our website meaning that nothing in addition has assessed on her account. As
mentioned above the payoff amount owed as of October 21, 2013 was $791.78. [redacted] made a principle payment of $451.86 on October 21, 2013 and a payment of
$128.94 on February 01, 2014 leaving a remaining amount due of $210.98 to
settle the account based on the payoff due October 21, 2013. The $210.98 would
need to be paid to my office to settle the account no later than Tuesday,
February 18, 2014.
As of today Monterey Financial has only reported positively
to the credit bureaus regarding this account.  We will continue to report
all applicable information to the credit bureaus accordingly. Should [redacted]
elect not to accept my
settlement offer of honoring her pay-off amount due as of October 21, 2013, she has the option to continue to make her contractual
payments of $128.94 until the account is paid in full. The next payment on the account is due on March 01,
2014.[redacted] indicated the possibility of placing a stop payment on the
February 01, 2014 payment. If done, [redacted] would be responsible to replace
that payment in addition to contractual return payment fees. The account would
also reflect past due for the February 01, 2014 payment and could be subject to
late fees and negative credit reporting.

If you have any choice don't go with this company Monterey Financial is extremely misleading in the beginning of the contract I was told I had 12 payments the first payment I paid at the store at the end of the contract there is a residual payment why would you expect someone to pay triple the amount for furniture and then let it go back by not paying the last payment they're extremely misleading extremely rude the representative that I spoke with pretty much had in mind of other take it or leave it when I brought it to his attention he tried to correct it if you have any choice in the matter and I know people are this is turbulent times and people don't have those choices all the time and you need to not go to Monterey Financial

Monterey Financial has expert negotiators that have the consumer sign the documents backdated, via the internet, without the consumer being able to write an actual date of signing the contract. We signed the contract on the 7th of the month, yet 3 weeks later the payment was due. Second, using Monterey financial's website to make payments they charge $10 for using it. Third, Monterey staff make it sound so easily to sell their services, Yet they charged us $2878 extra for the broker, United Medical Credit, whom we applied through; Not knowing of the charge that Monterey would pass it to the consumer, us. Fourth, asking for anything such a due date they charge $25. United Medical were so easy to sell their services, without telling us in the beginning of their $2878 charge, until we had seen the physician and purchase the physician's food products.

In response to the complaint received: [redacted] entered into a contract with [redacted]. on 08-09-2015 as [redacted] states in the complaint, and the contract outlines an amount financed of $3992.00 at a 16% APR (Contract attached).
The contract was assigned to...

Monterey Financial Services the same day, per the “Notice of intent to Assign” outlined in the contract. In January of 2016, [redacted] spoke to a Monterey representative after the account had become 2 months past due on payments. He indicated that he had not been working due to surgeries/hospitalization that he had experienced and was unable to pay the account up to date, and was unable to afford the contractual monthly payment amount.
At that time it was discussed that he would need financial assistance, where the Monterey representative arranged a reduced payment arrangement to prevent the [redacted] account from becoming further delinquent. When the contractual payments were reduced to an amount lower than the contractual payments as agreed upon in the contract, it was explained that the past due amount would be moved to the back of the loan, and the loan would be extended accordingly (due to the fact that the [redacted] were unable to pay the past due amount up to date at the time).
At this point, the [redacted] have made 5 of 36 contractual payments, and the account is currently due for the July payment. I urge the [redacted] to contact our office to discuss their current financial situation, and to discuss any further questions or concerns they may have regarding their loan. the rescission period outlined in the contract (on 3-29-16), Monterey has taken the necessary steps to have the information verified to close the account accordingly. I apologize for any perception of a delay in getting the cancellation verified, but the account has since been closed accordingly as a cancellation.

I did not electronically sign anything.  They state an ip addess of E-SIGN (275670 - Sat Mar 24 00:00:00 PDT 2012[redacted] - 03/24/2012 14:31:11] ).    This is NOT my ip address. 
My ip address is   [redacted].   [redacted] look at the 14 hour difference in time.
I asked numerous times for them to provide proof of signature, initials or anything showing I actually signed something and they cannot prrovide anything.[redacted] did not render services.  They were suppose to provide 6 months of mentoring and help set up a business. 
I received exactly 2 voice mails.  I did not even speak to anyone.  I asked a laywer and he said that a voicemail is not services provided as I did not speak to anyone.I tried to tell Monterey this and they would not listen.I also tried to contact Pemier Mentoing and have them cancel anything and got no response.
TWO MONTHS later, Monterey started taking money out of an account.  I had to close the account to get them to stop taking money for something that I only filled out an application for and did not signany contract for and had also not gotten any service for.
They have listed on this application that I work at [redacted] which I did not, I was on Disability and was paid by [redacted], They have my cell phone on this application, which I did not have in 2012 and just gave them that number 2 weeks ago when I tried to talk to them again., so they modified a document to fit their needs
They have my monthly income as 1000.00 which I have never had as a monthly income.I did NOT sign anything and never received any mentoring.
On the advise of someone else, I offered them 900.00 to settle everything.......until the lawyer told ne that I should not settle because no services wee rendered, they have false information, and modified a document and cannot show prroof of me signing anythingALSO please note online them scam reports against this company for exactly what they are doing to me.  There are tons of complaints against Montery and [redacted].I honestly did not sign anything, I was and still am on permanent disability and could not then or anything ever afford this.  I did not sign a contract and did not received services

Monterey Financial Services has and always will be no better than a last resort loan shark for consumers with cash flow issues.
They survive due to their agreements to provide financing for companies that have decent reputations but no in house financing for their goods/services. No consumer in their right mind would go directly to Monterey Financial for a loan because as a finance company they could not compete with the products/services that other companies provide.
I have paid off their outrageous loan along with the up front interest charge and the absolutely ridiculous list of service charges for making payments, miscellaneous fees (not making it up they actually just add fees and list them as miscellaneous) and severed relations with this company.
I have also stopped doing business with [redacted] for being associated with this company and made sure that they understood why I was taking my business elsewhere.
DO NOT DO BUSINESS WITH MONTEREY FINANCIAL SERVICES unless you feel like flushing a large amount of money down the toilet.

As stated in the original response, Monterey has changed [redacted] account status from past due, to reflect current, so for [redacted] to state no changes have been made is innaccurate. Monterey has also waived all fees assessed on the account since she first notified our office of the return (July through September), in the amount of $28. If the next due of 10-1-14 does not work for [redacted], Monterey is willing to chane her due date to a more suitable one, but she has not communicated such to our office, and as she has stated in her last 2 communications in this forum, she will be making her payments as scheduled. I urge [redacted] to contact our office, toll free at 877-775-3080 to make the necessary arrangements.
