I am rejecting this response because:
In my complaint I stated my desired outcome to have Ryan Homes honor the warranty agreement and cover the cost to repair the damaged sewage pipe under my driveway identified in the presence of Ryan Homes Rep by [redacted]  [redacted], Ryan Homes Plumber. There's a possibility that the damaged pipe may have caused the sewage backup but Ryan says the damaged pipe is normal. It will remain unknown as to what caused the backup but the damaged sewage pipe of my new home needs to be repaired because my house is still under warranty.

Ryan Homes is in the process of evaluating the HVAC unit through a 3rd party. This inspection is scheduled for Tuesday, July 22, 2014. Based on the findings of the inspection,...

Ryan Homes will make necessary repairs, including upsizing the HVAC unit, if it is determined to be undersized.

The total amount collected at
settlement with regard to Water and Sewer was $1,140. ...

$570 of that amount is applicable for 2015
and the remaining $570 is applicable for 2016.
Because this is a December
settlement and 1st payment is due in January, the mortgage company
requires this amount in advance to establish escrow.
Please reference the Sewer
and Water Declaration as well as the Sewer and Water Disclosure that was
signed at the point of sale, which states that the first year’s payment is due
upon settlement and is collected each year following in January for the next 33
yrs.

I purchased my new townhome built by NV homes in 2013 at Deep Creek Village. The sales team sold us on the potential that a dock would be built with water privilege for the community. Once the community was complete, the builder built their final property on the lot where the access would be and sold with exclusive private water rights access. Total bait and switch, I will never do business with this company again.

We stand by our earlier
statement and maintain our position the consumer defaulted on the contract and
that his deposit was properly retained.

What I was told in September was that NVR mortgage denied me and I was eligible for the incentive with a lender of my choice.  Ms. D[redacted] (NVR branch manager) told me she would forward my information to [redacted] to help me out.  I specifically asked her if I would get the incentive if I went with another mortgage company and she said yes.  Now they are claiming that [redacted] is the same as NVR mortgage and I will not receive the incentive.  It is not the same company and they can't show me the proof that [redacted] is under NVR.  That NVR might have brokered the mortgage is a different story.  They lied and were deceitful.  I will never recommend anyone do business with NVR.

Ryan Home agrees to replace the air conditioning unit as
well as schedule the cleaning of the air ducts with the homeowner.

Beware of Ryan Homes. They promise you to deliver better quality home to win the business BUT they are no different than any other low quality homes in the area. I suggest you hire a home inspector to inspect the home before 1 year otherwise you will be lashing out 1000s of dollar from your wallet to fix the crap which Ryan delivered.
My egress wall was not installed correctly, not even 1% correct as per the manufacturer guideline. When I called Ryan Homes to report the issue, they didn't even care as the house is past 1 year warranty period.

Our sincere apologies for the previous response posting, please disregard as it was unrelated to the Revdex.com complaint assigned [redacted].
Regarding Revdex.com [redacted], The NVHomes Production Manager has completed an inspection on the [redacted] property on Monday, July 21st and found the grading to be in good order with no signs of erosion or
drainage issues (see pictures).  The customer is on vacation, and when the
customer returns the NVHomes Production Manager will contact him and offer to bury and extend  his
sump line to make sure it is not recirculating.

The [redacted] Homes Service Manager has been working with the [redacted] to resolve this issue.  [redacted] Homes has agreed to replace the flooring and [redacted] has agreed to cover the cost of the upgrade.

    Thank you for your time on this matter. I have spoken with Mr. [redacted] and a gentleman by the name of Ben and there was no offer to have the items repaired and I have a recording from the project manager that he was going to contact the service center on my issues and nothing was ever put in and no service ticket was issued. I had a meeting with the county inspector today at my home and there are several code violations that were noted regarding these problems. There are lawyers involved at this time and Ryan homes is just wasting your time on getting these items resolved. No effort has been taken to correct the issues.

We WERE key word is WERE going to buy a home from NVR/Ryan Home's in Lansdale, PA. They work as dual agents but are in fact mainly only in Ryan Home interest. They never disclosed to us that we could have a lawyer look over their written contract (in being first time home buyers we didn't know better) in which they used vague language (always say in good faith but never define what this good faith is) to basically say if you can't buy the house we will keep the down payment as well as say we can force you to wait up to two years to settle. We were up front about our credit score mine is good and my not wife's not so good but got told we would not have to pay any PMI (never disclosed you needed a minimum credit score). I meet with the loan officer after we sign the paper but within the week we can cancel without a penalty, he only showed me paper work with what it would be with my name on the loan and thus no PMI never discussed or showed that with my wife on the loan there would be PMI and the payments above our budget. I get the loan officer all the stuff he needs, I assume he sent the stuff to the underwriter if he did I have no proof but got a call two weeks later saying hey we need to put your wife on the loan since you got denied (never received any paper work stating so or why) with only your name on the loan. Takes them about a week or two so now a month has gone by since we signed the contract to get us the paper work with my wife name on it and guess what, the PMI is now added in due to her credit score to our surprise since we were never disclosed to the terms of the PMI and the payment is now $600 a month which we can't afford. We then call the Ryan Homes person we worked with and she tells us well if you cancel we will keep your down payment and why did you wait so long to inform us you didn't say anything right away or bat an eye when the loan officer showed you the numbers at the first meeting. Well we said first of all you never showed me the numbers with my wife on the first meeting and also we waited so long to say no since it took you guys a month to get us the paper work with my wife name on it. So they have now kept our down payments which was our life savings and refuse to give it back due to their inability to be up front and honest to us and feel like we were cheated out of our money and can't do anything since they also stipulate if you try to come after us we can sue you for all legal fees we incur. This company is nothing but a scam that takes advantage of people and keep's their money. I advise everyone I know to stay away from them and tell them my story.

Our response was very detailed.  Our Production Managers and Service Managers have had detailed conversations with the homeowner on this subject manner, as well.  **. [redacted] was informed that the change in stone was a joint decision between
NVR and the condo management firm.  Further, that decision was not made
for [redacted] alone, but also our other condo communities.  **.
[redacted] was also informed that if he simply followed the proper channels with the condo association
that he could affect the change of the stone on either his building, or the
other buildings in the community, but that neither [redacted] nor the
homeowners own the exterior of the property in question.  Therefore, we
cannot change out the stone without direction from the condo
association.  **. [redacted] said repeatedly that he would “never go to the
condo association,” he would rather go through the Revdex.com.
 
[redacted] would also like to be clear that
there is no difference in quality OR price between the two stones in
question.  There are no “upgraded” stones in the community.
 
Finally, to address the roads;
they are only the base coat.  The developer of the community, Buchanan
[redacted], is responsible for all roads in the community at this point.  Once construction
of the condos and townhouses is complete, [redacted] will come back and put a top
coat on all the roads.  This is the normal building practice for all
construction, residential or commercial.  The flooding that **. [redacted] is referencing
is partly because this topcoat has not been applied yet, but is more impacted
by the Erosion and Sediment controls in place.  Developers and builders
are mandated by the county and the EPA to put silt-filtering stone bundles
around all storm inlets while there is active construction in the
community.  These bundles slow the drainage of water and can create
temporary ponding during heavy rains.  The controls cannot be removed
under any circumstances without sever penalty from the county and/or the EPA.

There are several inaccuracies in the reply by the Corporate Customer Relations department and this is more then warranty work; I want the repair job that was started to be completed.
 
The initial complaint started prior to December 2014 but was formally submitted on our 30 day list as instructed by our Project manager; Brady.
We were informed it would not be looked at until the spring thaw. The pipe that was installed (as seen in these photos; [redacted] ) is an improper installation of a french drain that was installed in February 2015. I communicated this with our project manager who said again, that I was right, they did a bad job and that it wouldn't be the permanent solution. He requested that I wait a few months to see if it does anything. He also said we didn't need to worry because it'll get fixed. I asked what a permanent fix would be and Brady stated that most likely running a better pipe solution to the storm water drains during the development of the next phase of lots. The problem did not go away so I filed a formal ticket on August 25th after trying to work with Brady and Shane (Brady's replacement) but nobody responded or followed through. It was about 6 months since [redacted] took ownership of the issue but left it unresolved; not roughly a year.
 
As seen in the photos there is no proper pipe entrance for customer maintenance or water flow. The placement of the rock was done so to prevent my daughter from playing in the marsh that developed.
It was done after the water continued to seep through the ground not prior and has not gotten worse since the rock was placed there.
 
You can see in the photos that the contractors hired by [redacted] improperly installed a french drain using an unsleeved pipe without gravel and was certainly not deep enough to achieve the desired results of water mitigation. This is clearly a situation where corners were cut. They additionally damaged the silt fence to force the undirected water flow into adjacent lots which is eroding the land of the undeveloped lots. Any civil engineer or landscape architect will conclude that this was done improperly, without regard to consequence and is most likely causing additional water issues as a result of the corners cut.
 
I have also included a copy of the customer warranty (in the attached photos) information regarding standing or ponding water. It states under section 2. "Performance standard" that; "The necessary grades and swales shall have been established by us to insure proper drainage away from the home. Standing or ponding water shall not remain for more than 48 hours in the immediate area after a rain; except in swales which drain other areas." I still maintain that this has not been done and inferior/questionable methods were taken to attempt to resolve the issue. I see no clause that identifies natural causes for ponding water to not be addressable issues.
 
Further; The improper water mitigation installed by Fox Ridge and it's contractors violates Mt. Juliet storm water and water mitigation codes under section 4-106 and sub codes(4-106.1 through 4-106.303) in violation of Ordinance 2-20-1997 and Ordinance No. 3013-81 (adopted Nov. 25th 2013) all sections 3 through 7 (in part but excluding section 9)  and appears to also violate sections of the Federal EPA code40 CFR 122.26.
I have contacted the City of Mount Juliet for additional direction.

My Boyfriend and I are purchasing a home with Ryan Homes in South Carolina and used their Mortgage company called NVR. We were supposed to close today and be 1st time home buyers and have a great experience but that's not the case. Yesterday 10/26/16 at 5pm my boyfriend received a phone call from NVR satiating that they keep getting rejected when they tried to retrieve my boyfriends 1040 tax return. She then stated without these papers we can not have you close tomorrow 10/27/16. How does a company call us less then 24 hour before we close? its 5pm what are we going to do? She said tomorrow morning head down to the local IRS office and have them print the 1040's out for you (she made it sound so easy) Today the day of our closing we woke up at 730 am so we can try to get some help without having any appointments at the Irs office. After sitting in the waiting room for 2 hours we get told, without an appointment we cant help you. Now its 10am! I called the regional manager who tried to help us but nothing could be done. He then proceeds to tell me that this mistake is on them and on behalf of NVR he is truly sorry and that it could have been caught in July. No one took their time in the 3 months of this process to check, double check or triple check that all papers are in place for our expected closing day on 10/27/16! after loss of sleep from the night before and not closing on our expected date now I had to try and push my moving company back a few hours to accommodate them to close tomorrow 10/28/16 morning at 930am. The regional manager said because we caused you so much trouble were going to cut you a check for $600 from your closing cost. What is $600 ? they should be giving me back my whole final closing cost to accommodate the trouble they put me and my boyfriend! Its a sweet jester but not enough for what we went through today. This will be my first and last time ever working with NVR.

Dear [redacted] and [redacted],
I reject Ryan Homes response of my complaint to the substandard construction of my home, that was sold to me under the pretense of SUPERIOR Quality.  Ryan Homes is morally, ethically and professionally corrupt, the sound test that Ryan Homes conducted on January 31, 2014 in my opinion was fixed and fraudulent, which only proved that the home was built to minimal standards with substandard materials which are required by the IBC, but sold under the pretense of SUPERIORITY.   The installation of additional features in the Unit above mine, DID NOT REDUCE ANY OF THE NOISE Transmission issues that have cause my living environment to be hostile with my neighbor.  I have researched endlessly, about the NOISE TRANSMISSION issues that I am having, only to be completely disappointed in the fact that RYAN Homes basically failed to use any noise reduction systems or materials on the market when designing, building these on-top of each other condos, not to mention that Ryan Homes also failed to consider the environmental issues of building in the flight pattern or in such close proximity to a high volume highway .  If Ryan Homes would have considered, using superior quality materials and workmanship when building these Condominiums, I would not be having these NOISE TRANSMISSION issues.  It is completely dispiccable that RYAN Homes assumes NO Responsibility legally or morally in the building of these poor quality, workmanship, or of decietful marketing and selling of these homes.  I was assured by the sales representative and the Senior Project Manager of the Site that Ryan Homes Homes are of SUPERIOR QUALITY, and that I would RARELY and BARELY hear the Air Traffic or the high volume highway traffic in my home, which was a flat out LIE.  The fixes that I am considering are replacing the windows to above builder grade (which is the lowest quality of windows in order to barely pass inspection) and installation of sound proofing materials between the common walls/ceiling, flooring of my unit, above unit and the outside walls (because RYAN Homes used NO system/materials but somehow managed to pass a acoustical test to the lowest STD possible by using their own company, which knows the standard required to pass.)  These issues have caused me a considerable amount of stress, and will cost me approximately an additional amount of close to $25K to $30 K to fix these issues, which should have been considered prior to building these condominiums and selling them under deceitful practices.

1.) I am rejecting this response because I believe there has been vertical movement of more than 1/2 inch.
2.) Also in my opinion these are more than "surface cracks" as described by Mr. R[redacted] . These cracks have severed the full thickness of the concrete which is at least 4" inches in depth. The Crack(s) start on one end of the concrete to the other end for 30  linear feet.
3.) I believe Ryan Homes did not properly compact the area where the concrete cracks have occurred thus the issue we have now. These structural cracks started to occur within 6 months of the initial pouring of the concete pad(s). I brought this to the attention of the Project Manager Ron K[redacted] within the 6 month timeline and also at the 10 month review conducted by him on behalf of Ryan Homes as well.
4.) I paid full price for a brand new concrete driveway and I still want a brand new driveway for years to come. Not a botched job that was improperly designed and executed.
