I didn't get the loan through Resurgent, I got it through *** ***I was not given a choice in being sold to resurgentI never made a late payment with previous os companyA billing statement is required as I am required to send to send payment stub with my check.the billing invoice was not a courtesy with the company I acquired the loan from and the same policy should be carried over to a company that buys my loan with out my approvalAlso Resurgent admitted fault in saying there had been glitches related to my account which have been supposedly resolvedHowever it is November 14th and I have not received an invoice for payment due November 15th.

Although the account has been closed, waiting until the next reporting cycle to the credit bureaus, is not satisfactory. On top of that if it takes 30-days for it to be removed, I am looking at months until it no longer appears on the reports. This will impact me being able to obtain any kind of loan. I have applied for a mortgage loan and was told this account was the declining factor. I see no reason why Resurgent cannot have it removed immediately. I have discussed this again with my attorney, whose name I am willing to provide, and he stressed again the fact that I can file suit against the company. Therefore, I am requesting the credit bureaus be notified immediately to remove this from my reports. Once this is accomplished, I will consider the account closed to my satisfaction

This letter is in response to the additional concerns submitted by [redacted] dated November 12, 2014 regarding the above referenced account.  LVNV Funding LLC ("LVNV") owns the account number ending in[redacted] Resurgent Capital Services L.P. (“Resurgent”) is the servicer of the account owned by LVNV.
 
[redacted] charged off this debt and sold the account.  It is likely that [redacted] believes that the “Charge-Off” means that the debt is satisfied; however, this is not the case.  Charge-off is an accounting requirement which means that an account has been recognized as unlikely to repay and no longer considered an asset to the original creditor.  It does not affect the debtor’s responsibility for the account debt. 
 
After charge-off, an account remains collectible, and if sold, the current owner has the right to collect.  Derogatory account information may remain on a credit report for up to seven years.  It is the “Date of First Delinquency” that the consumer reporting agencies (also known as “credit bureaus”) use to determine the start of the 7-year reporting period for a charged off account.  The “Date of First Delinquency” for this account is May 16, 2008.  Since the legal time limit for bureau reporting is approaching on this account, a request to delete the LVNV tradeline will be submitted to the three major consumer reporting agencies during the next reporting cycle.
