Nutrisystem provides several different options to purchase the product including Auto-Delivery, Month to Month and A La Carte orderingPlease see attachedAccording to Nutrisystem’s records, on January 22, Ms*** enrolled in the NutriSystem Auto-Delivery Program With the current Auto-Delivery program, customers get a 20% discount off the month to month program price and free shipping within the Continental US when they remain on the program for at least shipmentsCustomers are automatically shipped their 28-Day order once every four weeks, and charged accordingly, unless they cancel. Customers are sent an e-mail reminder or given a telephone call when their next order is to be shippedCustomers can edit, customize or delay their Auto-Delivery order, simply by calling ###-###-#### or visiting nutrisystem.comTo cancel their Auto-Delivery order, customers must call ###-###-####. If a customer cancels prior to paying for their second 28-Day program delivery, their payment method is charged for the amount of the auto delivery discount they received on their first 28-Day program delivery. The Terms and Conditions of the Auto-Delivery Program are posted on the website where Ms*** enrolled in the program. On February 12, 2015, Ms*** was sent an email indicating her second order was being shipped to her on. That same day, Ms*** went on to the Nutrisystem website and delayed her next order until February 16, 2015. Please see the screenshot below from Ms***’s account (attached)
Ms***’s order was shipped to her on February 16, 2015. That same day, Ms*** contacted Nutrisystem and indicated she wanted to cancel her Auto-Delivery Program. Ms*** was informed that she would be charged for the discount she received on her first order ($68.99) if she chose to cancel her Auto-Delivery program before accepting and paying for her second order. Ms*** agreed to remain on the Auto-Delivery program and her next order was delayed until March 16,
On February 22, 2015, Ms*** contacted Nutrisystem and cancelled her Auto-Delivery Program
According to *** delivery records Ms*** received her second order on February 20, 2015. Ms*** is eligible to return this order under Nutrisystem’s day Return PolicyPlease see attached. If Ms*** would like to return the order please have her contact the Customer Service Department at Nutrisytem (###-###-####) before March 20, to request a return authorization number.
Under the terms and conditions of the Auto-Delivery Program that Ms*** enrolled in *** was required to purchase two (2) orders in order to receive the discounted price that she received on her first order. As indicated above this information is posted on the website and Ms*** indicated she agreed to the Terms and Conditions of the program when she submitted her order. However, in the spirit of good consumer relations if Ms*** returns the second order within the day return policy Nutrisystem will waive the charge for the discount she received on her first order ($68.99)

On January 19, *** *** was sent an email indicating that his second order was being processed for him
On January 23, 2015, *** *** contacted Nutrisystem to cancel his Auto-Delivery Program. *** *** was informed that he would be charged for the discount he received on his first order ($84.99) if he chose to cancel the program before accepting and paying for his second order. *** ***’s account was cancelled and he was charged $in accordance with the terms of the Auto-Delivery Program.
The Nutrisystem program has helped millions of people lose weight for over years and is backed by scientific evidence. That is why Nutrisystem is able to offer both a money back guarantee and has a day refund policy in place. Under Nutrisystem’s day Money Back Guarantee Nutrisystem clients can try the Nutrisystem program for days and if they are not completely satisfied they can contact Nutrisystem within days of receiving their order and return it for a full refund of their purchase price (please see attached). Under the day Return Policy Nutrisystem clients can return any unused food products they have within days of receiving their order for a refund (please see attached). However, Nutrisystem cannot guarantee that our customers will lose weight as we cannot verify whether our clients have adhered to the program. We are sorry that *** *** was not satisfied with the program. After reviewing *** ***’s complaint I contacted our Customer Service Department to determine if they had a listing for *** *** or his email address ***@***.net. *** ***’s email address is not registered with Nutrisystem and Nutrisystem has no profile for *** *** in its database. Based on the information that *** *** provided, it appears that he received an email from a third party which contains some type of Nutrisystem promotional offer.
Nutrisystem takes spam emails and the sending of them very seriously. Nutrisystem is unable to determine the origin of the emails from *** ***’s complaintIf *** *** could forward the actual emails to me, we would be in a better position to determine who is sending them. In the meantime, Nutrisystem has placed *** ***’s email address on its own “Do Not Email” list

I have to say that I have been extremely disappointed with my Nutrisystem experienceFirst of all, all of the food is so processed that it made me sick to my stomach after a few days I'm used to eating fresh fruits and veggies but I didn't know that everything was so processed! All of the pictures make it look like everything is freshSecond of all, after a week the new Apple IOS came out and it caused the NuMi app to crash and glitch I messaged customer service and they just said "oh well"Third of all, after weeks (days) I decided to cancel any recurring orders Oh guess what?? You can't do it online You can upgrade or downgrade online but you can't cancel All that shows me is the company wants to prevent people from easily canceling and pressuring when into stayingI call the number to cancel and guess what?? The woman pressures me like no other to stay I kept saying I didn't like the food and it made me sick She then said "oh you have to pay $to cancel because you are past the day limit...it says so in the policy" I was ONE day late I read the policy and it says some garbled message about if you cancel after days but before the reorder date then "Nutrisystem receives a $credit" What the heck does that mean??
All I can say is these people don't care about you or your weight loss and only care about money Goodbye and never again

"The Nutrisystem Money Back Guarantee is posted on the Nutrisystem website and the information is provided via telephone when our customers contact Nturisystem via telephone"I signed up with a "Mick" on 12/30/and was NEVER told the food had to be returned. It was the principal of the matter, as everyone kept telling me the same thing - that I was told (and here we go again) WHEN I WAS NOT TOLD. If I had been told, why would I have become so upset? I would have already known. If it doesn't make sense than it's NOT TRUE!
I have been recompensed fully so the case can be closed and I appreciate all of your help. However, I was NEVER told the food needed to be returned. If anyone at Nutrisystem cared enough they would have reviewed the taped from that day and they would have seen that I was not told

On June 20, (the same day ***’s order was being shipped to her) *** contacted Nutrisystem indicating that she received an email stating she was getting a shipment and she asked not to have any other foods sent to her. The representative asked *** if she wanted to cancel her auto-delivery program and *** replied yes. The representative cancelled ***s auto-delivery program and provided her with a cancellation number. The order that was in the process of being shipped to *** was not cancelled as the representative thought *** just wanted her auto-delivery program cancelled. *** contacted Nutrisystem the following day (June 21, 2016) and indicated she wanted the order that was in transit to her cancelled. The representative was unable to stop the order that was already in transit to *** so a RMA number and a return label (at a cost of $19.99) was issued to ***. *** was informed that it would take 7-business days for *** to see a credit once her order was returned to Nutrisystem. ***s shipment was returned to Nutrisystem on June 27, and *** was issued a credit in the amount of $on July 13, 2016. *** should be in receipt of the credit at this time. On April 17, *** *** purchased the NutriSystem Auto-Delivery Program at www.nutrisystem.com. With our Auto-Delivery Program, customers receive a 35% discount off the full retail value of a 4-week plan with every auto-delivery purchaseThey also receive free shipping (Continental US). By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel. If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. If our customers decide to cancel before the second shipment and after the day guarantee period, they authorize us to charge a $early cancellation fee. If they cancel any time after they receive their second month there is no fee. After reading this language, customers click to “submit their order”. The terms and conditions of the auto-delivery program have always been posted throughout the website (please see the attached page)However in response to customer complaints and inquiries Nutrisystem has added additional language and information throughout the website to make it clearer to our customers that they are choosing the Auto-Delivery program and agreeing to the terms and conditions of the program, including the $cancellation charge before they make their purchase. Specifically, the auto-delivery terms and the cancellation fee are conspicuously displayed at the “submit my order” button (please see the attached page) and if the customer clicks on the Auto-Delivery option the benefits of auto-delivery as well as the cancellation fee are clearly stated (please see the attached page). *** *** submitted her order and agreed to the terms and condition prior to her purchase. *** ***’s first order was delivered to her on April 21,
On May 15, *** *** was sent an email indicating her second order was being processed for her. *** *** contacted Nutrisystem via telephone that same day to cancel her auto-delivery*** *** was informed that if she cancelled before she received her second order she would be charged a $cancellation fee. *** *** was asked to confirm whether or not she wanted to cancel. *** ***’s auto-delivery was not cancelled at this time.
On May 18, Nutrisystem received an email from *** *** requesting the cancellation of her auto-delivery program. *** *** indicated she was unaware of the $cancellation fee when she signed up and she did not want to pay the $fee. Nutrisystem responded by cancelling *** ***’s auto-delivery program and waiving the $cancellation fee*** *** was provided with a confirmation number and advised the $fee was waived.
It is unclear as to how *** *** received a second order as indicated in her complaint. The second order that was pending on *** ***’s account was cancelled when her auto-delivery program was cancelled and Nutrisystem does not show that a second order was shipped to *** *** If *** *** can provide the tracking number from the second package that she received we will be happy to look into this further

Therefore, *** ***’s June 13, was cancelled for loss prevention reasons. *** *** contacted Nutrisystem about the issue on June 13, 2016. *** ***’s auto-delivery was reactivated and the gift cards that *** *** applied to the order were re-applied to a new order. *** *** received her order on June 16, *** *** is a long-time customer of Nutrisystem and we appreciate her business. On February 24, *** *** contacted Nutrisystem and requested to cancel her Auto-Delivery programShe also requested to return the order she received under the day guarantee period. *** *** was provide with a return label and advised that it could take 7-business days for her to see the refund. *** *** return was received at a Nutrisystem warehouse on February 29, 2016.
On March 2, 2016, *** *** contacted Nutrisystem regarding an update on her refund. The representative erroneously informed *** *** it could take 7-business days to see the refund.
On March 14, 2016, *** *** contacted Nutrisystem about her refund. *** *** was informed it could take 7-business days to see her refund. *** *** indicated the previous representative had told her 7-days and she was very upset that she hadn’t received her refund yet. Her call was escalated to a manager who saw that her return was received by the warehouse and initiated the refund to *** ***. *** *** was issued a full refund (less $shipping) in the amount of $on March 15, 2016. *** *** enrolled in the NutriSystem Auto-Delivery Program online at www.nutrisystem.com on March 17, Nutrisystem offers several different plans to choose from*** *** chose the Nutrisystem Men’s Select plan with Turbo Ten when he purchased the program online. With Auto-Delivery our customer receive an email or a telephone call prior to the next order being sent to them. *** *** was sent his first order on March 18,
On April 7, 2016, *** *** was sent an email indicating his next order was being processed for him. According to Nutrisystem’s records, *** *** went to the Nutrisystem website on April 9, and changed his plan to the Men’s Weekends My Way Select plan. *** *** was sent an order confirmation on April 10, and his shipment was sent to him on April 13,
On April 19, 2016, *** *** contacted Nutrisystem and indicated the shipment that he received did not include the products he selectedThe representative apologized and offered to send *** *** a return label for the ready to go food products he received (frozen food products on non-returnable and non-refundable). *** *** agreed to keep the frozen food products he receivedThe representative assisted *** *** with customizing a new shipment and a new shipment was sent to *** ***
On May 13, 2016, *** *** contacted Nutrisystem regarding the refund for the incorrect order he received. *** *** was informed that he would be issued a refund for the ready to go food products he received and he would not be issued a refund for the frozen food products that he received and retained. *** ***’s call was escalated to a supervisor who informed him the same
*** ***’s account was reviewed further on May 16, and it was determined that he should be issued a full credit for the second order that was shipped to him that did not include the correct products he ordered. *** *** was issued a full credit of $on May 16, and he should be in receipt of the credit at this time. We apologize that *** *** was not initially given a full credit for the second order that was shipped to him and we wish him continued success with his weight loss goals
