This letter is in response to your correspondence dated October 21, 2014 regarding the above referenced account.  LVNV Funding LLC ("LVNV") owns the account number ending in [redacted].  Resurgent Capital Services LP ("Resurgent") is the servicer of the account owned by LVNV.  The account was previously sold by [redacted] on or about May 9, 2013.  The total current balance as of the date of this communication is $7,052.39, which includes a principal balance of $6,492.11 and an interest balance of $560.28.  Additionally, this account is accruing interest at a rate of 6 percent.   Please review the following account information:
 
This account originated on April 7, 2008 with [redacted] and was opened with [redacted].
This account charged off on May 31, 2010.
The last payment in the amount of $138.19 was received on September 26, 2012.
No payments have been received on this account since Resurgent started servicing it in May 9, 2013.
Enclosed is a copy of the credit application, the terms and conditions and a letter containing validation that was mailed to [redacted] on July 2, 2014.
All ownership rights were transferred to LVNV when this account was purchased from the previous creditor.  Those include the right to collect and report to the consumer reporting agencies (also known as “credit bureaus”).  Currently, this account is being reported to the three major consumer reporting agencies on behalf of LVNV.  The original creditor may also continue to report the history of this account from the origination date to the time of sale.
 
In accordance with the Fair Credit Reporting Act, the LVNV tradeline is being reported as “disputed” to the three major consumer reporting agencies. It will continue to report as such throughout the permissible reporting period unless new information indicates that the dispute should be removed.
Resurgent utilizes third party collection agencies to service accounts on its behalf.  This account has been placed with various collection agencies since LVNV’s acquisition. Any notification requirements for this account would have been met by these collection agencies.
The term “open” in [redacted] credit report does not literally mean that the account is open or can be used.  That information is one of the data reporting requirements set by the consumer reporting agencies and is a “portfolio type” which we report as “Open,” meaning only that the entire balance is due upon demand.  This is an accurate description of the account, which was charged off and therefore the entire balance is delinquent and due.  If [redacted] has additional questions related to the credit bureau reporting, then she will need to contact the respective credit reporting agencies.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted]2, and have determined that this does not resolve my complaint. 
The attachments provided by Resurgent are not valid proofs of what constitutes proper debt validation.  FCRA rules state that validation rests on the debt collector. The debt collector contacts the original creditor to obtain proof of the debt. The original creditor then sends the necessary documents to the debt collector and the debt collector then presents the documents to the consumer as proof as validation.
Proof would be in the form of the contract between my-self and original creditor ([redacted]) bearing my signature which would verify I once held an account with [redacted] which I never did.  For this purpose this would prove the validity of the claim because everyday millions of Americans are subject to mistaken identity.  
The letter sent to me from Resurgent dated Sept 10th is not valid.  A letter stating that the company now owns this debt is not valid proof.  Should I just take their word for it? There is signature of mine on this document.  I can write 10 letters to my friends and family stating they owe me a debt does that make my claim valid? NO it is not proof enough to support my claim. The account summary report dated 11/3/14 is also not a form of validation this is information that Resurgent has in their data base and did not come from [redacted]. Again there is no signature of mine found on any of the presented documents.
For this purpose I reject their response and this matter is not settled. No documents were presented to me or the Revdex.com bearing my signature.  Furthermore the letter sent by my-self to Resurgent dated September 17, 2014 does not demand a cease and desist of communication.  I have sent  via a seperate email/ attached a copy of my letter to them as proof of the contents of the letter.  I have done research on this debt collector and Resurgent is well known for placing cease and desist of communications on accounts even when not asked by a consumer in order to avoid the validation process. My letter clearly states my reason for writing the company and the acceptable documents requested for validation. Nowhere in my letter mentions cease and desist. To my knowledge I have also never disputed this account electronically to the Credit Bureaus. This company blatantly lies to avoid any form of directly validating an account with the consumer.
As of now Resurgent continues to report an un-validated debt on my credit report which is causing significant damage to my credit file. I have already sought legal advice in this matter. Should they so choose to continue to willfully report this account on my file, I will have no choice but to sue them in a court of law for violating the FCRA and the FDCPA and report them to the FTC and the attorney general. Regards,[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. 
The documents enclosed do not prove they own the account. They have not provided the documents from the original lender, contractually showing the agreement I made with them and have not met the requirements for the FCRA.  Sending a bunch of documents with their letterhead is just that, their documents. They either provide the original documents from the orginal lender or remove the negative marks from my credit bureaus.

This is not the case, because for debt purchasers, the credit reporting agencies use the “Open Date” field only to capture the date that the account was purchased. The “Open Date” is not used in calculating the seven-year period that derogatory information remains on a credit report. Rather, it is the “Date of First Delinquency” that the credit reporting agencies use for determining the start of the seven-year reporting period. The “Date of First Delinquency” for this account is February 18, 2006. This account originated on December 12, 2006 with [redacted] and was opened with [redacted]. --- Agreed
This account charged off on January 2, 2009 with a balance of $569.43. --- Agreed
No payments have been received on this account since Resurgent started servicing it in January 2009 --- Do not agree.  The DLA on this account with the original creditor was 07/08, shouldn't the DLA reported on the credit report be the DLA with the original creditor?? 
 
I also have further concerns. I still think that this [redacted] Account was settled under LVNV Funding account #[redacted]
Please reference LVNV Funding acct#[redacted] it is showing as a paid collection in the amount of $592 (which is very close to what was owed to [redacted]).  It also shows a DLA of 07/08 which agains corresponds with the information posted on my credit report by the original creditor.  Another reason why I think that the paid LVNV collection that is showing as paid is for the [redacted] account.  Also the LVNV account that contains this info on my report does not contain any information about the original creditor which is another reason I think the outstanding LVNV account is a duplicate of the paid account.
Also, the [redacted] charge off shows a high credit amount of $700, LVNV acct#[redacted] is showing the hi credit on this account was $890, but also showing a balance of $1635.  So what is really owed? $890? $569.43? $700? or $1635? (which by the way is almost a 200% increase in the charged off balance). 
I just find it odd that the information reported for the LVNV collections account that I have paid and settled with more closely resembles the information that is reflected on my report with that of the [redacted] account that was charged off.
