Good morning Merchant had full knowledge of the charge for the cancellation fee in the amount of 1500.00 dollars Merchant was speaking with our client support specialist between the dates of March [redacted] to March [redacted] Merchant stated that they are selling their business and we told them...

that we will give them 30 percent off their FULL cancellation fee and their new fee was 1500.00. We have all emails between us and the merchant and all documentation where it states that they have an LD fee; which is our cancellation fee. Every merchant has a different cancellation fee and the only time we charge 395.00 cancellation fee is if we can not beat or match a competitors rates.  [redacted]'s original cancellation Fee was 2700.00 Dollars It was stated to the merchant on March [redacted]. we have the communication between us and the merchant Unfortunately at this time we will not be issuing the merchant a refund.

 As is typical for Red Payments, I never heard from them. I'm not disputing the exchange fees charged by Visa and Mastercard, what I am disputing is the surcharge that is levied by Red Payments on top of this which is significantly higher than the contracted rate.Tim

 When I did get a courtesy call they asked me if everything was OK and I said yes because because I never knew that my signature was forged by one of their representatives
  And I make sure I asked over and over is this a contract is there something  I need to sign before You process this and they said know.I never got the email for my signature or nothing like that all of a sudden I'm calling to cancel  then they told me it was $1000 cancellation fee. Wish did not state in the information that was sent to me after I called to cancel.this company is not true full they send people out to sign people up but do not check to see anything before they approve this application

 To whom it may concern.I don't agree with your proposal.  You can't give me an offer on something that I was scammed into.  If necessary, I will take this case further, either to a small claims court or the Attorney general's office and my witnesses are willing to come and testify in court. I will do whatever it takes to win this case, even if I have to use your bad reviews and fraud records that are already shown online from previous customers.  If necessary, I will contact previous customers that were also scammed by your company ( and there are many of them) to testify against you.
 I suggest that you go take a look and see for yourselves how many complaints and bad reviews are against you.  Whether in the Revdex.com or other websites.

Good Afternoon    Looking into the history of your account we have come upon several notes; We advised you that Steven G[redacted] is not an employee of Red Payments, he was an independent contractor that no longer had an affiliation with Red Payments. When receiving your cancelation letter...

the first thing we did was call you to attempt to retain. You were speaking to Krystal at the time, and she had advised that you had signed an agreement with us and there is an LD fee that is associated with breaching the contract.    5/** a phone was made by Krystal, where she spoke with the you the merchant and sent you over a copy of your contract, where you signed that you read and understood the terms and agreement. On 6/* you spoke with Krystal again and advised her to proceed with the closure request. She went over the contract with you once again and advised you of the LD fees.   Then you called back the same day and stated to hold off on the closure, which we did   6/* we left you a message to try to get you back on board 6/** left a message with [redacted] to have the merchant give us a call back   6/** as per you the merchant you wanted to proceed with the closure request, because you felt you didnt sign a contract when it states on the application that this is an application and agreement.  Our first goal was not to close you and charge you ANY fee, but to lower your rates and keep you on board with us.....this was refused.According to your terms and conditions that you signed that you red and understood 4.04 Effect of Termination. When termination becomes effective, the parties’ rights and obligations existing under this Agreement survive. If this Agreement is terminated, regardless of cause, Bank may withhold and discontinue the disbursement for all Cards and other Merchant Transactions in the process of being collected and deposited. If Merchant is terminated for cause, Merchant acknowledges that Bank may be required to report Merchant's business name and the names and other identification of its principals to the MATCH file maintained by [redacted] and [redacted] and/or the CMNF file maintained by [redacted]. Merchant expressly agrees and consents to such reporting if Merchant is terminated for any reason requiring listing on the MATCH file or CMNF. Merchant waives and will hold harmless Bank from any claims that Merchant may raise as a result of Bank’s MATCH file reporting or [redacted]'s CMNF reporting. Merchant will also immediately cease requesting Authorizations. If Merchant obtains any Authorization after termination, the fact that any Authorization was requested or obtained will not reinstate this Agreement. Further, Merchant will return all Bank property, forms, or equipment. All obligations for Transactions prior to termination (including payment for Chargebacks and Bank’s expenses relating to Chargebacks) survive termination. Bank is not liable to Merchant for damages (including prospective sales or profits) due to termination. Following termination, Merchant will upon request provide Bank with all original and electronic copies of Sales Drafts and Credit Vouchers that have been retained by Merchant as ofthe date oftermination. Upon termination, any amounts due to Bank will accelerate and be immediately due and payable, without any notice, declaration or other act whatsoever by Bank. The parties agree that if for any reason other than a material uncured breach by Bank, this Agreement is terminated before completion of the thencurrent term and without first giving Bank the right to match the terms of a written bona fide third party offer, Merchant shall be liable for de-conversion fees represented by multiplying Merchant’s average monthly processing fees by the number of months remaining in term, plus Bank’s costs and attorneys’ fees. If, however, Bank fails to respond to such third party offer or is not willing to match it, then Merchant shall only be liable for de-conversion fees representing four hundred (400) dollars per location. As stated before, we are not here to take anything away from a business and were more then happy to lower your rates and keep you on board with us, this offer was refused and according to your agreement we had the right to close your account and charge you the LD fees In the event you would come back to process with us the LD fee is returned in 3 monthly installments  thank you

Good morning We apologize your experience with Red Payments was not up to your standards. We see that your signed Volume and your real Volume is a lot different. according to your price analysis, you would see all the savings only when your processing your full signed volume. As...

I see the manager had told you, that when you are processing the signed volume we can do something about the reimbursement. It was also stated that, if you had the agreement that you made with the sales rep about the no contract in writing, that we would gladly honor it.  Nothing was presented to us. The cancellation fee would have been 650.00. Since your experience wasn't what we would like it to be we can close you with out a cancellation fee. All of our charges are on your terms and conditions, which you signed that you agree to and understand them. We can gladly send them over to you as well, if you like. We are waiting to hear back from your in order to process the cancellation in a timely fashion.Again I apologize on behalf of everyone in red payments.
