All ownership rights were transferred to LVNV when this account was purchased from the previous creditor.  Those include the right to collect and report to the consumer reporting agencies (also known as “credit bureaus”).  Currently, this account is being reported to the three major consumer reporting agencies on behalf of LVNV.  The original creditor may also continue to report the history of this account from the origination date to the time of sale.
 
Receipt of this complaint is the first communication, written or otherwise that Resurgent has received from [redacted] regarding the above referenced account.  In accordance with the Fair Credit Reporting Act, a request to update the LVNV tradeline as “disputed” will be submitted to the three major consumer reporting agencies during the next reporting cycle.
 
Resurgent utilizes third party collection agencies to service accounts on its behalf.  This account has been placed with various agencies for servicing since LVNV’s acquisition.  Any notification requirements for this account would have been met by these collection agencies.
 
The consumer reporting agencies reporting guidelines have defined a “factoring company” as a company or individual who purchases accounts with the intent of collecting debts owed.  Therefore, the term is accurate in this situation and the account is reported correctly.
 
The consumer reporting agencies use the term “installment account” to describe a revolving line of credit.  Resurgent does not provide this comment to the bureaus, they add it to the account record, and therefore, we cannot alter it. 
 
Enclosed please find a bill statement and an account summary. Resurgent received a dispute that [redacted] submitted electronically through one of the consumer reporting agencies.  Resurgent responded to the dispute in the adequate time by providing the corresponding information to the respective credit bureau.
[redacted] mentions that her credit report shows this as a new account.  The term “open” appearing on her credit report does not literally mean that the account is open or can be used.  This information is one of the data reporting requirements set by the credit bureaus of providing a “portfolio type,” which is reported as “open,” meaning only that the entire balance is due upon demand.  This is an accurate description of the account which was charged off and therefore, the balance is delinquent and due. 
Resurgent utilizes third party collection agencies to service accounts on its behalf.  This account was placed with [redacted] LLC. Enclosed please find the letter from [redacted] LLC containing debt validation that was sent.  
 
Please find enclosed terms and conditions of the account and bill statements from this account. The bill statement for December 25, 2013 to January 24, 2014 reflects the same address as [redacted] listed on her Revdex.com complaint.

Resurgent has not acknowledged or addressed the fact that it took over 2 years to obtain a satisfaction of judgement.  Resurgent's response was that I should contact the credit reporting companies.  That isn't the problem or the issue.  The problem is that they never obtained a satisfaction of judgment even though I paid off the judgement over two years ago.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  I originally opened the [redacted] account in June 2007 during a special promotion over Father's Day weekend. The offer was 1 year, no-interest on purchases if the amount was paid off within one year of the purchase. I paid the balance of the account IN FULL in April 2008, LESS THAN one year after purchase. Although the credit history does not presently show all entries dating back to the beginning of the debt in July 2007, it did show that I made on-time payments except for 1 month for the entire length of the debt. And I made no other purchases with that account after the initial purchase.
Despite that, [redacted] claimed additional charges, not honoring the terms of their original offer, AFTER I was given the final payment amount and paid that balance, which I disputed. That is reflected in the account history shown on my credit report with the supposedly late payments beginning in May 2008. However, [redacted] CHARGED OFF the amount in question less than 6 months later, which rendered my balance with them to $0 owed.
LVNV then bought it from [redacted] about that same time. It is my understanding that LVNV is a company that buys old debt from other credit companies and attempts to collect on it, even if the debt has been settled with or written off by the original creditor. This appears to be the case in this instance. I am presently involved with a separate dispute regarding LVNV. Having this on my credit report for this entire time has caused substantial damage to my credit scores at all three credit reporting agencies.
Due to the age of the debt, I no longer have any supporting documentation unfortunately.
